Pursuant to Decree No. 24/2006/NĐ-CP dated March 6, 2006 of the Government amending and supplementing certain articles of Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;
Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
After receiving opinions from the Ministry of Health and upon the proposal of the Director of the Department of Tax Policy,
DECISION:
Article 1.
1. Issuing with this Decision the Schedule of Preventive Healthcare Fees and the Schedule of Health Quarantine Fees at Border Gates to be uniformly applied throughout the country.
2. The preventive healthcare fees and health quarantine fees prescribed in Clause 1 of this Article shall apply to preventive healthcare facilities that are state management agencies or public service units within the preventive healthcare system; They shall not apply to preventive healthcare facilities operating commercial services related to preventive healthcare according to permits issued by competent state authorities.
3. If the preventive healthcare fees and health quarantine fees prescribed in this Article are set in Vietnamese Dong (VND), they shall be collected in VND; If they are set in United States Dollars (USD), they may be collected in USD or VND based on the exchange rate published by the State Bank of Vietnam at the time of collection.
Article 2. The entities required to pay fees according to the rates prescribed in Article 1 of this Decision are organizations and individuals of Vietnam and foreign organizations and individuals who have their preventive healthcare work carried out by Vietnamese preventive healthcare authorities as follows:
1. Preventive healthcare testing.
2. Health quarantine at border gates.
3. Quality inspection of various types of vaccines, immunological products, bactericidal and insecticidal preparations for household and medical use.
4. Vaccination and medical pest control.
Article 3. Preventive healthcare fees are revenue items belonging to the state budget, managed and utilized as follows:
1. State agencies responsible for implementing preventive healthcare work as prescribed by the Ministry of Health (hereinafter referred to collectively as the fee-collecting agency) shall retain 90% (ninety percent) of the total amount of fees actually collected, except for the fee-collecting agency for health quarantine at Ho Chi Minh City which retains 70% (seventy percent) to cover expenses for specialized preventive healthcare work and fee collection as follows:
a) Payment of salaries or wages, allowances, contributions based on salaries or wages, according to current regulations for direct fee collectors (excluding salary costs for civil servants already receiving salaries under current regulations);
b) Expenses for preventive healthcare work and fee collection including:
- Costs for inspection, testing, quality inspection, and health quarantine related to preventive healthcare and border health quarantine;
- Inspection of preventive healthcare work implementation;
- Payment of remuneration for hiring experts for inspection, testing, quality inspection, and health quarantine related to preventive healthcare and border health quarantine;
- Expenses for conferences, seminars, meetings of the quality inspection and health quarantine boards related to preventive healthcare and border health quarantine;
c) Direct expenses for fee collection such as office supplies, office materials, telephone, electricity, water, travel expenses... according to current standards and norms;
d) Regular maintenance and major repair costs for assets, machinery, and equipment directly serving preventive healthcare work and fee collection; depreciation of fixed assets to carry out preventive healthcare work and fee collection;
đ) Purchase costs of materials, raw materials, and other expenses directly related to preventive healthcare work and fee collection;
e) Rewards and welfare for staff directly performing preventive healthcare work, services, and fee collection in the unit, on average, up to three months' salary if the annual income exceeds the previous year, and up to two months' salary if it is lower or equal to the previous year, after ensuring the expenses specified in points a, b, c, d, and đ of this clause. Each year, the fee-collecting agency must settle actual income and expenditure. After settling according to regulations, any unspent fees in the year may be transferred to the next year for continued spending according to the prescribed regulations. The retained fees for the fee-collecting agency to cover fee collection expenses shall not be reflected in the state budget.
2. The fee-collecting agency shall remit 10% (ten percent) of the collected fees to the state budget; specifically, the fee-collecting agency for health quarantine in Ho Chi Minh City shall remit 30% (thirty percent) according to the corresponding chapters, categories, sections, sub-sections, and sub-subsections of the current state budget schedule.
Article 4. This Decision takes effect fifteen days after its publication in the Official Gazette.
Article 5. This Decision replaces Decision No. 21/2000/QĐ-BTC dated February 21, 2000 of the Minister of Finance on issuing the Schedule of Preventive Healthcare Fees and Charges, Decision No. 144/2000/QĐ-BTC dated September 15, 2000 on amending and supplementing certain rates in Decision No. 21/2000/QĐ-BTC, and Circular No. 84/2000/TT-BTC dated August 16, 2000 of the Ministry of Finance guiding the management and utilization of preventive healthcare fees and charges.
Article 6. Other contents related to the collection, payment, management, use, receipt vouchers, and publicizing the preventive healthcare fee collection regime and border health quarantine fees not mentioned in this Decision shall be implemented according to the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws on fees and charges, and Circular No. 45/2006/TT-BTC dated May 25, 2006 amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws on fees and charges.
Article 7. In the course of implementation, if there are difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance./.
