CIRCULAR

REGULATIONS IMPLEMENTING DECREE NO. 123/2006/NĐ-CP OF THE GOVERNMENT ON MANAGEMENT OF FISHERY ACTIVITIES OF ORGANIZATIONS AND INDIVIDUALS OF VIETNAM IN MARINE AREAS

Pursuant to Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decree No. 123/2006/NĐ-CP dated October 27, 2006 of the Government on management of fishery activities of organizations and individuals of Vietnam in marine areas (hereinafter referred to as Decree No. 123/2006/NĐ-CP),

The Ministry of Agriculture and Rural Development hereby provides detailed regulations for implementation of certain provisions of Decree No. 123/2006/NĐ-CP as follows:

Article 1. Scope and Applicability

This Circular provides detailed regulations for implementation of Article 5, Article 6, Article 7, and Article 8 of Decree No. 123/2006/NĐ-CP.

This Circular applies to organizations and individuals of Vietnam related to fishery activities in marine areas.

Article 2. Detailed Provisions Point a, Clause 4, Article 5 regarding fishery activities at the offshore line within the territorial waters of Vietnam

Fishing vessels with main engine power of 50 horsepower or more engaged in longline, trawl, seine, and squid fishing operations when operating at the offshore line must meet safety conditions listed in the Certificate of Technical Safety of Fishing Vessels and minimum safety equipment on fishing vessels operating in waters beyond 24 nautical miles according to Appendix 1 issued together with Circular No. 02/2007/TT-BTS dated July 13, 2007 of the Ministry of Fisheries (now the Ministry of Agriculture and Rural Development) guiding the implementation of Decree No. 66/NĐ-CP dated May 19, 2005 of the Government on ensuring safety for people and fishing vessels engaged in fishery activities (referred to as Circular No. 02/2007/TT-BTS).

Article 3. Detailed Provisions for Article 6 on Conditions for Fishery Activities Outside the Territorial Waters of Vietnam

Fishing vessels going to operate fishery activities outside the territorial waters of Vietnam must be equipped with minimum safety devices for people and fishing vessels, communication equipment for fishing vessels operating in waters beyond 50 nautical miles according to Appendix 1 issued together with Circular No. 02/2007/TT-BTS.

Article 4. Detailed Provisions , Clause 1, Clause 2 Article 7a of this Regulation. on the procedures and formalities for issuing relevant documents for fishing vessels going to engage in fishery activities outside the territorial waters of Vietnam

1. Procedures and formalities for issuing relevant documents for fishing vessels going to engage in fishery activities outside the territorial waters of Vietnam

a. The vessel owner submits the dossier as prescribed in Clause 1, Article 7 of Decree No. 123/2006/NĐ-CP to the Provincial Fisheries Resource Exploitation and Protection Service (hereinafter referred to as the Fisheries Resource Exploitation and Protection Service).

b. Within two working days, the Fisheries Resource Exploitation and Protection Service shall examine and confirm the validity of the dossier and transfer it to the National Fisheries Resource Exploitation and Protection Service.

c. Within five working days from the date of receipt of the dossier, the National Fisheries Resource Exploitation and Protection Service shall examine the dossier, issue and transfer the relevant documents as prescribed in Clause 2, Article 7 of Decree No. 123/2006/NĐ-CP to the Fisheries Resource Exploitation and Protection Service. If these documents are not issued, the National Fisheries Resource Exploitation and Protection Service shall notify the vessel owner in writing and specify the reasons.

d. Within one working day from the date of receipt of the documents transferred by the National Fisheries Resource Exploitation and Protection Service, the Fisheries Resource Exploitation and Protection Service shall notify the vessel owner to collect them.

e. Upon receiving the documents issued by the National Fisheries Resource Exploitation and Protection Service, the vessel owner must return the relevant documents previously issued for the operation of the fishing vessel to the Fisheries Resource Exploitation and Protection Service where the vessel is registered, including:

- Certificate of Registration of Fishing Vessel (original);

- Certificate of Safety of Fishing Vessel (original);

- Fishing Permit (original if applicable).

The Fisheries Resource Exploitation and Protection Service shall be responsible for storing the relevant documents returned by the vessel owner.

Forms and relevant documents for fishing vessels engaging in fishery activities outside the territorial waters of Vietnam are stipulated in:

- Appendix 1: Application for issuance of documents for fishing vessels engaging in fishery activities outside the territorial waters of Vietnam;

- Appendix 2: Certificate of Technical Safety of Fishing Vessel;

- Appendix 3: Certificate of Nationality of Fishing Vessel;

- Appendix 4: Permit for fishing vessels to engage in fishery activities outside the territorial waters of Vietnam;

- Appendix 5: List of Crew Members.

2. Procedures and formalities for allowing fishing vessels to return and reissue relevant documents for fishing vessels engaging in fishery activities within the territorial waters of Vietnam

a. After the termination of the Cooperation Agreement on fishery activities between organizations and individuals of Vietnam and foreign partners, the vessel owner wishing to bring the vessel back to operate within the territorial waters of Vietnam must submit the dossier to the National Fisheries Resource Exploitation and Protection Service (through the Fisheries Resource Exploitation and Protection Service). The dossier includes the following documents:

- Application for permission to return and reissue relevant documents for fishing vessels to engage in fishery activities within the territorial waters of Vietnam (Appendix 6);

- Minutes of Termination of Cooperation Agreement on fishery activities with foreign partners (original in Vietnamese or certified copy in Vietnamese);

- Documents issued by the National Fisheries Resource Exploitation and Protection Service for the vessel to engage in fishery activities outside the territorial waters of Vietnam (in case of loss of issued documents, the vessel owner must submit a statement explaining the loss, which must be confirmed by the police or border guard authority where the loss occurred).

b. Within two working days from the date of receipt of the valid dossier, the Fisheries Resource Exploitation and Protection Service shall transfer the dossier to the National Fisheries Resource Exploitation and Protection Service;

c. Within three working days from the date of receipt of the dossier, the National Fisheries Resource Exploitation and Protection Service shall issue a written approval and transfer it to the Fisheries Resource Exploitation and Protection Service. In case of disapproval, the vessel owner shall be notified in writing with the reasons specified.

d. Within one working day from the date of receipt of the approval document transferred by the National Fisheries Resource Exploitation and Protection Service, the Fisheries Resource Exploitation and Protection Service shall notify the vessel owner and proceed with the procedures to restore the operation of the vessel.

Paragraph d. The Fisheries Resource Exploitation and Protection Branch shall carry out technical safety inspections for fishing vessels, issue relevant documents within its authority to restore operations for fishing vessels in accordance with regulations.

Paragraph e. In the event that the Fisheries Resource Exploitation and Protection Branch loses the documents specified in Paragraph d, Clause 1 of this Article, in addition to implementing the provisions of Paragraph d, Clause 2 of this Article, the Branch must issue a Temporary Fishing Vessel Registration Certificate and simultaneously announce three times on mass media about the loss of these documents. Fifteen days from the last announcement, if there is no dispute, the previous Fishing Vessel Registration Certificate will become invalid, and the Branch will issue a new Fishing Vessel Registration Certificate to the vessel owner. If a dispute arises, the Branch shall be responsible for resolving it.

Article 5. Detailed Provisions Clause 4, Article 8 regarding the responsibilities of organizations and individuals in organizing, recording, submitting, processing data and samples of Fishing Logbooks and Fishing Reports

1. Responsibilities of the Master and Crew Members of Fishing Vessels:

a. The Master is responsible for recording the Fishing Logbook and writing the Fishing Report according to the provided model; The crew member operating the fishing vessel (for vessels under 20 horsepower) must write a report on the fishing situation according to the provided model;

b. The vessel owner, Master, or crew member must submit the Fishing Logbook and Fishing Report once every quarter during the first week of the following quarter (the first week of April, July, October, and January of the following year) at the designated location:

- Directly to the Fisheries Resource Exploitation and Protection Branch (where the vessel is managed); or to the Port Management Board (at fish ports or wharfs where such boards exist);

- At coastal areas or small islands, if the Master or vessel owner does not have the opportunity to submit the Fishing Logbook and Fishing Report at the aforementioned locations, they may submit them to the People's Committee of the commune where they are located.

2. Responsibilities of the Department of Capture Fisheries and Resources Protection and Provincial Fisheries Resource Exploitation and Protection Branches:

a. Organize and guide the Masters and crew members of fishing vessels on how to record Fishing Logbooks and Fishing Reports for fishing vessels under their management, issue Fishing Permits.

b. Organize and announce collection points for Fishing Logbooks and Fishing Reports, distribute models of Fishing Logbooks and Fishing Reports. Confirm receipt of Fishing Logbooks and Fishing Reports submitted by vessels. Models of Fishing Logbooks and Fishing Reports are distributed to fishing vessels based on the fishing method listed in the Fishing Permit.

c. Input data from collected Fishing Logbooks and Fishing Reports into the database, regularly before the sixth day of the third week of April, July, October, and January of the following year. Transfer quarterly data to the Institute of Aquatic Products in the first week of the following quarter.

d. The Department of Capture Fisheries and Resources Protection leads and coordinates with the Institute of Aquatic Products to build a database; establish procedures for data entry and processing; train local officials in data entry, processing, and summarization from Fishing Logbooks and Fishing Reports; write reports on local fishing activities from the database; inspect and urge provincial Fisheries Resource Exploitation and Protection Branches in recording, organizing, submitting, and processing data from Fishing Logbooks and Fishing Reports.

e. Provincial Fisheries Resource Exploitation and Protection Branches compile data to report on fishing activity situations; management and issuance of Fishing Permits according to the model specified in Appendix 9 of this Circular. Quarterly reports are sent to the Department of Agriculture and Rural Development and the Department of Capture Fisheries and Resources Protection before the sixth day of the third week of April, July, October, and January of the following year.

3. Responsibilities of the Institute of Aquatic Products:

a. Receive and manage the fishing data database collected from Fishing Logbooks and Fishing Reports transferred from localities.

b. Lead the processing and summarization of data from Fishing Logbooks and Fishing Reports submitted by units and report results to the Department of Capture Fisheries and Resources Protection.

c. Conduct research and develop fisheries forecasts and resources, coordinate with the Department of Capture Fisheries and Resources Protection to publish forecast results.

4. Models of Fishing Logbooks and Fishing Reports:

a. Appendix 7a: Model of Fishing Logbook for Hook Fishing;

b. Appendix 7b: Model of Fishing Logbook for Net Seining;

c. Appendix 7c: Model of Fishing Logbook for Drift Netting;

d. Appendix 7d: Model of Fishing Logbook for Trawling;

e. Appendix 7e: Model of Fishing Logbook for Other Net Fishing;

f. Appendix 8: Model of Fishing Report.

5. Funding for Implementation

Funds for printing, processing data from Fishing Logbooks and Fishing Reports are budgeted and supplemented into the annual operational budget of the unit assigned the tasks of printing, distributing, and processing data from Fishing Logbooks and Fishing Reports. Relevant units prepare a budget for regular activities.

Article 6. Implementation Provisions

1. This Circular takes effect forty-five (45) days from the date of issuance.

2. Departments, Bureaus, Inspectors, Institutes, Centers under the Ministry of Agriculture and Rural Development; Provincial Departments of Agriculture and Rural Development shall urge and inspect the implementation of this Circular in accordance with their functions, duties, and authorities.
