CIRCULAR
Prescribes types of forms and books
regarding criminal enforcement work
Based on the Criminal Enforcement Law 2010;
Pursuant to Decree No. 77/2009/NĐ-CP dated September 15, 2009 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security,
The Minister of Public Security hereby prescribes forms and books for criminal enforcement work as follows:
Article 1. Scope of Regulation
This Circular stipulates and promulgates the following types of forms and books for use in criminal enforcement work.
1. Forms and books on enforcement of custodial sentences, including:
a) 78 types of forms marked from PT1 to PT78.
b) 25 types of books marked from SPT1 to SPT25.
2. Forms and books on enforcement of capital punishment, including:
a) 02 types of forms marked from TH1 to TH2.
b) 03 types of books marked from STH1 to STH3.
3. Forms and books on enforcement of suspended sentences, non-custodial corrective education, residence prohibition, probation, deprivation of certain civil rights, prohibition from holding public office, prohibition from practicing a profession or engaging in a specific activity, including:
a) 31 types of forms marked from PK1 to PK31.
b) 03 types of books marked from SPK1 to SPK3.
4. Forms and books on enforcement of deportation, including:
a) 12 types of forms marked from PK32 to PK43.
b) 01 type of book marked SPK4.
5. Forms and books on enforcement of compulsory medical treatment measures, including:
a) 02 types of forms marked from CB1 to CB2.
b) 01 type of book marked SCB1.
6. Forms and books on enforcement of placement in educational centers, including:
a) 42 forms marked from GD1 to GD42.
b) 12 types of books marked from SGD1 to SGD12.
7. Forms and books on enforcement of community-based educational measures, including:
a) 24 types of forms marked from GDX1 to GDX24.
b) 01 type of book marked SGDX1.
Article 2. Applicability
This Circular applies to prisons, detention centers, educational centers, compulsory medical treatment facilities, provincial-level criminal enforcement agencies, district-level criminal enforcement agencies, village-level People's Committees, and other relevant agencies, organizations, and individuals involved in criminal enforcement.
Article 3. Printing of forms and books on criminal enforcement work
1. Forms and books on criminal enforcement work shall be printed and distributed annually; units and localities with needs for forms and books shall prepare quantity estimates and submit them to the Criminal Enforcement and Legal Aid General Department for printing and distribution planning.
2. Based on proposals from units and localities, the Criminal Enforcement and Legal Aid General Department will develop plans, budget estimates, and organize printing and distribution or guide units and localities in printing.
Article 4. Implementation provisions
1. This Circular takes effect from October 24, 2011.
2. Directors of General Departments, heads of units under the Ministry, Provincial Police Chiefs, Chief Wardens of Prisons, Chief Wardens of Detention Centers, Principals of Educational Centers, Heads of provincial-level criminal enforcement agencies, Heads of district-level criminal enforcement agencies are responsible for organizing the implementation of this Circular.
3. The Director of the Criminal Enforcement and Legal Aid General Department is responsible for assisting the Minister in guiding, directing, and inspecting the management and use of forms and books on criminal enforcement work by police units and localities, prisons, and detention centers in accordance with regulations.
4. During the implementation of this Circular, if difficulties or obstacles arise, police units and localities shall report to the Ministry (through the Criminal Enforcement and Legal Aid General Department) for timely guidance.
