DECREE

Provisions on conditions for operating motor vehicle inspection services

Based on the Government Organization Law dated June 19, 2015;

Pursuant to the Investment Law dated November 26, 2014;

Pursuant to the Road Traffic Law 2008 dated November 13, 2008;

At the proposal of the Minister of Transport,

The Government issues this Decree to stipulate conditions for operating motor vehicle inspection services.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates conditions for operating motor vehicle inspection services for automobiles, trailers, semi-trailers pulled by automobiles, and similar types of vehicles (hereinafter referred to collectively as motor vehicles), and the issuance of certificates confirming eligibility to operate motor vehicle inspection services.

Article 2. Applicability

1. This Decree applies to agencies, organizations, and individuals related to the management and operation of motor vehicle inspection services.

2. This Decree does not apply to agencies, organizations, and individuals conducting inspections of military and police motor vehicles used for national defense and security purposes.

Article 3. Explanation of Terms

2. Self-generated and self-consumed electricity is electricity produced and consumed by an organization or individual to serve their own needs.

1. Motor vehicle inspection (hereinafter referred to as inspection) is the periodic examination of the technical safety quality and environmental protection of motor vehicles.

2. Certificate of Inspection for Technical Safety Quality and Environmental Protection of Road Motor Vehicles (hereinafter referred to as certificate of inspection) is a certification confirming that a motor vehicle has been inspected and meets the standards, regulations, and requirements for technical safety quality and environmental protection.

3. Motor vehicle registration inspection unit (hereinafter referred to as registration inspection unit) is an organization established in accordance with the law, providing public service to perform inspections and issue certificates of inspection for motor vehicles.

4. Inspection workshop is an area arranged with inspection positions, inspection equipment, supporting equipment, and inspection tools.

5. Inspection assembly line is a place where inspection positions are set up and inspection equipment is installed. Inspection assembly lines include two types:

a) Type I inspection assembly line: Inspects motor vehicles with a weight distributed to each single axle not exceeding 2,000 kg during inspection.

b) Type II inspection assembly line: Inspects motor vehicles with a weight distributed to each single axle not exceeding 13,000 kg during inspection.

Article 4: Principles of operation for motor vehicle inspection services

1. Only organizations holding a certificate confirming eligibility to operate motor vehicle inspection services may engage in the business of motor vehicle inspection services.

2. Organizations engaged in the business of motor vehicle inspection services shall not conduct road transportation using automobiles, maintenance, or repair of motor vehicles, nor shall they have direct relations with organizations conducting road transportation using automobiles, maintenance, or repair of motor vehicles. If the organization engaged in the business of motor vehicle inspection services is a joint-stock company, organizations and individuals engaged in road transportation using automobiles, maintenance, or repair of motor vehicles shall hold no more than 10% of the shares of the organization engaged in the business of motor vehicle inspection services.

Chapter II

CONDITIONS FOR OPERATING MOTOR VEHICLE INSPECTION SERVICES

Article 5. General Conditions for Operating Motor Vehicle Inspection Services

1. The establishment of registration inspection units must comply with the overall planning of the network of registration inspection units and inspection assembly lines.

2. Organizations meeting the conditions regarding infrastructure, equipment, and human resources as stipulated in this Chapter shall be issued a certificate confirming eligibility to operate motor vehicle inspection services.

Section I

INFRASTRUCTURE CONDITIONS

Article 6. Floor Area of Registration Inspection Units

1. For registration inspection units with one Type I inspection assembly line, the minimum floor area required for inspection activities is 1,250 square meters.2.

2. For registration inspection units with one Type II inspection assembly line, the minimum floor area required for inspection activities is 1,500 square meters.2.

3. For registration inspection units with two inspection assembly lines, the minimum floor area required for inspection activities is 2,500 square meters.2.

4. For registration inspection units with three or more inspection assembly lines, the floor area required for inspection activities from the third assembly line onwards shall increase by at least 625 square meters for each additional assembly line.2.

Article 7. Inspection Workshop

1. An inspection workshop with only one type I inspection line shall have a minimum clearance size (Length x Width x Height) of 30 x 4 x 3.5 (m).

2. An inspection workshop with only one type II inspection line shall have a minimum clearance size (Length x Width x Height) of 36 x 5 x 4.5 (m).

3. For inspection workshops with multiple inspection lines arranged side by side, the distance between the centers of the inspection lines must be no less than 4 meters, and the distance from the center of the outermost inspection line to the inner wall of the workshop must be no less than 2.5 meters.

4. In cases where inspection lines are arranged in multiple inspection workshops, the total minimum length of the inspection workshops must equal the corresponding length specified in Clause 1 and Clause 2 of this Article.

Article 8. Office Building, Parking Lot, Internal Road

1. The inspection unit shall have an office building and waiting rooms for drivers and vehicle owners (hereinafter referred to as the vehicle owner).

2. The system of roads for motor vehicles entering and exiting the inspection workshop, internal traffic roads, and parking lots must have a road width of at least 3 meters and must be covered with asphalt concrete or cement concrete.

Article 9. Testing Equipment, Inspection Tools

1. The testing equipment of one inspection line includes:

a) Brake testing equipment;

b) Weight measuring equipment;

c) Lateral slip measurement equipment;

d) Exhaust gas analysis equipment;

đ) Smoke measurement equipment;

e) Noise measurement equipment. For inspection units with two or more inspection lines arranged within the same inspection workshop, it is only necessary to equip a minimum of one noise measurement device;

g) Headlight testing equipment;

h) Undercarriage inspection support equipment;

i) Vehicle lifting equipment (vehicle lift) or inspection pit;

k) Engine loading equipment (for cases where the exhaust gas inspection process for motor vehicles is carried out using the loaded method).

2. The testing equipment of each inspection line may be arranged in multiple inspection workshops or outside the inspection workshop.

3. The testing equipment must ensure:

a) It has a centralized control software program that uniformly controls the operation of the equipment according to the inspection procedures, sets evaluation standards, and establishes inspection sequences depending on the arrangement of the testing equipment (except for the equipment specified in points b, h, and i of Clause 1 of this Article);

b) The control software program must have Vietnamese language for all features;

c) The database of the control software program must be secured according to the requirements of the inspection process and connected to transmit data to the national common vehicle inspection database at the Vietnam Registration Agency.

4. Testing equipment must be inspected and calibrated before being put into use and during its use according to regulations; technical functions of the equipment must be maintained throughout its use period and between calibration periods.

5. Inspection tools for one inspection line include:

a) Tire pressure inspection tools;

b) Flashlights;

c) Special-use hammers;

d) Length measuring tools;

đ) Jacks on the inspection pit (if there is an inspection pit).

Article 10. Provisions on information equipment, storage, and data transmission

1. Must have an internet connection to ensure data transmission, images for inspection, with a static IP address and equipment to create a virtual private network (VPN) connection with the Vietnam Vehicle Inspection Agency's server system.

2. The inspection unit must store inspection data in accordance with the regulations of the Ministry of Transport.

3. The server, internal network-connected computers, and software for managing inspection information and controlling testing equipment on the inspection line must be installed to serve management work consistent with the inspection business process. Data from these software programs must be stored on the inspection unit's server and synchronized through a virtual private network (VPN) with the centralized inspection database on the Vietnam Vehicle Inspection Agency's server system.

4. Other equipment:

a) Office equipment;

b) Cameras or digital cameras to photograph motor vehicles entering for inspection;

c) IP cameras to monitor the inspection of motor vehicles on the inspection line; capable of storing vehicle inspection images (in video format) for a minimum of 30 days from the date of inspection;

d) Have screens in waiting rooms for vehicle owners to monitor the inspection images during the inspection process;

đ) Have fire prevention, firefighting, safety, labor protection, and environmental hygiene equipment in accordance with the provisions of the law.

5. Must have a system to receive pre-inspection registration information from vehicle owners via telephone, website, or through online public services.

PART II

STAFFING REQUIREMENTS

Article 11. Inspector

Inspectors are divided into two categories: Motor Vehicle Inspector and Senior Motor Vehicle Inspector.

1. Motor Vehicle Inspector

a) Professional qualifications: Graduated from a university or higher in automotive engineering, automotive technology, mechanical engineering, or mechanical technology programs that include the following subjects: Automotive theory, Automotive structure, Automotive design and calculation, Automotive technical maintenance, Internal combustion engines, and Automotive electronics or equivalent courses. In cases where such courses are not available, supplementary training can be conducted at universities;

b) Minimum English proficiency level B or equivalent;

c) Undergo inspector training according to the content prescribed by the Ministry of Transport;

d) Complete a minimum of 12 months of practical training as a motor vehicle inspector at an inspection unit after completing the training;

đ) Achieve satisfactory results in the assessment of motor vehicle inspector skills;

e) Hold a valid driver's license for automobiles.

2. Senior Motor Vehicle Inspector:

a) Must be a motor vehicle inspector with a minimum of 36 months of experience;

b) Undergo senior motor vehicle inspector training according to the content prescribed by the Ministry of Transport;

c) Achieve satisfactory results in the assessment of senior motor vehicle inspector skills.

Article 12. Procedures for Issuing Inspector Certificates

1. Individuals meeting the conditions stipulated in Clauses 1 and 2 of Article 11 of this Decree have the right to request the Vietnam Vehicle Inspection Agency to issue an inspector certificate. The application dossier for issuing an inspector certificate includes:

a) Application for issuance of an inspector certificate;

b) A professional curriculum vitae according to the model prescribed in Appendix I attached to this Decree (for the first-time issuance of a motor vehicle inspector certificate and reissuance of a motor vehicle inspector certificate after revocation);

c) Certified copies from the original, or certified copies, or copies accompanied by the original for verification of university diplomas and transcripts (for the category of motor vehicle inspector) and certificates as prescribed in Clauses 1 and 2 of Article 11 of this Decree;

d) A confirmation letter of practical training as a vehicle inspection officer from the inspection unit (for the vehicle inspection officer category);

đ) Training certificate for inspector skills;

e) One color photo measuring 4 cm x 6 cm, ID card style, taken within six months.

2. Procedure and method of implementation

a) Organizations and individuals complete the dossier in accordance with Clause 1 of this Article and submit it to the Vietnam Vehicle Inspection Agency. For the category of motor vehicle inspector, the submission of the dossier must be completed within twelve months from the date of completion of the practical training for inspector skills;

b) The Vietnam Vehicle Inspection Agency receives and checks the dossier components; within three working days from the date of receiving the dossier; if satisfactory, notify the organization or individual requesting the inspector certificate about the time to conduct practical skill assessments on the inspection line and the mastery of standards, norms, and regulations; if unsatisfactory, provide a written response stating the reasons;

c) The Vietnam Vehicle Inspection Agency conducts the inspector skill assessment, the results of which are recorded in the inspector assessment report according to the model prescribed in Appendix II attached to this Decree; if the assessment results are satisfactory, issue the inspector certificate within five working days from the date of the assessment. If the assessment is unsatisfactory, organizations and individuals have the right to request the Vietnam Vehicle Inspection Agency to reassess after six months from the date of the assessment;

d) The receipt of dossiers and delivery of results shall be carried out directly, through the postal service, or through online public services.

3. The inspector certificate according to the model prescribed in Appendix II attached to this Decree has a validity period of thirty-six months from the date of issuance and may be renewed upon expiration, loss, or damage. The validity period of the renewed certificate shall not exceed the validity period of the previously issued certificate, except in cases of renewal due to expiration.

Article 13. Procedure for Reissuing the Inspection Certificate

1. Within thirty days before the expiration date of the inspection certificate, the inspection unit and the inspector shall submit a request for reissuing the inspection certificate (accompanied by one color photograph measuring 4 cm x 6 cm, similar to an identity card, taken within six months) to the Vietnam Vehicle Inspection Agency. Within five working days from the receipt of the request, the Vietnam Vehicle Inspection Agency shall conduct an assessment of the inspector's inspection skills at their workplace. If the requirements are met, the inspection certificate will be issued three working days after the assessment. If not, the reasons for non-compliance shall be clearly recorded in the inspection assessment report. The inspection unit and the inspector have the right to request a reassessment from the Vietnam Vehicle Inspection Agency one month after the initial non-compliant assessment.

2. In case the inspection certificate is lost or damaged, the inspector shall submit a request for reissuing the inspection certificate to the Vietnam Vehicle Inspection Agency while suspending participation in vehicle inspections at the inspection unit. Based on the retained file, the Vietnam Vehicle Inspection Agency shall issue a new inspection certificate within seven working days from the receipt of the request, clearly noting that it is a reissued certificate and invalidating the previously issued lost or damaged certificate.

Article 14. Suspension of Inspectors

Inspectors may be suspended from participating in inspection activities for a period of one to three months in the following cases:

1. Altering inspection results.

2. Failure to comply with relevant procedures, standards, and technical regulations in inspections.

Article 15. Revocation of the Inspection Certificate

Inspectors shall have their inspection certificates revoked in the following cases:

1. Fabricating documents to obtain an inspection certificate.

2. Failing to meet the conditions stipulated in Clause 1 and Clause 2 of Article 11 of this Decree.

3. Tampering with inspection results or failing to comply with relevant procedures, standards, and technical regulations, resulting in serious consequences.

4. Being suspended from participating in inspection activities more than twice within twelve months.

5. Being convicted by a court judgment that has become legally binding.

6. Losing or being restricted in civil capacity.

7. Not working at any inspection unit for over twelve months.

8. Simultaneously working at two or more inspection units.

Article 16. Procedures for suspending participation in inspection activities, revoking the inspection certificate

1. The Vietnam Vehicle Inspection Agency shall issue a decision to suspend or revoke the inspection certificate, notify relevant agencies to cooperate in its implementation, and publish it on the electronic information website.

2. Inspectors must return their inspection certificates to the Vietnam Vehicle Inspection Agency (in cases where the certificate is revoked) and immediately cease participation in vehicle inspections at the inspection unit upon the effective date of the revocation decision.

3. Inspectors whose inspection certificates have been revoked can only apply for reissuance after thirty-six months from the date of revocation, provided they have undergone refresher training in inspection skills.

Article 17. Inspection Technical Staff

1. The minimum professional qualification is a vocational college degree.

2. Minimum English proficiency level A or equivalent.

3. To be trained and issued a training certificate for inspection technical staff in accordance with the regulations of the Ministry of Transport.

Article 18. Responsible for the inspection chain

1. Must be a high-level motor vehicle inspector.

2. Appointed by the organization establishing the inspection unit.

Article 19. Head of the inspection unit

1. Must be a motor vehicle inspector and have performed the duties of a motor vehicle inspector for at least 36 months.

2. Appointed by the organization establishing the inspection unit.

Article 20. Number of inspectors, number of motor vehicles to be inspected by the inspection unit

1. To carry out inspection activities, each inspection chain must have a minimum of 03 inspectors, including at least 01 high-level motor vehicle inspector.

2. There must be a responsible person for the inspection chain. Each responsible person for the inspection chain can only be responsible for a maximum of 02 chains.

3. The number of motor vehicles granted a certificate of inspection within a day (calculated over 08 working hours) must satisfy the following regulations simultaneously:

a) In case each inspector checks 01 vehicle, it shall not exceed 20 vehicles/day for 01 inspector; in case more than 01 inspector checks 01 vehicle, it shall not exceed 20 times the number of inspectors/day (number of inspectors * 20).

b) Not exceeding 90 vehicles for 01 type I inspection chain and not exceeding 70 vehicles for 01 type II inspection chain.

Chapter III

ISSUANCE, SUSPENSION, REVOCATION CERTIFICATE OF SUITABILITY FOR MOTOR VEHICLE INSPECTION ACTIVITIES

Article 21. Procedures for issuing the certificate of suitability for motor vehicle inspection activities

1. After completing the construction and installation of technical facilities of the inspection unit, the inspection unit prepares 01 set of application documents for the certificate of suitability for motor vehicle inspection activities to be sent to the Vietnam Inspection Agency, the documents include:

a) A request for inspection and issuance of a certificate of compliance with conditions for motor vehicle inspection activities;

b) A list of job titles working at the inspection unit with labor contracts as prescribed or decisions on acceptance for inspectors and inspection staff; appointment decisions for the responsible persons for the inspection chain and the head of the inspection unit;

c) List of inspection equipment, inspection tools, information, storage, data transmission equipment as prescribed in Article 9 and Article 10 of this Decree.

2. Procedures and methods for issuing certificates of qualification for vehicle inspection activities

 a) Within 03 working days, if the documents meet the requirements, the Vietnam Inspection Agency will notify the inspection unit about the time for inspecting and evaluating the inspection unit; if they do not meet the requirements, the Vietnam Inspection Agency must notify the organization in writing, specifying the reasons;

b) Within 07 working days from the date of notification for inspection and evaluation, the Vietnam Inspection Agency conducts actual inspection and evaluation, the results of which are recorded in a report according to the model prescribed in Appendix IV attached to this Decree. If the requirements are met, the certificate of suitability for motor vehicle inspection activities will be issued within 05 working days; if the inspection and evaluation results do not meet the requirements, the Vietnam Inspection Agency must notify in writing within 03 working days for the organization to rectify and conduct re-inspection and evaluation.

3. Acceptance of documents and delivery of results are carried out directly, through the postal system or through online public services.

4. The certificate of suitability for motor vehicle inspection activities according to the model prescribed in Appendix V attached to this Decree; is reissued in cases where it has expired, been lost, damaged, or in cases of changes in personnel, positions, premises, inspection workshops, inspection chain arrangements, inspection equipment.

Article 22. Reissuance procedures certificate of suitability for motor vehicle inspection activities

1. The reissuance of the certificate of suitability for motor vehicle inspection activities due to revocation is carried out like the first issuance as prescribed in Article 21 of this Decree.

2. In case the certificate of suitability for motor vehicle inspection activities is lost or damaged, the inspection unit sends a written request for reissuance of the certificate of suitability for motor vehicle inspection activities to the Vietnam Inspection Agency, while suspending motor vehicle inspection activities. The Vietnam Inspection Agency bases on the retained file to reissue the certificate of suitability for motor vehicle inspection activities within 15 working days from the date of receipt of the request, clearly stating that the reissued certificate of suitability for motor vehicle inspection activities replaces the previously issued certificate of suitability for motor vehicle inspection activities that was lost or damaged.

Article 23. Suspension of operations conducting motor vehicle inspection services

The inspection unit may be suspended partially or entirely from operating motor vehicle inspection services for a period of 01 month to 03 months in the following cases:

1. Failing to ensure conditions regarding infrastructure, human resources, inspection equipment, inspection tools, information, storage, and data transmission equipment as prescribed in this Decree.

2. Conducting inspections when inspection equipment and inspection tools are damaged, do not guarantee accuracy, have not been tested, evaluated, or calibrated as prescribed.

3. Conducting inspections and issuing certificates of inspection for motor vehicles that do not comply with technical standards, regulations, and authority provisions.

4. Having three or more inspectors suspended or two or more inspectors having their inspector certificates revoked within 12 months.

5. Using or assigning inspectors who are not suitable for the content of their inspector certificates.

Article 24. Sale certificate of suitability for motor vehicle inspection activities

The inspection unit's certificate of suitability for motor vehicle inspection activities will be revoked in the following cases:

1. The Certificate of Eligibility for Motor Vehicle Inspection was issued due to fraud or falsification of application documents, papers, or materials.

2. The Certificate of Eligibility for Motor Vehicle Inspection has been intentionally altered or tampered with, causing distortion of its contents.

3. Not commencing inspection activities within 06 months from the date of issuance of the certificate of suitability for motor vehicle inspection activities.

4. Ceasing motor vehicle inspection activities continuously for more than 06 months.

5. Being suspended from all motor vehicle inspection activities more than twice within 12 months.

6. Having five or more inspectors suspended or three or more inspectors having their inspector certificates revoked within 12 months.

7. The inspection unit being dissolved or requesting revocation.

Article 25. Procedure for suspension of operations and revocation certificate of suitability for motor vehicle inspection activities

1. The Vietnam Inspection Agency issues a decision to suspend operations and revoke the certificate of suitability for motor vehicle inspection activities, notifies relevant agencies to coordinate implementation, and publishes it on its electronic information website.

2. The inspection unit must return the certificate of qualification for vehicle inspection to the Vietnam Vehicle Inspection Agency upon revocation, and immediately cease vehicle inspection activities from the date the decision becomes effective.

3. An organization establishing an inspection unit whose certificate of qualification for vehicle inspection has been revoked shall not engage in vehicle inspection activities for a period of thirty-six months from the date of revocation, except for organizations establishing an inspection unit that are public service units.

4. When operations are suspended or the certificate of qualification for vehicle inspection is revoked, the head of the inspection unit and the inspectors directly conducting inspections shall continue to be held legally responsible for the results of inspections issued by their unit while such results remain valid.

5. When operations are suspended or the certificate of qualification for vehicle inspection is revoked, related organizations and individuals must continue to fulfill other obligations and responsibilities as prescribed by law.

Article 26. Procedures for ceasing vehicle inspection activities

1. In cases where operations are suddenly halted for more than one continuous day due to objective conditions, the inspection unit must report to the local Department of Transport and the Vietnam Vehicle Inspection Agency, clearly stating the reasons for cessation and the remediation plan; notify the waiting room for vehicle owners and maintain a department to handle matters related to inspection records; remediation must be completed within one month.

2. In cases where the inspection unit requests to cease operations for up to six consecutive months:

a) The inspection unit must submit a written report to the local Department of Transport and the Vietnam Vehicle Inspection Agency, clearly stating the reasons and duration of cessation thirty days before the cessation date, and notify the waiting room for vehicle owners;

b) Maintain a department to handle matters related to inspection records.

3. In cases where the inspection unit requests to cease operations for more than six consecutive months:

a) The inspection unit must submit a written report to the local Department of Transport and the Vietnam Vehicle Inspection Agency, clearly stating the reasons and duration of cessation thirty days before the cessation date, and notify the waiting room for vehicle owners;

b) Return the certificate of qualification for vehicle inspection;

c) Transfer all vehicle records managed by the unit to another inspection unit according to the guidance of the Vietnam Registration Agency.

Chapter IV

IMPLEMENTATION

Article 27. Responsibility for implementation

1. The Ministry of Transport

a) Take the lead and coordinate with relevant ministries, sectors, and localities to develop and approve the overall planning of the network of inspection units and inspection chains;

b) Guide, organize implementation, inspect, and handle violations of the regulations stipulated in this Decree;

2. The Ministry of Finance shall issue and guide the implementation of financial revenue and expenditure regulations in the field of vehicle inspection.

3. Provincial People's Committees and municipal people's committees under the central government shall direct the local Departments of Transport and relevant agencies to manage business operations of vehicle inspection services according to the provisions of this Decree; allocate land for the construction of inspection units in accordance with the overall planning of the network of inspection units and inspection chains.

4. Organizations establishing inspection units

a) Be responsible for the legality of the application dossier for issuing certificates of meeting the conditions to operate vehicle inspections;

b) Coordinate with the Vietnam Vehicle Inspection Agency before implementing the construction of inspection workshops to ensure compliance with the overall planning of the network of inspection units and inspection chains;

c) Ensure the operation of the inspection unit in accordance with regulations;

d) Implement decisions on handling by authorized agencies when the inspection unit violates business conditions or inspection activities;

đ) Ensure the rights of workers in accordance with the law;

5. The Vietnam Vehicle Inspection Agency

a) Organize the implementation, guide, conduct specialized inspections, and perform tasks assigned according to the provisions of this Decree and the guidance of the Ministry of Transport regarding vehicle inspection services;

b) Annually inspect and evaluate the maintenance of conditions concerning infrastructure, human resources, testing equipment, inspection tools, information equipment, data storage, data transmission, inspection records, and reporting systems of inspection units; calibrate testing equipment;

c) Develop, manage, and guide the uniform use of software management programs and inspection databases nationwide, connecting networks for data transmission and managing inspected vehicle data;

d) Plan and implement training for vehicle inspection officers and inspection staff at the request of vehicle inspection units, individuals, and organizations establishing vehicle inspection units; provide specialized training on inspection content and procedures as prescribed by the Ministry of Transport;

đ) Report on the implementation of inspection work as required;

e) Handle or propose disciplinary actions against organizations and individuals violating conditions as stipulated in this Decree;

g) Publish on the websites of authorized state agencies lists of inspection units granted, suspended, or revoked certificates of qualification for vehicle inspection activities;

6. Inspection Units:

a) Comply with the provisions of this Decree and relevant laws regarding business conditions and inspection activities for vehicles;

b) Conduct inspections and issue inspection certificates for vehicles in accordance with technical standards, specifications, and regulations;

c) Maintain conditions concerning infrastructure, human resources, testing equipment, inspection tools, information equipment, data storage, and data transmission;

đ) Collect inspection fees and other types of fees and charges as prescribed by law;

đ) Within eighteen months from the date of issuance of the certificate of qualification for vehicle inspection activities, the inspection unit must establish, apply, and maintain a quality management system according to ISO 9001 standards;

e) Publicly display at the waiting room and inspection workshop the inspection procedures and contents; prices, fees, charges, inspection cycles, hotlines of the Vietnam Vehicle Inspection Agency, and other notifications as required;

g) Carry out or cooperate in performing tasks related to traffic safety assurance, vehicle technical condition, and transportation infrastructure protection as required by authorized agencies;

h) Ensure a minimum operating time of eight hours per day and five days per week for normal inspection activities; publicly announce inspection times at the inspection unit's headquarters.

i) To protect personal information of the vehicle owner and the inspection database, except in cases where there is a request from an authorized agency;

k) To be subject to supervision and inspection by authorized agencies regarding business conditions and during the operation of motor vehicle inspection;

l) To implement data transmission and reporting as prescribed.

Chapter V

IMPLEMENTING PROVISIONS

Article 28. Transitional Provisions

1. The certificate of eligibility for motor vehicle inspection activities issued before the effective date of this Decree remains valid until its expiration date stated on the certificate. Units that have been approved to establish and do not meet the requirements of this Decree will still be issued certificates of eligibility for motor vehicle inspection activities according to the regulations at the time of approval of the establishment proposal.

2. The inspector certification issued before the effective date of this Decree remains valid until its expiration date. Individuals currently undergoing training or internship as inspectors will still be issued inspector certifications according to the regulations at the time of training.

3. Within three years from the effective date of this Decree, established units and those whose establishment proposals have been approved, as well as inspectors who have been issued inspector certifications must fully comply with the conditions stipulated in this Decree, except for the provisions set out in point a and point d, Clause 1, Article 11 of this Decree. In cases where inspector certifications are reissued to inspectors and certificates of eligibility for motor vehicle inspection activities are reissued to units that do not meet the requirements of this Decree before the three-year period from the effective date of this Decree, they shall be implemented according to the regulations applicable to the issuance of old certificates, with the validity period of the certificate not exceeding three years from the effective date of this Decree.

Article 29. Effective date

1. This Decree takes effect from July 1, 2016.

2. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of People's Committees of provinces and centrally governed cities, and related organizations are responsible for implementing this Decree.
