Pursuant to Decree No. 01/2022/ND-CP dated November 30, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense; Decree No. 03/2025/ND-CP dated February 28, 2025 amending and supplementing certain provisions of Decree No. 01/2022/ND-CP dated November 30, 2022 of the Government;

The Minister of National Defense issues this Circular regulating and guiding the implementation of certain provisions of Decree No. 70/2015/ND-CP dated September 01, 2015 of the Government detailing and guiding the implementation of certain provisions of the Health Insurance Law for the People's Army, the People's Public Security Force, and personnel engaged in confidential work; Decree No. 74/2025/ND-CP dated March 31, 2025 amending and supplementing certain provisions of Decree No. 70/2015/ND-CP dated September 01, 2015 of the Government:

1. Health insurance card; scope and level of health insurance benefits; medical examination and treatment under health insurance in certain cases; health insurance contracts.

2. Budget preparation, management, and utilization of initial healthcare costs at military medical units, agency healthcare facilities (hereinafter referred to as the initial healthcare cost budget for military personnel); payment methods and application of payment methods for health insurance medical examination and treatment costs; direct payment of health insurance medical examination and treatment costs between social insurance agencies and health insurance participants; payment of health insurance medical examination and treatment costs at medical facilities in border, island, and extremely difficult mountainous areas; allocation, management, and utilization of health insurance revenue; management and utilization of the health insurance medical examination and treatment fund for military personnel.

In accordance with the proposal of the Director of the General Logistics Department - Technical Service;

1. Officers of the People's Army and professional military personnel on active duty.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates on:

2. Non-commissioned officers, soldiers of the People's Army on active duty; students of the Military Academy receiving subsistence allowances who are Vietnamese citizens.

3. Students undergoing reserve officer training for three months or more who have not joined social insurance or health insurance.

Article 2. Applicability

4. Students of the Military Academy receiving subsistence allowances who are foreign nationals.

5. Personnel engaged in confidential work receiving salaries equivalent to those of military personnel working at the State Cryptographic Agency.

6. Students of the Confidential Work Academy receiving subsistence allowances who are Vietnamese citizens.

7. Students of the Confidential Work Academy receiving subsistence allowances who are foreign nationals.

8. Medical examination and treatment facilities under the Ministry of National Defense; relevant agencies, units, and individuals.

HEALTH INSURANCE CARD; SCOPE AND LEVEL OF HEALTH INSURANCE BENEFITS

7. A foreigner who receives living expenses is a beneficiary.

Chapter II
HEALTH INSURANCE CARD; SCOPE AND LEVEL OF HEALTH INSURANCE BENEFITS

Article 3. Health Insurance Card

1. The health insurance card for the subjects specified in Article 2 of this Circular shall be implemented according to the provisions of Articles 6, 7, 8, and 9 of Decree No. 70/2015/NĐ-CP dated September 1, 2015 of the Government detailing and guiding the implementation of certain articles of the Health Insurance Law for the People's Army, the People's Public Security Force, and personnel engaged in confidential work, as amended and supplemented by Clauses 5, 6, 7, and 8 of Article 1 of Decree No. 74/2025/NĐ-CP dated March 31, 2025 amending and supplementing some articles of Decree No. 70/2015/NĐ-CP.

2. The electronic or paper health insurance card issued by the Social Insurance Agency of the Military shall contain the following basic information:

a) Health insurance number as prescribed by the Vietnam Social Security;

b) Personal information of the health insurance participant, including: Full name; gender; date, month, year of birth;

c) Effective period of the health insurance card (from date month year to date month year);

d) Registration place for initial medical examination and treatment under health insurance;

đ) For the paper health insurance card, it also includes additional signature information: Scanned signature with position, name, and rank of the Director of the Social Insurance Agency of the Military;

3. Health insurance card information shall be integrated for lookup by health insurance number and citizen identification number/personal identification number of the health insurance participant.

4. Management, recovery, and temporary retention of health insurance cards

a) The health insurance card of the subject specified in Article 2 of this Circular shall be recovered or temporarily retained according to the provisions of Article 9 of Decree No. 70/2015/NĐ-CP. Medical facilities have the responsibility to temporarily retain the health insurance card when another person uses the card for medical examination and treatment under health insurance and report to the unit and the Social Insurance Agency of the Military for handling according to the law;

b) The health insurance card of the subject specified in Article 2 of this Circular shall be managed according to the provisions of Clause 8 of Article 1 of Decree No. 74/2025/NĐ-CP. Subjects specified in Clauses 1 and 5 of Article 2 of this Circular must report to their unit command according to current regulations when going for medical examination and treatment.

5. Time and validity of use of health insurance card

The validity of use of the health insurance card shall be implemented according to the provisions of Point b Clause 5 of Article 1 of Decree No. 74/2025/NĐ-CP. The validity of use of the health insurance card in certain cases is specifically defined as follows:

a) For Non-commissioned Officers and Soldiers during their active service period, the validity of use of the health insurance card runs from the day of enlistment until the last day of discharge; in cases where they are sent for study, training, or extension of active service, the validity of use is extended from the expiration date of the old card to the end of the study or training period;

Example 1: Comrade Nguyen Van Tam enlisted in February 2024 and completed his active service on January 18, 2026. Comrade Tam's health insurance card will be valid until January 31, 2026.

Example 2: In the case of Comrade Nguyen Van Tam in Example 1, on January 18, 2026, Comrade Tam completed his active service and was assigned for reserve officer training from January 19, 2026. The reserve officer training unit is responsible for requesting a health insurance card for Comrade Tam with validity from February 1, 2026, until the end of the reserve officer training period.

b) For students undergoing reserve officer training for three months or more who have not participated in health insurance or social insurance, the validity of use of the health insurance card runs from the start of the course until its completion.

6. The Minister of National Defense decides the time for issuing the electronic health insurance card.

Article 4. Issuance of Health Insurance Cards

1. The dossier, procedures, and formalities for issuing, reissuing, and exchanging health insurance cards shall be carried out in accordance with the provisions of Articles 7 and 8 of Decree No. 70/2015/NĐ-CP, amended and supplemented by Clauses 6 and 7 of Article 1 of Decree No. 74/2025/NĐ-CP.

2. Units at the brigade level and equivalent shall be responsible for directing personnel offices, military forces, and labor organizations to guide military personnel in filling out the Application Form for Participation and Adjustment of Health Insurance Information according to Model I of the Appendix attached to this Circular; establish the List of Participants in Health Insurance; request letters for issuance, reissuance, and exchange of health insurance cards; and Lists of Reissued and Exchanged Health Insurance Cards according to Models II, III, and IV of the Appendix attached to this Circular through software provided by the Military Social Insurance. These documents shall be sent to units at the division level and above via military data transmission or directly to the Military Social Insurance.

3. Units at the division level and equivalent shall be responsible for directing personnel offices, military forces, and labor organizations to establish the List of Participants in Health Insurance; request letters for issuance, reissuance, and exchange of health insurance cards; and Lists of Reissued and Exchanged Health Insurance Cards according to Models II, III, and IV of the Appendix attached to this Circular through software provided by the Military Social Insurance. In cases where units do not have military data transmission, they shall send these documents via military postal service or directly to the Military Social Insurance.

Establish a request letter for extending the participation period in health insurance according to Model III of the Appendix attached to this Circular for cases where military personnel have health insurance cards issued by the Military Social Insurance that have expired but still fall within the category eligible for card issuance in the following year.

4. The issuance of health insurance cards for newly enlisted soldiers shall be carried out as follows: Prior to enlistment, the Military Command of the commune shall guide citizens who have been issued call-up orders to fill out the Application Form for Social Insurance and Health Insurance, which must be confirmed by the People's Committee of the commune or equivalent and handed over to the receiving unit along with the military service dossier. The unit tasked with training new soldiers shall carry out the process in accordance with the procedures stipulated in Clause 6 of Article 1 of Decree No. 74/2025/NĐ-CP.

Article 5. Scope of Coverage for Transportation Costs of Patients

The subjects specified in Article 2 of this Circular, in cases where they need to be transferred to another medical facility as prescribed in Article 12 of Circular No. 21/2025/TT-BQP dated April 14, 2025, issued by the Minister of National Defense regarding the classification of technical expertise levels; evaluation and certification of medical facility quality; registration and transfer of patients between medical facilities under the Ministry of National Defense, shall be reimbursed for transportation costs.

Article 6. Level of Health Insurance Benefits

1. The subjects specified in Article 2 of this Circular, when seeking medical treatment at health insurance-covered medical facilities, shall have their medical examination and treatment costs covered by the health insurance fund according to the benefit levels prescribed in Article 11 of Decree No. 70/2015/NĐ-CP, amended and supplemented by Clause 10 of Article 1 of Decree No. 74/2025/NĐ-CP.

2. In cases where the subjects specified in Article 2 of this Circular seek medical treatment on demand, the health insurance fund shall cover the portion of medical examination and treatment costs within the scope prescribed in Clause 1 of Article 21 of the Health Insurance Law and the benefit levels prescribed in Article 22 of the Health Insurance Law. The difference between the cost of medical services sought on demand and the amount covered by the health insurance fund shall be borne by the patient and paid to the medical facility.

3. The health insurance fund shall reimburse transportation costs to the entity providing patient transportation services based on the approved service transportation price.

4. In cases where there is no approved transportation service price, the health insurance fund shall reimburse transportation costs based on the following criteria:

a) The actual distance between two medical facilities;

b) The reimbursement rate for fuel costs shall be calculated at a standard of 0.2 liters of RON 95-III gasoline per kilometer, without applying the benefit ratio prescribed in Article 22 of the Health Insurance Law. The price of RON 95-III gasoline shall be based on the announcement by the competent authority in the area where the medical facility transporting the patient is located at the time of transport.

5. For medical facilities providing patient transportation services in cases where there is no approved transportation service price, the health insurance fund shall reimburse as follows:

a) Reimburse round-trip transportation costs to the medical facility transferring the patient based on the actual fuel consumption recorded on the fuel receipt, but not exceeding the fuel cost reimbursement rate prescribed in point b of Clause 4 of this Article;

b) If the patient transportation vehicle does not use gasoline or diesel, the fuel cost reimbursement rate prescribed in point b of Clause 4 of this Article shall apply;

c) If more than one patient is transported in the same vehicle, the reimbursement rate shall be calculated based on the rate for transporting one patient;

d) The medical facility designating the patient transfer shall be responsible for compiling all transportation costs and settling accounts with the social insurance agency. Medical staff from the receiving medical facility shall sign off on the patient transfer form provided by the transferring medical facility.

6. For patients who arrange their own transportation, the health insurance fund shall reimburse as follows:

a) Reimburse one-way (outbound) transportation costs to the receiving medical facility according to the reimbursement rate prescribed in Clause 4 of this Article;

b) The medical facility designating the patient transfer shall record the fact that the patient has arranged their own transportation on the patient transfer form.

c) The medical examination and treatment facility receiving patients shall refund expenses to patients based on transportation invoices provided by patients in accordance with point a of this clause and consolidate transportation costs for settlement with the social insurance agency.

Chapter III
REGISTRATION FOR MEDICAL EXAMINATION AND TREATMENT UNDER HEALTH INSURANCE AT THE INITIAL STAGE; TRANSFER OF PATIENTS BETWEEN MEDICAL EXAMINATION AND TREATMENT FACILITIES UNDER HEALTH INSURANCE; MEDICAL EXAMINATION AND TREATMENT UNDER HEALTH INSURANCE

Article 7. Registration for medical examination and treatment under health insurance; transfer of patients between medical examination and treatment facilities under health insurance

1. Subjects specified in Article 2 of this Circular shall register for initial medical examination and treatment, change registration for initial medical examination and treatment in accordance with the provisions of Article 11 of Circular No. 21/2025/TT-BQP.

2. Transfer of patients between medical examination and treatment facilities under health insurance for subjects specified in Article 2 of this Circular shall be carried out in accordance with the provisions of Article 12 of Circular No. 21/2025/TT-BQP.

Article 8. Medical examination and treatment under health insurance in certain cases

1. Subjects specified in Article 2 of this Circular must present information about their health insurance card and identity proof when undergoing medical examination and treatment in one of the following forms:

a) Health insurance card in paper form or electronic form. In case the paper health insurance card does not have a photograph, they must additionally present one of the following identity proofs: identification card, citizen identification card, certificate of identification, passport, or other identity proof issued by authorized agencies or organizations at level 2 of the electronic identity account (VNeID).

b) Identification card or citizen identification card or electronic identity account (VNeID) level 2 that integrates health insurance card information.

2. Health insurance examination and treatment facilities shall verify the information of the subjects specified in Article 2 of this Circular in the National Insurance Database and the Ministry of Defense's Database.

If there is complete personal information, and the card is still valid, the health insurance examination and treatment facility shall accept the patient for medical examination and treatment and ensure full scope of benefits and entitlements under health insurance.

If there is no data or the data does not match or the card is no longer valid, the military unit's medical service and the health insurance examination and treatment facility shall immediately notify the Military Social Insurance Agency for verification and confirmation of the card information.

3. Subjects specified in Article 2 of this Circular who register for initial medical examination and treatment at primary or basic-level health examination and treatment facilities, when seeking medical examination and treatment at specialized-level facilities, only need to present information about their health insurance card and one of the identity proofs specified in Clause 1 of this Article along with a referral letter from a unit at battalion level or higher; when seeking medical examination and treatment at primary or basic-level facilities, only need to present information about their health insurance card and one of the identity proofs specified in Clause 1 of this Article, which will be fully covered by the health insurance fund according to the provisions of Articles 10 and 11 of Decree No. 70/2015/NĐ-CP amended and supplemented by Clauses 9 and 10 of Article 1 of Decree No. 74/2025/NĐ-CP.

Example 1: Comrade Lieutenant Tran Van A, belonging to Battalion 3, Division B, Corps C; registers for initial medical examination and treatment under health insurance at Tan Xuan Commune Health Station (primary level). When Comrade A seeks medical examination and treatment at any primary or basic-level health examination and treatment facility of the Military nationwide and presents information about his health insurance card and one identity proof, Comrade A will be fully covered by the health insurance fund according to the regulations.

Example 2: In the case of Comrade Tran Van A in Example 1, when seeking medical examination and treatment at any specialized-level health examination and treatment facility of the Military nationwide, and presenting information about his health insurance card, a referral letter from Battalion 3, and one identity proof, Comrade A will be fully covered by the health insurance fund according to the regulations.

4. Subjects specified in Article 2 of this Circular who register for initial medical examination and treatment at specialized-level health examination and treatment facilities, when seeking medical examination and treatment at primary, basic, or specialized levels, must present information about their health insurance card and one of the identity proofs specified in Clause 1 of this Article, and will be fully covered by the health insurance fund according to the provisions of Articles 10 and 11 of Decree No. 70/2015/NĐ-CP amended and supplemented by Clauses 9 and 10 of Article 1 of Decree No. 74/2025/NĐ-CP.

Example 1: Comrade Colonel Nguyen Van B, Deputy Head of the Planning Department/Central Logistics and Technical Department/Command of C; registers for initial medical examination and treatment under health insurance at Central Military Hospital 108 (specialized level); Comrade B goes to seek medical examination and treatment at any other specialized-level health examination and treatment facility of the Military (Military Traditional Medicine Institute or Military Hospital 103 or Military Hospital 175,...) or all primary or basic-level health examination and treatment facilities of the Military nationwide, only needs to present information about his health insurance card and one identity proof (no need to present a referral letter from Central Military Hospital 108) then Comrade B will be fully covered by the health insurance fund according to the regulations.

Example 2: In the case of Comrade Nguyen Van B in Example 1, when seeking medical examination and treatment at Military Hospital E/Region G or Battalion F Clinic (basic level), and presenting information about his health insurance card and one identity proof, Comrade B will be fully covered by the health insurance fund according to the regulations.

5. In case the subjects specified in Article 2 of this Circular are undergoing inpatient treatment or emergency care and need to be transferred to another healthcare facility, such transfer shall be carried out in accordance with the provisions of Article 12 of Circular No. 21/2025/TT-BQP.

6. In cases where patients have health insurance cards but cannot present the information about their health insurance cards or are waiting for issuance, reissuance, or replacement of their health insurance cards, military medical units and healthcare facilities must immediately notify the Military Social Insurance to obtain the health insurance code or issue the health insurance card. Healthcare facilities are responsible for receiving patients for examination and treatment and ensuring full coverage of benefits under the health insurance scheme; they must also compile and settle examination and treatment costs according to the guidelines of the Military Social Insurance.

7. Healthcare facilities are not allowed to establish additional procedures for health insurance examination and treatment beyond those stipulated in Clause 1 of this Article.

Chapter IV
PAYMENT AND SETTLEMENT OF HEALTH INSURANCE EXAMINATION AND TREATMENT COSTS

Article 9. Preparation, management, and utilization of initial healthcare funding for military personnel

1. Conditions for expenditure

a) There must be at least one military medical staff member responsible for or concurrently performing initial healthcare services.

b) There must be a separate military medical room to provide first aid and initial treatment for insured individuals who suffer from accidents, injuries, or common illnesses.

2. Expenditure items shall be implemented in accordance with the provisions of Clause 1 of Article 21 of Decree No. 70/2015/NĐ-CP, amended and supplemented by Clause 18 of Article 1 of Decree No. 74/2025/NĐ-CP, specifically:

a) Purchase of medicines and medical equipment approved for circulation in Vietnam for providing first aid and initial treatment for the subjects specified in Article 2 of this Circular when they suffer from accidents or common illnesses;

b) Payment for technical service fees for examination and treatment at military medical units in accordance with the Technical Service List specified in Appendices I and II of Circular No. 21/2025/TT-BQP;

c) Procurement and repair of medical equipment and office equipment for initial healthcare activities;

Example: Procurement and repair: Blood pressure monitor, stethoscope, minor surgery kit, ENT examination lamp, electroacupuncture machine, electrocardiogram machine, computer, printer, barcode reader, file cabinet, medicine cabinet, table, chair, signboard, resuscitation protocol, office supplies, and other medical and office equipment.

d) Procurement of software for management and information security assurance for examination and treatment activities.

3. Preparation, allocation, and assignment of budget estimates

a) Preparation of budget estimates

Annually, the financial department takes the lead and coordinates with the military medical department at the same level based on the expenditure items stipulated in Clause 2 of this Article; troop strength; annual plan tasks; implementation status of the previous year and estimated implementation of the current year to prepare the budget estimate for initial healthcare funding for military personnel and submit it to the financial department of the higher-level unit up to the direct subordinate unit of the Ministry of National Defense for consolidation and submission to the Military Social Insurance together with the report on the budget estimate for social insurance, health insurance, and unemployment insurance revenue and expenditure.

b) Allocation and assignment of budget estimates

Annually, based on assigned tasks in initial healthcare, the budget estimates prepared by units and used within the Ministry of National Defense, the Military Social Insurance takes the lead and coordinates with relevant agencies to develop a plan for allocating the budget estimate for initial healthcare funding for military personnel, which is submitted to the Financial Department of the Ministry of National Defense for consolidation and approval by the Minister of National Defense before being assigned to units for management and use.

In cases where adjustments to the budget estimate for initial healthcare funding for military personnel are necessary, units must submit adjustment requests to the financial department of the higher-level unit up to the direct subordinate unit of the Ministry of National Defense for consolidation and submission to the Military Social Insurance together with the adjustment of the budget estimate for social insurance, health insurance, and unemployment insurance revenue and expenditure. The Military Social Insurance develops an adjustment plan, submits it to the Financial Department of the Ministry of National Defense for consolidation, and then submits it to the Minister of National Defense for review and decision.

4. Allocation of funds

Based on the Decision on the annual budget estimate issued by the Minister of National Defense, the Military Social Insurance implements the allocation of funds for initial healthcare funding for military personnel to units for management and use.

5. Payment and settlement

a) Payment

Payment for the contents specified in Points a, c, and d of Clause 2 of this Article shall be carried out in accordance with the current regulations of the State and the Ministry of National Defense. If units cannot self-fund, higher-level military medical units will procure and distribute to lower-level units.

Payment for technical services shall be capped at the highest price of that technical service provided by state primary healthcare facilities in the province. If there is no price for that technical service at state primary healthcare facilities in the province, payment shall be capped at the lowest price of that technical service provided by state basic healthcare facilities in the province.

Units may use revenue from technical services in initial healthcare to cover expenses related to the provision of technical services, including: drug, chemical, and consumable material costs used during the provision of technical services, waste disposal costs, environmental sanitation costs, and other directly related costs. Any remaining revenue after covering these expenses can be used to supplement the income of military medical staff providing technical services and other stipulated uses according to the unit's regulations. Revenue from technical services in initial healthcare shall be centrally managed and uniformly handled by the unit's financial department in accordance with current regulations.

b) Settlement

Quarterly, annually, the financial agency of units at the regiment level and equivalent shall take the lead and coordinate with the medical service at the same level to prepare reports on the settlement of expenditures for primary health care of military personnel and submit them to the financial agency of the superior unit up to the unit directly under the Ministry of National Defense for consolidation, and then submit them to the Military Social Insurance for review and settlement according to the current regulations of the State and the Ministry of National Defense regarding the financial management mechanism for social insurance, health insurance, and unemployment insurance. The unspent budget for primary health care expenses in the year may be carried over to the next year. The primary health care funds of the Ministry of National Defense as stipulated in point a, Clause 1, Article 21 of Decree No. 70/2015/ND-CP, amended and supplemented in Clause 18, Article 1 of Decree No. 74/2025/ND-CP, if not fully utilized in the year, may be carried over to the next year.

Article 10. Settlement of health insurance examination and treatment costs; settlement of health insurance revenue and expenditure with the Vietnam Social Security

1. Settlement of health insurance examination and treatment costs

a) The method of settling health insurance examination and treatment costs shall be implemented in accordance with Clause 1, Article 18 of Decree No. 70/2015/ND-CP, amended and supplemented in point a, Clause 14, Article 1 of Decree No. 74/2025/ND-CP.

b) The settlement of health insurance examination and treatment costs at health facilities providing health insurance services shall be implemented in accordance with Clauses 2 and 3, Article 18 of Decree No. 70/2015/ND-CP, amended and supplemented in point b, Clause 14, Article 1 of Decree No. 74/2025/ND-CP.

c) Direct settlement of health insurance examination and treatment costs shall be implemented in accordance with Clauses 1, 2, 3, 4, and 5, Article 19 of Decree No. 70/2015/ND-CP, amended and supplemented in Clause 15, Article 1 of Decree No. 74/2025/ND-CP.

2. Settlement of health insurance examination and treatment costs; settlement of health insurance revenue and expenditure with the Vietnam Social Security

a) Settlement of health insurance examination and treatment costs

The Military Social Insurance transfers the examination and treatment funds to the Vietnam Social Insurance to settle the examination and treatment costs of the subjects specified in Article 2 of this Circular when they seek medical examination and treatment at health facilities providing health insurance services that have signed contracts with the Social Insurance of provinces and centrally-administered cities, in accordance with point c, Clause 3, Article 18 of Decree No. 70/2015/ND-CP, amended and supplemented in point b, Clause 14, Article 1 of Decree No. 74/2025/ND-CP, specifically as follows:

Upon receipt of the multi-level travel cost notification from the Vietnam Social Insurance, the Military Social Insurance will compare it with the data of the cards of the subjects under its management, review, and transfer the multi-level travel examination and treatment costs to the Vietnam Social Insurance for payment of examination and treatment costs to health facilities not contracted with the Military Social Insurance in accordance with the regulations.

b) The settlement of the health insurance fund revenue and expenditure of the Military Social Insurance with the Vietnam Social Insurance shall be implemented in accordance with the current regulations of the State and the Ministry of National Defense regarding the financial management mechanism for social insurance, health insurance, and unemployment insurance.

Article 11. Payment of transportation costs

The payment of transportation costs shall be carried out in accordance with the provisions of Clause 5, Article 11 of Decree No. 70/2015/NĐ-CP, amended and supplemented by Clause 10, Article 1 of Decree No. 74/2025/NĐ-CP, and other regulations of the Government on the payment of transportation costs.

Article 12. Payment and settlement of medical examination and treatment costs under health insurance for subjects specified in Article 2 of this Circular and people specified at point c, Clause 4, Article 31 of the Health Insurance Law at medical examination and treatment facilities located in border areas, islands, communes, and particularly difficult villages At medical examination and treatment facilities located in border areas, islands, communes, and particularly difficult villages, the payment and settlement of medical examination and treatment costs under health insurance for subjects specified in Article 2 of this Circular and people specified at point c, Clause 4, Article 31 of the Health Insurance Law shall be implemented in accordance with the provisions of Article 19a of Decree No. 70/2015/NĐ-CP, added by Clause 16, Article 1 of Decree No. 74/2025/NĐ-CP.

2. Management of funds for medical examination and treatment under health insurance for subjects specified in Article 2 of this Circular and people specified at point c, Clause 4, Article 31 of the Health Insurance Law at medical examination and treatment facilities not contracted for medical examination and treatment under health insurance in remote island areas shall be carried out as follows:

a) Remote island areas include islands and island groups more than 150 nautical miles from the mainland and DK platforms;

b) Contents of expenditure: Purchase of medicines and medical equipment approved for circulation in Vietnam;

c) Preparation of budget estimates, allocation, and assignment of budget estimates

Annually, units assigned the task of providing medical examination and treatment under health insurance in remote island areas shall base their budget estimates for medical examination and treatment under health insurance in remote island areas (including: list, estimated unit prices, total amount) on the contents of expenditure, personnel strength, tasks assigned by competent authorities, implementation status of the previous year, projected implementation of the planned year, disease structure, human resources, and medical equipment, and send them to the financial authority of the directly superior unit for consolidation and submission to the Military Social Security Fund together with the budget estimates for social insurance, health insurance, and unemployment insurance, while also sending them to the General Logistics Department - Technical Service for review.

Annually, based on the medical examination and treatment tasks in remote island areas assigned by the Ministry of National Defense, the reviewed budget estimates of the units, and the ratio of funds allocated according to point b, Clause 3, Article 19a of Decree No. 70/2015/NĐ-CP, added by Clause 16, Article 1 of Decree No. 74/2025/NĐ-CP, the Military Social Security Fund will develop a plan for allocating budget estimates for medical examination and treatment under health insurance in remote island areas, submit it to the Financial Department for consolidation, and report to the Minister of National Defense for approval and assignment of budget estimates to the units.

d) Allocation of funds

Based on the Decision on the annual budget estimate issued by the Minister of National Defense, the Military Social Security Fund will allocate funds to the units to ensure medical examination and treatment in remote island areas.

Annually, based on the transferred funds for medical examination and treatment costs under health insurance for people working, studying, and living in remote island areas transferred by the Vietnam Social Security to the Ministry of National Defense, the Military Social Security Fund will allocate funds to the units.

Each quarter and annually, the financial unit responsible for consolidating the budget estimates assigned by the directly subordinate unit of the Ministry of National Defense shall prepare reports on the settlement of expenditures for medical examination and treatment under health insurance in remote island areas and submit them to the Military Social Security Fund for review and settlement in accordance with current State and Ministry of National Defense regulations on financial management mechanisms for social insurance, health insurance, and unemployment insurance.

Unused funds from the budget estimates of the units compared to the assigned budget estimates shall be carried over to the next year for continued use, and unused funds allocated according to point b, Clause 3, Article 19a of Decree No. 70/2015/NĐ-CP, added by Clause 16, Article 1 of Decree No. 74/2025/NĐ-CP, shall be transferred to the next year's budget source.

In cases where the transferred funds are insufficient to ensure medical examination and treatment, the units shall prepare requests for additional funding from the state budget, submit them to the Military Social Security Fund for consolidation, and report to the Financial Department of the Ministry of National Defense for review, and then report to the Minister of National Defense to request the State to ensure the remaining funds.

HEALTH INSURANCE MEDICAL EXAMINATION AND TREATMENT CONTRACT

The remaining budget funds of units that have not been fully utilized compared to their budget estimates shall be carried over to the next year for continued use. The amount of funds allocated according to point b, Clause 3, Article 19a of Decree No. 70/2015/NĐ-CP, supplemented at Clause 16, Article 1 of Decree No. 74/2025/NĐ-CP, if not fully utilized, shall be transferred to the next year's budget.

In cases where the transferred funds are insufficient to ensure medical examinations and treatments, the units shall submit supplementary fund requests from the state budget to the Military Social Insurance for consolidation, and send them to the Finance Department of the Ministry of National Defense for review, and report to the Minister of National Defense to request the State to ensure the remaining funds.

Chapter V
MEDICAL EXAMINATION AND TREATMENT CONTRACTS UNDER HEALTH INSURANCE

Article 13. Conditions for signing health examination and treatment insurance contracts

1. Ensuring the operating conditions of health examination and treatment facilities in accordance with Article 49 of the Health Examination and Treatment Law, consistent with the scope of health examination and treatment services provided under health insurance.

2. Ensuring standards for connecting and interlinking health examination and treatment insurance data with the information system and health insurance claims processing system of the social insurance agency in accordance with regulations of the Minister of Health, and verifying payment data in accordance with the provisions of the law.

Article 14. Health examination and treatment insurance contracts

Health examination and treatment insurance contracts are signed between health examination and treatment facilities meeting the conditions stipulated in Article 13 of this Circular and shall be implemented as follows:

1. Health examination and treatment facilities under the management of the Ministry of National Defense may sign one health examination and treatment insurance contract with the Military Social Insurance and one contract with the social insurance agency directly under the Vietnam Social Security.

2. The legal representative of the health examination and treatment facility to sign health examination and treatment insurance contracts is the head of the units or persons holding one of the positions of general manager, director, or hospital director of the health examination and treatment facility, or a person authorized by the head of the health examination and treatment facility.

3. The content, procedures, and documentation for signing contracts, signing supplementary agreements, suspending, terminating, and dissolving health examination and treatment insurance contracts shall be carried out in accordance with the provisions of Articles 23, 24, 25, 26, 27, 28, 29, 31, 32, and 33 of Decree No. 108/2025/NĐ-CP dated July 1, 2025, guiding the implementation of certain provisions of the Health Insurance Law.

4. Rights and responsibilities of the parties in implementing health examination and treatment insurance contracts shall be carried out in accordance with the provisions of Articles 34 and 35 of Decree No. 108/2025/NĐ-CP dated July 1, 2025, guiding the implementation of certain provisions of the Health Insurance Law.

Chapter VI
ALLOCATION AND MANAGEMENT OF HEALTH INSURANCE REVENUE; MANAGEMENT AND USE OF HEALTH EXAMINATION AND TREATMENT INSURANCE FUNDS

Article 15. Allocation and Management of Health Insurance Revenue

1. Allocation and management of health insurance revenue shall be carried out in accordance with the provisions of Article 20 of Decree No. 70/2015/NĐ-CP amended and supplemented at Clause 17, Article 1 of Decree No. 74/2025/NĐ-CP.

2. Preparation of budget estimates, allocation, assignment of budget estimates, settlement of income and expenditure of health insurance shall be carried out in accordance with the provisions of Article 23 of Decree No. 70/2015/NĐ-CP.

Article 16. Management and Use of Health Examination and Treatment Insurance Funds

1. Use of health examination and treatment insurance funds shall be carried out in accordance with the provisions of Article 21 of Decree No. 70/2015/NĐ-CP amended and supplemented at Clause 18, Article 1 of Decree No. 74/2025/NĐ-CP.

2. In cases where the health examination and treatment fund has more income than expenditures, the surplus funds not fully utilized shall be used in accordance with the provisions of Clause 2, Article 21 of Decree No. 70/2015/NĐ-CP. The Military Social Insurance shall take the lead and coordinate with the Department of Military Medicine / General Logistics and Technical Service, the Finance Department / Ministry of National Defense to develop plans for using surplus funds for the year, report to the head of the Political Bureau, and submit to the Minister of National Defense for approval.

3. In cases where the health examination and treatment fund has less income than expenditures, the Military Social Insurance shall be responsible for compiling reports to the Ministry of National Defense requesting the Vietnam Social Security to ensure in accordance with the provisions of Clause 3, Article 21 of Decree No. 70/2015/NĐ-CP.

Chapter VII
RESPONSIBILITIES OF THE AGENCIES AND UNITS

Article 17. Responsibilities of the General Staff Department

1. Direct the Military Personnel Department to share data and information about subjects under its management with the Policy and Social Affairs Department/Political Directorate for organization management and issuance of health insurance cards.

2. Direct the Cryptographic Department to ensure security for the connection and sharing of data between agencies and units in accordance with regulations of the Ministry of National Defense.

Article 18. Responsibilities of the Political Directorate

1. Direct the Cadre Department to share data and information about subjects under its management with the Policy and Social Affairs Department (Military Social Insurance) for organization management and issuance of health insurance cards.

2. Direct the Propaganda and Education Department to take the lead and coordinate with relevant agencies and units to disseminate and guide policies and benefits of health insurance for subjects managed by the Ministry of National Defense.

3. Direct the Policy and Social Affairs Department (Military Social Insurance) to implement health insurance for subjects managed by the Ministry of National Defense, specifically as follows:

a) Take the lead in guiding, implementing, and managing the organization's implementation of health insurance policies and systems within the Ministry of National Defense; report on the implementation results of health insurance laws and policies within the Ministry of National Defense;

b) Take the lead in managing and settling the collection of health insurance funds from subjects specified in Article 2 of this Circular with agencies and units under the Ministry of National Defense. Lead in guiding units to issue health insurance cards and process initial healthcare costs;

c) Take the lead in managing and using funds allocated for medical examinations and treatments as stipulated in Article 21 of Decree No. 70/2015/ND-CP; develop plans for using the funds specified in Clause 2 of Article 21 of Decree No. 70/2015/ND-CP; allocate and guide the use of health insurance management funds; directly settle examination and treatment costs for subjects specified in Article 2 of this Circular;

d) Coordinate with the Medical Service/Logistics and Technical General Department and the Finance Department of the Ministry of National Defense to study and advise on policies, systems, and the implementation of health insurance for subjects specified in Article 2 of this Circular;

đ) Sign contracts for medical examinations and treatments covered by health insurance with medical facilities under the management of the Ministry of National Defense. Advance payments, appraise, settle, and finalize expenses for medical examinations and treatments covered by health insurance according to regulations and quantities, advance payment ratios; record unsettled finalization costs and issues. Settle and finalize with the Vietnam Social Security the costs for medical examinations and treatments of subjects specified in Article 2 of this Circular at medical facilities not contracted with the Military Social Insurance;

e) Conduct cost appraisal for medical examinations and treatments covered by health insurance based on electronic data transferred daily by medical facilities to the Military Social Insurance's reception portal; based on the results of the electronic data appraisal, develop plans for direct inspections at medical facilities providing health insurance services according to regulations; direct and guide medical facilities to resolve difficulties and issues in the implementation of health insurance medical examinations and treatments;

g) Take the lead and coordinate with the Medical Service/Logistics and Technical General Department to guide subjects specified in Article 2 of this Circular to register for initial medical examinations and treatments at military medical facilities and health insurance medical facilities not under the management of the Ministry of National Defense, suitable to the characteristics and circumstances of each unit regarding their location and the capacity of medical facilities;

h) Coordinate with medical facilities in verifying and clarifying information of health insurance participants when required and resolving difficulties and issues in: Receiving and checking procedures for health insurance medical examinations and treatments; temporarily holding health insurance cards and handling cases of violations according to authority upon receiving reported violations; applying information technology in appraising and settling costs for health insurance medical examinations and treatments for medical facilities;

i) Regularly or unexpectedly conduct inspections on the use of health insurance funds for medical examinations and treatments at medical facilities, military medical units, and agency medical facilities;

k) Provide information on health insurance medical facilities and guide health insurance participants to choose appropriate initial medical examination and treatment registration facilities;

l) Take the lead and coordinate in disseminating and guiding the implementation of health insurance laws and policies within the Ministry of National Defense;

m) Take the lead and coordinate in organizing training for health insurance professionals working in agencies and units under the Ministry of National Defense;

n) Take the lead in building and managing the Ministry of National Defense's health insurance database; coordinate with the 86th Military Region Command and the Telecommunications Arm to establish standards for connections and infrastructure to ensure verification of health insurance card information, implement electronic health insurance cards, serve health insurance medical examinations and treatments, and exploit and share data with national databases and specialized databases in accordance with legal provisions and Ministry of National Defense regulations;

o) Share data and information on health insurance medical examinations and treatments with the Medical Service/Logistics and Technical General Department for research and advice on health insurance policies in the military.

Article 19. Responsibilities of the General Department of Logistics - Technical Affairs

1. Review the budget estimate for medical expenses to ensure health check-ups and treatments for the subjects specified in Article 2 of this Circular who receive health check-ups and treatments in remote coastal areas.

2. Direct the Military Medical Service to implement health insurance for subjects under the management of the Ministry of National Defense, specifically as follows:

a) Take the lead and coordinate to research, advise on, and propose health insurance policies and procedures for the subjects specified in Article 2 of this Circular.

b) Coordinate to manage and utilize data from health check-ups and treatments under health insurance to advise and propose to the Head of the Ministry of National Defense on implementing health insurance policies and procedures.

c) Coordinate to propose measures to strengthen and improve healthcare facilities under the management of the Ministry of National Defense to meet the conditions for health check-ups and treatments for the subjects specified in Article 2 of this Circular and other insured subjects.

d) Propose the classification and technical level ranking for healthcare facilities under the management of the Ministry of National Defense for approval by the Minister of National Defense.

đ) Approve the list of technical services provided at healthcare facilities under the management of the Ministry of National Defense within their authority.

Take the lead and coordinate with relevant agencies to propose the Ministry of National Defense issue permits for health check-up and treatment activities for healthcare facilities, and issue permits for practicing health check-ups and treatments for practitioners managed by the Ministry of National Defense according to the provisions of the law.

e) Direct and guide military healthcare facilities to sign and implement health insurance contracts for health check-ups and treatments.

g) Take the lead and coordinate with the Social Insurance of the Military and related agencies to guide the registration for initial health check-ups and treatments at military healthcare facilities, in accordance with the characteristics of the Military and the capacity of healthcare facilities.

h) Take the lead and coordinate with related agencies to inspect and supervise the implementation of health insurance policies and procedures at agencies, units, and healthcare facilities under the management of the Ministry of National Defense.

i) Coordinate with related agencies and units to promote health insurance policies and procedures within the Ministry of National Defense.

k) Coordinate to organize procurement of medicines and medical equipment from the health insurance fund according to point b, Clause 3, Article 19a of Decree No. 70/2015/ND-CP amended and supplemented by Clause 16, Article 1 of Decree No. 74/2025/ND-CP based on the allocated budget to implement health check-up and treatment activities for military personnel, civilians, and workers living and working in remote coastal areas.

Article 20. Responsibilities of the Financial Department of the Ministry of National Defense

1. Coordinate with the Military Medical Service of the General Department of Logistics - Technical Affairs to research, advise on, and propose health insurance policies and procedures for the subjects specified in Article 2 of this Circular.

2. Guide units to prepare the budget estimate for contributions to health insurance for the subjects specified in Article 2 of this Circular and to complete settlement according to state regulations and those of the Ministry of National Defense; consolidate the budget estimates and report to the Minister of National Defense to ensure funding for agencies and units.

3. Annually, based on the proposal of the Social Insurance of the Military regarding the allocation plan and adjustment of the budget estimate for primary healthcare costs, the budget estimate for health check-ups and treatments in remote coastal areas, consolidate and submit to the Minister of National Defense for consideration and approval for units to implement.

4. Consolidate the shortfall in funds for health check-ups and treatments in remote coastal areas compared to the insufficient transferred amount for health check-ups and treatments as proposed by the Social Insurance of the Military to report to the Ministry of National Defense to request the State to ensure funding.

5. Coordinate with the Social Insurance of the Military to guide healthcare facilities under health insurance, agencies, and units managing the subjects specified in Articles 2 of this Circular on valid procedures and documents for payment and settlement of health check-up and treatment costs under health insurance from the health insurance fund and state budget as stipulated in this Circular; exchange information between the two agencies after concluding the settlement of health insurance costs for the subjects specified in Articles 2 of this Circular to manage and use the state budget and health insurance fund strictly in accordance with the law.

6. Coordinate with the Social Insurance of the Military to guide units and military healthcare facilities to manage and use primary healthcare costs for military personnel, health check-up and treatment costs in remote coastal areas, and health check-up and treatment costs under health insurance as stipulated in this Circular.

7. Coordinate with the Social Insurance of the Military to manage and use the health check-up and treatment fund under health insurance, surplus funds from the health check-up and treatment fund under health insurance as stipulated in this Circular.

Article 21. Responsibilities of agencies and units directly under the Ministry of National Defense

1. Propaganda and disseminate policies and laws on health insurance for objects under their management.

2. Implement and organize health insurance for objects within the unit's responsibility as stipulated in this Circular.

3. Annually, agencies and units at the regiment level and above, according to the classification of object management, shall guide the objects specified in Article 2 of this Circular to fill out the Declaration Form for Providing and Changing Information of Social Insurance and Health Insurance Participants, compile lists of health insurance participants, retain electronic and paper copies of declarations and lists, and related documents concerning the issuance, reissuance, and replacement of health insurance cards for objects at the unit; the retention period shall be carried out in accordance with regulations of the Ministry of National Defense. Implement connectivity and data sharing of social insurance and health insurance participants, security measures for connectivity and data sharing among agencies and units as prescribed by the Ministry of National Defense.

4. Implement management of objects and collection of social insurance and health insurance; propose issuance of social insurance books and health insurance cards; manage allocated social insurance and health insurance funds strictly, using them for their intended purposes; timely prepare budgets, settle accounts, and report final settlements of income and expenditure in compliance with regulations.

5. Receive and manage health insurance cards in accordance with regulations. Timely review requests for issuance of health insurance cards for participants.

6. Apply information technology in managing, issuing, and using health insurance cards, managing medical examinations and treatments, and settling and finalizing costs for medical examinations and treatments under health insurance.

7. Heads of units directly under the Ministry of National Defense are responsible for reviewing, assessing, seeking opinions from relevant functional agencies under the Ministry of National Defense, and issuing decisions to assign primary healthcare tasks to medical facilities with inpatient beds.

8. Units assigned the task of providing medical examinations and treatments under health insurance for military personnel and civilians living and working in remote coastal areas are responsible for directing subordinate agencies and units to implement medical examinations and treatments; organizing procurement and utilization of medicines, chemicals, consumables, and medical equipment to serve medical examinations and treatments in remote coastal areas in accordance with the law.

9. Coordinate with the General Staff 86 and the Telecommunications Service to ensure standards for connectivity, interoperability, and data sharing for medical examinations and treatments under health insurance with the social insurance administration's information system and inspection system as prescribed by the Minister of Health and the Minister of National Defense, serving the issuance of health insurance cards, management of electronic health records for military personnel, and resolution of health insurance benefits and medical examinations and treatments under health insurance.

Article 22. Responsibilities of health insurance medical examination and treatment facilities

1. Implement provisions of Article 43 of the Health Insurance Law and other responsibilities as prescribed by laws on medical examinations and treatments.

2. Adhere to laws on medical examinations and treatments, professional guidelines of the Ministry of Health, and related laws on procurement and bidding to ensure quality, effectiveness, and cost-efficiency in supplying medicines, chemicals, medical equipment, and medical technical services.

3. Comply with legal provisions on input data standards, output data standards, electronic data extraction and transfer, digital conversion, and electronic transactions in the field of healthcare. Strengthen and upgrade information infrastructure systems to meet conditions for connectivity and data sharing for medical examinations and treatments under health insurance as prescribed by the Government.

4. Medical examination and treatment facilities are responsible for publicly disclosing the results of technical specialty grading approved by competent authorities on their websites and at patient reception areas.

5. Send electronic data on medical examinations and treatments under health insurance immediately after the end of each medical examination session or outpatient treatment course or inpatient treatment course of patients as prescribed by the Minister of Health to serve management and cost settlement for medical examinations and treatments under health insurance.

6. Ensure conditions for conducting medical examinations and treatments under health insurance in compliance with health insurance laws, medical examination and treatment laws, and health insurance medical examination and treatment contracts.

7. Provide medical records and related documents for medical examinations and treatments and cost settlement for medical examinations and treatments under health insurance for objects specified in Article 2 of this Circular upon request from the social insurance agency and competent state authorities.

8. Aggregate, settle, and finalize costs for medical examinations and treatments under health insurance for objects specified in Article 2 of this Circular as prescribed; promptly issue and promulgate procedures and professional guidelines for medical examinations and treatments under health insurance, measures to prevent abuse and fraud of health insurance funds within their authority; proactively identify, review, and verify high-cost medical examinations and treatments under health insurance at the facility based on notifications and warnings from the Military Social Insurance in accordance with the law.

9. Medical examination and treatment facilities assigned the task of providing medical examinations and treatments under health insurance for military personnel and civilians living and working in remote coastal areas are responsible for organizing and implementing medical examinations and treatments for military personnel and civilians in compliance with regulations.

Chapter VIII
IMPLEMENTING PROVISIONS

Article 23. Effectiveness of Implementation

1. This Circular takes effect from July 1, 2025.
