THE MINISTER OF FORESTRY
Pursuant to Decree No. 237/HĐBT dated September 19, 1985 of the Council of Ministers promulgating the Regulations on preparation, examination, and approval of construction project designs;
Pursuant to Circular No. 01/TT-LB dated March 9, 1991 of the Joint Ministry of Construction - State Committee for Science, Technology and Environment - Finance - National Bank of Vietnam guiding the implementation of the Management Regulations for Construction Projects 385/HĐBT;
Considering the proposal for delegation of authority to review TKKT-DT from the Associations, Corporations, and Companies,
DECISION:
Article 1- Authorizes the General Directors of the Associations and Corporations and the Directors of Companies (with attached list) to review TKKT-DT for forestry works according to the following provisions:
1- Conditions for projects authorized to be reviewed:
Below the level requiring technical economic feasibility study;
Not funded by state capital (state budget, non-repayable aid, preferential loans or interest-free loans according to state plans...).
2- Specific types of projects authorized to be reviewed as follows:
a- Architectural works.
Civilian houses and residential buildings up to Class III;
Small processing plants with investment capital of 300 million dong or less;
b- Transportation works.
Forest roads of Class III or lower with gravel surface;
Bridges up to 10 meters long;
Culverts up to 50 meters long;
Various types of drains.
c- Water conservancy works.
Small water canals, irrigation channels, and drainage ditches.
d- Forestry works.
Seedling nurseries, germplasm gardens, seedling forests, botanical gardens, and plant collections;
Reforestation;
Forest enclosure and enrichment;
Care and protection.
e- Other works.
Land reclamation and soil improvement;
Infrastructure works serving development and construction;
Minor components with investment capital of 100 million dong or less, supplementing main works already approved.
In addition, the General Directors and Directors are also authorized to review TKKT-DT for certain types of works funded by state capital under Project 327-CT according to Point II-3-a of Circular No. 12-LSCN dated August 18, 1993 of the Ministry of Forestry "guiding some issues regarding technical economic feasibility studies, budget estimates, and construction of Project 327-CT".
Article 2.
The Associations, Corporations, and Companies must strengthen their departments responsible for reviewing TKKT-DT.
The review and approval of TKKT-DT must be based on current state regulations governing construction management.
Annual reports summarizing the reviews and approvals of TKKT-DT for the year must be submitted to the Ministry including the following contents:
List of works and components reviewed and approved for TKKT-DT during the year (name, scale, grade, approved budget estimate).
List of staff assigned to review TKKT-DT during the year and projected for the next year.
Article 3. The General Directors and Directors of the units delegated authority and the Heads of related units are responsible for implementing this Decision.
All provisions contrary to this Decision are hereby abolished.
