MINISTRY OF SCIENCE AND TECHNOLOGY, TECHNOLOGY AND ENVIRONMENT

Regarding the issuance of the Regulation on the Organization and Operation of the Project Preparation and Management Board

 and management of the Project to support the development of human resources for the software industry.On May 22, 1993, the Government issued Resolution No. 249/1993/NĐ-CP regarding the tasks, authorities, and organizational structure of the Ministry

 

THE MINISTER OF SCIENCE, TECHNOLOGY AND ENVIRONMENT

Pursuant to Decree No. 22/CP of Science, Technology, and Environment; Pursuant to Decree No. 17/2001/NĐ-CP dated May 4, 2001 of the Government on the Regulation on Management and Use of Official Development Assistance;

Pursuant to Decision No. 550/QĐ-TCCBKH dated May 12, 1997 of the Ministry

of Science, Technology, and Environment on the Charter of the Organization and Operation of the Ministry's Office; Ministry of Science and Technology Pursuant to Decision No. 1553/QĐ-BKHCNMT dated July 17, 2002 of the Ministry of Science, Technology, and Environment on the establishment of the Project Preparation and Management Board for the Project to support the development of human resources for the software industry;

At the proposal of the Director of the Project Preparation and Management Board, the Head of the Ministry's Office Ministry of Science and Technology and the Director of the Department of Organization and Scientific Personnel, This Decision hereby promulgates the Regulation on the Organization and Operation of the Project Preparation and Management Board for the Project to support the development of human resources for the software industry.

This Decision shall take effect fifteen days from the date of signature. The Director of the Project Preparation and Management Board, the Director of the Department of Organization and Scientific Personnel, the Director of the Department of International Relations, the Head of the Ministry's Office and the Heads of related units are responsible for implementing this Decision./.

 

DECISION:

Article 1Organization and operation of the Project Preparation and Management Board for the Project to support the development of human resources for the software industry (issued together with Decision No. 64/2002/QĐ-BKHCNMT dated August 12, 2002 of the

Article 2Minister of Science, Technology, and Environment).

The Project Preparation and Management Board for the Project to support the development of human resources for the software industry (abbreviated as the Project Management Board) was established pursuant to Decision No. 1553/QĐ-BKHCNMT dated July 17, 2002 of the Minister of Science, Technology, and Environment. The Project Management Board is located at the Ministry

 

REGULATIONS

of Science, Technology, and Environment and operates under the direction of the Head of the Ministry's Office. The Project Management Board uses the seal and account of the Ministry's Office. The working location of the Project Management Board is arranged by the Ministry's Office.

 The Project Management Board uses the international transaction name of Executing Agency of The Project on Supporting the Human Resource Development for Software Industry (shortened as HUDESI). Functions of the Project Management Board:

The Project Management Board assists the Head of the Ministry's Office

in preparing and managing the Project using non-repayable aid funds from the Government of India for supporting the development of human resources in the software industry.

 

PART I

GENERAL PROVISIONS

Article 1Tasks of the Project Management Board: 1. Serve as the point of contact and coordinate with the Indian representative office and domestic and foreign agencies to carry out activities related to Project preparation.

Article 22. Manage and organize the implementation of the Project after it has been officially approved by the Government. 3. Prepare and submit reports on Project implementation, financial statements, and evaluations of Project outcomes to relevant authorities based on close cooperation and consolidation of reports from beneficiary units of Project support activities. 4. Be responsible for the effectiveness of Project fund usage towards enhancing the capacity of beneficiary units in developing human resources for the software industry through Project support activities.

ORGANIZATIONAL STRUCTURE AND OPERATIONS

 

Chapter II

2. Compiling the contents and budget estimates for sub-projects and tasks of ministries, sectors, and localities, reporting to the Minister so that the Ministry of Science and Technology can submit them to competent authorities for examination and approval. Mobilizing resources for the implementation of the Project;

Article 3The Director of the Project Management Board is responsible to the Head of the Ministry's Office

for all Project activities; has the authority and responsibility to organize and implement the tasks stipulated in Article 4 of this Regulation. The Deputy Director assists the Director. In the absence of the Director, the Deputy Director may act on behalf of the Director to manage and resolve Project Management Board matters with the approval of the Head of the Ministry's Office. Staff working for the Project on a part-time basis will be compensated according to current regulations, while staff working under labor contracts will be paid from the Project's operational budget. The Director of the Project Management Board decides on the allocation and specific duties of staff grouped into teams.The operating budget of the Project Management Board is sourced from the Project's budget.

Article 4The Project Management Board implements work procedures and cooperative relationships with subordinate units of the Ministry's Office and functional departments within the Ministry

in accordance with the Ministry's work regulation. The Project Management Board coordinates support activities of the Project for beneficiary units and leads the implementation of tasks listed in Article 4 of this Regulation. Staff working for the Project on a part-time basis will be compensated according to current regulations, while staff working under labor contracts will be paid from the Project's operational budget. The Director of the Project Management Board decides on the allocation and specific duties of staff grouped into teams.The Director of the Project Management Board may represent the Head of the Ministry's Office in dealings with domestic and foreign agencies related to the Project upon authorization by the Head of the Ministry's Office.

This Regulation takes effect fifteen days from the date of signature.

The Heads of the Ministry's Office, the Director of the Department of Organization and Scientific Personnel, and the Director of the Project Management Board are responsible for organizing the implementation of this Regulation.

When amendments or supplements to this Regulation are necessary, the Director of the Project Management Board shall report to the Head of the Ministry's Office

 

Chapter III

in coordination with the Director of the Department of Organization and Scientific Personnel to present to the leadership of the Ministry

Article 5for consideration and decision./. for all activities of the Project; has the right and bears responsibility for organizing the implementation of tasks stipulated in Article 4 of this Regulation.

The Deputy Director assists the Director. In case the Director is absent, the Deputy Director is authorized to act on behalf of the Director to manage and handle the affairs of the Project Management Board with the consent of the Minister's Office Director.

Article 6Staff working for the Project under a part-time system shall be entitled to remuneration according to the current regulations, and staff working under a labor contract shall be paid from the Project's operating funds. The Director of the Project Management Board decides on the allocation and arrangement of staff into groups and specifies the specific duties of each group.

, Clause 1, Clause 2 Article 7a of this Regulation.The operating funds of the Project Management Board shall be sourced from the Project's funds.

 

Chapter IV

WORK RELATIONSHIPS

Article 8The Project Management Board implements work systems and cooperative relations with units under the Minister's Office and functional units within the Ministry in accordance with the Ministry's Work Regulations.

The Project Management Board coordinates support activities of the Project for beneficiary units and takes the lead in implementing the tasks recorded in Article 4 of this Regulation.

The Director of the Project Management Board represents the Minister's Office Director in dealing with domestic and foreign agencies and organizations related to the Project after being authorized by the Minister's Office Director. .

 

Chapter V

IMPLEMENTING PROVISIONS

Article 9This Regulation shall take effect fifteen days from the date of signature.

Article 10Directors of the Minister's Office, Department Heads of the Organization and Scientific Personnel Department, and the Director of the Project Management Board are responsible for organizing the implementation of this Regulation.

Article 11When amendments or supplements to this Regulation are necessary, the Director of the Project Management Board shall report to the Minister's Office Directorin coordination with the Department Head of the Organization and Scientific Personnel Department to submit to the Ministry's leadership for consideration and decision./.
