DECISION:
Article 1. Now hereby promulgates with this Decision the Regulation on the selection, recognition, and awarding of high-quality construction projects.
Article 2. This Decision shall take effect fifteen days from the date of signature. This Regulation replaces the Regulation on the selection, recognition, and awarding of outstanding and high-quality projects issued together with Decision No. 168/QĐ-KT dated April 3, 1993 of the Ministry of Water Resources (now the Ministry of Agriculture and Rural Development). All previous regulations contrary to this Regulation are abolished.
Article 3. The Heads of the Ministry's Office, the Heads of the Department of Science and Technology and Product Quality, the Head of the Department of Basic Investment Construction, the Head of the Department of Finance and Accounting, the Directors of Provincial Departments of Agriculture and Rural Development, the Directors of Project Management Boards, and the Heads of related units are responsible for implementing this Decision./.

REGULATION ON THE SELECTION, RECOGNITION, AND AWARDING OF HIGH-QUALITY CONSTRUCTION PROJECTS.
(Issued together with Decision No. 64/2002/QĐ-BNN dated July 12, 2002)
SCOPE OF APPLICATION: This Regulation governs the registration, selection, recognition, and awarding of new and improved construction projects that meet high quality standards within the agricultural and rural development sector. These projects are managed by project management boards under the Ministry and provincial departments of agriculture and rural development.

PART I
GENERAL PROVISIONS
Article 1.Projects eligible for selection will be reviewed for quality from the design phase through completion, handover, and commissioning, but primarily based on the quality of construction work.
Projects eligible for review include those investment projects (new construction, improvement, repair) listed below:
1. Water conservancy complexes.
2. Individual water conservancy works (culverts, overflow dams, raised dams, reservoir dams, pumping stations, hydropower plants, canal sections, works on canals) with an investment value of 3 billion dong or more.
Special cases: small projects in mountainous areas, projects applying advanced technology, or projects with outstanding quality and aesthetics, even if their investment value is lower than the above threshold, may also be considered, but must be approved by the Standing Board.
3. Construction, transportation, civil architectural, and industrial projects within water conservancy, agriculture, and forestry projects.
SCOPE OF APPLICATION: This Regulation applies to all projects mentioned in Article 1 constructed by domestic and foreign contractors and located within the territory of Vietnam.
Article 2.REGISTRATION OF HIGH-QUALITY PROJECTS
PART I
All contractors constructing projects have the right to register their projects for selection as high-quality projects.
Article 3.In cases where a project involves multiple contractors, one contractor designated by agreement, the largest contractor, or appointed by the Project Management Board, will be responsible for registering the project for selection.
In cases where a project consists of several independent components constructed separately by different contractors, each contractor may register their component individually.
Registration procedures:
Article 4.1. Contractors must submit a registration form to the Ministry's High-Quality Project Selection Council (headed by the Department of Science and Technology and Product Quality) before commencing construction of the project.
2. Special cases: contractors may register after starting construction, provided they have valid reasons and obtain approval from the Standing Council.

SELECTION
Article 5.Conditions for construction works to be selected as high-quality works:
1. There must be a registration form.
2. The construction work must be completed, accepted for handover and put into use, and pass a trial period as follows:
a) For flood control works (reservoirs, overflow dams, dikes, revetments...), they must pass one flood season.
b) For drainage stations and pumping stations, they must pass one flood prevention season.
c) For drought resistance works (irrigation pumping stations, irrigation culverts...), they must pass one irrigation season.
d) For other works, they must pass six months of operation.
The trial period starts from the date of acceptance for use.
Special cases: If a work has been put into actual use due to objective reasons without being officially accepted for handover, the trial period will start from the date it was actually put into use.
Other cases: The Standing Board reports to the Ministry for instructions and decisions.
Article 6.Application dossier - see Appendix 2:
The application dossier shall consist of two sets, sent to the Ministry of Agriculture and Rural Development (through the Department of Science, Technology and Product Quality).
Article 7.The Selection Committee consists of:
1. Chairperson: A leader from the Department of Science, Technology and Product Quality.
2. Members: Representatives from the following units: Investment and Construction Department, Water Management and Irrigation Works Administration, Planning and Master Planning Department, Agricultural Union, Flood and Storm Prevention and Dyke Management Administration (if the works under review are dyke-related flood and storm prevention works).
The staff member from the Department of Science, Technology and Product Quality serves as the Secretary of the Committee.
Article 8.Responsibilities of the Committee:
1. Advise the Ministry on the selection, recognition, and rewarding of high-quality works, and propose measures to promote such activities throughout the industry.
2. The Committee (or its representative) is responsible for monitoring, organizing on-site inspections, and preparing inspection reports on the quality of works, guiding, and assisting registered units during the construction process to ensure high-quality standards.
Working procedures of the Committee: As required by the tasks.
Decisions of the Committee are valid when at least two-thirds of the members agree and when selecting works, there must be a scoring sheet signed by at least two-thirds of the members sent to the Standing Board.
Article 9.Conditions for a work to be proposed for recognition as a high-quality work include:
1. Complete dossier as per Article 6.
2. The score of the work (the average score given by Committee members) must reach 80% or more of the maximum possible points. The scoring criteria for works are detailed in Appendix 3.
Article 10.The dossier submitted to the Ministry for decision on recognition and rewarding of high-quality works includes:
1. Report of the Department of Science, Technology and Product Quality.
2. Minutes of the Selection Committee meeting.
3. Proposal from the Project Owner or Project Management Board (for projects managed by the Ministry).
4. Proposal from the Contractor.
5. Proposal from the Provincial Department of Agriculture and Rural Development (for projects managed by local authorities).
Chapter IV
AWARDS
Article 11.Award titles:
Works recognized by the Ministry as high-quality works, the related units constructing the works will be rewarded by the Ministry as follows:
1. The construction contractor (B) will be awarded a Gold Medal, Certificate, and a High-Quality Work Recognition Certificate and monetary reward.
2. The consulting contractor (design), Project Management Board, and other B parties (if any) will be awarded Certificates and High-Quality Work Recognition Certificates and monetary rewards based on their level of contribution.
3. Groups and individuals will be awarded Commendation Certificates and monetary rewards.
4. Units with many high-quality works will be rewarded by the Ministry of Agriculture and Rural Development and the Agricultural Union during annual reviews.
Article 12.Reward levels:
The reward levels for groups and individuals depend on their achievements in ensuring high-quality works, as specified in Appendix 4.
In case of inflation, the above rewards will be adjusted by the Ministry.
Article 13.
1. Sources of reward funds:
a) Deducted from the benefits generated by cost savings and high quality of the works, or from other basic construction costs within the approved total budget estimate.
b) Deducted from the competition and welfare fund of groups with high-quality works.
For Project Management Boards, deductions are made from Item 4 Clause II Part II Circular No. 23/2002/TT-BTC dated March 20, 2002, of the Ministry of Finance, based on the approved project management board's cost estimates by the Ministry.
2. Procedures, formalities, responsibilities for setting up and deducting rewards:
From the outset, when preparing feasibility studies, preliminary studies, design consultants prepare budgets and total investment amounts, they should reserve a portion for "inspection and quality incentive costs." The Basic Construction Investment Department and relevant units assist the Ministry in reviewing these project budgets and submit them for approval by the Ministry. Project Management Boards will establish procedures for these costs according to the Ministry's decision and record them under the "other basic construction costs" of the project.
Other sources of reward funds are implemented according to the Ministry's decision.
Chapter V
RIGHTS AND RESPONSIBILITIES OF RELATED UNITS AND RESPONSIBILITIES OF RELATED UNITS
Article 14.Rights of contractors (design, construction) with high-quality works:
1. When bidding for similar works, each high-quality work recognized previously can be given additional bonus points in the bid scoring table.
Bonus points are only counted for works recognized as high-quality within five years from the bidding date.
2. Contractors with many high-quality works are favored when selecting bids and awarding contracts.
Article 15.Responsibilities of Contractors (design, construction):
1. Report to the Standing Board key milestones of construction, such as flow control, foundation pit acceptance, ground treatment, major and complex components for easy monitoring and inspection.
2. Organize quality inspection and management systems, train staff to ensure work quality.
3. Record quality in the construction logbook, report fully and truthfully on the situation, and facilitate the Committee's inspection visits.
Appendix 2
APPLICATION DOSSIER FOR HIGH-QUALITY CONSTRUCTION WORKS
OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT
1. Registration form.
2. Proposal from the Contractor requesting the Ministry to recognize and reward the work as a high-quality work. Minutes of meetings, scoring sheets, and proposals from the grassroots-level Committee to establish the dossier.
3. Description of the work:
Name, location.
Construction unit, construction management, design unit.
Scheme of the project, tasks, characteristics, progress schedule.
Construction process, innovative improvements, changes during construction. Quantity, cost. Copy of the decision approving the technical design.
Summary of quality management work, general evaluation and contractor's recommendations.
4. Records of acceptance for major stages and final acceptance for use by the facility and its superiors (of the province, Ministry, or State if applicable).
5. Quality confirmation document, effectiveness of the project, recommendation for commendation from Board A for the three participating units (A, B, design). Clearly state the source of potential rewards (if decided by the Ministry). .
6. Quality confirmation document, effectiveness, recommendation from the unit managing the operation and use of the project or the Department of Agriculture and Rural Development.
7. Copies of material testing results (sand, gravel, cement, iron, steel), concrete testing, embankment soil testing (including ultrasonic inspection, shot firing, drilling inspection, etc., if applicable).
8. Some characteristic drawings: front view, side view, cross-sections of main structures.
9. Three to four photos of size 20 x 24, panoramic views from upstream and downstream.
The dossier submitted to the Ministry includes:
For projects under selection: two sets.
Selection review fee for each project is 300,000 VND paid in one installment.

INDIVIDUALS WHO CONTRIBUTED TO THE HIGH QUALITY OF THE PROJECT REWARD LEVELS FOR GROUPS THAT CONTRIBUTED TO THE HIGH QUALITY OF THE PROJECT: a) Construction contractors:
1. Receive a reward of 3 to 15 million VND per high-quality project.
b) Design consultants, Project Management Board:
Receive a reward of 1 to 5 million VND per high-quality project.
2.Reward levels for groups that contributed to the high quality of the project:
From 1 to 3 million VND.
3.Reward levels for individuals who contributed to the high quality of the project:
From 500,000 VND to 2 million VND.
In case of price fluctuations, the above rewards will be determined by the Ministry appropriately./.
