DECISION OF THE PRIME MINISTER

On the List of State Secrets of Top Secret and High Secret Levels in the Field of Science and Technology

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000;

Pursuant to the Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protection of State Secrets;

Considering the proposal of the Minister of Science and Technology and the Minister of Public Security,

DECISION:

Article 1. The List of State Secrets of Top Secret Level in the Field of Science and Technology includes information within the following scope:

Special important policies of the Party and the State on the field of science and technology related to national security strategy and national defense strategy that have not been announced.

Article 2. The List of State Secrets of High Secret Level in the Field of Science and Technology includes information within the following scope:

1. Strategies, planning, plans for the development of science and technology serving national security, defense, and homeland defense.

2. Documents and directives of Party and State leaders on the field of science and technology that have not been announced.

3. Inventions, useful solutions, technical secrets, new technologies with special importance to the cause of developing science and technology and the economy-society that have not been announced.

4. Materials and data results of scientific and technological research programs and topics related to national security and defense that have not been announced.

Article 3. This Decision shall take effect fifteen days from the date of publication in the Official Gazette and replaces Decision No. 85/TTg dated February 5, 1996 of the Government Chairman on the list of state secrets in the fields of Science, Technology, and Environment.

Article 4. The Minister of Science and Technology and the Minister of Public Security are responsible for supervising the implementation of this Decision.

Article 5. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of provincial People's Committees under the central government are responsible for implementing this Decision.
