DECISION OF THE MINISTER OF TRANSPORT
On Compulsory Pilotage Zones for Maritime Navigation in Vietnam
THE MINISTER OF TRANSPORTATION
Pursuant to the Maritime Code of Vietnam dated June 14, 2005;
Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
At the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration,
DECISION:
Article 1. Scope of Regulation
This Decision regulates the compulsory pilotage zones for maritime navigation in Vietnam.
Article 2. Applicability
This Decision applies to:
1. The shipmaster or the person operating the vessel and the captain of the following types of vessels: Vietnamese seagoing vessels, foreign seagoing vessels, public service vessels, fishing vessels, inland waterway vessels, hydrofoils, and foreign military vessels arriving in Vietnam; when operating within the compulsory pilotage zones for maritime navigation in Vietnam;
2. Maritime pilot organizations and Vietnamese maritime pilots;
3. Agencies, organizations, and individuals related to the compulsory pilotage zones for maritime navigation in Vietnam.
Article 3. Explanation of Terms
1. The compulsory pilotage zone (referred to as the compulsory pilotage zone) is a defined area of water from the pilot boarding and disembarking areas at ports, wharves, anchorages, transshipment areas, storm shelters, shipbuilding and repair yards, and offshore crude oil terminals where seagoing vessels must use a pilot when entering or leaving the area, as announced by the Minister of Transport.
2. The non-compulsory pilotage zone (referred to as the non-compulsory pilotage zone) is an area of water within Vietnam's territorial sea where seagoing vessels are not required to use a Vietnamese maritime pilot when navigating.
3. The pilot boarding and disembarking area is a defined area of water where vessels can anchor to board or disembark pilots.
Article 4. Compulsory Pilotage Zones
1. The compulsory pilotage zone in Quảng Ninh:
From the pilot boarding and disembarking areas at ports, wharves, anchorages, transshipment areas, storm shelters, and shipbuilding and repair yards located within the administrative boundaries of Quảng Ninh Province.
2. The compulsory pilotage zone in Hải Phòng - Thái Bình - Nam Định:
From the pilot boarding and disembarking areas at ports, wharves, anchorages, transshipment areas, storm shelters, and shipbuilding and repair yards located within the administrative boundaries of Hải Phòng City (including the transshipment area of Hải Phòng Port in Quảng Ninh Province), Thái Bình Province, and Nam Định Province.
3. The compulsory pilotage zone from Thanh Hóa to Quảng Trị:
From the pilot boarding and disembarking areas at ports, wharves, anchorages, transshipment areas, storm shelters, and shipbuilding and repair yards located within the administrative boundaries of Thanh Hóa, Nghệ An, Hà Tĩnh, Quảng Bình, and Quảng Trị Provinces.
4. The compulsory pilotage zone from Thừa Thiên Huế to Quảng Nam:
From the pilot boarding and disembarking areas at ports, wharves, anchorages, transshipment areas, storm shelters, and shipbuilding and repair yards located within the administrative boundaries of Đà Nẵng City, Thừa Thiên - Huế Province, Quảng Nam Province, and Quảng Ngãi Province.
5. The compulsory pilotage zone in Bình Định - Phú Yên:
From the pilot boarding and disembarking areas at ports, wharves, anchorages, transshipment areas, storm shelters, and shipbuilding and repair yards located within the administrative boundaries of Bình Định and Phú Yên Provinces.
6. The compulsory pilotage zone in Khánh Hòa:
From the pilot boarding and disembarking areas at ports, wharves, anchorages, transshipment areas, storm shelters, and shipbuilding and repair yards located within the administrative boundaries of Khánh Hòa and Ninh Thuận Provinces.
7. The compulsory pilotage zone in Hồ Chí Minh City - Đồng Nai - Bình Dương - Long An:
From the pilot boarding and disembarking areas at ports, wharves, anchorages, transshipment areas, storm shelters, and shipbuilding and repair yards located within the administrative boundaries of Hồ Chí Minh City, Đồng Nai, Bình Dương, and Long An Provinces.
8. The compulsory pilotage zone in Bà Rịa - Vũng Tàu and along the Tiền River:
From the pilot boarding and disembarking areas at ports, wharves, anchorages, transshipment areas, storm shelters, and shipbuilding and repair yards located within the administrative boundaries of Bà Rịa - Vũng Tàu Province, Mỹ Tho City, Vĩnh Long Province, and Đồng Tháp Province.
9. The compulsory pilotage zone along the Hậu River, Kiên Giang Province, and Cà Mau Province:
From the pilot boarding and disembarking areas at ports, wharves, anchorages, transshipment areas, storm shelters, and shipbuilding and repair yards located within the administrative boundaries of Cần Thơ City, Hậu Giang Province, An Giang Province, Đồng Tháp Province, Vĩnh Long Province, Sóc Trăng Province, Trà Vinh Province, Kiên Giang Province, and Cà Mau Province.
10. The compulsory pilotage zone in the offshore oil and gas fields in the southern part of Vietnam:
From the pilot boarding and disembarking areas to the crude oil storage facilities at offshore oil terminals and oil and gas facilities in the offshore oil and gas fields in the southern part of Vietnam.
Article 5. Effective Date
This Decision takes effect from January 1, 2006, and replaces Decision No. 2917/QĐ-VT dated December 25, 1992 of the Minister of Transport on pilotage zones for maritime navigation in Vietnam.
Article 6. Implementation Organization
The Director of the Office of the Ministry, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Maritime Administration, Directors of the Vietnam Inland Waterways Administration, Directors of Provincial Departments of Transport (Provincial Departments of Transport and Public Works), Directors of Marine Port Authorities, Directors of Pilotage Companies, and relevant agencies, organizations, and individuals are responsible for implementing this Decision.
