Pursuant to Decree No. 57/2002/ND-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;
Pursuant to Decree No. 24/2006/ND-CP dated March 6, 2006 of the Government amending and supplementing certain articles of Decree No. 57/2002/ND-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;
Pursuant to Decree No. 47/CP dated August 12, 1996 of the Government on the management of weapons, explosives, and auxiliary equipment;
Pursuant to Decree No. 59/2006/NĐ-CP dated June 12, 2006 of the Government detailing the Law on Trade regarding goods and services prohibited from trade, restricted trade, and conditional trade;
After receiving the opinion of the Ministry of Industry and upon the proposal of the Director of the Tax Policy Department,
DECISION:
Article 1.
Organizations and enterprises of Vietnam and foreign countries when registering for permits to use industrial explosives at central authorities with competent authority according to the law must pay the fee for reviewing the permit to use industrial explosives as stipulated in this Decision.
Article 2.
The level of collection of fees for reviewing the issuance of permits to use industrial explosives is specified as follows:

Article 3.
In cases where the permit is reissued or replaced but there is no change in location or conditions for using industrial explosives, the collection rate shall be fifty percent (50%) of the corresponding collection rate as prescribed in Article 2 of this Decision.
Article 4.
The fee for reviewing the issuance of permits to use industrial explosives is a revenue item belonging to the state budget, which is managed and used as follows:
1. The agency collecting the fee for reviewing the issuance of permits to use industrial explosives is entitled to retain ninety percent (90%) of the total amount of fees collected before depositing it into the state budget to cover costs for review work and fee collection, as detailed below:
a) Expenses directly serving the review and fee collection such as office supplies, office materials, telephone, electricity, water, travel expenses according to current standards and norms;
b) Depreciation and regular maintenance, major repairs of assets and machinery/equipment directly serving the review and fee collection work;
c) Costs for materials, raw materials, and other expenses directly related to fee collection;
d) Expenses for hiring translation and specialized calculation services to serve the review work;
đ) Payment of remuneration to civil servants and employees who undertake additional fee collection tasks outside their assigned functions and duties;
e) Rewards and welfare for staff directly involved in the review and fee collection work. The average annual maximum amount for setting up the reward fund and welfare fund per person shall not exceed three (3) months' salary if the revenue exceeds that of the previous year, and two (2) months' salary if the revenue is lower than or equal to that of the previous year.
2. The agency collecting the fee for reviewing the issuance of permits to use industrial explosives is responsible for depositing ten percent (10%) of the collected fees into the state budget according to the relevant chapters, types, sections, items, and sub-items of the current state budget classification.
Article 5.
Other contents related to the collection, payment, management, use, receipt vouchers, and publicizing the fee collection system not mentioned in this Decision shall be implemented in accordance with Circular No.
63/2002/TT-BTC dated July 24, 2002 guiding the implementation of legal provisions on fees and charges, and Circular No. 45/2006/TT-BTC dated May 25, 2006 amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002 guiding the implementation of legal provisions on fees and charges.Article 6.
This Decision takes effect fifteen days from the date of publication in the Official Gazette.
Article 7.
During the implementation process, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance.
