Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Article 38 and Article 40 of the Law on Prevention and Control of Infectious Diseases dated November 21, 2007;

Considering the proposal of the Minister of Health,

DECISION:

Clause 4 of Article 6Scope of application

This Decision stipulates the conditions for declaring an epidemic and declaring the end of an infectious disease outbreak.

Article 2. Conditions for declaring an infectious disease outbreak

The declaration of an infectious disease outbreak shall only be carried out when the following two conditions are met:

1. The number of people infected with the infectious disease exceeds the normally expected number of cases as forecasted by the provincial or centrally-administered municipal health authorities.

2. At least one of the following risk factors exists:

a) The scale and nature of the disease outbreak exceed the control capacity of the provincial or centrally-administered municipal health authorities;

b) The disease outbreak has been identified by the Minister of Health as having a mutated causative agent, posing a higher mortality risk, and lacking effective containment measures;

c) The disease outbreak has a high mortality rate but the causative agent remains unknown and there are no effective containment measures;

d) The disease outbreak occurs during natural disasters or catastrophes.

Article 3.Conditions for declaring the end of an infectious disease outbreak

1. The declaration of the end of an infectious disease outbreak shall only be made when all conditions specified in Clause 1 of Article 40 of the Law on Prevention and Control of Infectious Diseases are met. The period without new cases must equal the incubation period of the infectious disease. The Minister of Health shall specify the incubation period for each infectious disease.

2. In cases where the World Health Organization issues new recommendations regarding conditions for declaring the end of an infectious disease outbreak that differ from those specified in Clause 1 of this Article, additional conditions based on these new recommendations shall be implemented according to regulations set forth by the Minister of Health.

Article 4.Responsibilities for declaring an epidemic and declaring the end of an infectious disease outbreak

The person(s) authorized under Clause 2 of Article 38 and Clause 2 of Article 40 of the Law on Prevention and Control of Infectious Diseases shall be responsible for declaring an epidemic after confirming that the conditions for declaring an epidemic as specified in Article 2 of this Decision have been met, and for declaring the end of an infectious disease outbreak after confirming that the conditions for declaring the end of an infectious disease outbreak as specified in Article 3 of this Decision have been met.

Article 5. Effective Date

This Decision takes effect from December 15, 2010.

Article 6.Implementation responsibility

The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
