Regulations on Measures for Energy Efficiency and Conservation in Transport Activities

  On the basis of the Law on Energy Efficiency and Conservation dated June 28, 2010;

  On the basis of Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

  On the basis of Decree No. 21/2011/NĐ-CP dated March 29, 2011 of the Government detailing and providing implementation measures for the Law on Energy Efficiency and Conservation;

  The Minister of Transport hereby promulgates regulations on measures for energy efficiency and conservation in transport activities as follows:

Article 1. Scope of Regulation

This Circular stipulates measures for energy efficiency and conservation in transport activities.

Article 2. Applicability

This Circular applies to organizations and individuals related to traffic planning work; investment and construction activities of transport works; production, assembly, importation of transport vehicles for circulation; transport operations.

Article 3. Measures for Energy Efficiency and Conservation in Traffic Planning, Construction, and Renovation of Transport Works

1. Planning Work

Organizations and individuals when developing strategies and plans for the development of transport must include energy efficiency and conservation as a criterion for selecting options; prioritize the development of public transport, large-capacity transport means with high energy efficiency (railways, inland waterways, other transport means); pay attention to the interconnectivity of transport modes to save fuel.

2. Investment in Construction and Renovation of Transport Works

a) Encourage organizations and individuals participating in designing and preparing investment projects for the development of transport systems to choose routes with shorter distances, utilizing current flows, minimizing slopes; select energy-saving technologies and construction solutions; optimize the supply of raw materials and materials to reduce transportation volumes, enhance energy efficiency, and minimize environmental pollution;

b) The construction units are responsible for applying energy-saving measures as stipulated in the approved project; using machinery and equipment reasonably; establishing and implementing fuel consumption standards, machine hour rates, maintenance quotas to improve the fuel efficiency of machinery and equipment;

c) Units receiving handover and operating transport works are responsible for performing maintenance work according to regulations, maintaining the technical condition of the works to reduce fuel consumption during transport operations.

Article 4. Measures for Energy Efficiency and Conservation in Transport Operations

1. Transport Organizations

a) Organizations and individuals engaged in transport business when formulating transport organization plans must include energy efficiency and conservation as a criterion for selecting options. Prioritize options that shorten transport distances, increase payload utilization factors, and distance utilization factors;

b) Encourage organizations and individuals engaged in transport business to apply technology in management and operation of transport; combine transport modes to enhance energy efficiency in transport operations at their units.

2. Investment and Management of Transport Vehicles

a) Establish and implement fuel consumption standards within enterprises; annually update and perfect these standards to promote energy efficiency and conservation in accordance with the law;

b) Establish maintenance quotas and strictly adhere to regular maintenance schedules for transport vehicles and equipment during operation to maintain their technical condition and enhance energy efficiency;

c) Adhere to the service life of transport vehicles and develop plans to phase out vehicles that do not meet the minimum energy efficiency standards as currently prescribed.

3. Promote the Application of New Technologies and Renewable Energy in Transport

Organizations and individuals both inside and outside the industry may combine resources as currently prescribed to organize research and application of new technologies, use of new and renewable energy to enhance energy efficiency in transport operations.

Article 5. Management of fuel consumption standards for transport vehicles to manage energy use efficiently and effectively.

1. Transport vehicles produced, assembled, or imported for circulation must comply with national technical regulations on fuel consumption standards issued by competent authorities.

2. Organizations and individuals engaged in transportation business must include fuel consumption standards for 1,000 units of transport products (T.Km; Hk.Km) in their vehicle operation economic and technical indicators system; implement management and technical measures to reduce this standard within their own units.

Article 6. Reporting and statistical systems for energy use.

1. Transportation enterprises falling under key energy-consuming entities as defined in Point a Clause 1 Article 6 of Decree No. 21/2011/NĐ-CP shall be responsible for arranging energy managers to develop annual and five-year energy use plans and report annually on energy use status according to the guidance of the Ministry of Industry and Trade.

1. Department of Environment.

a) Urging, supervising, and summarizing the implementation of laws on efficient and economical energy use in transportation activities, annually reporting to the Ministry's leadership on the results of implementation;

b) Advising and proposing funding sources to implement research and application projects on science and technology, new energy applications to enhance energy efficiency in transportation activities according to current regulations.

2. Department of Transport. Advising and proposing incentive mechanisms and policies to promote public transportation development; measures to regulate transportation demand between different modes of transport; limiting vehicles with low capacity and high fuel consumption; promoting the development of transportation methods that use energy efficiently and economically.

3. Vietnam Vehicle Inspection Agency.

a) Building and submitting to the Ministry of Transport for issuance of national technical regulations on fuel consumption standards for certain types of transport vehicles suitable for each period as stipulated in Point a Clause 4 Article 33 of Decree No. 21/2011/NĐ-CP of the Government;

b) Organizing testing, certification of fuel consumption levels according to national technical regulations for types of transport vehicles produced, assembled, and imported;

c) Conducting safety and environmental inspections; checking compliance with vehicle usage age limits set by competent state authorities.

4. Vietnam Highway Administration, Vietnam Civil Aviation Authority, Vietnam Maritime Administration, Vietnam Railway Administration, Vietnam Inland Waterway Administration:

a) Implementing measures to use energy efficiently and economically in organizing and managing transportation systems according to their respective levels;

b) Organizing supervision and inspection of the implementation of regulations on efficient and economical energy use by units under their management; annually reporting to the Ministry of Transport on the results of implementation.

5. Departments of Transport.

a) Organizing traffic guidance and diversion to minimize congestion and reduce transport distances; developing and enhancing the efficiency of public transport routes; promoting non-motorized transport (pedestrian streets; bicycle lanes...) based on local conditions;

b) Implementing measures to use energy efficiently and economically in organizing and managing transportation systems and managing transport vehicles according to their respective levels; reporting to the Ministry of Transport on the results of implementing state management regulations on efficient and economical energy use in transportation activities at the local level.

Article 8. Effective Date

1. This Circular takes effect 45 days from the date of signature.

2. The Director of the Ministry's Office, the Director of the Ministry's Inspectorate, Heads of Departments, Directors of the Vietnam Highway Administration, Directors of various Bureaus, Directors of Departments of Transport of provinces and centrally-administered cities, Heads of relevant agencies, organizations, and individuals are responsible for enforcing this Circular./.
