Pursuant to the Ordinance on Fees and Charges;

BASED ON THE GOVERNMENT DECREE NO. 77/2003/NĐ-CP OF JULY 1, 2003, PROVIDING THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF FINANCE;

BASED ON THE GOVERNMENT DECREE NO. 71/2006/NĐ-CP OF JULY 25, 2006, ON PORT MANAGEMENT AND NAVIGATION CHANNELS;

BASED ON THE OPINION OF THE MINISTRY OF TRANSPORTATION AT LETTER NO. 6388/BGTVT-VT OF OCTOBER 18, 2006;

At the proposal of the Director of the Enterprise Financial Department.

Article 1. ENTERPRISES THAT HAVE NAVIGATION CHANNELS THEY HAVE INVESTED IN AND OPERATE MAY CHARGE NAVIGATION SECURITY FEES FROM VESSELS ENTERING AND LEAVING THEIR NAVIGATION CHANNELS AT THE LEVELS SET BY THE STATE AND MAY AUTHORIZE MARITIME PORT SERVICES TO COLLECT THESE FEES ON BEHALF OF THE ENTERPRISES.

Article 2. ENTERPRISES THAT HAVE NAVIGATION CHANNELS THEY HAVE INVESTED IN AND OPERATE ARE RESPONSIBLE FOR WITHDRAWING 30% OF THE ANNUAL TOTAL OF NAVIGATION SECURITY FEES COLLECTED FROM THEIR NAVIGATION CHANNELS TO CONTRIBUTE TO NATIONAL MARITIME SAFETY EFFORTS.

Article 3. BASED ON THE NUMBER OF LICENSED VESSELS ENTERING AND LEAVING THE NAVIGATION CHANNELS, THE MARITIME PORT SERVICES SHALL NOTIFY THE AMOUNT TO BE WITHDRAWN FROM EACH CHANNEL, INFORM THE ENTERPRISES MANAGING THE NAVIGATION CHANNELS, AND BE RESPONSIBLE FOR COLLECTING THE AMOUNT TO TRANSFER IT TO THE COMPANIES ASSURING MARITIME SAFETY AS PROVIDED BY CURRENT REGULATIONS.

Article 4. THIS DECISION SHALL TAKE EFFECT FROM JANUARY 1, 2007. ORGANIZATIONS AND INDIVIDUALS SUBJECT TO THE PAYMENT OF NAVIGATION FEES AND CHARGES; GOVERNMENT AGENCIES, ORGANIZATIONS COLLECTING NAVIGATION FEES AND CHARGES, AND RELATED UNITS SHALL BE RESPONSIBLE FOR IMPLEMENTING THIS DECISION./.
