Decree No. 65/2009/ND-CP amends and supplements certain provisions of Decree No. 123/2003/ND-CP dated October 22, 2003 on material standards for logistics support for active-duty military personnel.

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Military Service dated December 30, 1981, amended and supplemented in 1990, 1994, and 2005;

Pursuant to the Law on Officers of the Vietnam People's Army dated December 21, 1999, amended and supplemented in 2008;

Upon the proposal of the Minister of National Defense,

DECREE:

Article 1. Amending and supplementing certain articles of Decree No. 123/2003/NĐ-CP dated October 22, 2003 on material standards for logistics support for active-duty military personnel, with the following contents:

Organizations and individuals involved in handling accidents in port waters and shipping channels shall follow Circular No. 27/2012/TT-BGTVT dated July 20, 2012 issued by the Minister of Transport on reporting and investigating maritime accidents. In cases where a vessel encounters an incident or accident that cannot be resolved within 30 minutes, it must immediately report to the Maritime Search and Rescue Coordination Center for rescue operations or assistance."

Article 9. Standards for equipping medical supplies

1. The standards for initial medical equipment and devices and annual replacement equipment.

Clause 2. Standards for equipping medical supplies shall be provided according to each type of healthcare facility in the military.

Point a. For special-class military hospitals, they shall be equipped at the equivalent level of special-class hospitals under the Ministry of Health.

Point b. For Class 1 military hospitals, they shall be equipped at the equivalent level of Class 1 hospitals under the Ministry of Health.

Point c. For Class 2 military hospitals, they shall be equipped at the equivalent level of Class 2 hospitals under the Ministry of Health.

Point d. For specialized military hospitals, they shall be equipped according to planning and specific mission requirements.

Subpoint đ. Specialized military hospitals shall annually receive a budget equivalent to the drug, bandage, and chemical budget for the same year plan (in addition to the new equipment budget).

2. Article 11 shall be amended and supplemented as follows:

Article 11. Water consumption standard for daily living

The water consumption standard for daily living must ensure a minimum of 130 to 150 liters of clean water per person per day, applicable to areas with clean water sources.

Units stationed in areas without shared clean water sources may, depending on actual conditions, be equipped with machinery to extract clean water or invest in construction projects to provide clean water for daily living, ensuring a minimum of 130 to 150 liters per person per day.

The water consumption standard for military hospitals must ensure a minimum of 250 liters per hospital bed per day and night.

3. Article 14 shall be amended and supplemented as follows:

Article 14. Electricity consumption standard

The electricity consumption standard in the military includes standards for residential and working electricity consumption; command readiness combat electricity consumption; technical assurance electricity consumption; logistics assurance electricity consumption; training electricity consumption; disease prevention and treatment electricity consumption.

Units located in coastal islands, border guard posts, highlands, remote areas, and units stationed in areas without national grid power supply shall be equipped with generator systems with capacity sufficient to meet lighting requirements and appropriate to the number of personnel assigned to each unit. Minimum operating hours of generators are six hours per day.

Article 15. List

1. Attached to this Decree are detailed lists regarding certain basic material standards for logistics support for active-duty military personnel:

Point a. List No. 01: Uniform standards for non-commissioned officers and soldiers.

Point b. List No. 02: Uniform standards for officers and professional military personnel.

Point c. List No. 03: Essential food item standards.

Point d. List No. 04: Drug, bandage, and chemical standards.

Subpoint đ. List No. 05: Medical equipment and professional uniform standards.

Point e. List No. 06: Equipment for group 1 means and protection against chemical, biological, and nuclear weapons (NBC).

Point g. List No. 07: Sanitation miscellaneous expense standards.

Point h. List No. 08: Living, working, public activity area, and other auxiliary construction standards within military camps.

Point i. List No. 09: Equipment standard quotas.

Point k. List No. 10: Electricity consumption standard quotas.

2. In addition to the material standards listed in this Decree, some other material standards not expressed through lists include:

Point a. Rations for military branches, service corps, pathological supplementary meals, supplementary meals during training and combat, readiness combat duty, exercises, disaster prevention, and other tasks.

Point b. Professional uniforms, additional uniforms.

Point c. Kitchen and kitchen equipment.

Point d. Combat and field training equipment.

The Minister of National Defense shall specify the details of the standards stipulated in Clause 2 of this Article.

3. Material standards for logistics support for active-duty military personnel shall be guaranteed based on the principle of using quantitative standards as the main basis; in terms of value, according to technical standards of each type of material and prices at each time point (average annual price) to calculate the budget guarantee; equipment that must be purchased in foreign currency shall be calculated based on the exchange rate for converting foreign currency at each time point; types that cannot be measured by quantity standards shall be adjusted according to the annual inflation index announced by the State from the time this Decree is issued. For the quota standards of military medical materials for active-duty military personnel, they shall be calculated equivalently to the health insurance payment level at the same time plus a factor specific to military activities. The Minister of National Defense shall decide on adjusting the "inflation index" for subordinate agencies and units under the Ministry of National Defense.

4. In case of necessity, the Minister of National Defense shall submit to the Prime Minister for amending and supplementing the detailed lists stipulated in Clause 1 of this Article.

Article 2. Effectiveness

This Decree takes effect from September 15, 2009.

The material standards for logistics support for active-duty military personnel stipulated in this Decree shall be implemented from September 1, 2009.

Article 3. Responsibility for guidance

The Ministry of National Defense shall take the lead and coordinate with the Ministry of Finance, the Ministry of Planning and Investment, and other relevant ministries and sectors to guide the application of material standards for logistics support at different levels and for different categories of active-duty military personnel, suitable to the characteristics of the military in different regions.

Article 4. Responsibility for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of government-attached agencies, Chairpersons of provincial People's Committees under the central city shall be responsible for implementing this Decree./.
