Decree No. 65/2016/NĐ-CP on conditions for operating automobile driving training services and driving license examination services.

DECREE

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Investment Law dated November 26, 2014;

Pursuant to the Road Traffic Law 2008 dated November 13, 2008;

Based on the Law on Standards and Technical Regulations dated June 29, 2006;

Based on Decree No. 15/2019/NĐ-CP dated February 1, 2019 of the Government detailing certain provisions and implementation measures of the Vocational Education Law;

At the proposal of the Minister of Transport;

The Government issues this Decree to stipulate the conditions for operating automobile driving training services and driving examination services.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates the conditions for operating automobile driving training services and driving examination services.

Article 2. Applicability

This Decree applies to driving training establishments, driving examination centers, organizations, and individuals engaged in activities related to operating automobile driving training services and driving examination services in Vietnam.

Article 3. Explanation of Terms

1. An automobile driving training base is a vocational education institution that performs the function of training driving skills for automobiles.

2. Training capacity is the maximum number of trainees that an establishment is permitted to train at one time, determined by the total number of trainees training for various categories of driver's licenses, including both theoretical and practical trainees at the time of determining the training capacity.

3. Driving examination center is a facility constructed in accordance with national technical standards, providing driving examination services and classified as follows:

a) Type 1 driving examination center: Conducts examinations to issue driver’s licenses for categories A1, A2, A3, A4, B1, B2, C, D, E, and categories F (FB2, FC, FD, FE).

b) Type 2 driving examination center: Conducts examinations to issue driver’s licenses for categories A1, A2, A3, A4, B1, B2, and category C.

c) Type 3 driving examination center: Conducts examinations to issue driver's licenses for categories A1, A2, A3, and A4.

Article 4. Planning for the development of establishments operating automobile driving training services and driving examination services

1. The Ministry of Transport shall take the lead and coordinate with provincial People's Committees to develop and approve a network planning for driving training establishments and driving examination centers in line with the country's economic and social development strategies and human resource development plans; responsible for announcing, inspecting, and supervising the implementation of the approved planning.

2. Establishments operating automobile driving training services and driving examination services as stipulated in this Decree must be developed according to the planning and constructed in accordance with prescribed technical standards.

3. Competent authorities, during the process of issuing permits for investment and business operations in automobile driving training services and driving examination services, must seek opinions from the competent authorities issuing driving training licenses and certificates confirming the eligibility to operate driving examination centers regarding the suitability of the network planning for driving training establishments and driving examination centers.

Chapter II

CONDITIONS FOR OPERATING, ISSUING AND REVOKING DRIVING TRAINING LICENSES

Article 5. General Conditions for Driving Training Establishments

1. It must be a vocational education institution established in accordance with the provisions of the law.

2. It must comply with the network planning for driving training establishments.

Article 6. Conditions concerning technical infrastructure

1. System of specialized classrooms

a) Includes theory classrooms and practice classrooms, ensuring the quantity, technical standards, and professional expertise appropriate to the scale of training as prescribed by the Ministry of Transport;

b) Driving training establishments with a training capacity of 500 trainees or more must have at least two traffic law classrooms and two driving technique classrooms; with a training capacity of 1,000 trainees or more, they must have at least three traffic law classrooms and three driving technique classrooms;

c) Traffic law classroom: Equipped with audio-visual devices (screens, projectors), road sign charts, and road scene models;

d) Classroom for Vehicle Construction and Routine Maintenance: Equipped with engine cutaway models, power transmission system models; electrical system model; diagrams or drawings illustrating the structure and operation principles of engines, power transmission systems, suspension systems, braking systems, steering systems;

đ) Driving Technique Classroom: Equipped with audio-visual aids for teaching (audio tapes, projection lamps...); has diagrams or drawings illustrating basic driving maneuvers (adjusting the driver's seat, driving posture, position of holding the steering wheel...); has automobiles equipped for cold and hot gear shifting practice (which can be arranged in separate locations);

e) Transportation Operations Classroom: Equipped with boards and charts for teaching specialized transportation operations such as cargo and passenger transport; has drawings of cargo marking symbols;

g) Practical Maintenance and Repair Classroom: Equipped with ventilation and lighting systems, meeting safety and hygiene requirements; floor without cracks or slipperiness; equipped with specialized tools for maintenance and repair; has operational engine assemblies, power transmission systems, steering systems, electrical systems; has disassembly tables, boards, and chairs for teaching and practical work;

h) Teaching Management Room: Has a training program schedule, academic year progress chart, desks, and necessary equipment for training managers;

2. Practice Vehicles

a) Must have sufficient practice vehicles corresponding to the training capacity recorded in the driving training license;

b) Must be owned by the driving training establishment. Can use leased vehicles for a term of one year or longer, not exceeding 50% of the number of owned vehicles of the same category of the driving training establishment for practice vehicles of categories B1, B2, C, D, E; practice vehicles of category FC can use leased vehicles with terms and quantities suitable for training needs. For vehicles of categories B1 and B2 with automatic transmissions, leased vehicles may be used;

c) Driving training establishments with driving examination services can use examination vehicles for teaching driving for up to 50% of the time used for examination purposes;

d) Trucks used for teaching driving of categories B1 and B2 must have a load capacity of 1,000 kg or more, not exceeding 30% of the total number of practice vehicles of the same category of the driving training establishment;

đ) Must have a valid certificate of technical inspection and environmental protection for motor vehicles;

e) Must have an auxiliary brake system located on the instructor's seat, securely and conveniently structured, safe, and effective during use;

g) The vehicle body must have a roof to protect from rain and sun, and a secure seat for the learner;

h) Both sides of the doors or both sides of the vehicle body must display the name of the driving training establishment, the direct management agency, and the contact phone number as specified in Appendix I attached to this Decree;

i) Motor vehicles must have two "DRIVING PRACTICE" signs as specified in Appendix II attached to this Decree;

k) Must be issued a practice vehicle permit by the competent authority when meeting the conditions stipulated in points b, d, đ, e, g, h, and i of this clause.

3. Driving Practice Grounds

a) Belongs to the training facility's right of use; if renting a driving practice field, it must have a contract with a term of five years or more and must be within the same network of motor vehicle driving training facilities planning;

b) Motor vehicle driving training facilities with a training volume of 1,000 trainees or more must have at least two driving practice fields as prescribed;

c) The motor vehicle driving practice field must have a complete system of traffic signs and signals, sufficient scenarios for each lesson according to the training program content; the size of the driving practice areas must comply with the national technical standards for motor vehicle driving examination centers corresponding to each vehicle category;

d) The surface of the field must have sufficient elevation and drainage systems to ensure that it does not flood; the surfaces of lanes and driving practice areas must be paved with asphalt or cement concrete, and must have sufficient road markings; the driving practice exercises must be bordered;

đ) Must have waiting rooms and seats for trainees to practice;

e) Minimum area of the driving practice field: Category B1 and B2 is 8,000 m²;²; Categories B1, B2, and C is 10,000 m²;²; Categories B1, B2, C, D, E, and F is 14,000 m²;².

4. Must have programs, textbooks, and lesson plans as prescribed.

Article 7. Conditions for driving instructors

1. General conditions

a) Must have a teaching staff meeting the criteria for primary level teachers as stipulated in Clause 4, Article 53 of the Vocational Education Law;

b) Must meet the pedagogical standards as prescribed;

c) The number of full-time instructors must ensure fifty percent of the total number of instructors of the training facility.

2. Conditions for theoretical instructors

a) Must hold a diploma from a secondary vocational school or higher in one of the following majors: law, automotive technology, automotive engineering technology, automobile assembly, or other majors with thirty percent or more of specialized automotive training content;

b) Must have at least Level A computer proficiency;

c) Instructors teaching the Driving Technique subject must hold a driver's license corresponding to the category of vehicle being trained or higher.

3. Conditions for practical instructors

a) Must hold a diploma from a secondary vocational school or higher or have a vocational skill certificate to teach primary level;

b) Instructors teaching motor vehicle driving must hold a driver's license corresponding to or higher than the category of vehicle being trained, but not lower than Category B2;

c) Instructors teaching Categories B1 and B2 must hold a driver's license valid for three years or more from the date of issuance; instructors teaching Categories C, D, E, and F must hold a driver's license valid for five years or more from the date of issuance;

d) Must have undergone training on practical driving instruction skills according to the program issued by the competent authority and obtained a certificate of practical driving instructor.

Article 8. Certificate of Practical Driving Instructor and Authority to Issue the Certificate of Practical Driving Instructor

1. The Certificate of Practical Driving Instructor is issued by the competent authority according to the model prescribed in Appendix III attached to this Decree; it may be reissued in case of loss, damage, or changes related to the content of the Certificate of Practical Driving Instructor.

2. Authority to issue the Certificate of Practical Driving Instructor

a) The Vietnam Road Administration issues the Certificate of Practical Driving Instructor for instructors belonging to training facilities under central agencies assigned by the Ministry of Transport;

b) Provincial Departments of Transport issue the Certificate of Practical Driving Instructor for instructors belonging to training facilities managed by local authorities.

Article 9. Procedures for Issuing Certificates for Driving School Instructors

1. The dossier shall include:

a) A request form in accordance with the model prescribed in Appendix IV attached to this Decree;

b) A diploma from a college level or higher or a vocational skill certificate for teaching basic level (a copy accompanied by the original for verification or a certified copy);

c) A valid driver's license (a copy accompanied by the original for verification or a certified copy);

d) A teaching profession certificate (a copy accompanied by the original for verification or a certified copy);

đ) A health certificate issued by a competent medical facility in accordance with regulations;

e) One color photograph measuring 3 cm x 4 cm on a blue background, in identification card format, taken within six months;

2. Procedures for Implementation

a) An individual or training institution shall prepare one set of dossier and submit it directly or via postal service to the authority responsible for issuing certificates for driving school instructors as stipulated in Clause 2, Article 8 of this Decree;

b) The Department of Transport or Vietnam Highway Corporation shall receive individual dossiers or lists of dossiers prepared by training institutions according to the model prescribed in Appendix V attached to this Decree, and organize inspections and evaluations. In cases where individuals do not meet the requirements, the Department of Transport or Vietnam Highway Corporation must respond in writing and specify the reasons;

c) Within no more than three working days from the date of passing the inspection, the Department of Transport or Vietnam Highway Corporation shall issue a certificate for driving school instructors and record it in the tracking book according to the model prescribed in Appendix VI attached to this Decree. In cases where individuals do not pass, the Department of Transport or Vietnam Highway Corporation must notify in writing;

Article 10. Procedures for Reissuing Certificates for Driving School Instructors

1. The dossier shall include the components specified in points a, c, đ, and e of Clause 1, Article 9 of this Decree;

2. Procedures for Implementation

a) An individual or training institution shall prepare one set of dossier and submit it directly or via postal service to the authority responsible for issuing certificates for driving school instructors as stipulated in Clause 2, Article 8 of this Decree;

b) The Department of Transport or Vietnam Highway Corporation shall receive individual dossiers or lists of dossiers prepared by training institutions according to the model prescribed in Appendix V attached to this Decree. In cases where individuals do not meet the requirements, the Department of Transport or Vietnam Highway Corporation must respond in writing and specify the reasons;

c) Within no more than three working days from the date of receiving complete dossiers, the Department of Transport or Vietnam Highway Corporation shall issue a certificate for driving school instructors and record it in the tracking book according to the model prescribed in Appendix VI attached to this Decree;

Article 11. Driving Practice Vehicle Permit and Authority to Issue Driving Practice Vehicle Permit

1. The driving practice vehicle permit shall be issued by the competent authority according to the model prescribed in Appendix VII attached to this Decree, with a validity period corresponding to the permitted circulation time of the driving practice vehicle;

2. Competent authority to issue driving practice vehicle permits

a) Vietnam Highway Corporation shall issue driving practice vehicle permits for vehicles of training institutions under central agencies assigned by the Ministry of Transport;

b) The Department of Transport shall issue driving practice vehicle permits for vehicles of training institutions managed by local authorities;

Article 12. Procedures for Issuing Driving Practice Vehicle Permits

1. The dossier shall include:

a) A list of vehicles requesting issuance of driving practice vehicle permits according to the model prescribed in Appendix VIII attached to this Decree;

b) Vehicle registration certificate (a copy accompanied by the original for verification or a certified copy);

2. Procedures for Implementation

a) Organizations shall submit the list prescribed in point a of Clause 1 of this Article along with the application dossier for issuance of driving practice vehicle permits directly or via postal service to the competent authority for issuing driving practice vehicle permits as stipulated in Clause 2, Article 11 of this Decree;

b) The Department of Transport or Vietnam Highway Corporation shall organize the issuance of driving practice vehicle permits for organizations requesting permits at the time of issuing driving practice vehicle permits;

c) Within no more than one working day from the date of issuing driving practice vehicle permits to training institutions, the Department of Transport or Vietnam Highway Corporation shall issue driving practice vehicle permits. If not issued, they must respond in writing and specify the reasons;

d) In cases of reissuing driving practice vehicle permits or adding driving practice vehicles: Training institutions shall prepare one set of dossier including the components specified in Clause 1 of this Article and submit it directly or via postal service to the competent authority for issuing driving practice vehicle permits as stipulated in Clause 2, Article 11 of this Decree;

Within no more than three working days from the date of receiving complete dossiers as prescribed, the Department of Transport or Vietnam Highway Corporation shall organize inspections and issuance of driving practice vehicle permits for training institutions. If not issued, they must respond in writing and specify the reasons.

Article 13. Driving School Training License for Motor Vehicles and Competent Authority to Issue Such License

1. The driving school training license for motor vehicles shall be issued by the competent authority to driving schools that meet the conditions stipulated in Articles 5, 6, and 7 of this Decree.

2. The driving school training license for motor vehicles shall follow the model prescribed in Appendix IX attached to this Decree; it shall be reissued in cases where the license is lost, damaged, or there are changes related to the content of the driving school training license.

3. Competent authorities issuing the driving school training license for motor vehicles

a) The Vietnam Road Transport Administration shall issue new or reissue the driving school training license for motor vehicles to driving schools under central agencies assigned by the Ministry of Transport;

b) The Department of Transport shall issue new or reissue the driving school training license for motor vehicles to driving schools managed by localities.

Article 14. Procedures for Issuing the Driving School Training License for Motor Vehicles

1. The dossier shall include:

a) Documents including a report requesting issuance of the driving school training license according to the model prescribed in Appendix X attached to this Decree;

b) Decision on establishment of vocational education institutions by the competent authority (a copy with the original for verification or a certified copy);

c) Business registration certificate (a copy with the original for verification or a certified copy);

d) Certificate of instructors teaching practical driving (a copy with the original for verification or a certified copy);

đ) Vehicle registration certificate (a copy with the original for verification or a certified copy).

2. Procedures for Implementation

a) After completing the construction of physical facilities, investment in means of instruction, and equipment for driving training in accordance with technical and professional standards of driving schools for motor vehicles, organizations or individuals shall prepare one set of application documents and submit them directly or via postal service to the competent authority issuing the driving school training license for motor vehicles as stipulated in Clause 3 of Article 13 of this Decree;

b) In case the application documents are incomplete, within two working days from the date of receipt of the documents, the Department of Transport or the Vietnam Road Transport Administration must respond in writing to the organization or individual;

c) Within ten working days from the date of receiving complete documents as prescribed, the Department of Transport or the Vietnam Road Transport Administration shall take the lead and coordinate with the vocational education management agency to conduct an on-site inspection of the driving school, prepare a record according to the model prescribed in Appendix XI attached to this Decree, and issue the driving school training license for motor vehicles to the school meeting the conditions. If not issued, they must respond in writing and specify the reasons.

Article 15. Procedures for Reissuing the Driving School Training License for Motor Vehicles

1. The driving school training license for motor vehicles shall be reissued when adjusting the category of vehicles trained or the training volume

a) The application documents include the components prescribed in point a, point d, and point đ of Clause 1 of Article 14 of this Decree (only supplementing the changed contents compared to the most recent issuance);

b) Procedure

The driving school shall prepare one set of application documents and submit them directly or via postal service to the competent authority issuing the driving school training license for motor vehicles as stipulated in Clause 3 of Article 13 of this Decree;

Within five working days from the date of receiving complete documents as prescribed, the competent authority shall coordinate with the vocational education management agency to conduct an on-site inspection of the driving school and prepare a record according to the model prescribed in Appendix XI attached to this Decree;

Within three working days from the end of the inspection, the competent authority shall reissue the driving school training license for motor vehicles to the driving school. If not issued, they must respond in writing and specify the reasons.

2. The driving school training license for motor vehicles shall be reissued if lost, damaged, or other content changes

a) The driving school shall have a document requesting reissuance of the driving school training license for motor vehicles and clearly state the reason for damage, loss, or the content needing change, and submit it directly or via postal service to the competent authority;

b) Within three working days from the date of receiving complete documents as prescribed, the competent authority shall reissue the driving school training license for motor vehicles to the driving school. If not issued, they must respond in writing and specify the reasons.

Article 16. Revocation of Driving License Training Permit

1. The training institution shall have its driving license training permit revoked indefinitely if it commits any of the following violations:

a) Engaging in fraudulent acts to establish or obtain a driving license training permit;

b) Failing to commence driving license training activities within twenty-four months from the date of issuance of the driving license training permit;

c) Being suspended from enrolling students for driving license training two or more times within eighteen months;

d) The permit being issued beyond the authorized authority;

đ) Altering, erasing, or tampering with the content on the issued permit;

e) Leasing or lending out the permit.

2. The competent authority issuing the driving license training permit shall carry out the revocation process according to the following procedures:

a) Issuing a decision to revoke the driving license training permit, notifying relevant agencies to cooperate in implementation, and publishing on the electronic information website of the Department of Transport;

b) The driving license training institution must return the driving license training permit to the issuing agency, and simultaneously cease all driving license training activities under the revoked permit immediately upon the decision taking effect.

Chapter III

CONDITIONS FOR BUSINESS OPERATIONS, ISSUANCE AND REVOCATION OF LICENSE CERTIFICATES FOR DRIVING TEST CENTERS MEETING ACTIVITY REQUIREMENTS

Article 17. General Conditions for Driving Test Centers

1. Established in accordance with the provisions of the law.

2. Type 1 and Type 2 driving test centers must be constructed in compliance with the network planning of driving test centers by the Ministry of Transport; Type 3 driving test centers must be built in line with the socio-economic development plans of provinces and centrally-administered cities.

Article 18. Physical Facilities Requirements

1. General conditions

a) Area of the driving test center: Type 1 centers must have an area of at least 35,000 square meters; Type 2 centers must have an area of at least 20,000 square meters; Type 3 centers must have an area of at least 4,000 square meters;²b) The center must have sufficient equipment to ensure environmental hygiene and fire safety;²c) Motor vehicles used for testing:²;

Quantity: For category A1, B1, B2, and C driving tests, there must be a minimum of two vehicles per category, and for other categories, a minimum of one vehicle per category; for road driving tests, there must be a minimum of one vehicle per category.

Testing vehicles for theoretical driving tests belong to organizations or individuals operating the driving test center, must have a valid technical inspection certificate for motor vehicles; must be equipped with auxiliary braking systems installed in accordance with regulations. For category FC testing vehicles, contractual vehicles may be used with appropriate duration and quantity based on testing needs.

Road driving test vehicles must meet traffic participation conditions as stipulated by the Road Traffic Law; must have auxiliary braking systems located on the examiner's seat, securely structured, convenient, safe, and ensuring effective braking during use; may use contractual vehicles for a period of one year or longer, not exceeding fifty percent of the owned vehicles of the same category of the organization or individual operating the driving test center; must be fitted with two "TEST" signs;

d) Theoretical testing equipment: At least two servers; at least ten workstations for Type 3 driving test centers, at least twenty workstations for Type 1 or Type 2 driving test centers;

đ) Practical driving testing equipment for simulated driving tests: At least two computers installed with software for managing and conducting driving tests for each type of driving test center;

e) Practical driving testing equipment for road driving tests: At least two computers installed with software for managing and conducting driving tests, one computer serving as a server and manager with dedicated leased line and static IP address.

2. Technical Requirements

The driving test center must comply with technical requirements set forth in the National Technical Regulations on Driving Test Centers for Motor Vehicles on Roads issued by the Ministry of Transport, including: lanes, traffic signals, road marking systems, boundary lines, test course pavements, standard posts and shapes of test courses; motor vehicles used for testing; theoretical testing equipment; practical driving testing equipment for simulated driving tests; practical driving testing equipment for road driving tests; control room and other ancillary facilities.

2. Technical Conditions

The examination center must meet the technical requirements set forth in the National Technical Regulations on motor vehicle driving examination centers issued by the Ministry of Transport, including: lanes, traffic signal lights, road signaling systems, lane markings, examination simulation sidewalks, standard posts and examination scenarios in the examination field; motor vehicles used for examinations; theoretical examination equipment; practical driving examination equipment in simulations; practical driving examination equipment on roads; control rooms and other auxiliary facilities.

Article 19. Certificate for Driving License Examination Centers Meeting Conditions for Operation

1. The certificate for driving license examination centers meeting conditions for operation shall be issued by the competent authority to driving license examination centers that meet the conditions stipulated in Article 18 of this Decree.

2. The certificate for driving license examination centers meeting conditions for operation shall be in the form prescribed in Appendix XII attached to this Decree; it shall be reissued in cases where the certificate is lost, damaged, or there are changes related to the contents of the certificate or changes in testing equipment, types, and quantities of automobiles used for driving license examinations. The reissued certificate must include a provision nullifying the effectiveness of the previously issued certificate.

3. Competent authority issuing the certificate for driving license examination center operations

a) The Vietnam Highway Administration shall issue new and reissue certificates for driving license examination centers meeting conditions for operation for type 1 and type 2 examination centers;

b) The Department of Transport shall issue new and reissue certificates for driving license examination centers meeting conditions for operation for type 3 examination centers within the provinces and centrally-administered cities.

Article 20. Approval of Overall Layout Plan for Type 1 and Type 2 Driving License Examination Center Testing Sites

1. The dossier shall include:

a) Investment registration certificate (a copy with the original for verification or a certified copy);

b) Overall layout plan drawing;

c) Construction permit (a copy with the original for verification or a certified copy);

d) Design documentation for testing sites, list of types of motor vehicles used for testing, and automatic scoring equipment.

2. Procedures for Implementation

a) Organizations and individuals submit a request letter along with two sets of documents directly or through postal service to the Vietnam Highway Administration;

b) Within no more than five working days from the date of receipt of complete documents as prescribed, the Vietnam Highway Administration shall issue an approval letter to the organization or individual concerned and simultaneously send it to the Department of Transport; if disapproval is given, a written response must be provided with specific reasons. If no response is received beyond the deadline, the request shall be deemed approved.

Article 21. Procedures for Issuing Certificates for Type 1 and Type 2 Driving License Examination Centers Meeting Conditions for Operation

1. After completing the construction of the driving license examination center, organizations and individuals shall submit a request letter to the Vietnam Highway Administration requesting inspection and issuance of a certificate for the driving license examination center meeting conditions for operation.

2. Within no more than ten working days from the date of receipt of the request letter, the Vietnam Highway Administration shall cooperate with the Department of Transport to conduct inspections and issue the certificate. In case of non-issuance, a written response must be provided with specific reasons.

Article 22. Procedures for Issuing Certificates for Type 3 Driving License Examination Centers Meeting Conditions for Operation

1. The dossier shall include:

a) Construction permit (a copy with the original for verification or a certified copy);

b) Overall layout plan drawing, design documentation for testing site dimensions, and types of motor vehicles used for testing.

2. Procedures for Implementation

a) After completing the construction of the driving license examination center, organizations and individuals shall submit one set of documents directly or through postal service to the Department of Transport requesting issuance of a certificate for the driving license examination center meeting conditions for operation;

b) Within no more than five working days from the date of receipt of complete documents as prescribed, the Department of Transport shall conduct inspections and issue the certificate. In case of non-issuance, a written response must be provided with specific reasons.

Article 23. Procedure for Reissuing the Certificate of Driving License Examination Center Meeting Conditions for Operation

1. The certificate of a driving license examination center shall be reissued if there is a change in examination equipment, types, or number of motor vehicles used for examinations.

a) The driving license examination center shall submit a request for reissuance of the certificate directly or through postal service to the competent authority responsible for issuing the certificate in accordance with Clause 3, Article 19 of this Decree;

b) Within no more than ten working days from the date of receipt of the request, the General Department of Vietnam Transportation shall coordinate with the Department of Transport to organize inspections and reissue certificates for driving license examination centers of type 1 and type 2 meeting conditions for operation; the Department of Transport shall organize inspections and reissue certificates for driving license examination centers of type 3 meeting conditions for operation. In case of non-reissuance, a written response must be provided along with the reasons.

2. The certificate of a driving license examination center shall be reissued if it is damaged, lost, or if there is a change related to the content of the certificate.

a) The driving license examination center shall prepare a request for reissuance of the certificate and clearly state the reason for damage or loss, and submit it directly or through postal service to the competent authority responsible for issuing the certificate in accordance with Clause 3, Article 19 of this Decree;

b) Within no more than three working days from the date of receipt of the request, the competent authority shall reissue the certificate for the driving license examination center. In case of non-reissuance, a written response must be provided along with the reasons.

Article 24. Revocation of the Certificate of Driving License Examination Center Meeting Conditions for Operation

1. The certificate of a driving license examination center shall be revoked indefinitely in the following cases:

a) Engaging in fraudulent behavior to obtain the certificate of a driving license examination center meeting conditions for operation;

b) Not conducting driving license examination activities within twenty-four months from the date of issuance of the certificate of a driving license examination center;

c) Having the certificate of a driving license examination center meeting conditions for operation revoked twice or more within eighteen months;

d) The certificate being issued without proper authority;

đ) Altering or tampering with the content on the certificate;

e) Lending or renting out the certificate.

2. The competent authority responsible for issuing the certificate of a driving license examination center meeting conditions for operation shall carry out revocation according to the following procedures:

a) Issuing a decision to revoke, notifying relevant agencies to cooperate in implementation and publishing on the electronic information website of the competent authority;

b) The driving license examination center must return the certificate to the issuing authority and immediately cease all driving license examination activities according to the certificate that has been revoked upon the decision taking effect.

Chapter IV

IMPLEMENTING PROVISIONS

Article 25. Transitional Provisions

1. Driving instructors who have been issued certificates before this Decree comes into effect but do not meet the conditions stipulated in this Decree must complete compliance with the provisions of this Decree by July 1, 2019.

2. Licenses for driving training schools and certificates of driving license examination centers meeting conditions for operation issued before this Decree comes into effect shall remain valid until their expiration dates and may be renewed upon expiration.

3. For training institutions and driving license examination centers that have been issued certificates meeting conditions for operation before this Decree comes into effect but do not comply with the provisions of this Decree, they must transfer back to the management agency within six months from the date this Decree takes effect.

Article 26. Responsibility for Implementation

1. The Ministry of Transport

a) Regulations on technical standards and professional qualifications for classrooms, practice cars, practice fields, teaching materials, and training programs;

b) Organizing inspections, audits, and handling violations of the provisions of this Decree.

2. The General Department of Vietnam Transportation

a) Implementing, inspecting, and auditing compliance with the conditions stipulated in this Decree; directing driving license examination centers to conduct examinations for driving training schools under its management;

b) Regularly organizing standardization checks of driving license examination centers, ensuring compliance with national technical standards for driving license examination centers;

c) Announcing and updating lists of driving training schools and driving license examination centers that have been issued or revoked certificates nationwide on the electronic information website of the General Department of Vietnam Transportation.

a) Annually review and allocate local government budget funds entrusted through the Social Policy Bank for lending as prescribed by law;

a) Cooperating with the Ministry of Transport to inspect and supervise the implementation of the planning network of driving training schools and driving license examination centers;

b) Directing functional agencies to organize inspections and audits of compliance with the conditions stipulated in this Decree.

4. Department of Transport

a) Implementing, inspecting, and auditing compliance with the conditions stipulated in this Decree; directing driving license examination centers to conduct examinations for driving training schools under its management. In cases where the locality does not have a driving license examination center meeting conditions for operation, examinations shall be conducted at another location;

b) Announcing and updating lists of driving training schools and driving license examination centers that have been issued or revoked certificates within the scope of management on the electronic information website of the Department of Transport.

5. Driving training schools shall be responsible for

a) Organizing new training and upgrading driving licenses according to the volume, duration, location, and category of driving license specified in the driving training license;

b) Maintaining and enhancing facilities and equipment for teaching; managing the teaching staff to ensure compliance with the prescribed conditions.

6. Driving license examination centers shall be responsible for ensuring facilities and equipment for inspection and scoring in accordance with regulations to achieve accurate and impartial examination results.

Article 27. Effectiveness and Responsibility for Implementation

1. This Decree shall take effect from July 1, 2016.

2. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of Provincial People's Committees, and organizations and individuals concerned shall be responsible for implementing this Decree./.
