CIRCULAR

Regulations on knowledge testing of traffic laws for road safety to restore points on driving licenses

BASED ON THE ROAD TRAFFIC ORDER AND SAFETY LAW dated June 27, 2024;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Traffic Police Corps;

The Minister of Public Security issues this Circular regulating knowledge testing of traffic laws for road safety to be eligible for restoring points on driving licenses.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular regulates knowledge testing of traffic laws for road safety for individuals whose driving licenses have been deducted all points to be eligible for restoring points on driving licenses.

Article 2. Applicability

1. Police officers and non-commissioned officers of the People's Public Security (hereinafter referred to collectively as officers) shall carry out the task of testing knowledge of traffic laws for road safety.

2. Public security units and localities.

3. Individuals whose driving licenses have been deducted all points.

4. Agencies, organizations, and individuals related to the testing of knowledge of traffic laws for road safety.

Chapter II

SPECIFIC PROVISIONS

Article 3. Persons eligible to participate in knowledge testing of traffic laws for road safety

Persons eligible to participate in knowledge testing of traffic laws for road safety are those whose driving licenses have been deducted all points.

Article 4. Authorities with the power to test knowledge of traffic laws for road safety

Authorities with the power to test knowledge of traffic laws for road safety include:

1. Traffic Police Corps.

2. Provincial and centrally-administered city Traffic Police Departments.

Article 5. Ensuring conditions for organizing knowledge testing of traffic laws for road safety

1. Ensuring material and equipment under the authority of the testing agency:

a) Having a room for testing knowledge of traffic laws for road safety equipped with computers and printers for officers performing testing tasks and necessary materials and equipment directly serving the testing process; computers for participants to use must be connected to the Ministry of Public Security's WAN network to the server located at the Traffic Police Corps;

The server must install approved software for testing knowledge of traffic laws for road safety by the Ministry of Public Security, which connects to computers at testing sites and must ensure security and data safety of computers used for testing purposes, storing connection logs and data modifications.

b) Having a surveillance camera system covering the entire image of the testing room, with data storage devices for camera images. The surveillance camera system must ensure confidentiality and prevent unauthorized access from outside;

c) In cases where computers at the testing site do not have a WAN network connection as stipulated in point a, Clause 1 of this Article, the testing authority shall use devices capable of securely storing information to store participant information for testing organization.

2. Officers assigned the task of testing knowledge of traffic laws for road safety must hold a motorcycle license category A and a car driver's license, and must undergo training organized by the Traffic Police Corps and obtain an Examiner card.

Article 6. Content, method, time, structure of the test paper, and satisfactory results

1. Testing content, including:

a) Testing theoretical knowledge of traffic laws for road safety conducted according to theory examination questions for issuing driving licenses as prescribed by the Minister of Transport (hereinafter referred to as theoretical knowledge testing);

b) Testing knowledge of traffic laws for road safety through simulated traffic situations on computers as prescribed by the Minister of Transport (hereinafter referred to as simulated knowledge testing).

2. Testing methods:

a) For theoretical knowledge testing, participants complete a multiple-choice test on a computer using the traffic laws knowledge testing software;

b) For simulated knowledge testing, participants handle traffic situations through simulations on a computer.

3. Time, structure of the test paper, and satisfactory results for theoretical knowledge testing:

a) Participants holding a Class A1 driving license take the test for 19 minutes. The test consists of 25 multiple-choice questions, each question worth 01 point, including 01 question that is a disqualification point. A score of 21/25 or higher is considered satisfactory. If the score is 21/25 or higher but the disqualification point question is answered incorrectly, it is not considered satisfactory;

b) Participants holding a Class A or B1 driving license take the test for 19 minutes. The test consists of 25 multiple-choice questions, each question worth 01 point, including 01 question that is a disqualification point. A score of 23/25 or higher is considered satisfactory. If the score is 23/25 or higher but the disqualification point question is answered incorrectly, it is not considered satisfactory;

c) Participants holding a Class B driving license take the test for 20 minutes. The test consists of 30 multiple-choice questions, each question worth 01 point, including 01 question that is a disqualification point. A score of 27/30 or higher is considered satisfactory. If the score is 27/30 or higher but the disqualification point question is answered incorrectly, it is not considered satisfactory;

d) Participants holding a Class C1 driving license take the test for 22 minutes. The test consists of 35 multiple-choice questions, each question worth 01 point, including 01 question that is a disqualification point. A score of 32/35 or higher is considered satisfactory. If the score is 32/35 or higher but the disqualification point question is answered incorrectly, it is not considered satisfactory;

đ) Participants holding a Class C driving license take the test for 24 minutes. The test consists of 40 multiple-choice questions, each question worth 01 point, including 01 question that is a disqualification point. A score of 36/40 or higher is considered satisfactory. If the score is 36/40 or higher but the disqualification point question is answered incorrectly, it is not considered satisfactory;

e) Individuals participating in the examination with a driving license category D1, D2, D, BE, C1E, CE, D1E, D2E, DE shall complete the examination within 26 minutes. The examination structure consists of 45 multiple-choice questions, each question being worth 01 point, including 01 question that is considered a failing point. A score of 41/45 points or higher is required to pass. In cases where the score is 41/45 points or higher but the individual answers incorrectly to the question considered a failing point, they will not meet the requirements.

4. Time, structure of the examination, and results meeting the requirements for the theoretical knowledge test on traffic laws through simulation:

The examination time does not exceed 10 minutes. The examination is designed with 10 simulated traffic situation questions, each question representing a potential traffic safety risk scenario, each question having a maximum score of 05 points and a minimum score of 0 points. The score obtained by the examinee corresponds to the moment of recognizing and identifying the potential traffic safety risk scenario through interaction with a computer equipped with simulation software. An examinee achieves the passing requirement with a score of 35/50 points or higher.

5. Examination results meeting the requirements will restore points on the driving license:

a) For individuals whose motorcycle driving license has been deducted all points: Points on the driving license will be restored when the theoretical knowledge test result on traffic laws meets the requirements specified in point a and point b, Clause 3 of this Article;

b) For individuals whose car driving license has been deducted all points: Points on the driving license will be restored when the examination results meet the requirements for both contents, namely the theoretical knowledge test on traffic laws and the knowledge test on traffic laws through simulation as stipulated in points c, d, đ, e, Clause 3 and Article 4 of this Law.

Individuals who fail the theoretical knowledge test on traffic laws will not be allowed to take the knowledge test on traffic laws through simulation.

Individuals who pass the theoretical knowledge test on traffic laws but fail the knowledge test on traffic laws through simulation will have their theoretical knowledge test results retained for a period of 01 year from the date of the successful test.

Individuals who fail the examination may re-register for the examination after 07 working days from the end of the previous examination.

Article 7. Registration and organization of the traffic law knowledge examination regarding road traffic order and safety:

1. Examination registration dossier:

a) Application form for the traffic law knowledge examination regarding road traffic order and safety according to Model No. 01 attached as an appendix to this Circular;

b) Health certificate of the driver issued by a competent medical facility still valid for use.

2. Time of organization and submission of the examination registration dossier:

a) The examination time is publicly announced by the competent authority organizing the examination on the electronic portal under its management jurisdiction;

b) The examination registration dossier must be submitted to the competent authority organizing the examination before the examination registration date in one of the following forms: online at the National Public Service Portal, the Ministry of Public Security's Public Service Portal, via the National Identity Application; via postal service; directly.

In case of online submission, the applicant must fully declare information, attach the dossier as stipulated in Article 1 of this Article, and register the examination date, choosing the competent authority organizing the examination.

In case of direct submission, the receiving agency assigns an officer to check the dossier, writes a receipt clearly stating the examination time and location.

3. Applicants can submit the dossier to the competent authority organizing the examination as stipulated in Article 4 of this Circular at their place of permanent residence, temporary residence, or current place of residence.

Individuals who fail the examination may re-register for the examination at the competent authority that organized the previous examination or choose another competent authority to request a re-examination. If requesting a re-examination and the health certificate is still valid, the applicant only needs to submit the application form for the examination.

4. Notification of the examination organization time:

a) At least 02 working days before the examination date, after receiving a complete and valid dossier, the competent authority organizing the examination will notify the previously registered applicants about the examination time and location via the email address or phone message recorded in the application form;

b) In case of changing the previously notified examination time and location, the competent authority organizing the examination must notify the previously registered applicants via the email address or phone message recorded in the application form about the new examination time and location.

5. Examinees must be present at the designated time and location as announced by the competent authority organizing the examination and use one of the following identification documents: citizen identity card, citizen identity card; driving license; certificate of identity (for Vietnamese citizens whose nationality cannot be determined); resident permit, temporary resident permit (for foreigners) for the competent authority to verify against the information in the application form.

In cases where the examinee's information is available in the electronic identity card, the electronic identity verification system through the National Identity Application, such information will be utilized for verification against the information in the application form.

6. Examinees must log into the traffic law knowledge examination software and follow the instructions of the examination officer to complete the examination content. Examinees must comply with the rules at the examination venue.

Foreign examinees and ethnic minority examinees who do not read or write Vietnamese shall use interpreters hired by the competent authority organizing the examination during the examination. During the examination, the interpreter must accurately translate all questions in the software, provide full explanations and guidance on how to complete the examination so that the examinee can proceed.

7. Upon completion of the examination time, examinees sign the record sheet according to Model No. 02 attached as an appendix to this Circular. In cases where the examinee is a foreigner or an ethnic minority with an interpreter, both the examinee and the interpreter must sign or affix their fingerprints at the signature location on the examination record sheet.

The inspection record shall be established in two copies, one copy to be stored at the competent authority conducting the inspection, and one copy to be handed over to the person participating in the inspection.

Article 8. Responsibilities of the Competent Authority for Inspecting Knowledge of Traffic Law on Road Traffic Order and Safety

1. Ensuring conditions for organizing inspections of knowledge of traffic law on road traffic order and safety as prescribed in Article 5 of this Circular.

2. Publicly posting study materials for reviewing knowledge of traffic law on road traffic order and safety on the electronic portal within its management scope.

3. Assigning staff to receive registration files for inspection and staff to perform the task of inspecting knowledge of traffic law on road traffic order and safety.

4. Announcing publicly on the electronic portal within its management scope, before the 25th day of each month, the planned date for the inspection in the following month so that those who have registered for the inspection can choose and register their inspection date using Form No. 01 attached to this Circular.

5. Organizing inspections at least twice per week and publicly announcing the inspection dates on the electronic portal within its management scope.

6. Disseminating and guiding the procedures for those participating in the inspection when organizing inspections of knowledge of traffic law on road traffic order and safety.

7. Notifying the results of inspections of knowledge of traffic law on road traffic order and safety to the authority responsible for deducting points from driving licenses and the license plate management authority when data sharing has not been connected.

8. Storing at the competent authority for inspection: surveillance camera footage of the examination room for a minimum period of two years; registration files, inspection records of knowledge of traffic law on road traffic order and safety in paper form and electronic data on software for a minimum period of five years.

Article 9. Budget for Organizing Inspections of Knowledge of Traffic Law on Road Traffic Order and Safety

The budget for organizing inspections of knowledge of traffic law on road traffic order and safety shall be allocated from fines collected for administrative violations related to road traffic order and safety and proceeds from auctioning vehicle license plates after they have been deposited into the state budget, and shall be managed and used in accordance with the provisions of the law.

Chapter III

IMPLEMENTING PROVISIONS

Article 10. Effective Date

This Circular takes effect from January 1, 2025.

Article 11. Responsibility for Implementation

1. The Director of the Traffic Police Department shall be responsible for:

a) Directing, supervising, and urging the implementation of this Circular;

b) Organizing research on the construction, management, maintenance, and upgrading of the software for inspecting knowledge of traffic law on road traffic order and safety, and reporting to the leadership of the Ministry of Public Security;

c) Organizing research and application of science and technology, managing the work of inspecting knowledge of traffic law on road traffic order and safety;

d) Guiding uniformly the internal regulations at the location where inspections of knowledge of traffic law on road traffic order and safety are organized.

2. The Director of the Provincial Police Department under the direct jurisdiction of the central government shall be responsible for:

a) Periodically every six months, annually, or at any time, reporting to the Ministry of Public Security (through the Traffic Police Department) on the results of inspections of knowledge of traffic law on road traffic order and safety within their management scope;

b) Organizing mobile inspections of knowledge of traffic law on road traffic order and safety when ensuring the conditions for organizing inspections as prescribed in Article 5 of this Circular.

3. Heads of units under the Ministry's agencies, Directors of Provincial Police Departments under the direct jurisdiction of the central government, and relevant organizations and individuals shall be responsible for implementing this Circular.

During the implementation of this Circular, if there are difficulties or obstacles, local police units, organizations, and individuals concerned shall report to the Ministry of Public Security (through the Traffic Police Department) for timely guidance./.
