CIRCULAR
GUIDANCE ON THE IMPLEMENTATION OF DECREE 133/HĐBT ON PRESS CONFERENCES ISSUED BY THE MINISTRY OF CULTURE AND INFORMATION NUMBER 65/BC ON OCTOBER 6, 1995
Pursuant to Decree 81/CP dated November 8, 1993 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Culture and Information;Pursuant to Article 9 of Decree 133/HĐBT dated April 20, 1992 of the Council of Ministers (now the Government) on the functions and tasks of the management of press activities by the Ministry of Culture and Information;
Upon permission from the Prime Minister, the Ministry of Culture and Information provides detailed guidance on the implementation of Article 18 of Decree 133/HĐBT dated April 20, 1992 on press conferences as follows:
1- Press conference is understood as:
Agencies, organizations, and individuals invite representatives and reporters from news agencies to meet for the purpose of announcing, explaining, or declaring an issue within their jurisdiction that is related to their interests.
2- Agencies, organizations, Vietnamese citizens, and foreign agencies, organizations, and individuals holding press conferences shall be responsible for implementing this Circular.
3- Agencies, organizations, and citizens who wish to hold a press conference must notify the competent state agency managing press activities in writing at least 12 hours in advance. The notification shall include: Purpose, content, program, list of invitees, time, location, and host.
A press conference can only be organized after obtaining the consent of the competent state agency.
If there is no written response from the competent agency within six hours of receiving the notification, it shall be deemed as agreed.
4- Central-level agencies wishing to hold a press conference must notify in writing the following agencies:
- In the Hanoi area, notify in writing the Ministry of Culture and Information (Press Department).
- In the Ho Chi Minh City area, notify in writing the Office of the Press Department of the Ministry of Culture and Information in Ho Chi Minh City.
- Central-level agencies wishing to organize a press conference in other provinces and cities must notify the People's Committee of the province or centrally-administered city (Department of Culture and Information) where the press conference will be held.
5- Provincial-level agencies and citizens wishing to hold a press conference must notify in writing the People's Committee of the province or centrally-administered city (Department of Culture and Information) where the press conference will be held.
6- Foreign diplomatic missions, international organizations, and foreign business and individual cooperation organizations wishing to hold a press conference in a local area must notify in writing the People's Committee of the province or centrally-administered city in that area (Department of Culture and Information).
7- Diplomatic missions, official delegations visiting Vietnam wishing to hold a press conference shall implement according to the regulations of the Ministry of Culture and Information and the Ministry of Foreign Affairs.
8- The Ministry of Culture and Information, People's Committees of provinces and centrally-administered cities have the right to refuse or terminate a press conference if they find signs of violation of the Press Law, the provisions of Decree 133/HĐBT dated April 20, 1992, and this Circular.
9- Vietnamese and foreign agencies, organizations, and individuals violating the regulations on press conferences will be subject to administrative penalties or criminal prosecution.
10- This Circular takes effect from the date of issuance.
