CIRCULAR

OF THE MINISTRY OF FINANCE AND THE MINISTRY OF HEALTH

Regulations on the collection of registration fees for foreign companies applying for importation of medicines and pharmaceutical raw materials into Vietnam

To strictly manage foreign companies registering to import medicines and pharmaceutical raw materials into Vietnam. On March 30, 1991, the Ministry of Health issued Circular No. 7/BYT-TT guiding the registration process for foreign companies applying for export and import of medicines and pharmaceutical raw materials with Vietnamese companies;

Pursuant to Decision No. 276/CP dated July 28, 1992 of the Council of Ministers (now Prime Minister) regarding the unified management of various types of fees and charges, and Circular No. 48/TC-TCT dated September 28, 1992 of the Ministry of Finance guiding the implementation of the aforementioned decision;

The Ministry of Finance and the Ministry of Health hereby stipulate the amount of registration fee and the usage regime for foreign companies applying for importation of medicines and pharmaceutical raw materials into Vietnam (referred to collectively as the company registration fee),

a) All foreign companies applying to register for importing medicines and pharmaceutical raw materials into Vietnam must pay the company registration fee.

1. Organizations and individuals who obtain from state management agencieslicenses for international travel agency business and tour guide cards as providedfor in Clause 1, Article 6 and Article 10 of Decree No. 27/2001/NĐ-CP dated June5, 2001, on travel agency business and tour guiding must pay the fees prescribedin this Circular.

2. Rates:

b) The company registration fee is divided into two categories: application review fee and license issuance fee.

When submitting the company registration application, foreign companies must pay the application review fee. Upon receiving the business permit from the Ministry of Health, the companies must pay the license issuance fee.

The company registration fee shall be collected in US dollars (USD).

The business permit is valid for two years from the date of issuance. At the end of this period, if companies wish to continue their operations, they must pay the required fees and charges as stipulated in this Circular.

The one-time application review fee or license issuance fee is as follows:

1. Police agencies responsible for collecting fees shall:

a) Application review fee: 200 USD per application.

b) License issuance fee: 2000 USD per license.

II. MANAGEMENT AND USE OF COMPANY FEES

Company fees are revenue items of the State budget collected concurrently with the receipt of applications and issuance of licenses by the Ministry of Health.

When collecting fees and charges, receipts issued by the Ministry of Finance (General Tax Department) must be used, obtained at the Hanoi Tax Bureau, and managed and utilized according to the current stamp receipt management regulations of the Ministry of Finance.

The agency directly responsible for collecting fees may retain 25% of the total amount collected to cover the costs of review and related work directly associated with issuing licenses, and to provide bonuses to staff involved in reviewing company registrations and collecting fees and charges, but the maximum annual bonus shall not exceed three months' basic salary. Any remaining funds not spent by the end of the year must be remitted to the State budget. The use of retained foreign currency must comply with the current State foreign exchange management regulations.

The remaining amount (after the above percentage has been deducted) must be deposited into the State Treasury's centralized foreign currency account at the Central Foreign Trade Bank Account Number 212.210.370.001 under Item 35 "collection of various fees and charges" of the State Budget Classification. The deadline for payment is as specified by the local tax authority, but no later than the fifth day of the following month for the previous month's payments.

Annually, the Ministry of Health must prepare plans for fee collection, settle accounts for fee collection, and report the use of retained funds to the Ministry of Finance.

The tax authority is responsible for monitoring and urging the agencies issuing permits for foreign companies engaged in the importation of medicines and pharmaceutical raw materials to promptly remit the required amounts to the State budget.

During the implementation process, if there are difficulties or issues, they should be reported to the Ministry of Finance and the Ministry of Health for research and resolution./.

This Circular takes effect from the date of signature.
