DECISION OF THE GOVERNOR OF THE STATE BANK
Regarding the cessation of operations and the merger of Vietnam Gold, Silver and Precious Stones Corporation into the Agricultural Bank of Vietnam and the Mekong Delta Development Bank

Pursuant to the Law on the State Bank of Vietnam No. 01/1997/QH-10 dated December 12, 1997;
Pursuant to the Law on State-Owned Enterprises dated April 20, 1995;
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 50-CP dated August 28, 1996 of the Government on the establishment, restructuring, dissolution, and bankruptcy of state-owned enterprises, and Decree No. 38/CP dated April 28, 1997 of the Government amending and supplementing certain articles of Decree No. 50-CP;
Pursuant to Decision No. 98/2003/QĐ-TTg dated May 14, 2003 of the Prime Minister approving the overall plan for the reorganization and modernization of state-owned enterprises directly under the State Bank of Vietnam for the period 2003-2005;
At the proposal of the Director of the Accounting and Finance Department,
DECISION
Article 1. Now, the following mergers are made:
1Vietnam Gold, Silver and Precious Stones Corporation (including the corporation's office, dependent accounting units, and public service units) and 29 affiliated independent accounting units of Vietnam Gold, Silver and Precious Stones Corporation into the Agricultural Bank of Vietnam (Annex No. 01 attached);
2Twelve affiliated gold, silver, and precious stones companies under Vietnam Gold, Silver and Precious Stones Corporation into the Mekong Delta Development Bank (Annex No. 02 attached).
Article 2. The Chairman of the Board of Directors and General Director of Vietnam Gold, Silver and Precious Stones Corporation shall be responsible for transferring the operational status, capital, assets, organizational structure, personnel, and other relevant documents of the units named in Article 1 to the Agricultural Bank of Vietnam and the Mekong Delta Development Bank in accordance with current regulations.
Article 3. The Agricultural Bank of Vietnam shall be responsible for receiving and representing all rights and obligations of Vietnam Gold, Silver and Precious Stones Corporation in cases where such rights and obligations cannot be allocated to the units and affiliated companies mentioned in Article 1.
Article 4. The operations of Vietnam Gold, Silver and Precious Stones Corporation established by Decision No. 366/QĐ-NH5 dated December 21, 1995 of the Governor of the State Bank are hereby terminated.
Article 5. This Decision takes effect from July 1, 2003.
Article 6. The Head of the Office, the Director of the Accounting and Finance Department, the Heads of related units under the State Bank, the Chairman of the Board of Directors, the General Director of Vietnam Gold, Silver and Precious Stones Corporation, the Agricultural Bank of Vietnam, and the Mekong Delta Development Bank are responsible for implementing this Decision./.
