RESOLUTION

ORGANIZATION AND OPERATIONS OF THE MILITARY DIRECTOR BOARD OF COMMUNE, WARD, SPECIAL ZONE UNDER THE PROVINCE MILITARY COMMAND, DIRECTLY UNDER THE CENTRAL GOVERNMENT, CAPITAL MILITARY COMMAND, HO CHI MINH CITY MILITARY COMMAND

Pursuant to the Government Organization Law No. 63/2025/QH15;

Pursuant to the National Defense Law No. 22/2018/QH14, amended and supplemented by Law No. 18/2023/QH15, Law No. 38/2024/QH15, Law No. 98/2025/QH15;

Pursuant to the Law on Militia and Self-Defense Forces No. 48/2019/QH14, amended and supplemented by Law No. 98/2025/QH15;

Pursuant to the Law on Officers of the Vietnam People's Army No. 16/1999/QH10, amended and supplemented by Law No. 19/2008/QH12, Law No. 72/2014/QH13, Law No. 48/2019/QH14, Law No. 52/2024/QH15, Law No. 98/2025/QH15;

Pursuant to the Law on Professional Military Personnel, Civil Servants and State Defense Workers No. 98/2015/QH13, amended and supplemented by Law No. 98/2025/QH15;

Pursuant to the Law on Reserve Mobilization Forces No. 53/2019/QH14, amended and supplemented by Law No. 98/2025/QH15;

Pursuant to the Law on Military Service No. 78/2015/QH13, amended and supplemented by Law No. 48/2019/QH14, Law No. 98/2025/QH15;

Pursuant to the Civil Defense Law No. 18/2023/QH15, amended and supplemented by Law No. 98/2025/QH15;

Pursuant to the Law on National Defense and Security Education No. 30/2013/QH13, amended and supplemented by Law No. 35/2018/QH14, Law No. 98/2025/QH15;

Pursuant to the Law on Local Administration Organization No. 72/2025/QH15;

Pursuant to Resolution No. 206/2025/QH15 of the National Assembly on special mechanisms for handling difficulties and obstacles due to legal regulations;

Based on the proposal of the Minister of National Defense;

The Government hereby promulgates this Resolution on the organization and operations of the Military Director Board of commune, ward, special zone under the province military command, directly under the central government, Capital Military Command, Ho Chi Minh City Military Command.

Article 1. Scope of Regulation

This Resolution stipulates the organization and operations of the Military Director Board of commune, ward, special zone (hereinafter referred to collectively as the Military Director Board at the commune level) under the province military command, directly under the central government, Capital Military Command, Ho Chi Minh City Military Command (hereinafter referred to collectively as the Military Director Board at the provincial level) during the period before the amendment, supplementation, or issuance of new laws related to the Military Director Board at the commune level.

Article 2. Applicability

This Resolution applies to the Military Director Board at the commune level and agencies, organizations, and individuals related to the organization and operations of the Military Director Board at the commune level.

Article 3. Position and Functions of the Military Director Board at the Commune Level

1. The Military Director Board at the commune level is a local military agency under the Military Director Board at the provincial level.

2. The Military Director Board at the commune level has the function of advising the party committee and superiors; the party committee and local administration at the same level in performing state management functions regarding military and national defense in the locality; organizing the construction, management, command, and operation of units and armed forces under its authority to be strong, ready for combat, and perform military and national defense tasks in the commune area.

3. The Military Director Board at the commune level has legal personality, seal, bank account, and separate office. The model of the seal, the organization of engraving, registration, management, and use of the seal of the Military Director Board at the commune level shall be carried out according to the provisions of the Minister of National Defense.

Article 4. Tasks of the Military Director Board at the Commune Level

1. Advise the party committee and superiors; the party committee and local administration at the commune level to lead the construction of the whole-people national defense, the combined national defense posture with the people's security posture, the defensive region, and comprehensive strong bases; advise the People's Committee at the commune level on the organization, construction, mobilization of militia forces in accordance with the law.

2. Advise the party committee and local administration at the commune level to implement state management over local defense work; direct, manage, and operate to fulfill national defense and military tasks in the locality; unify command of armed forces when there are situations concerning national defense in accordance with the law.

3. Training and readiness for combat

a) Take the lead in advising the party committee and local administration at the commune level to organize training, instruction, and combat exercises in the defensive region, civil defense, search and rescue;

b) Take the lead and coordinate with relevant agencies at the same level to develop combat documents and implement combat readiness and combat tasks;

c) Develop plans and organize training for regular forces and Self-Defense Militia in accordance with the combat training plan of the Military Director Board at the provincial level;

d) Organize competitions and participate in competitions at various levels;

đ) Maintain the ability to be ready for combat, serve combat, and engage in combat of local armed forces and Self-Defense Militia under its authority;

e) Coordinate with Public Security, Military units, and other forces in the area in exercises, competitions, serving combat, and engaging in combat; participate in preventing and combating terrorist activities, sabotage, disturbances, riots, maintaining political stability, social order, and safety;

g) Advise and handle situations related to military, national defense, civil defense; prepare all aspects, implement orders, decisions, measures during curfew, martial law, emergency situation in national defense, war situation, partial and total mobilization to meet the requirements of combat and serving combat of the locality.

4. Building forces

a) Build regular forces, including: Implementing decisions of competent authorities on planning, organization, and staffing of the Military Director Board at the commune level; managing and using manpower; implementing policies for relevant subjects in accordance with the law;

b) Build Self-Defense Militia forces, including: Implementing decisions of competent authorities on building forces; organizing training and inspecting activities of Self-Defense Militia forces in the area; training and instructing cadres working in military affairs in agencies, organizations, and localities; implementing policies and other tasks for Self-Defense Militia in accordance with the law;

c) Build reserve mobilization forces, including: Taking the lead and coordinating with relevant agencies, advising the party committee and local administration at the commune level to implement targets and plans for building, mobilizing, and receiving reserve mobilization forces in accordance with decisions of competent authorities; implementing mobilization work for the military and industry in the locality; implementing partial and total mobilization orders in accordance with decisions of competent authorities; managing reserve mobilization sources; coordinating with receiving units and agencies, organizations in the local political system to build and improve the quality of reserve mobilization units;

d) Take the lead in advising the Military Service Council at the commune level on recruitment work; implement military recruitment work; coordinate with relevant agencies and organizations to receive and orient employment for discharged servicemen.

5. Building the defensive region

a) Take the lead and coordinate with relevant agencies and units at the same level to advise and build the defensive region, potential within the defensive region, and activities of forces within the defensive region;

b) Unify command of armed forces to maintain the defensive region in all situations.

6. National defense and security education work

Take the lead and coordinate with relevant agencies and units at the same level to advise the People's Committee at the commune level to establish the National Defense and Security Education Council; manage and organize training on national defense and security knowledge for relevant subjects in accordance with the law; disseminate national defense and security knowledge to the entire population; coordinate with functional agencies to implement national defense and security education in the area.

7. Logistics and technical work

Carry out logistics and technical work in accordance with the provisions; register, manage, and use weapons, technical equipment, explosive materials, support tools, and equipment of the Self-Defense Militia unit under its authority.

8. Coordinate with Public Security, Border Guard, Navy, Coast Guard, Fisheries Surveillance, Forest Rangers, and related agencies and organizations to maintain political security, social order, and safety, prevent crime, protect the area, maritime and island sovereignty, and national borders in accordance with the law and competent authorities.

9. Coordinate with the Vietnam Fatherland Front Committee, related agencies, and organizations at the commune level to publicize and mobilize the people to implement the Party's guidelines and policies, state laws, participate in building comprehensive strong bases, and implement social policies.

10. Perform other tasks in accordance with the law and orders from superiors.

Article 5. Organization of the People's Military Command at the Commune Level

1. The People's Military Command at the commune level consists of the Commandant, Political Instructor (兼任乡党委书记), Deputy Commandant, Deputy Political Instructor, assistants, and technical staff.

2. The Minister of National Defense decides on the organization, staffing, duties, and positions of the People's Military Command at the commune level, ensuring that the total staffing does not increase according to the decision of the competent authority.

Article 6. Funding Assurance

1. Funding for the organization and operation of the People's Military Command at the commune level comes from the state budget and other lawful financial sources as stipulated by law.

2. Local budgets ensure funding for the construction of offices, training grounds, and practice areas; the central budget supports funding for localities facing budgetary difficulties.

Article 7. Responsibilities of Ministries, Equivalent Ministries, and Localities

1. The Ministry of National Defense is responsible before the Government for state management of the People's Military Command at the commune level as prescribed by law.

2. Ministries, equivalent ministries, and people's committees at all levels within their respective duties and authorities shall cooperate with the Ministry of National Defense in managing the People's Military Command at the commune level.

3. The provincial people's committee plans and allocates land funds and finances for the construction of offices, training grounds, and practice areas for the People's Military Command at the commune level.

Article 8. Effective Date

1. This Resolution takes effect from January 26, 2026 until February 28, 2027.

2. During the period this Resolution is effective, where the provisions set out in Article 20, Point d, Clause 1 of Article 23 of the Law on Militia and Self-Defense Forces No. 48/2019/QH14, amended and supplemented by Law No. 98/2025/QH15, and other relevant legal documents conflict with the provisions of this Resolution, they shall be implemented according to this Resolution.

Article 9. Implementation and Responsibility for Enforcement

1. Issue the List of Legal Normative Documents and Articles, Clauses, Points requiring amendment and supplementation attached to this Resolution.

2. The Ministry of National Defense is responsible for implementing this Resolution, monitoring, compiling issues, recommendations, and resolving them according to its authority or reporting to the competent authority as prescribed.

3. The Ministers, Heads of Equivalent Ministries, and Chairpersons of Provincial People's Committees directly under the Central Government are responsible for enforcing this Resolution.
