DECREE

Detailed regulations on the implementation of the Ordinance amending Article 21 of the Ordinance on Preferential Treatment for Revolutionary Activists, Martyrs and Families of Martyrs, War Invalids, Veterans, Anti-War Activists, and Those Who Have Contributed to the Revolution

THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Ordinance amending Article 21 of the Ordinance on Preferential Treatment for Revolutionary Activists, Martyrs and Families of Martyrs, War Invalids, Veterans, Anti-War Activists, and Those Who Have Contributed to the Revolution dated December 1, 1998;

At the proposal of the Minister of Labor, Invalids and Social Affairs,

DECREE:

Article 1. Anti-war activists as defined in Article 1 of the Ordinance amending Article 21 of the Ordinance on Preferential Treatment for Revolutionary Activists, Martyrs and Families of Martyrs, War Invalids, Veterans, Anti-War Activists, and Those Who Have Contributed to the Revolution who have reached the age of 60 for males and 55 for females shall be entitled to monthly allowances or one-time allowances based on their years of participation in the anti-war effort.

Based on the budget capacity, the Ministry of Labor, Invalids and Social Affairs and the Ministry of Finance shall provide specific guidance on the entitlement to one-time allowances.

Article 2. In special cases, anti-war activists who have not yet reached the age of 60 for males and 55 for females may be entitled to one-time allowances based on their years of participation in the anti-war effort, including:

1. Anti-war activists who are war invalids (including those classified as Type B war invalids recognized before December 31, 1993) and those with disabilities due to war injuries or illnesses rated at 81% or higher.

2. Anti-war activists who died from January 1, 1995 onwards.

Article 3. In addition to the subjects specified in Article 2 of this Decree, based on the budget capacity and the circumstances of the anti-war activists, the Ministry of Labor, Invalids and Social Affairs, in coordination with the Ministry of Finance, shall submit to the Government for decision on one-time preferential allowances for other special cases.

Article 4. The amount of allowance for the subjects specified in Articles 1 and 2 of this Decree is as follows:

1. Monthly allowance calculated based on the duration of participation in the anti-war effort, with each year of participation entitling to an allowance of 2,400 VND.

2. One-time allowance calculated based on the duration of participation in the anti-war effort, with each year of participation entitling to an allowance of 120,000 VND.

3. In cases where the duration of participation in the anti-war effort includes months, six months or more will be counted as one year, and less than six months will be counted as half a year.

Article 5. Anti-war activists receiving monthly allowances who are not entitled to salaries, pensions, or long-term disability allowances, upon death, the organization responsible for burial shall be granted funeral expenses and burial fees totaling 1,152,000 VND.

Article 6. Procedures and documents concerning anti-war activists as stipulated in this Decree shall be established by the Department of Labor, Invalids and Social Affairs in the locality where the anti-war activist resides, and submitted to the Chairman of the People's Committee of the province or centrally-administered city for recognition and resolution of benefits.

The Ministry of Labor, Invalids and Social Affairs shall guide and inspect the confirmation of benefits and procedures for archiving documents.

The Ministry of Defense and the Ministry of Public Security shall take the lead in coordinating with the Ministry of Labor, Invalids and Social Affairs to guide and inspect the confirmation of benefits and procedures for archiving documents for anti-war activists under the management of the Ministry of Defense and the Ministry of Public Security.

Article 7. Abolish Article 59 of Decree No. 28/CP dated April 29, 1995 detailing and guiding the implementation of certain provisions of the Ordinance on Preferential Treatment for Revolutionary Activists, Martyrs and Families of Martyrs, War Invalids, Veterans, Anti-War Activists, and Those Who Have Contributed to the Revolution dated August 29, 1994.

Article 8. This Decree shall take effect fifteen days from the date of signature.

Ministers of Ministries, Heads of agencies equivalent to Ministries, Heads of government agencies, and Chairmen of provincial and centrally-administered municipal People's Committees are responsible for implementing this Decree./.
