MINISTER OF HOME AFFAIRS

Pursuant to Decree No. 102/SL-L004 dated May 20, 1957 on the right to establish Associations;

Pursuant to Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decree No. 88/2003/NĐ-CP dated July 30, 2003 of the Government on the organization, operation, and management of Associations;

Considering the proposal of the Chairman of the Vietnam-Belgium Friendship Association and the opinion of the Director of the Department for Non-Governmental Organizations,

DECISION:

Article 1. Approves the Charter of the Vietnam-Belgium Friendship Association which was adopted at the First National Congress on November 15, 2004.

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. The Chairman of the Vietnam-Belgium Friendship Association and the Director of the Department for Non-Governmental Organizations shall be responsible for implementing this Decision./.

CHARTER

VIETNAM-BELGIUM FRIENDSHIP ASSOCIATION

(Issued pursuant to Decision No. 66/2005/QĐ-BNV dated July 5, 2005 of the Ministry of Home Affairs)

 

PART I

PRINCIPLES AND PURPOSES

Article 1. Principles

The Vietnam-Belgium Friendship Association (hereinafter referred to as the Association) is a social organization, a member of the Vietnam Union of Friendship Organizations, operating under the Charter of the Association, the Charter of the Vietnam Union of Friendship Organizations, and complying with the laws of the Socialist Republic of Vietnam.

The Association operates nationwide, has its headquarters in Hanoi, possesses separate assets and accounts, has legal personality, and uses its own seal.

Article 2. Purpose of Operation

The purpose of the Vietnam-Belgium Friendship Association is to contribute to strengthening and expanding friendly relations, mutual understanding between the people of Vietnam and Belgium; serving as a bridge to develop economic, trade, scientific, technological, educational, cultural, and social relations between the people of Vietnam and Belgium.

Chapter II

TASKS OF THE ASSOCIATION

Article 3. The Vietnam-Belgium Friendship Association has the following tasks:

1. Contributing to the dissemination and introduction of Vietnam to the people of Belgium, about the domestic and foreign policies of the Socialist Republic of Vietnam.

2. Organizing and coordinating with state agencies and people's organizations within the country to conduct activities aimed at developing friendly relations between the people of Vietnam and Belgium in accordance with the foreign policy of the Socialist Republic of Vietnam.

3. Contributing to introducing the situation of the country and the people of Belgium to the people of Vietnam.

4. Building and contributing to developing friendly and cooperative relations with Belgian friendship organizations and other social organizations through exchange visits; book and film exchanges, and other activities as prescribed by the laws of both countries.

5. Supporting and promoting economic, trade, scientific, technological, educational, cultural, sports, tourism, etc., cooperation between organizations in Vietnam and partners in Belgium.

6. Publishing publications to serve the activities of the Association in accordance with the law.

Chapter III

MEMBERS

Article 4. Members of the Association

All organizations and Vietnamese citizens who agree with the Charter of the Association, voluntarily submit an application to join the Association, and are approved by the Central Executive Board of the Association will become members of the Association. Organizations will become member organizations, and individuals will become members (hereinafter collectively referred to as members).

Article 5. Responsibilities of Members

1. Adhering to the Charter and implementing resolutions of the Association; actively participating in the Association's activities to maintain and develop friendly relations between the people of Vietnam and Belgium.

2. Widely publicizing the Association among the Vietnamese people to attract new members and expand the scope of the Association's activities.

3. Paying membership fees as prescribed.

Article 6. Rights of members

1. Nomination, recommendation, and election to leadership positions in the Association; discussing, providing opinions, and voting on issues at meetings concerning the work of the Association.

2. Participating in activities organized by the Association, receiving inquiries and assistance from the Association when encountering difficulties.

3. Requesting to leave the Association.

Article 7. Removal and expulsion of members

1. Members wishing to leave the Association must notify the competent authority of the Association in writing to have their name removed from the list of members.

2. Members who act contrary to the Charter and resolutions of the Association will have their names removed from the list of members.

Chapter IV

Article 8. Principles of Organization

Article 8. Organizational principles

The Vietnam-Belgium Friendship Association operates based on the principles of consultation, democracy, and unified action. The Central Executive Board of the Association is elected through democratic consultation. In special cases where elections cannot be held, a temporary Central Executive Board of the Association will be appointed, but not exceeding one term. The leadership bodies of the Association include:

- The General Assembly of all members or the National Congress of the Association.

- The Central Executive Board of the Association.

- The Central Standing Board of the Association.

- The Central Inspection Board of the Association.

Article 9. Organizational Structure of the Association

The organizational structure of the Association includes the Central Association, local associations participating as member associations of the Central Association, Clubs, Centers, and Branches directly under the Central Association.

At the local level, depending on specific requirements and conditions, if there is a need to establish an association, it will be considered and decided by the People's Committee of the province or centrally-administered city.

The Central Association is responsible for guiding local associations in drafting the Charter, organizing, and operating the Association, ensuring consistency in implementing the foreign policy of the Socialist Republic of Vietnam.

Article 10. Leadership Bodies of the Association

The highest leadership body of the Association is the General Assembly of all members or the National Congress of the Association. The General Assembly of all members or the National Congress of the Association convenes every four years, tasked with discussing reports from the Central Executive Board of the Association, adopting resolutions, reviewing and amending the Charter, and electing the Central Executive Board of the Association.

1. The Central Executive Board of the Association is the body responsible for leading all activities of the Association between congresses.

a) The Central Executive Board of the Association consists of: the Chairperson, Vice-Chairpersons, Secretary-General, Standing Board members, and Central Executive Board members.

b) The Central Executive Board of the Association decides on policies and measures to implement the resolutions of the Congress; directs member associations to operate and participate in activities of the Vietnam Union of Friendship Organizations. The Central Executive Board of the Association meets once a year.

2. The Standing Board is appointed by the Central Executive Board of the Association, consisting of the Chairperson, Vice-Chairpersons, Secretariat (which may include a Secretary-General and Secretary), and Standing Board members. The Standing Board meets twice a year and is responsible for

a) Direct the Secretariat to prepare the content of the meetings of the Executive Committee and organize the implementation of the Resolutions of the Congress, the Resolutions of the Central Executive Committee of the Association, and together with the Chairman of the Association to manage the meetings of the Executive Committee.

b) Guide members to implement the Resolutions of the Central Executive Committee of the Association.

c) Resolve complaints, accusations, protect the legitimate rights of members when they are violated, resolve difficult issues for members and member organizations in implementing this Charter.

3. The Secretariat, appointed by the Standing Committee, includes the General Secretary and secretaries, responsible for:

a) Assisting the Standing Committee to prepare the content of the meetings and convening the meetings.

b) Assisting the Standing Committee and the Executive Committee to monitor and support member organizations and members in implementing the Resolutions of the Central Executive Committee of the Association.

c) Managing the assets, infrastructure, documents, and finances of the Association.

4. The Chairman of the Association is responsible for:

a) Leading and managing all activities of the Association; together with the Standing Committee to manage the meetings of the Executive Committee.

b) Representing the Executive Committee to coordinate with sector management agencies to implement activities within the internal and external relations of the Association. Participate in the activities of the Vietnam Friendship Association.

5. Deputy Chairmen assist the Chairman, assigned by the Chairman to handle specific issues and authorized to manage the work of the Executive Committee in the absence of the Chairman.

6. The Audit Board of the Association is appointed by the Central Executive Committee of the Association, the Head of the Audit Board must be a member of the Executive Committee of the Association. The Audit Board is responsible for:

a) Checking the implementation and compliance with the Charter, Resolutions of the Association, and the activities of the Executive Committee.

b) Auditing the finances of the Association.

e) Considering and resolving complaint letters (if any).

7. The Executive Committees of the Associations at provincial and municipal levels and member organizations base on the provisions stipulated in this Charter, based on the Resolutions of the leadership bodies of the Central Executive Committee of the Association to serve as the basis for the content of their organizational activities.

Article 11. Members of the Executive Committee and the Standing Committee of the Association

The number of members of the Central Executive Committee of the Association and member associations is decided by the corresponding level Congresses, including Standing Committee members. The number of people in the Standing Committee shall not exceed one-third of the number of Executive Committee members. The term of office of the Central Executive Committee of the Association is four years. The term of office of the Executive Committees of member associations is determined by the Charter of the member association.

Article 12. System of cooperation within the Association

1. The Central Association coordinates, guides, and supports local member associations in their activities.

2. Local member associations actively operate according to the Charter of the Association, not contrary to the resolutions of the Central Association, quarterly report their work to the Central Association. Local member associations must cooperate and be under the direction of the local friendship organization association (if any).

Chapter V

ASSETS AND FINANCES

Article 13. The financial resources of the Association are formed from the following sources

1. Support from the Vietnam Friendship Association.

2. Membership fees contributed by member organizations and members (to be annually regulated by the Central Executive Committee).

3. Grants from domestic and foreign organizations and individuals in accordance with the provisions of the law.

4. Other lawful revenues.

Article 14. Management and use of the Association's assets and finances

1. The Association's finances are managed by the Association's Secretariat according to the principle of centralized unity and allocated for the Association's activities as prescribed by the Executive Committee's regulations.

2. The use of assets, budget preparation, and financial reporting system of the Association are carried out in accordance with the regulations of the Ministry of Finance.

3. The Association's assets and finances upon merger, division, or dissolution are implemented in accordance with the law.

Chapter VI

REWARD AND DISCIPLINE

Article 15. Awards

Organizations of the Association, member organizations, and members who have many achievements in the Association's activities will be rewarded.

Article 16. Disciplinary Measures

Organizations of the Association, member organizations, and members who operate contrary to the Charter and Resolutions of the Association will be removed from the Association's list.

Chapter VII

ARTICLE IMPLEMENTATION

Article 17. Procedure for amending and supplementing the Charter

Only the General Meeting of all members or the National Congress of the Association has the right to amend and supplement this Charter.

Article 18. Effectiveness

1. All Association organizations, member organizations, and members must comply with this Charter in all activities.

2. This Charter consists of 7 Chapters and 18 Articles, adopted by the First National Congress of the Vietnam-Belgium Friendship Association on November 15, 2004, and becomes effective according to the decision of the Ministry of Home Affairs./.
