Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Law on Fees and Charges;

Pursuant to Decree No. 24/2004/NĐ-CP dated January 14, 2004 of the Government detailing the implementation of certain provisions of the Ordinance on Posts and Telecommunications concerning radio frequency spectrum;

Pursuant to the opinion of the Ministry of Posts and Telecommunications at Circular No. 2418/BBCVT-KHTC dated November 3, 2006 regarding the adjustment of the ratio of state budget revenue from the collection of radio frequency spectrum license fees and usage charges;

At the proposal of the Director of the Enterprise Finance Department.

Article 1. Amending the first paragraph of Article 4 of Decision No. 22/2005/QD-BTC dated April 11, 2005 of the Minister of Finance as follows:

"Each year, the fee and charge collection agency shall remit 40% (forty percent) of the total revenue from radio frequency spectrum fees and charges to the state budget. The fee and charge collection agency is allowed to retain 60% (sixty percent) of the total revenue from radio frequency spectrum fees and charges to cover costs for fee and charge collection according to prescribed regulations and costs for state management of radio frequency spectrum."

Article 2. The Radio Frequency Spectrum Management Agency is responsible for managing and using the retained funds in accordance with Circular No. 95/2003/TT-BTC dated October 10, 2003 of the Ministry of Finance on guiding the financial mechanism for the Radio Frequency Spectrum Management Agency.

Article 3. This Decision takes effect from January 1, 2007.

Other contents not amended or supplemented in this Decision shall continue to be implemented in accordance with Decision No. 22/2005/QD-BTC dated April 11, 2005 of the Minister of Finance./.
