PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Physical Culture and Sports dated November 29, 2006;
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
1. To fully exploit and effectively utilize the potential, infrastructure system, and position of the Region, with Ho Chi Minh City as the leading force, to create a driving force for comprehensive development in the fields of culture, family, physical education and sports, and tourism, thereby promoting the cultural market, physical education and sports activities, and tourism throughout the country and other localities.
DECISION:
Article 1. Position and Functions
1. The General Department of Physical Culture and Sports is an agency under the Ministry of Culture, Sports and Tourism, with the function of advising the Minister of Culture, Sports and Tourism on state management and implementing state management tasks and powers regarding physical culture and sports throughout the country.
2. The General Department of Physical Culture and Sports has legal personality, bears the seal of the National Emblem, is a budgetary unit at level II, and has its own account at the State Treasury.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The General Department of Physical Culture and Sports shall perform the specific tasks and powers as follows:
1. Submit to the Minister of Culture, Sports and Tourism for submission to the Government and the Prime Minister for decision:
a) Draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly, draft resolutions, decrees of the Government on physical culture and sports, and other projects and programs according to the assignment of the Minister of Culture, Sports and Tourism;
b) Strategies, overall plans, national programs for developing physical culture and sports, and important national projects and programs on physical culture and sports; draft decisions, directives of the Prime Minister on physical culture and sports;
c) Negotiations, signing, and joining international treaties on physical culture and sports.
2. Submit to the Minister of Culture, Sports and Tourism for approval and issuance:
a) Long-term, five-year and annual plans for the development of sports and projects and programs on sports;
b) Draft decisions, directives, circulars on physical culture and sports;
c) Regulations on managing mass physical culture and sports activities, sports for persons with disabilities, and recreational sports;
d) Regulations on managing high-performance sports and professional sports;
đ) Regulations on conditions and national technical standards for physical culture and sports facilities, training and competition equipment of physical culture and sports establishments and sports disciplines;
e) Plans for coordinating activities among Ministries, ministerial-level agencies, government agencies, provincial People's Committees, and central political-social organizations and social organizations in carrying out tasks related to physical culture and sports;
g) Specific policies, measures, and guidance on implementing the operational mechanisms of public service organizations in the field of physical culture and sports in accordance with the law.
3) Directing and organizing the implementation of strategies, plans, programs, projects, and proposals on physical culture and sports after approval according to the分级授权的部长文化体育旅游部的规定。
4. Regarding international cooperation:
Directing and organizing the implementation of international treaties, participating in international organizations on physical culture and sports; international cooperation programs and plans on physical culture and sports; implementing international cooperation and integration in the field of physical culture and sports according to the分级授权的文化体育旅游部部长的规定和法律规定。
5. Regarding physical culture and sports for all people:
a) Promoting and mobilizing the people to participate in physical culture and sports activities; guiding methods of physical exercise suitable for age, gender, occupation, health status, and disability condition;
b) Guiding sectors and localities in training and building teams of physical culture and sports instructors and volunteers; coordinating in organizing professional training for grassroots physical culture and sports volunteers;
c) Taking the lead and coordinating with sectors and localities in exploiting and popularizing traditional ethnic sports and health improvement methods both domestically and internationally;

đ) Guiding and organizing inspections and evaluations of the development of mass physical culture and sports activities according to specified criteria.
6. Regarding physical education and sports in schools:
Advising the Minister of Culture, Sports and Tourism to coordinate with the Ministry of Education and Training in implementing tasks:
Regarding physical education and school sports activities:
b) Specifying physical fitness standards and evaluating physical fitness results of students.
c) Train and guide the implementation of policies and systems for physical education and sports teachers and lecturers;
d) Specifying the system of school sports competitions.
c) Organizing training and guiding the implementation of policies for physical education teachers and lecturers;

b) Advising the Minister of Culture, Sports and Tourism to coordinate with the Ministry of National Defense and the Ministry of Public Security in promulgating physical fitness standards in the People's Army and the Public Security Force; organizing training; cultivating coaches, athletes, and specifying sports events within armed forces.
Regarding high-performance sports and professional sports:
Advising the Minister of Culture, Sports and Tourism on managing high-performance sports and professional sports:
a) Guiding the implementation of policies and benefits for athletes, coaches, and referees;
b) Organizing or coordinating the organization of regional, continental, and world sports championships held in Vietnam, national physical culture and sports congresses, and specifying ownership rights for high-performance and professional sports events;
c) Submitting to the Minister of Culture, Sports and Tourism for issuance of regulations on standards, procedures, and formalities for awarding athlete, coach, and referee ranks;
d) Submitting to the Minister of Culture, Sports and Tourism for regulations on procedures and formalities for establishing national sports teams and national teams in each discipline;
đ) Guide the development of training and coaching programs for athletes, coaches, and referees;
e) Guiding the registration of activities of high-performance sports and professional sports establishments;
g) Proposing honors and awards for outstanding athletes and coaches.
9. Organizing and implementing research, application of science, technology, and medicine in the field of physical culture and sports according to the分级授权的文化体育旅游部部长的规定。
10. Implementing management over the activities of associations and non-governmental organizations in the field of physical culture and sports according to the分级授权的文化体育旅游部部长的规定和法律规定。
11. Implement investment projects under the General Department of Physical Education and Sports according to the classification of the Minister of Culture, Sports and Tourism and the provisions of the law;
12. Building and managing databases on physical culture and sports; organizing the production of promotional products for physical culture and sports activities both domestically and internationally according to the assignment of the Minister of Culture, Sports and Tourism.
13. Implementing administrative reform according to the objectives and contents of the administrative reform program approved by the Minister of Culture, Sports and Tourism.
14. Implement inspection work, coordinate with audits, prevent and combat corruption, waste, and negative practices, and handle violations of laws in the field of physical education and sports according to the分级权限的部长的文化体育旅游部的规定和法律规定。
15. Manage organizational structure, staffing, implement salary systems, and待遇、奖励、惩罚制度对体育总局体 dục体 thao下属的干部、公务员、职员和员工;根据文化体育旅游部部长的分级权限和法律规定,与干部、公务员、职员以及从事体育工作的人员进行培训和提升。
16. Manage finances, assets assigned, and implement budgets allocated according to the provisions of the law;
17. Perform other tasks and authorities delegated by the Minister of Culture, Sports and Tourism.

7. Institute of Physical Education and Sports Science.

9. Vietnam Sports Newspaper.
10. National Sports Complex.
11. National Training Center for Physical Culture and Sports in Hanoi.
12. National Training Center for Physical Culture and Sports in Ho Chi Minh City.
13. National Training Center for Physical Culture and Sports in Da Nang.
14. National Training Center for Physical Culture and Sports in Can Tho.
15. Sports Information Center.
16. Ba Dinh Sports Center;
17. Vietnam Sports Hospital;
18. Vietnam Sports and Tourism Film Center.
The Mass Sports Department, the High Performance Sports Department, and the Office shall be organized into divisions.
In this Article, organizations from Clause 1 to Clause 6 are administrative organizations assisting the General Director in performing state management functions; organizations from Clause 7 to Clause 18 are affiliated public service units under the General Department of Physical Education and Sports (as stipulated in Decision No. 149/QĐ-TTg dated February 4, 2008 of the Prime Minister on public service units under the Ministry of Culture, Sports and Tourism).
The Minister of Culture, Sports and Tourism shall submit to the Prime Minister for decision on establishment, renaming, dissolution, restructuring, and reorganization of administrative organizations under the General Department of Physical Education and Sports.
The Minister of Culture, Sports and Tourism shall decide on the establishment, dissolution, restructuring, and reorganization of other affiliated public service units under the General Department of Physical Education and Sports in accordance with the law.
Article 4. Leadership
1. The Sports Administration has a Director General and not more than three Deputy Directors General.
2. The General Director and Deputy General Directors shall be appointed, relieved of duty, transferred, or reassigned by the Minister of Culture, Sports and Tourism in accordance with the law.
3. The General Director of the General Department of Physical Education and Sports shall define the functions, tasks, authorities, and organizational structures of organizations and units under the General Department of Physical Education and Sports.
4. The General Director of the General Department of Physical Education and Sports shall be responsible before the Minister of Culture, Sports and Tourism and the law for all activities of the General Department of Physical Education and Sports. Deputy General Directors of the General Department of Physical Education and Sports shall be responsible before the General Director of the General Department of Physical Education and Sports and the law for the areas of work they are assigned to manage.
Article 5. Effectiveness and Responsibility for Implementation
1. This Decision shall take effect fifteen days after its publication in the Official Gazette.
2. The Minister of Culture, Sports and Tourism, ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, chairpersons of provincial people's committees directly under the central government, and the General Director of the General Department of Physical Education and Sports shall be responsible for implementing this Decision./.
