Pursuant to the Law on Organization of the Government dated December 25, 2001;

The Governor of the State Bank of Vietnam issues this Circular amending and supplementing some articles of Circular No. 10/2015/TT-NHNN dated July 22, 2015, issued by the Governor of the State Bank of Vietnam guiding the implementation of certain contents of Decree No. 55/2015/NĐ-CP dated June 9, 2015, of the Government on credit policies to serve the development of agriculture and rural areas.

At the request of the Minister of Agriculture and Rural Development,

Inspection the Prime Minister issues this Decision to stipulate criteria,hproceduresonfor recognizing high-tech agriculture zones. áp dụng công nghệ cao.

Article 1. Scope and Applicability

Article 1. This Decision stipulates criteria, authority, procedures, and formalities for recognizing high-tech agriculture zones.

Article 2. This Decision applies to agencies, organizations, and individuals related to the recognition of high-tech agriculture zones in Vietnam.

Article 3. Criteria for determining high-tech agriculture zones

A high-tech agriculture zone is a concentrated production area that applies advanced technology in agriculture to produce one or several agricultural products with regional advantages, ensuring high productivity, quality, added value, and environmental friendliness as prescribed by law. A high-tech agriculture zone must meet the following criteria:

Point 1. Organized production and product consumption linked through value chains; there must be a central organization within the region, such as a business enterprise, cooperative, or cooperative federation operating within the region, which signs contracts to implement value chain linkages in the region's agricultural production.

Point 2. Products produced in the zone are commodity products with regional advantages, focusing on the following groups of products:

a) High-yielding and high-quality crop, livestock, and aquaculture seeds with superior resistance capabilities;

b) Agricultural, forestry, and aquatic products with high added value and economic efficiency; product quality meeting international, regional, or national standards (Viet GAP).

Point 3. Applied technologies include advanced technologies and biotechnologies in seed selection, propagation, and disease control for crops and livestock; intensive farming, super-intensive farming, deep processing to increase added value; automation and semi-automation technologies; information technology, remote sensing, and environmentally friendly technologies. These technologies are applied on an industrial scale, enhancing production efficiency, increasing product value, and boosting labor productivity.

Point 4. A high-tech agriculture zone is a specialized cultivation area, contiguous within the administrative boundaries of a province, with suitable natural conditions, relatively complete technical infrastructure including transportation, irrigation, electricity, facilitating commodity production, and aligning with the overall development planning of the industry and locality.

Point 5. Production subjects and scale of the zone:

a) Flower production with a minimum area of 50 hectares;

b) Safe vegetable production with a minimum area of 100 hectares;

c) Rice seed production with a minimum area of 100 hectares;

d) Propagation and production of edible mushrooms and medicinal mushrooms with a minimum area of 5 hectares;

e) Perennial fruit trees with a minimum area of 300 hectares;

f) Perennial industrial crops (tea, coffee, pepper) with a minimum area of 300 hectares;

g) Aquaculture: Seed production with a minimum area of 20 hectares; commercial farming with a minimum area of 200 hectares;

h) Dairy cattle farming with a minimum number of 10,000 heads/year; beef cattle farming with a minimum number of 20,000 heads/year;

i) Pork meat farming with a minimum number of 40,000 heads/year; pig breeding (sows) with a minimum number of 2,000 heads/year;

j) Poultry farming with a minimum number of 50,000 heads/batch.

Article 3. Competence to Recognize High-Tech Agriculture Zones

The People's Committee of the province or centrally governed city is the authority responsible for deciding to recognize high-tech agriculture zones.

Article 4. Procedures and Formalities for Recognizing High-Tech Agriculture Zones

1. The lead organization of the zone shall prepare a dossier to request recognition of the high-tech agriculture zone and submit it directly or through postal service to the Department of Agriculture and Rural Development with ten sets of dossiers, including one original set and nine copies. The dossier includes:

a) A request for recognition of the high-tech agriculture zone;

b) An explanatory document on the high-tech agriculture zone meeting the criteria specified in Article 2 of this Decision.

2. Within five working days from the date of receipt of the dossier, the Department of Agriculture and Rural Development shall be responsible for checking and notifying in writing the requesting organization about the validity of the dossier. The time for supplementing and amending the dossier is thirty days from the date of receiving the notification letter.

3. Within thirty working days from the date of receipt of a valid dossier requesting recognition of the high-tech agriculture zone, the Department of Agriculture and Rural Development shall be responsible for organizing an assessment and submitting to the People's Committee of the province or centrally governed city for a decision to recognize the high-tech agriculture zone. In case of refusal to recognize, the reasons must be notified in writing to the requesting organization.

Article 5. Revocation of the Decision to Recognize High-Tech Agriculture Zones

The People's Committee of the province or centrally governed city shall issue a decision to revoke the recognition of the high-tech agriculture zone if it no longer meets one of the criteria stipulated in Article 2 of this Decision.

Article 6. Implementation Organization

1. The Ministry of Agriculture and Rural Development is responsible for guiding, urging, inspecting, compiling, and reporting to the Prime Minister on the implementation of this Decision.

2. Provincial People's Committees directly under the Central Government

a) Recognition and revocation of the decision to recognize high-tech agriculture zones;

b) Urging, inspecting, auditing, and supervising the implementation of this Decision at local levels; directly managing the activities of recognized high-tech agriculture zones at local levels;

c) Reporting periodically every six months or at any time upon request to the Ministry of Agriculture and Rural Development on the implementation of this Decision and any issues arising during its implementation for compilation and reporting to the Prime Minister.

Article 7. Implementation Provisions

1. This Decision takes effect from February 10, 2016.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally governed city People's Committees, and related agencies are responsible for implementing this Decision./.
