Regarding the functions, tasks, powers, and organizational structure of the National Reserve Agency
THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of Ministries and ministerial-level agencies;
Based on Decree No. 35/CP dated May 27, 1995 of the Government on establishing the National Reserve Agency under the Government;
Considering the proposal of the Director of the National Reserve Agency and the Minister, Head of the Government Organizational Structure - Civil Servants Board,
DECREE:
Article 1. The National Reserve Agency is an agency under the Government, performing the function of state management over all national reserve activities and directly managing certain items of national reserves according to the division of labor by the Government.
Article 2. The National Reserve Agency performs the tasks and powers stipulated in Article 21 of Decree No. 15/CP dated March 2, 1993 of the Government and the following specific tasks and powers:
1. Submitting draft laws, ordinances, strategies, plans, policies, and management systems for national reserves to the Government, and guiding, directing, and inspecting the implementation of these matters after approval.
2. Issuing regulations on management rules, procedures, norms, standards, and economic-technical quotas within the field of national reserves, and inspecting the implementation of such documents.
3. Compiling the demand for materials and goods for national reserves and coordinating with relevant agencies (State Planning Commission, Ministry of Finance, and other Ministries assigned by the Government to manage national reserves) to establish, balance, and allocate financial resources for national reserves in the annual State plan for submission to the Government for decision.
4. Organizing inspections and audits of the management of national reserve goods by agencies assigned by the Government to manage them. Having the right to request agencies managing national reserves to report periodically or at short notice on the situation of national reserve management within their respective agencies for consolidation and reporting to the Prime Minister.
5. Organizing research and application of advanced technologies and scientific techniques in the field of preservation and management of national reserves; gradually modernizing the warehouse system, equipment, and preservation technology for national reserve goods.
6. Directing the implementation of purchasing, selling, preserving, exporting, and importing national reserve goods assigned by the Government to be managed directly by the Agency. Being authorized to directly import and export certain items serving national reserves according to decisions of the Prime Minister.
7. Organizing international cooperation in the field of national reserves as prescribed by the Government.
8. Developing plans and organizing the implementation of training and professional development for staff in the national reserve sector.
9. Managing the organizational structure, public service units, state-owned enterprises, staffing, assets, and finances of the Agency according to the provisions of the Government.
Article 3. The organizational structure of the National Reserve Agency includes:
A. Organizations assisting the Director in performing state management functions:
National Reserve Policy Board.
Planning Board.
Financial and Accounting Board.
Preservation Technology Board.
Basic Construction Board.
Organization and Civil Servants Board.
Inspection.
Office.
B. Regional Reserve Goods Management Branches.
C. Public Service Organizations:
Science and Technology Preservation Center.
Training and Cadre Development School.
The Director of the National Reserve Agency shall define the functions, tasks, powers, and organizational structure of the above subordinate units.
Article 4. The National Reserve Agency is led by the Director and assisted by Deputy Directors. The Director and Deputy Directors are appointed and relieved of duty by the Prime Minister upon the recommendation of the Minister, Head of the Government Organizational Structure - Civil Servants Board.
Article 5. This Decree takes effect from the date of issuance. Decree No. 236-TTg dated May 12, 1994 of the Prime Minister and other previous regulations contrary to this Decree are abolished.
The Director of the National Reserve Agency, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial People's Committees under central jurisdiction are responsible for implementing this Decree./.
