ORGANIZATION OF THE NATIONAL ASSEMBLY

Pursuant to Chapter VI of the 1992 Constitution of the Socialist Republic of Vietnam, this Law stipulates on the organization and operation of the National Assembly, the Standing Committee of the National Assembly, the Councils and Committees of the National Assembly; the tasks and powers of the National Assembly deputies.

 

PART I

GENERAL PROVISIONS

Article 1

The National Assembly is the highest representative body of the people and the highest state power organ of the Socialist Republic of Vietnam.

The National Assembly is the sole organ with the authority to enact and amend the Constitution and laws.

The National Assembly decides on fundamental policies regarding domestic and foreign affairs, economic and social tasks, national defense, security, the main principles of the organization and operation of the state apparatus, social relations, and the activities of citizens;

The National Assembly exercises the highest supervisory power over all activities of the State.

Article 2

The National Assembly has the following tasks and powers:

1- Enact and amend the Constitution; enact and amend laws; decide on the legislative program for laws and ordinances;

2- Exercise the highest supervisory power over the implementation of the Constitution, laws, and resolutions of the National Assembly; examine reports on the activities of the President, the Standing Committee of the National Assembly, the Government, the Supreme People's Court, and the Supreme People's Procuracy;

3- Decide on the national socio-economic development plan;

4- Decide on the national financial and monetary policy; approve the State budget and its allocation, approve the final accounts of the State budget, and prescribe, amend, or abolish taxes;

5- Decide on the national ethnic policy;

6- Prescribe the organization and operation of the National Assembly, the President, the Government, the People's Courts, the People's Procuracies, and local administrations;

7- Elect, appoint, and remove the President, Vice Presidents, Chairperson of the National Assembly, Vice Chairpersons of the National Assembly, members of the Standing Committee of the National Assembly, the Prime Minister, the Chief Justice of the Supreme People's Court, and the Chief Prosecutor of the Supreme People's Procuracy; approve the President's proposal on the establishment of the National Defense and Security Council; approve the Prime Minister's proposal on the appointment, removal, or dismissal of Deputy Prime Ministers, Ministers, and other members of the Government;

8- Decide on the establishment and abolition of Ministries and agencies equivalent to Ministries under the Government; establish new, merge, divide, or adjust provincial and centrally-administered city boundaries; establish or dissolve special administrative-economic units;

9- Abolish documents issued by the President, the Standing Committee of the National Assembly, the Government, the Prime Minister, the Supreme People's Court, and the Supreme People's Procuracy that contravene the Constitution, laws, and resolutions of the National Assembly;

10- Decide on general amnesty;

11- Prescribe ranks and grades in the People's Armed Forces, diplomatic ranks and other state ranks; prescribe orders, medals, and state honorary titles;

12- Decide on fundamental policies regarding foreign affairs; approve or rescind international treaties signed or joined upon the President's proposal;

13- Decide on issues of war and peace; prescribe emergency situations and other special measures to ensure national defense and security;

14- Decide on referendums;

Article 3

The National Assembly operates and functions according to the principle of democratic centralism; works in plenary sessions and decides by majority.

The effectiveness of the National Assembly's operations is ensured through the effectiveness of its sessions, the activities of the Standing Committee of the National Assembly, Councils, Committees, Delegations of National Assembly deputies, and individual National Assembly deputies.

Article 4

When performing their duties and powers, the National Assembly, the Standing Committee of the National Assembly, Councils, Committees, and National Assembly deputies rely on the participation of the Vietnam Fatherland Front, social organizations, and citizens.

State agencies, social organizations, economic organizations, and armed forces units, within their functions and responsibilities, have the duty to create conditions for Councils, Committees, and National Assembly deputies to perform their duties.

PART II

THE CHAIRPERSON OF THE NATIONAL ASSEMBLY AND THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

Article 5

The Standing Committee of the National Assembly consists of the Chairperson of the National Assembly, Vice Chairpersons of the National Assembly, and members, with the Chairperson of the National Assembly serving as Chairman, and the Vice Chairpersons of the National Assembly serving as Vice Chairmen.

Members of the Standing Committee of the National Assembly cannot concurrently be members of the Government and must work on a full-time basis.

The term of office of the Standing Committee of the National Assembly coincides with the term of the National Assembly. When the National Assembly's term ends, the Standing Committee of the National Assembly continues to perform its duties until the newly elected National Assembly elects a new Standing Committee.

Article 6

The Standing Committee of the National Assembly has the following tasks and powers:

1- Announce and preside over the election of National Assembly deputies;

2- Organize the preparation, convening, and presiding over National Assembly sessions;

3- Interpret the Constitution, laws, and ordinances;

4- Issue ordinances on matters delegated by the National Assembly;

5- Supervise the enforcement of the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly; supervise the activities of the Government, the Supreme People's Court, and the Supreme People's Procuracy; suspend the enforcement of documents issued by the Government, the Prime Minister, the Supreme People's Court, and the Supreme People's Procuracy that contravene the Constitution, laws, and resolutions of the National Assembly, and submit to the National Assembly for decision on the annulment of such documents; annul documents issued by the Government, the Prime Minister, the Supreme People's Court, and the Supreme People's Procuracy that contravene ordinances and resolutions of the Standing Committee of the National Assembly;

6- Supervise and guide the activities of People's Councils; abolish erroneous resolutions of provincial and centrally-administered city People's Councils; dissolve provincial and centrally-administered city People's Councils if they cause serious damage to the interests of the people;

7- Direct, coordinate, and harmonize the activities of the Ethnic Council and Committees of the National Assembly; guide and ensure the conditions for the activities of National Assembly deputies;

8- During periods when the National Assembly is not in session, approve the Prime Minister's proposal on the appointment, removal, or dismissal of Deputy Prime Ministers, Ministers, and other members of the Government, and report to the National Assembly at the next session;

9- During periods when the National Assembly is not in session, decide on declaring a state of war when the country is invaded and submit the decision to the National Assembly for approval at the next session;

10- Decide on general mobilization or partial mobilization; declare a state of emergency nationwide or in specific regions;

11- Conduct foreign relations on behalf of the National Assembly;

12- Organize referendums according to the decision of the National Assembly.

The Chairman of the National Assembly has the following duties and powers:

1- Chair sessions of the National Assembly, ensure the implementation of the Representative Rules of the National Assembly and the Internal Regulations of the National Assembly's Sessions; sign to certify laws and resolutions of the National Assembly;

2- Lead the work of the Standing Committee of the National Assembly; direct the preparation, convening, and chairing of sessions of the Standing Committee of the National Assembly;

3- Convene and chair meetings with the Chairman of the National Ethnic Council and the Heads of the National Assembly's Committees to discuss the program of activities of the National Assembly, the Ethnic Council, and the Committees; attend sessions of the Ethnic Council and the National Assembly's Committees when deemed necessary;

4- Maintain relations with National Assembly representatives;

5- Direct and organize the implementation of the National Assembly's budget;

6- Direct the implementation of the National Assembly's external affairs; represent the National Assembly in external relations; lead the activities of the National Assembly delegation in the World Parliamentary Union;

The Vice Chairpersons of the National Assembly assist the Chairperson in performing tasks as assigned by the Chairperson.

Article 8

The Standing Committee of the National Assembly directs, coordinates, and harmonizes the activities of the National Ethnic Council and the National Assembly's Committees; convenes and chairs sessions of the National Assembly.

In preparing for the National Assembly session, the Standing Committee of the National Assembly has the following responsibilities and authorities:

1- Propose the agenda for the session based on the suggestions of the State President, the Prime Minister, the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, the National Ethnic Council, the National Assembly's Committees, and National Assembly representatives;

2- Direct, coordinate, and harmonize the activities of relevant agencies in preparing the session's content; review the preparation of draft laws, reports, and other projects to be submitted to the National Assembly;

3- Decide on other issues related to the National Assembly session.

Article 9

The Standing Committee of the National Assembly submits to the National Assembly for approval the legislative construction program and ordinances according to the proposals of agencies, organizations, and individuals entitled to submit draft laws as stipulated in Article 62 of this Law.

Article 10

The Standing Committee of the National Assembly promulgates ordinances based on the legislative program already approved by the National Assembly;

Agencies, organizations, and individuals entitled to submit draft laws to the National Assembly also have the right to submit draft ordinances to the Standing Committee of the National Assembly.

Draft ordinances must be reviewed by the National Ethnic Council or the relevant Committee of the National Assembly before being submitted to the Standing Committee of the National Assembly. When deemed necessary, the Standing Committee of the National Assembly decides to seek opinions from National Assembly representatives before approving the draft ordinance.

 

Article 11

The Standing Committee of the National Assembly supervises the activities of the Government, the Supreme People's Court, and the Supreme People's Procuracy in implementing the Constitution, laws, ordinances, and resolutions of the National Assembly and the Standing Committee of the National Assembly.

The Standing Committee of the National Assembly decides on the quarterly and annual supervision programs; implements these programs itself or through the National Ethnic Council and relevant Committees of the National Assembly; reviews and discusses reports and recommendations in the supervision activities; requests individuals, organizations, and relevant state agencies to implement recommendations deemed necessary by the Standing Committee of the National Assembly.

Article 12

The Standing Committee of the National Assembly supervises and guides the activities of the People's Councils; itself or upon the proposal of the Prime Minister, the Procurator General of the Supreme People's Procuracy, the National Ethnic Council, the National Assembly's Committees, or National Assembly representatives, revoke incorrect resolutions of provincial and central city People's Councils; dissolve provincial and central city People's Councils if they cause serious damage to the interests of the people.

Article 13

The Standing Committee of the National Assembly itself or upon the proposal of the National Defense and Security Council, the National Assembly's Committees, or National Assembly representatives, annul documents of the Government, the Prime Minister, the Supreme People's Court, and the Supreme People's Procuracy that contravene ordinances and resolutions of the Standing Committee of the National Assembly; suspend the implementation of documents of the Government, the Prime Minister, the Supreme People's Court, and the Supreme People's Procuracy that contravene the Constitution, laws, and resolutions of the National Assembly, and submit to the National Assembly for approval the decision to annul at the nearest session.

Article 14

During the period when the National Assembly is not in session, the Standing Committee of the National Assembly approves the Prime Minister's proposal regarding the appointment, dismissal, and removal of Deputy Prime Ministers, Ministers, and other members of the Government, and report to the National Assembly at the nearest session.

Article 15

During the period when the National Assembly is not in session, upon the proposal of the National Defense and Security Council, decide on declaring a state of war when the country is invaded and submit to the National Assembly for approval at the nearest session; decide on general mobilization or partial mobilization, declare a state of emergency nationwide or in specific localities.

Article 16

Between two National Assembly sessions, the Standing Committee of the National Assembly examines the responses of the Prime Minister and other members of the Government, the Chief Justice of the Supreme People's Court, and the Procurator General of the Supreme People's Procuracy to questions and the implementation of recommendations from the National Ethnic Council, the National Assembly's Committees, and National Assembly representatives.

Article 17

The Standing Committee of the National Assembly meets at least once a month. The National Assembly Chairperson proposes the work agenda, directs the preparation, convening, and chairing of Standing Committee sessions.

Session documents must be sent to Standing Committee members at least seven days before the meeting date.

Article 18

The Standing Committee of the National Assembly operates under a conference system and decides by majority. Ordinances and resolutions of the Standing Committee of the National Assembly must be approved by more than half of the total number of Standing Committee members. Ordinances and resolutions must be published no later than fifteen days from the date of approval, except when the State President submits them to the National Assembly for reconsideration.

CHAPTER III

THE NATIONAL ETHNIC COUNCIL AND THE NATIONAL ASSEMBLY'S COMMITTEES

Article 19

The National Ethnic Council and the National Assembly's Committees are organs of the National Assembly responsible for reviewing draft laws, proposals on laws, draft ordinances, and other projects; reviewing reports assigned by the National Assembly or the Standing Committee of the National Assembly; submitting opinions to the National Assembly and the Standing Committee of the National Assembly on the legislative construction program and ordinances; exercising oversight rights and making recommendations on matters within their duties and powers.

Article 20

The National Ethnic Council has the following duties and powers:

1- Review draft laws, proposals on laws, draft ordinances, and other projects related to ethnic issues;

2- Supervise the implementation of laws, ordinances, resolutions of the National Assembly and the Standing Committee of the National Assembly in the field of ethnicity, programs, plans for economic and social development in mountainous areas and regions with ethnic minority populations, and the implementation of budgets in this field;

3- Propose to the National Assembly issues concerning ethnic policies, economic and social development in mountainous areas and regions with ethnic minority populations.

Article 21

The National Assembly establishes the following committees:

1- Legal Affairs Committee;

2- Economic and Budget Committee;

3- National Defense and Security Committee;

4- Culture, Education, Youth, Children, and Adolescents Committee;

5- Social Issues Committee;

6- Science, Technology, and Environment Committee;

7- Foreign Relations Committee.

Article 22

When necessary, the National Assembly may establish a temporary committee to study and review a draft or investigate a specific issue.

Article 23

The Legal Affairs Committee has the following tasks and powers:

1- Review draft laws, proposals on laws, draft ordinances regarding state organization and machinery, criminal, civil, administrative matters, legislative programs and ordinances, and other projects assigned by the National Assembly and the Standing Committee of the National Assembly; participate in reviewing projects reviewed by the Ethnic Council or other committees of the National Assembly to ensure constitutional and legal validity and consistency of the legal system;

2- Review proposals for establishing, abolishing ministries and agencies at ministerial level; merging, dividing, establishing new, and adjusting provincial and central city boundaries;

3- Supervise the implementation of laws, ordinances, resolutions of the National Assembly and the Standing Committee of the National Assembly in the fields of state organization and machinery, criminal, civil, and administrative matters; supervise the issuance of government resolutions, decrees; decisions and directives of the Prime Minister; guiding documents of the Supreme People's Court and the Supreme People's Procuracy on the application of laws in supervisory and trial activities; supervise the activities of the Supreme People's Court and the Supreme People's Procuracy;

4- Propose necessary measures to perfect the legal system.

"d) Within no more than one working day from the date of receiving the dossier submitted for administrative procedures by the specialized agency assigned by the Provincial People's Committee, the Chairman of the Provincial People's Committee shall issue a notification of the result of the inspection of plant-based food exports or a certificate at the request of the importing country."

The Economic and Budget Committee has the following tasks and powers:

1- Review draft laws, proposals on laws, draft ordinances, and other projects in the fields of economic management, business operations, budget, finance, and currency;

2- Review development plans, state budget estimates, and state budget allocations; reports of the Government on the implementation of economic and social development plans, state budgets, and final accounts of state budgets;

3- Supervise the implementation of laws, ordinances, resolutions of the National Assembly and the Standing Committee of the National Assembly in the fields of economic management, business operations, budget, finance, and currency; supervise the Government's activities in implementing national plans for economic and social development and state budgets;

4- Propose to the National Assembly issues concerning economic development plans, economic management, budget, finance, and currency.

Article 25

The National Defense and Security Committee has the following tasks and powers:

1- Review draft laws, proposals on laws, draft ordinances, and other projects in the fields of national defense and security;

2- Supervise the implementation of laws, ordinances, resolutions of the National Assembly and the Standing Committee of the National Assembly in the fields of national defense and security; supervise the implementation of national defense and security tasks and the implementation of budgets in these fields;

3- Propose to the National Assembly issues concerning national defense and security policies, necessary measures to implement the tasks and powers of the National Assembly and the Standing Committee of the National Assembly in the fields of national defense and security.

Article 26

The Culture, Education, Youth, Children, and Adolescents Committee has the following tasks and powers:

1- Review draft laws, proposals on laws, draft ordinances, and other projects in the fields of culture, education, information, sports, youth, children, and adolescents;

2- Supervise the implementation of laws, ordinances, resolutions of the National Assembly and the Standing Committee of the National Assembly in the fields of culture, education, youth, children, and adolescents; supervise the implementation of cultural and educational policies in national economic and social development plans; policies towards youth, children, and adolescents and the implementation of budgets in these fields;

3- Propose to the National Assembly issues concerning national cultural and educational development; policies towards youth, children, and adolescents.

Article 27

The Social Issues Committee has the following tasks and powers:

1- Review draft laws, proposals on laws, draft ordinances, and other projects in the fields of social issues;

2- Supervise the implementation of laws, ordinances, resolutions of the National Assembly and the Standing Committee of the National Assembly in the fields of social issues; supervise the implementation of social policies in national economic and social development plans and the implementation of budgets in these fields;

3- Propose to the National Assembly measures to address social issues.

Article 28

The Science, Technology, and Environment Committee has the following tasks and powers:

1- Review draft laws, proposals on laws, draft ordinances, and other projects in the fields of science, technology, and environmental protection;

2- Supervise the implementation of laws, ordinances, resolutions of the National Assembly and the Standing Committee of the National Assembly in the fields of science, technology, and environmental protection; supervise the implementation of policies for the development of science, technology, and environmental protection in national economic and social development plans and the implementation of budgets in these fields;

3- Propose to the National Assembly investment policies for the development of science, technology, and environmental protection.

Article 29

The Foreign Relations Committee has the following tasks and powers:

1- Review draft laws, proposals on laws, draft ordinances, and other projects in the fields of state foreign affairs, public and private international law; reports of the Government on foreign affairs work submitted to the National Assembly;

2- Supervise the implementation of laws, ordinances, resolutions of the National Assembly and the Standing Committee of the National Assembly in the field of foreign affairs; supervise the activities of the Government in implementing the State's foreign policy; foreign activities of sectors and localities.

3- Implement and assist the National Assembly in conducting external relations with the National Assemblies of other countries and the World Assembly of Parliaments;

4- Propose to the National Assembly issues related to the State's foreign policy, relations with the National Assemblies of other countries, with the World Assembly of Parliaments, and with international organizations.

Article 30.

The program of activities of the National Ethnic Council and the Committees of the National Assembly shall be decided by the Council and the Committees based on the Constitution, laws, ordinances, and resolutions of the National Assembly and the Standing Committee of the National Assembly, and according to the guidance and coordination of the Standing Committee of the National Assembly.

Article 31

The National Ethnic Council and the Committees of the National Assembly have the right to request members of the Government, the President of the Supreme People's Court, the Procurator-General of the Supreme People's Procuracy, and relevant state officials to provide documents or appear to present matters that the Council or the Committee examines or audits. The person receiving the request from the Council or the Committee of the National Assembly must comply with the request.

Article 32

When necessary, the National Ethnic Council and the Committees of the National Assembly may send their members to relevant agencies or organizations to investigate and examine matters of concern to the Council or the Committee. Relevant agencies and organizations have the responsibility to create conditions for members of the Council or the Committee to perform their tasks.

Article 33

The National Ethnic Council and the Committees of the National Assembly have the right to propose to the Prime Minister and other members of the Government, the President of the Supreme People's Court, the Procurator-General of the Supreme People's Procuracy, and the Chairmen of Provincial People's Councils directly under the central government about issues within the duties and powers of the Council and the Committee. The person receiving the proposal must consider and respond within the latest period of fifteen days from the date of receipt of the proposal. If the person receiving the proposal does not respond beyond this period or if the Council or the Committee does not agree with the content of the response, then the Council or the Committee has the right to propose to the Chairman of the National Assembly to request a response at a session of the Standing Committee of the National Assembly or at the nearest session of the National Assembly.

Article 34

The National Ethnic Council and the Committees of the National Assembly establish sub-committees to study and prepare issues within the scope of activities of the Council and the Committee. The head of the sub-committee must be a member of the Council or the Committee, while other members may not necessarily be members of the Council or the Committee or representatives of the National Assembly.

PART IV

NATIONAL ASSEMBLY DEPUTY

Article 35

A National Assembly representative is a person representing the will and aspirations of the people, not only representing the people in the constituency electing them but also representing the people nationwide; they are a person acting on behalf of the people to exercise state power in the National Assembly.

Article 36

The term of office of each National Assembly representative begins from the first session of that National Assembly term until the first session of the subsequent National Assembly term.

The term of office of a National Assembly representative elected to fill a vacancy starts from the session following the supplementary election until the first session of the subsequent National Assembly term.

Article 37

Among the National Assembly representatives, there are those who work on a full-time basis and those who work on a part-time basis. The number of National Assembly representatives working on a full-time basis is determined by the National Assembly.

Article 38

National Assembly Deputies are accountable to voters and simultaneously accountable to the National Assembly for the performance of their representative duties.

National Assembly representatives must set an example in complying with the Constitution and laws, lead a healthy life, respect public conduct rules, protect the rights and legitimate interests of citizens, and contribute to enhancing the people's mastery.

National Assembly representatives have the duty to disseminate and popularize laws, encourage the people to comply with laws, and participate in state management.

Article 39

National Assembly representatives have the duty to attend sessions of the National Assembly, participate in discussions and decisions on issues within the duties and powers of the National Assembly as stipulated in Article 1 and Article 2 of this Law.

Article 40

During the sessions of the National Assembly, representatives have the duty to participate in plenary sessions of the National Assembly; meetings of the Councils, Committees of the National Assembly, groups or Delegations of National Assembly representatives; discuss and vote on issues listed in the session agenda.

Article 41

National Assembly representatives have the right to submit draft laws, proposals for laws before the National Assembly, and draft ordinances before the Standing Committee of the National Assembly according to procedures and formalities prescribed by law.

Article 42 |||

National Assembly representatives have the right to question the President of the State, the Chairman of the National Assembly, the Prime Minister, and other members of the Government, the President of the Supreme People's Court, and the Procurator-General of the Supreme People's Procuracy. The person being questioned must answer the questions raised by the National Assembly representatives.

During the time the National Assembly is in session, National Assembly representatives may send questions to the Chairman of the National Assembly. The person being questioned must answer before the National Assembly at that session. In cases requiring investigation, the National Assembly may decide to answer before the Standing Committee of the National Assembly or at the next session of the National Assembly or by written response.

Between sessions of the National Assembly, questions are sent to the Standing Committee of the National Assembly to forward to the agency or person being questioned and to determine the deadline for answering the questions.

If the representative disagrees with the content of the answer, they have the right to request the Chairman of the National Assembly to bring it up for discussion before the National Assembly or the Standing Committee of the National Assembly.

When necessary, the National Assembly or the Standing Committee of the National Assembly may issue a resolution regarding the answer to the question and the responsibility of the person being questioned.

1. The "Labor Medal" second class shall be awarded or posthumously awarded to individuals meeting one of the following criteria:

National Assembly representatives must maintain close contact with voters, be subject to voter supervision, frequently meet with voters, understand their thoughts and aspirations; collect and truthfully reflect the opinions of voters to the National Assembly and relevant state agencies.

At least once a year, representatives must report to voters on the performance of their representative duties. Voters can directly or through the Fatherland Front request representatives to report on their work and may comment on the performance of National Assembly representatives.

Article 44 |||

When receiving petitions, complaints, or denunciations from the people, members of the National Assembly have the responsibility to study them, transfer them to relevant agencies, urge and monitor their resolution. Relevant state agencies must inform members of the National Assembly about the results of resolving such petitions, complaints, or denunciations.

If they find that the resolution of petitions, complaints, or denunciations is unsatisfactory, members of the National Assembly have the right to meet with the head of the relevant agency to understand and request reconsideration. In necessary cases, members of the National Assembly have the right to request the higher-level agency's head to resolve the matter.

Members of the National Assembly have the responsibility to inform the petitioner, complainant, or denouncer about the resolution results.

 

Article 45 |||

Upon discovering acts of violating the law causing damage to the interests of the State, legitimate rights of social organizations, economic organizations, armed units, or citizens, members of the National Assembly have the right to request relevant agencies, organizations, units, and responsible individuals to take necessary measures to promptly stop such illegal acts. The agency, unit, organization, or responsible individual must inform members of the National Assembly about the resolution results.

Article 46 |||

When performing their duties as representatives, members of the National Assembly have the right to contact state agencies, social organizations, economic organizations, and armed units. The heads of these agencies, organizations, or units, within their functions and responsibilities, have the duty to receive and respond to the requests of members of the National Assembly.

Article 47 |||

Members of the National Assembly have the right to attend People's Council meetings at various levels where they were elected, have the right to speak but not vote.

The Chairperson of People's Councils at all levels shall notify members of the National Assembly of the meeting date of the People's Council at their level, invite them to attend, and provide necessary documents.

Article 48

Representatives of the National Assembly elected in a province or centrally governed city form a Delegation of National Assembly Representatives. Each Delegation has a Leader and may have a Deputy Leader to organize activities of the Delegation, maintain relations with the Chairman of the National Assembly, the Standing Committee of the National Assembly, local administrative authorities, the Vietnam Fatherland Front Committee, and other local agencies and organizations regarding issues related to the activities of National Assembly representatives.

Each Delegation may have one to two representatives working on a full-time basis.

Article 49

A member of the National Assembly who no longer deserves the trust of the people shall be relieved of their position based on the severity of their mistake by the National Assembly or voters.

The Standing Committee of the National Assembly decides on the removal of a member of the National Assembly by the National Assembly or by voters, upon the proposal of the Central Vietnam Fatherland Front Committee, the Vietnam Fatherland Front Committee of a province, or voters.

In the case of the National Assembly removing a member of the National Assembly, the removal must be approved by two-thirds of the total number of members of the National Assembly.

In the case of voters removing a member of the National Assembly, the removal process follows procedures determined by the Standing Committee of the National Assembly.

Article 50

A member of the National Assembly may resign from their duties due to health reasons or other reasons. Acceptance of resignation by a member of the National Assembly is decided by the National Assembly; during the period between sessions, it is decided by the Standing Committee of the National Assembly and reported to the National Assembly at the next session.

A member of the National Assembly convicted of a crime and sentenced to imprisonment loses their status as a member of the National Assembly from the date the judgment becomes legally binding.

Article 51

Without the consent of the National Assembly and during the time when the National Assembly is not in session, without the consent of the Standing Committee of the National Assembly, a member of the National Assembly cannot be arrested, prosecuted, or searched in their residence or workplace. Proposals for arrest, prosecution, or search of a member of the National Assembly's residence or workplace fall under the jurisdiction of the Procurator General of the Supreme People's Procuracy.

If a member of the National Assembly is temporarily detained due to being caught committing a crime, the detaining agency must immediately report to the National Assembly or the Standing Committee of the National Assembly for examination and decision.

A member of the National Assembly cannot be dismissed or forced to leave their job by the agency or unit where they work without the approval of the Standing Committee of the National Assembly.

Article 52

Full-time members of the National Assembly are provided with workplaces and other necessary conditions for their representative activities.

State agencies, social organizations, and economic organizations where a member of the National Assembly works before becoming a full-time representative have the responsibility to accept and arrange employment for the member of the National Assembly after the end of their term.

The time spent by full-time members of the National Assembly in their representative duties counts towards continuous service time.

A member of the National Assembly working on a non-full-time basis must dedicate at least one-third of their working time to their representative duties. The agency or organization where the member works must create conditions for them to perform their duties.

The salary and other allowances of a member of the National Assembly are determined by the Standing Committee of the National Assembly.

CHAPTER V

SESSIONS OF THE NATIONAL ASSEMBLY

Article 53

The National Assembly convenes two regular sessions each year.

Extraordinary sessions of the National Assembly are convened by the Standing Committee of the National Assembly at the request of the President of the State, the Prime Minister, or at least one-third of the total number of members of the National Assembly, or according to their own decision.

Article 54

The Standing Committee of the National Assembly plans the agenda for regular sessions of the National Assembly; the Standing Committee of the previous term plans the agenda for the first session of the new term of the National Assembly.

 

Article 55

The Standing Committee of the National Assembly decides to convene regular sessions of the National Assembly no later than thirty days; extraordinary sessions no later than seven days before the opening of the session.

The work program of the session is sent to National Assembly deputies together with the decision to convene the session.

Article 56

The first session of each term of the National Assembly is convened by the Standing Committee of the previous term, no later than sixty days from the date of the election of members of the National Assembly.

The first session of each term of the National Assembly is opened and chaired by the Chairman of the previous term until the National Assembly elects a new Chairman.

Article 57

The agenda of the National Assembly session is decided by the National Assembly.

National Assembly deputies have the right to propose amendments and supplements to the agenda of the session that has been approved. Amendments and supplements to the agenda must be approved by more than half of the total number of National Assembly deputies.

Article 58

The National Assembly convenes in public sessions.

In cases of necessity, upon the proposal of the State President, the Standing Committee of the National Assembly, the Prime Minister, or one-third of the total number of National Assembly deputies, the National Assembly decides to convene in secret session.

Article 59

Issues on the agenda of the National Assembly session are discussed and decided at plenary sessions. In cases of necessity, the National Assembly decides to discuss at the National Ethnic Council and Committees, at the delegations of National Assembly members, and at the delegations of National Assembly representatives.

Article 60

Members of the Government who are not National Assembly deputies may be invited to attend plenary sessions of the National Assembly; they may express their opinions on issues within their sector or field of responsibility, upon request of the National Assembly or with the consent of the National Assembly upon their proposal.

Article 61

Representatives of state agencies, social organizations, economic organizations, armed forces units, press agencies, citizens, and foreign guests may be invited to attend public sessions of the National Assembly.

Article 62

The State President, the Standing Committee of the National Assembly, the National Ethnic Council, and the Committees of the National Assembly, the Government, the Supreme People's Court, the Supreme People's Procuracy, the Vietnam Fatherland Front, and its member organizations, and National Assembly deputies have the right to submit draft laws for consideration before the National Assembly.

The right to submit draft laws is exercised through the submission of new draft laws or draft laws amending and supplementing existing laws.

National Assembly deputies exercise their right to make suggestions on laws through proposing the promulgation of new laws or amendments and supplements to existing laws.

1. The subjects eligible for the award of the title "People's Doctor" and "Outstanding Doctor" include doctors, pharmacists, medical technicians, traditional medicine practitioners engaged in medical treatment, pharmaceutical production, medical research, disease prevention, epidemic control, and health management officials.

The National Assembly decides on the program for drafting laws and ordinances for the entire term of the National Assembly and the annual program according to the proposal of the Standing Committee of the National Assembly.

Draft laws must be reviewed by the National Ethnic Council or relevant Committee of the National Assembly, commented on by the Standing Committee of the National Assembly, and sent to National Assembly deputies at least twenty days before the opening of the session when submitted to the National Assembly.

Article 64

The National Assembly considers draft laws after hearing presentations from the agency, organization, or individual submitting the draft; reports on review by the Council or the leading review Committee, and votes to pass after discussion by the National Assembly. Based on the discussion opinions of National Assembly deputies, the chairperson of the session proposes issues for voting and the method of voting for the National Assembly to decide. The National Assembly passes draft laws by voting on each article and chapter, then voting on the entire draft or voting on the entire draft at once.

Article 65

The National Assembly decides on the long-term and annual plans for national socio-economic development; national financial and monetary policies, budget estimates, and state budget allocations.

The Government submits to the National Assembly the draft plan, budget estimate, and state budget allocation for the following year at the last session of the National Assembly of the previous year.

The National Assembly approves the final accounts of the state budget submitted by the Government no later than one year after the end of the fiscal year.

Projects must be sent to National Assembly deputies not later than ten days before the opening day of the session.

Article 66

The National Assembly considers drafts after hearing presentations from the Government, reports on review by the Council or relevant Committee, and votes to pass after discussion by the National Assembly.

The National Assembly approves projects by voting on each issue individually, followed by a vote on the entire project, or by a single vote on the entire project.

Article 67

At the last session of the year, the National Assembly considers and discusses the work report of the Standing Committee of the National Assembly, the Prime Minister, the Chief Justice of the Supreme People's Court, and the Prosecutor General of the Supreme People's Procuracy. During the mid-year session, these agencies send their work reports to National Assembly deputies; if necessary, the National Assembly may consider and discuss them.

The National Assembly may adopt a resolution on the work of the agencies that have reported.

Article 68

At the last session of each term of the National Assembly, the National Assembly considers and discusses the work report for the entire term of the National Assembly, the State President, the Standing Committee of the National Assembly, the Prime Minister, the Chief Justice of the Supreme People's Court, and the Prosecutor General of the Supreme People's Procuracy.

The work report for the entire term of the National Assembly is prepared by the Chairman of the National Assembly based on reports from the Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, and the delegations of National Assembly representatives.

Article 69

At the first session of the first term of each National Assembly, the National Assembly elects the Committee for Qualification Review of National Assembly Deputies, consisting of the Chairperson, a Deputy Chairperson, and members among National Assembly deputies proposed by the Chairman of the previous term of the National Assembly.

Based on the report of the Committee for Qualification Review of National Assembly Deputies, the National Assembly confirms the qualifications of elected National Assembly deputies or declares individual cases where the election of deputies is invalid.

The Committee for Qualification Review of National Assembly Deputies ceases its duties when the review of deputy qualifications is completed.

Article 70

The National Assembly elects the Chairman of the National Assembly, Vice Chairmen of the National Assembly, and members of the Standing Committee of the National Assembly from among National Assembly deputies listed in the nomination for each position proposed by the Standing Committee of the previous term of the National Assembly.

The number of Vice Chairmen of the National Assembly and members of the Standing Committee of the National Assembly is decided by the National Assembly.

Article 71

The National Assembly elects the State President from among National Assembly deputies proposed by the Standing Committee of the National Assembly.

Upon the proposal of the State President, the National Assembly elects the Vice State President from among National Assembly deputies; approves the establishment of the National Defense and Security Council.

Article 72

The National Assembly elects the Chairperson, Vice Chairpersons, and members of the National Ethnic Council from among National Assembly deputies, according to the list of nominations for each position proposed by the Chairman of the National Assembly.

The number of Vice Chairpersons, members of the National Ethnic Council, and the number of full-time members are decided by the National Assembly.

Article 73

The National Assembly elects the Chairperson, Vice Chairpersons, and members of each Committee of the National Assembly from among National Assembly deputies, according to the list of nominations for each position proposed by the Chairman of the National Assembly.

The number of Vice Chairpersons, members of each Committee, and the number of full-time members are decided by the National Assembly.

Article 74

The National Assembly elects the Prime Minister from among National Assembly deputies proposed by the State President.

The National Assembly approves the Prime Minister's proposal regarding the appointment of Deputy Prime Ministers, Ministers, and other members of the Government according to the list of candidates for each position.

Article 75

The National Assembly elects the Chief Justice of the Supreme People's Court and the Prosecutor General of the Supreme People's Procuracy from among National Assembly deputies proposed by the State President.

Article 76

The National Assembly elects the delegation of secretaries for each term of the National Assembly, including the Head of the Secretariat and secretaries from among National Assembly deputies according to the list proposed by the Chairman of the National Assembly.

The Session Secretariat has the following tasks and powers:

1- Prepare minutes of each session, minutes of the session, prepare press releases about the National Assembly session; compile the opinions of National Assembly deputies during the National Assembly session;

2- Coordinate with the National Ethnic Council, Committees of the National Assembly, and relevant agencies to revise draft laws and draft resolutions submitted to the National Assembly;

3- Perform other tasks assigned by the President of the National Assembly. The President of the previous National Assembly session appoints the Acting Secretary for the first session of the new National Assembly term until the National Assembly elects a Standing Committee.

Article 77

At the first session of each National Assembly term, the Standing Committee of the National Assembly, the Prime Minister, the Chief Justice of the Supreme People's Court, and the Procurator General of the Supreme People's Procuracy report on their work from the last session of the previous National Assembly term to the first session of the new National Assembly term.

Article 78

A Law or Resolution of the National Assembly must be approved by more than half of the total number of National Assembly deputies. In cases of dismissing a National Assembly deputy, shortening or extending the term of the National Assembly, or amending the Constitution, it must be approved by at least two-thirds of the total number of National Assembly deputies.

Laws and resolutions of the National Assembly must be certified by the National Assembly Chairperson and promulgated by the State President within fifteen days from the date of adoption.

Chapter VI

THE SUPPORTING MACHINERY AND BUDGET OF THE NATIONAL ASSEMBLY

Article 79

The Standing Committee of the National Assembly organizes the supporting machinery of the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, and the Committees of the National Assembly.

The organization and functions of these agencies are regulated by the Standing Committee of the National Assembly.

Article 80

The National Assembly's budget is an independent item in the State budget discussed and decided upon at the final session of the year by the National Assembly.

The President of the National Assembly directs and organizes the implementation of the National Assembly's budget.

Chapter VII

FINAL PROVISIONS

Article 81

This Law replaces the Law on the Organization of the National Assembly and the State Council dated July 3, 1981.
