Pursuant to the Law on Organization of the Government dated September 30, 1992;

Pursuant to the Reserve Mobilization Force Ordinance dated August 27, 1996;

DECISION:

Article 1. Now hereby promulgated with this Decision the following regulations:

- Living conditions for reserve mobilization units;

- Reporting procedures;

- Inspection procedures for the implementation of tasks in building reserve mobilization forces;

- Responsibilities for coordination between localities, units under the Ministry with regular units.

- Preparing necessary conditions for mobilizing reserve forces;

- Locations for receiving and transferring reserve mobilization forces;

- Time limit for completing the mobilization of reserve mobilization forces.

Article 2. The General Staff, Political General Department, Logistics General Department, and Technical General Department shall guide the implementation of this Decision within their respective functions and duties.

Article 3. This Decision takes effect from the date of signature.

Article 4. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of Provincial People's Committees directly under the Central Government, and Heads of military units shall implement this Decision.

REGULATIONS

ON LIVING CONDITIONS, REPORTING PROCEDURES, INSPECTION PROCEDURES FOR THE IMPLEMENTATION OF TASKS IN BUILDING RESERVE MOBILIZATION FORCES; RESPONSIBILITIES FOR COORDINATION BETWEEN LOCALITIES AND UNITS UNDER THE MINISTRY WITH REGULAR UNITS; PREPARING NECESSARY CONDITIONS FOR MOBILIZING RESERVE FORCES; LOCATIONS FOR RECEIVING AND TRANSFERRING RESERVE MOBILIZATION FORCES AND TIME LIMIT FOR COMPLETING THE MOBILIZATION OF RESERVE MOBILIZATION FORCES

Section 1

LIVING CONDITIONS FOR RESERVE MOBILIZATION UNITS

Article 1. Living conditions for reserve mobilization units are a form of management, a measure to enhance organizational and disciplinary qualities of reserve personnel and reserve mobilization units, helping localities and units receiving them to maintain a clear understanding of the quantity and quality of these units.

Article 2. Based on the directives of the People's Committee of the district, town, city, or provincial city (hereinafter referred to collectively as the district level), and the People's Committee of the commune, ward, or town (hereinafter referred to collectively as the commune level), organize living conditions for reserve mobilization units under their management.

Regular units have the responsibility to send officers to participate in living conditions activities with reserve mobilization units that they will receive.

Article 3. The Military Command of the commune has the responsibility to convene reserve personnel in reserve mobilization units to attend living conditions activities and oversee, guide the living conditions activities of these units. The commander of the reserve mobilization unit has the responsibility to manage the living conditions activities of the unit and prepare minutes to report to the People's Committee of the commune (through the Military Command of the commune) for monitoring and compiling reports to higher authorities.

Article 4. Reserve mobilization units directly managed by the commune must organize living conditions activities at least once a year; the timing of these activities is decided by the People's Committee of the commune; the content of the activities is directed by the military department of the district level. Reserve mobilization units called for concentrated training, exercises, readiness inspections for mobilization and combat readiness do not need to organize living conditions activities in that year.

Article 5. At least once a year, the People's Committee of the district organizes living conditions activities for reserve personnel holding command positions in reserve mobilization units from company level and above.

Section 2

REPORTING SYSTEM

Article 6. To ensure strict management of the construction of reserve mobilization forces by competent authorities, localities, units, and ministries assigned the task of constructing reserve mobilization units must comply with the reporting regulations.

Article 7. Ministries, agencies equivalent to Ministries, government agencies (hereinafter referred to collectively as the ministry level), provincial people's committees directly under the central government (hereinafter referred to collectively as the provincial level), and units under the Ministry of National Defense must annually report to the Ministry of National Defense on the following contents:

1. A mid-year report on the results of training, exercises, readiness inspections for mobilization and combat readiness of reserve mobilization units; this report must be submitted to the Ministry of National Defense before July 31.

2. An annual report on the results of training, exercises, readiness inspections for mobilization and combat readiness of reserve mobilization units; this report must be submitted to the Ministry of National Defense before January 15 of the following year.

3. A report on the results of organizing and constructing reserve mobilization units according to assigned targets and tasks; this report must be submitted to the Ministry of National Defense before July 31 each year.

Reports from the provincial level must also be sent to the Military Region Command.

Article 8.- Each quarter, units under the ministry level, district people's committees, regiments, brigades, divisions, and equivalent units must report to their immediate superiors on the results of organizing and constructing reserve mobilization units according to assigned targets and tasks.

Article 9.- The provincial and district military departments have the responsibility to assist the people's committees at the same level in implementing the reporting regulations stipulated in Articles 7 and 8 above.

Article 10.-

1. Each quarter, reserve personnel who are commanders of lower-level mobilization units have the responsibility to reflect the situation of their units to their immediate superior commanders.

2. In addition to the provisions of Clause 1 of this Article, the following applies:

a. Each quarter, commanders from squad to independent company level also have the responsibility to reflect the situation of their units to the People's Committee of the commune that manages the unit;

b. Each quarter, commanders from squad to independent battalion level also have the responsibility to reflect the situation of their units to the People's Committee of the district that manages the unit.

Article 11.- The General Staff, Political General Department, Logistics General Department, and Technical General Department shall develop reporting forms to submit to the Ministry for approval and guide all levels in their implementation.

Section 3

INSPECTION PROCEDURES FOR THE IMPLEMENTATION OF TASKS IN BUILDING RESERVE MOBILIZATION FORCES

Article 12.- Inspecting the implementation of tasks in building reserve mobilization forces is one of the measures to help leaders and commanders at all levels understand the current status of organizing and preparing for mobilization of reserve mobilization units, thereby enabling appropriate policies and measures to promote the implementation of tasks at all levels.

Article 13.- The head or functional agency of a higher level shall conduct inspections of subordinate levels at specified times or at any time.

Article 14.- Based on the task of building reserve mobilization forces of each locality and unit, and based on their intentions and purposes, leaders and commanders at each level shall decide to inspect the implementation of tasks in building reserve mobilization forces by subordinate levels.

Article 15.-

1. The Minister of National Defense and the Chief of General Staff shall inspect the work of building the reserve forces for mobilization for ministries, ministerial-level agencies, government-affiliated agencies, localities, and units with the responsibility of building the reserve forces for mobilization.

2. The ministers and heads of ministerial-level agencies and government-affiliated agencies shall inspect the implementation of building the reserve forces for mobilization for subordinate units and inspect the implementation of contents related to their respective fields within the construction of the reserve forces for mobilization.

3. Commanders at all levels in the military shall inspect the work of building the reserve forces for mobilization for units under their command; specifically, the Military Region Commanders shall also inspect localities within their region's jurisdiction.

4. The heads of provincial and district military offices shall assist the Chairpersons of the People's Committees at the same level in inspecting the work of building the reserve forces for mobilization for localities (excluding grassroots units tasked with building the reserve forces for mobilization assigned by the ministry).

5. Agencies with functional responsibilities shall assist leaders and commanders at various levels in inspecting matters within their scope of duties and responsibilities and inspect other matters delegated within the construction of the reserve forces for mobilization for objects under their inspection authority.

Section 4

RESPONSIBILITIES FOR COOPERATION BETWEEN LOCALITIES AND BETWEEN SUBORDINATE UNITS OF MINISTRIES, MINISTERIAL-LEVEL AGENCIES, AND GOVERNMENT-AFFILIATED AGENCIES WITH STANDING UNITS

Article 16.-

1. Matters primarily handled by localities, with standing units responsible for coordinating include:

a. Organizing the allocation of targets for building the reserve forces for mobilization;

b. Organizing the placement of reservists and technical equipment into reserve units;

c. Organizing activities of reserve units and reserve officers;

d. Organizing reviews and inspections of the quantity and quality of reservists and technical equipment;

e. Organizing readiness inspections for mobilization and combat preparedness of reserve units at their bases;

f. Promoting and advancing ranks for reserve officers in reserve units built by localities.

2. Matters primarily handled by standing units, with localities responsible for coordinating include:

a. Organizing annual training for reservists and reserve units;

b. Organizing the integration of reservists and technical equipment.

Article 17.-

1. Matters primarily handled by subordinate units of ministries, ministerial-level agencies, and government-affiliated agencies, with standing units responsible for coordinating include:

a. Organizing the assignment of tasks for building reserve units to grassroots units;

b. Organizing the placement of reservists and technical equipment into reserve units;

c. Organizing reviews and inspections of the quantity and quality of reservists and technical equipment;

d. Organizing readiness inspections for mobilization and combat preparedness of reserve units at their bases.

2. Matters primarily handled by standing units, with subordinate units of ministries, ministerial-level agencies, and government-affiliated agencies responsible for coordinating include:

a. Organizing training for reserve units;

b. Organizing the integration of reservists and technical equipment.

c. Promoting and advancing ranks for reserve officers in reserve units built by subordinate units of ministries, ministerial-level agencies, and government-affiliated agencies.

Article 18. The party primarily responsible for the matters specified in Article 16, Section 17 of this item shall be responsible for notifying the coordinating party of the implementation plan. The coordinating party shall be responsible for providing opinions and developing plans together with the primary party. Once they have agreed on the plan, both parties shall organize coordinated implementation.

Section 5

PREPARING NECESSARY CONDITIONS FOR MOBILIZING THE RESERVE FORCES FOR MOBILIZATION

Article 19. To ensure rapid, secret, and safe mobilization of the reserve forces for mobilization, provincial People's Committees, district People's Committees, and standing units of the military must effectively prepare the following aspects:

1. Command;

2. Concentration and reception of reservists and technical equipment;

3. Announcing the mobilization of the reserve forces for mobilization;

4. Protection during concentration, transportation, and handover of the reserve forces for mobilization.

Specific details of these preparatory aspects shall be guided by the General Staff Headquarters.

Chapter 6

HANDOVER LOCATIONS FOR THE RESERVE FORCES FOR MOBILIZATION

Article 20. The handover locations for the reserve forces for mobilization shall be determined by the receiving unit within its concentration area.

In cases where the receiving unit is more than five hundred kilometers away from the handing-over locality, the handover location shall be determined by the locality.

Section 7

TIME LIMIT FOR COMPLETING THE MOBILIZATION OF UNITS

RESERVE PERSONNEL

Article 21. The time limit for completing the mobilization of reserve units for mobilization shall be calculated from when the locality receives the mobilization order until the receiving unit completes organization and staffing.

The specific time limit will be stipulated in the mobilization plan for the reserve forces for mobilization.
