Regulations on the functions, tasks, and organizational structure of the Department of Overseas Labor

MINISTRY OF LABOR, INVALIDS AND SOCIAL AFFAIRS

Pursuant to the Government Organization Law dated December 25, 2001;

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 29/2003/NĐ-CP dated March 31, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;

At the proposal of the Director of the Cadre and Civil Servant Organization Department

Article 1. The Department of Overseas Labor is an entity under the Ministry of Labor, Invalids and Social Affairs, responsible for assisting the Minister in performing the state management function over labor export and expert dispatch as prescribed by law.

The Department of Overseas Labor has the international trade name of: Department of Overseas Labour, abbreviated as DOLAB.

Article 2. The Department of Overseas Labor has the following tasks and powers:

1. Researching, drafting, and submitting to the Ministry:

- Strategies, programs, five-year plans, and annual plans; solutions to promote labor export and expert dispatch;

- Legal regulatory documents on labor export and expert dispatch;

- Agreements, negotiation contents on labor export and expert dispatch between our country and foreign countries and international organizations.

2. Directing and guiding the implementation of state regulations and Ministry regulations on labor export and expert dispatch;

3. Exploiting and guiding the development of overseas labor markets;

4. Researching, collecting, and processing information and materials related to the field both domestically and internationally to serve labor export and expert dispatch activities. Promoting and introducing Vietnam's labor resources and supply capabilities to overseas labor markets. Advising on policies, mechanisms, and procedures for labor export and expert dispatch activities;

5. Reviewing and submitting to the Ministry for issuance and revocation of licenses for labor export and expert dispatch activities;

6. Managing registration, guiding the implementation of contracts for labor supply and expert dispatch;

7. Developing training and orientation education programs, compiling and distributing training materials for workers going abroad;

8. Providing professional training for staff involved in labor export and expert dispatch;

9. Collecting, managing, and utilizing revenues from labor export and expert dispatch activities as prescribed;

10. Inspecting and supervising labor export and expert dispatch activities; identifying and handling violations according to the authority granted or recommending appropriate measures to competent authorities for organizations and individuals violating regulations on labor export and expert dispatch;

11. Summarizing, concluding, evaluating, and reporting periodically and ad hoc on labor export and expert dispatch activities as prescribed;

12. Conducting scientific research on labor export and expert dispatch; training and providing professional and vocational training for staff as assigned by the Ministry;

13. Managing personnel, technical facilities, finance, and assets allocated according to state regulations and those of the Ministry;

14. Performing other tasks assigned by the Ministry.

Article 3. The Department of Overseas Labor directs and guides the professional and operational activities of labor management boards and units, and representatives of labor export enterprises abroad according to state regulations and the division of responsibilities by the Ministry; it may establish relations with embassies of foreign countries, international organizations within and outside the country, and Vietnamese embassies abroad regarding matters related to its assigned tasks.

Article 4. The Department of Overseas Labor has a Director and several Deputy Directors to assist.

The organizational structure of the Department includes:

1. Market Development Division.

2. Labor Management Division.

3. Training and Orientation Education Division.

4. Planning and Finance Division

5. Office.

6. Inspection Division.

7. Personnel and Organization Division.

8. Information and Advisory Center, which uses its own seal and account.

9. Labor Management Boards and Units in Foreign Countries.

The Director of the Department of Overseas Labor is responsible for establishing and implementing work regulations and internal working relationships within the unit; defining the functions and tasks of specialized agencies under the Department; assigning tasks to staff based on the allocated establishment, ensuring the completion of assigned tasks. The functions and tasks of labor management boards and units in foreign countries are decided by the Minister.

Article 5. The Department of Overseas Labor has legal personality, its own seal, and is authorized to open accounts in Vietnamese currency and foreign currencies at banks and State Treasury.

Article 6. This Decision shall take effect fifteen days after the date of signature. Previous regulations contrary to this Decision are abolished.

Article 7. The Head of the Ministry’s Office, the Director of the Personnel and Organization Department, the Director of the Department of Overseas Labor, and the Heads of relevant units are responsible for implementing this Decision.
