MINISTER OF FOREIGN TRADE
Pursuant to Decree No. 231-CP dated June 21, 1979 of the Council of Ministers stipulating the tasks, powers, and organizational structure of the Ministry of Foreign Trade;
Pursuant to Decree No. 35-CP dated February 9, 1981 of the Council of Ministers stipulating the tasks, powers, responsibilities of the Minister and the functions of the Ministry in certain areas of state management;
At the proposal of the Director of the Cadre and Civil Servant Department and the Director of the Import-Export Goods Inspection Bureau,
DECISION:
Article 1.- Now hereby promulgates with this Decision the regulations on the responsibility for ensuring export product quality and the operation of local export product quality inspection units.
Article 2.- These regulations shall apply within the scope of local production and business organizations exporting goods and shall take effect from the date of issuance.
Article 3.- Provincial People's Committees, city people's committees, and special zone people's committees under the central government, and directors of local production and business organizations exporting goods shall be responsible for implementing this decision.
The Director of the Import-Export Goods Inspection Bureau shall have the duty to inspect, monitor, and implement these regulations.

REGULATIONS
ON THE RESPONSIBILITY FOR ENSURING EXPORT PRODUCT QUALITY AND THE OPERATION OF LOCAL EXPORT PRODUCT QUALITY INSPECTION UNITS.
(issued together with Decision No. 668-BNgT/TCCB dated December 29, 1986 of the Minister of Foreign Trade).
I. GENERAL PROVISIONS
Article 1. Export products of local production and business organizations exporting goods must be ensured to meet quality standards during the production and business process in accordance with the relevant state regulations and this regulation.
Export products of the aforementioned local production and business organizations exporting goods include those exported within and outside the centrally assigned export quotas.
Article 2. Export products of local production and business organizations exporting goods must be inspected and issued a quality certificate by the quality inspection unit of the local production and business organization exporting goods (hereinafter referred to as the local export product quality inspection unit).
Article 3. Prior to export, export products that have been issued a quality certificate must be inspected or audited and confirmed to issue a quality certificate by the Import-Export Goods Inspection Bureau under the Ministry of Foreign Trade (hereinafter referred to as the Inspection Bureau) based on the State management function of the Ministry of Foreign Trade.
Article 4. The basis for the local export product quality inspection unit and the Inspection Bureau to inspect, audit, issue certificates, and confirm the issuance of quality certificates for export products according to their respective functions is the specific agreements on quality between buyers and sellers stipulated or referenced in related economic contracts based on the provisions of standards (national standards, industry standards, enterprise standards) or according to the buyer's standard requirements consistent with the signed foreign trade purchase and sale contracts.
Article 5. Local production and business organizations exporting goods bear administrative responsibility before higher-level state management agencies and compensate materially for organizations with which they have contracted in cases where they fail to fulfill quality commitments regarding export products due to their own fault (when there are complaints about quality).
Article 6. Local production and business organizations exporting goods organize local export product quality inspection units suitable to their organizational mechanisms, ensuring that all export consignments are inspected and issued quality certificates according to the production and business management function.
II. RESPONSIBILITIES OF LOCAL EXPORT PRODUCT QUALITY INSPECTION UNITS
Article 7. During the implementation of the function of inspecting and issuing certificates for export products of the locality, the local export product quality inspection unit has the following specific responsibilities:
7.1. Conduct inspections of raw materials used for producing export products, monitor and inspect production processes, processing, packaging, labeling, and transportation and storage processes within their production and business scope in a timely, comprehensive, and accurate manner in accordance with technical and technological procedures for ensuring quality.
7.2. After inspection, if export consignments meet the specified quality standards, issue a quality certificate.
7.3. In case export consignments do not meet the specified quality standards after inspection, do not issue a quality certificate and report to the director for review and resolution, while having the authority to propose measures to facilitate relevant departments in rectifying deficiencies to ensure export product quality.
7.4. Cooperate with the base to provide conditions to assist the superior local export product quality inspection unit and Inspection Bureau staff in performing inspection, audit, and confirmation of quality certificate issuance functions such as providing relevant technical documents related to export product production and other necessary means for inspection.
7.5. Monitor, assist, and train in inspection techniques and guide the activities of sampling teams within the unit, as well as accept assistance and training in inspection techniques from the Inspection Bureau.
7.6. The export product quality inspection unit of branch companies located at ports may not re-inspect export consignments that have already been confirmed to issue quality certificates by the Inspection Bureau within the prescribed period. In cases where suspected substitution, non-intact shipments, or suspected non-compliance with quality standards are discovered, report to the nearest Inspection Bureau unit for joint examination and resolution.
7.7. If the local export product quality inspection unit has opinions during the performance of its duties that are not agreed upon by the unit director, it has the right to report to the superior quality inspection unit and the Inspection Bureau for resolution.
The promotion, disciplinary action, and transfer of the head of the local export product quality inspection unit must be agreed upon by the Inspection Bureau.
III. IMPLEMENTATION PROVISIONS
Article 8. The local export goods quality inspection unit shall be directly under the direction of the director of the local export goods trading organization; at the same time, it shall be subject to professional guidance from the Inspection Agency.
Article 9. Any violations of this Regulation, depending on their severity, will be handled according to the laws of the State.
Article 10. During implementation, any difficulties encountered should be reported to the Inspection Agency (Ministry of Foreign Trade) for study and supplementation as appropriate.
