Regarding the transfer of state management tasks in vocational training from the Ministry of Education and Training to the Ministry of Labor, Invalids and Social Affairs
In order to implement the Decision of the Politburo on transferring the state management tasks in vocational training from the Ministry of Education and Training to the Ministry of Labor, Invalids and Social Affairs;
PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
At the proposal of the Minister, Head of the Government Organizational and Cadre Management Department, the Minister of Education and Training, and the Minister of Labor, Invalids and Social Affairs;
Transfer the state management tasks in vocational training from the Ministry of Education and Training to the Ministry of Labor, Invalids and Social Affairs. From July 1, 1998 onwards, all schools, centers, and institutions engaged in vocational training shall be under the state management of the Ministry of Labor, Invalids and Social Affairs for vocational training.
DECISION:
Article 1. The Minister of Education and Training is responsible for handing over to the Minister of Labor, Invalids and Social Affairs:
Article 2. 1. Specific state management tasks, files, documents, and budget in the field of vocational training from the Ministry of Education and Training to the Ministry of Labor, Invalids and Social Affairs; at the same time, direct the relevant state management agencies at all levels within the education and training sector nationwide to hand over specific state management tasks, budget, and other necessary conditions in the field of vocational training to corresponding state management agencies within the labor, invalids, and social affairs sector.
2. The number of officials and civil servants currently engaged in vocational training management from the Ministry of Education and Training will be transferred to the Ministry of Labor, Invalids and Social Affairs (the list of officials to be transferred will be agreed upon by both Ministries). At the local level, where deemed necessary, the provincial People's Committees directly under the Central Government, based on the authority granted, shall decide on the handover following the guidelines of the two Ministries of Education and Training and Labor, Invalids and Social Affairs.
3. Vocational training programs and projects funded domestically or internationally directly managed by the Ministry of Education and Training shall be transferred to the direct management of the Ministry of Labor, Invalids and Social Affairs.
Only vocational training projects intertwined with other types of training funded by foreign sources and currently headed by the Ministry of Education and Training shall continue to be managed by that Ministry until project completion.
The following technical teacher training schools directly managed by the Ministry of Education and Training shall be transferred to the direct management of the Ministry of Labor, Invalids and Social Affairs:
Nam Dinh Secondary Technical Teacher Training School II.
Vinh Secondary Technical Teacher Training School III (Nghe An).
Vinh Long Technical Teacher Training College IV.
The Minister of Labor, Invalids and Social Affairs is responsible for receiving the above-handover content from the Minister of Education and Training, jointly directing and guiding the handover and receipt between the two sectors nationwide; at the same time, must organize the implementation of the new tasks assigned and report to the Prime Minister for consideration and resolution of any issues arising during the handover and receipt process of the two Ministries.
Article 3. Chairmen of Provincial People's Committees directly under the Central Government shall direct the full handover and receipt of tasks and existing necessary conditions for vocational training work from educational and training management agencies to labor, invalids, and social affairs management agencies under their jurisdiction according to the guidelines of the Ministry of Education and Training and the Ministry of Labor, Invalids and Social Affairs.
The Minister, Head of the Government Organizational and Cadre Management Department, shall take the lead in coordinating with the Minister of Planning and Investment, the Minister of Finance, the Ministry of Education and Training, and the Ministry of Labor, Invalids and Social Affairs to implement the above handover and receipt in accordance with regulations and ensure that from July 1, 1998 onwards, the Ministry of Labor, Invalids and Social Affairs assumes responsibility for state management of vocational training.
Article 4. This Decision shall take effect fifteen days from the date of signature. All previous provisions contrary to this Decision are hereby abolished.
Article 5. Deputy Prime Minister.
Article 6. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees are responsible for enforcing this Decision.
