THE MINISTER OF FINANCE
Pursuant to Decree No. 57/2002/ND-CP dated June 3, 2002 of the Government detailing the implementation of the Law on Fees and Charges;
Pursuant to Decree No. 24/2006/ND-CP dated March 6, 2006 of the Government amending and supplementing certain articles of Decree No. 57/2002/ND-CP dated June 3, 2002 of the Government detailing the implementation of the Law on Fees and Charges;
Pursuant to Decree No. 68/2002/ND-CP dated July 10, 2002 of the Government detailing the implementation of certain provisions of the Marriage and Family Law regarding marriage and family relations involving foreign elements;
Pursuant to Decree No. 69/2006/ND-CP dated July 21, 2006 of the Government amending and supplementing certain articles of Decree No. 68/2002/ND-CP dated July 10, 2002 of the Government detailing the implementation of certain provisions of the Marriage and Family Law regarding marriage and family relations involving foreign elements;
Pursuant to Decree No. 77/2003/ND-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance.
After receiving opinions from the Ministry of Justice and upon the proposal of the Director of the Tax Policy Department,
DECISION:
Article 1. Foreign individuals, Vietnamese citizens, and foreigners when registering to adopt Vietnamese children as foster children, including: registration of adoption between Vietnamese citizens and foreigners, between foreigners permanently residing in Vietnam with each other; between Vietnamese citizens with each other or with foreigners which have been conducted at competent authorities abroad, must pay the fee for resolving adoption matters as prescribed in this Decision.
Article 2. No fee for resolving adoption matters shall be collected in cases where the child being adopted is:
1. Disabled or severely disabled;
2. Incapable of civil acts;
3. A victim of chemical warfare agents;
4. Infected with HIV/AIDS;
5. Suffering from other serious diseases.
Article 3. The level of collection of the fee for resolving adoption matters is 1,000,000 (One million) Vietnamese dong per file.
Article 4. The revenue from the fee for resolving adoption matters as prescribed in this Decision is a state budget revenue item, managed and used as follows: The collecting agency (International Adoption Bureau) is entitled to retain 100% (one hundred percent) of the collected fee amount to cover the costs for resolving adoption matters and collecting fees as stipulated in Clause 8 of Circular No. 45/2006/TT-BTC dated May 25, 2006 of the Ministry of Finance amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of legal provisions on fees and charges.
Article 5. This Decision takes effect fifteen days after its publication in the Official Gazette.
Article 6. Other contents related to the collection, submission, management, use, payment receipts, and publicizing the fee collection regime not mentioned in this Decision shall be implemented according to the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002 guiding the implementation of legal provisions on fees and charges and Circular No. 45/2006/TT-BTC dated May 25, 2006 amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002 guiding the implementation of legal provisions on fees and charges.
Article 7. In the course of implementation, if there are difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance.
