DECREE

AMENDING AND SUPPLEMENTING CLAUSE 3 OF ARTICLE 42 OF DECREE NO. 146/2007/NĐ-CP DATED SEPTEMBER 14, 2007 ON ADMINISTRATIVE SANCTIONS FOR VIOLATIONS IN THE FIELD OF ROAD TRAFFIC

THE GOVERNMENT

Pursuant to the Law on the Organization of the Government dated December 25, 2001;
Pursuant to the Road Traffic Law dated June 29, 2001;
Pursuant to the Ordinance on Handling Administrative Violations dated July 2, 2002;
Considering the proposal of the Minister of Public Security,

DECREE:

Article 1.

Amends and supplements Clause 3 of Article 42 of Decree No. 146/2007/NĐ-CP dated September 14, 2007 as follows:

"3. The traffic police, rapid response police, mobile police, and administrative management police for social order have the authority to impose sanctions on violations stipulated in the points, clauses, and articles of this Decree as follows:

a) Point d, point đ, point e, point g, point h, point k Clause 3; point b, point i Clause 4; point a, point g Clause 5; point b, point c, point đ Clause 6; point b Clause 7 Article 8;

b) Point g, point h Clause 1; point a, point b, point e, point g, point l, point m Clause 2; point c, point d, point e, point g Clause 3; point b Clause 4; point d Clause 6; Clause 7; Clause 8 Article 9;

c) Point a, point đ, point e, point g, point h, point i, point k Clause 2; point c, point d, point đ Clause 3; point b Clause 4; Clause 5; point b Clause 6 Article 10;

d) Point c, point e, point g, point h, point i Clause 1; Clause 2; Clause 3; Clause 4 Article 11;

đ) Article 12, Article 13, Article 14, Article 15;

e) Clause 2 Article 17;

g) Article 18, Article 21, Article 23;

h) Point a, point c, point đ, point e, point g Clause 4; Clause 5 Article 27;

i) Article 30, Article 33, Article 36, Article 38, Article 39".

Article 2

This Decree takes effect 15 days from the date of publication in the Official Gazette, replacing Clause 3 of Article 42 of Decree No. 146/2007/NĐ-CP dated September 14, 2007 on administrative sanctions for violations in the field of road traffic.

Article 3

1. The Minister of Public Security and the Minister of Transport shall be responsible for guiding and implementing this Decree within their respective functions, tasks, and powers.

2. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for enforcing this Decree./.
