Circular No. 67/2015/TT-BCA stipulates the List of State Secrets of Confidential Level in the Health Sector

CIRCULAR

Regulations on the List of State Secrets of Confidential Level in the Health Sector

Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000;

Pursuant to the Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protection of State Secrets;

Pursuant to Decree No. 106/2014/NĐ-CP dated November 17, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

After reaching consensus with the Minister of Health, the Minister of Public Security promulgates this Circular regulating the List of State Secrets of Confidential Level in the Health Sector.

Article 1. The List of State Secrets of Confidential Level in the Health Sector includes information and documents within the following scope:

1. Content of work meetings between Party and State leaders and Health Sector leaders regarding political issues and internal matters of the Health Sector that have not been disclosed.

2. Data, maps, specimens, genetic sources, and zoning plans for rare and endemic medicinal plant cultivation areas that have not been disclosed or have not yet been disclosed.

3. Reports on the number of people infected and deaths from newly emerging dangerous infectious diseases with unknown causative agents or mass poisonings that have not been disclosed.

4. Aggregate data on export, import, purchase, sale, use, and stock of narcotic drugs, psychotropic substances, and precursor chemicals used in pharmaceuticals, radioactive drugs used in the Health Sector that have not been disclosed.

5. Personnel files of civil servants, employees, party members, and leadership planning from the Department level and above in the Health Sector that have not been disclosed; organizational structure plans, leadership planning, reorganization, transfer, appointment, removal, disciplinary actions of personnel in the Health Sector that have not been disclosed.

6. Draft examination questions and answers, official examination questions and answers for recruitment of civil servants, employees in the Health Sector that have not been disclosed.

7. Inspection plans, verification reports on complaints and accusations; inspection results, verification results on complaints, verification results on accusations; draft inspection conclusions, draft decisions on complaints, draft conclusions on accusations; other information and documents related to inspections, public reception, complaint resolution, accusation handling, and anti-corruption, smuggling, and commercial fraud in the health sector that have not been disclosed or have not been disclosed.

8. Information related to organ donors and recipients that have not been disclosed or have not been disclosed.

9. Information about patients' health status and private lives recorded in medical records that have not been disclosed or have not been disclosed.

10. Files and documents on scientific childbirth that have not been disclosed.

11. Survey data and information on population that have not been disclosed.

12. Inventions, patents, and scientific and technological solutions in the health sector owned by the State or included in invention registration files under intellectual property laws that have not been disclosed.

13. Newly invented drugs and clinical trial data for herbal medicines and traditional medicines; production secrets, functional food formulas, compounding methods, and traditional medicine manufacturing processes that have not been disclosed or have not yet been disclosed; new non-drug treatment methods that have not been disclosed; medical equipment included in invention registration files under intellectual property laws or in circulation registration files that have not been disclosed.

14. Documents on computer network design of the Ministry and the Health Sector; passwords and security protocols for information security in the use and application of information technology by the Ministry of Health and the Health Sector.

15. Documents using information and materials belonging to the List of State Secrets of Confidential Level of other agencies and organizations.

Article 2. Effective Date

This Circular takes effect from February 1, 2016, replacing Decision No. 981/2004/QĐ-BCA(A11) dated September 28, 2004 of the Ministry of Public Security on the List of State Secrets of Confidential Level in the Health Sector and related population work contents in Decision No. 214/2006/QĐ-BCA(A11) dated March 24, 2005 of the Ministry of Public Security on the List of State Secrets of Confidential Level of the Population, Family, and Youth Commission.

Article 3. Responsibility for Implementation

1. The Ministry of Health and the Ministry of Public Security shall be responsible for guiding and supervising the implementation of this Circular.

2. Ministries, ministerial-level agencies, government agencies; People's Committees of provinces and centrally-administered cities shall be responsible for implementing this Circular.
