CIRCULAR
Regulations on criteria and indicators for evaluating the quality of public service provision in basic surveys of natural conditions, natural resources, and environmentspecialized agency under the People's Committee of the province/city.

Pursuant to Decree No. 16/2015/NĐ-CP dated February 14, 2015 of the Government stipulating the self-management mechanism of public service units;
On the basis of Decision No. 36/2017/NĐ-CP dated April 4, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
At the proposal of the Director of the Science and Technology Department and the Director of the Legal Department;
The Minister of Natural Resources and Environment promulgates this Circular to stipulate criteria and indicators for evaluating the quality of public services funded by the state budget for basic surveys of natural conditions, natural resources, and environment within the scope of management of the Ministry of Natural Resources and Environment.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates criteria and indicators for evaluating the quality of public services funded by the state budget for the following basic surveys:
1. Survey and assessment of land nationwide and in regions.
2. Survey and assessment of water resources, current status of exploitation and utilization of water resources; discharge into water sources for transboundary water sources and inter-provincial water sources.
3. Basic geological survey on minerals.
4. Survey and observation on meteorology and hydrology.
5. Establishment of national reference systems and national primary measurement data systems, national basic survey point systems.
6. Establishment and updating of the national topographic map system.
7. Compilation of national administrative maps at provincial level.
8. Surveying, establishment, and updating of administrative boundary maps and records to serve the demarcation, division, merger, and adjustment of administrative boundaries.
9. Basic survey on marine and island resources.
10. Surveys serving comprehensive management of coastal resources with inter-provincial scope, statistics, classification, and comprehensive management of marine and island resources managed by the central government.
Article 2. Applicability
This Circular applies to state management agencies on natural resources and environment; public service units and organizations and individuals providing public services funded by the state budget for basic surveys.
Article 3. Explanation of Terms
1. Quality of public services is the overall evaluation result reflecting the degree of customer satisfaction with the service.
2. Evaluation criterion includes contents and requirements that the service provider must meet to satisfy customer expectations. Each criterion has specific quality service evaluation indicators based on certain requirements and conditions.
3. Evaluation indicators are the levels of requirement and condition regarding a specific aspect of the evaluation criterion.
Chapter II
CRITERIA AND INDICATORS FOR EVALUATING THE QUALITY OF PUBLIC SERVICES ON BASIC SURVEYS
1. Criterion 1: Functions, tasks, material and technical foundations of organizations providing services to prepare national environmental status reports.
1. Criterion 1: Function, tasks, or business registration of the organization providing basic survey services.
2. Criterion 2: Physical facilities, technical infrastructure, and technology serving basic survey activities.
3. Criterion 3: Human resources serving basic survey activities.
4. Criterion 4: Attitude in providing basic survey services.
5. Criterion 5: Self-inspection and supervision.
6. Criterion 6: Compliance with technical regulations.
7. Criterion 7: Basic survey products.
8. Criterion 8: Storage of basic survey results.
9. Criterion 9: Occupational safety.
Article 5. Indicators and basis for evaluating Criterion 1
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) Established in accordance with the law, having functions, tasks, and organizational structure for basic surveys.
b) Years of experience in providing basic survey services.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
a) Documents stipulating functions, tasks, and organizational structure; licenses and business registrations of service providers;
b) Years of experience in providing basic survey services confirmed by the service provider's capability dossier.
Article 6. Indicators and bases for assessing criterion 2
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) The system of machinery, equipment, and technology serving the basic investigation activities of service providers;
b) Buildings, construction works, auxiliary equipment, and means serving the basic investigation activities of service providers.
2. The basis for assessment is the annual property statistics report of the service provider; economic and technical standards for each basic investigation activity.
Article 7. Indicators and bases for assessing criterion 3
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) The number of direct personnel implementing basic investigation activities of the service provider;
b) The quality of direct personnel implementing basic investigation activities of the service provider;
c) Management personnel for basic investigation activities of the service provider.
2. The basis for assessment is the statistical data report, human resources files, and labor contracts, expert hiring contracts of three months or more of the service provider; labor norms for each basic investigation category; regulations on job positions for public institutions.
Article 8. Indicators and bases for assessing criterion 4
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) Timely detection and reporting of developments during the basic investigation process that require review and adjustment of the subject, technology, or investigation procedure for the ordering agency; competent state management agencies. Promptly propose specific adjustments to the ordering agency to align with actual developments during the investigation process;
b) Compliance with decisions of competent state management agencies in basic investigation activities. Ready to meet urgent requirements of the ordering agency.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
a) Ad hoc and periodic reports of the basic investigation service provider;
b) Inspection records of ad hoc or periodic inspections; annual acceptance files of the supervisory level; other related documents concerning urgent requirements of the ordering agency (if any).
Article 9. Indicators and bases for assessing criterion 5
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) Self-inspection and supervision plans for basic investigation activities of the service provider;
b) Implementation of periodic self-inspections and supervision according to the plan or ad hoc actions by the service provider.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
a) Self-inspection and supervision plans for basic investigation activities of the service provider; inspection records or documentation, evidence recording self-inspection and supervision by the basic investigation service provider;
b) Inspection records and conclusions of the ordering agency or competent state management agencies.
Article 10. Indicators and bases for assessing criterion 6
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) Compliance with calibration, testing, and certification regulations for machinery and equipment serving basic investigation activities;
b) Compliance with technical standards, specifications, regulations, and technical procedures (collectively referred to as technical regulations), economic and technical norms during the preparation and implementation of investigation projects/tasks.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
a) Technical regulations published and permitted for use in basic investigation activities. In cases where there are no technical regulations, refer to approved projects/tasks and/or ordering agency orders;
b) Documents, reports, calibration certificates regarding calibration, testing, and certification results for investigation machinery and equipment as prescribed;
c) Annual acceptance documents of the supervisory level; Supervision and inspection reports on basic investigation activities by authorized agencies (if any).
Article 11. Indicators and bases for evaluating criterion 7
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) The quantity level of basic investigation products according to orders;
b) The quality of basic investigation products evaluated by specialized agencies in accordance with regulations and recognized;
c) Completion time compared to the requirements of the ordering agency.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
a) Annual acceptance documents, project/program/task completion acceptance documents of the management level or ordering agency;
b) Minutes of the management level acceptance council or quality inspection organization designated by the management level or ordering agency or competent state management agency;
c) Recognition documents for new proposals or discoveries from authorized levels (if any).
Article 12. Indicators and bases for evaluating criterion 8
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) Time, type, format, completeness level of information submitted for storage; carrier media in compliance with regulations (paper form, digital form);
b) Ensuring data security and confidentiality in accordance with regulations.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
a) Management regulations, technical regulations related to information/data storage, basic investigation results that have been promulgated and issued; legal normative documents on national secret protection work in the natural resources and environment sector still in effect;
b) Handover minutes, submission documents for storing information and basic investigation results or equivalent documents verifying that the basic investigation service provider has submitted information and results in accordance with regulations.
Article 13. Indicators and bases for evaluating criterion 9
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) Workers performing basic investigation tasks have received occupational safety training and are equipped with occupational safety equipment in accordance with regulations;
b) Occupational safety achievement rate in basic investigation activities.
2. The basis for evaluation includes occupational safety reports or inspection/trial reports on occupational safety; inspection/trial documents of the ordering agency or competent authority; labor accident statistics reports from basic investigation service providers.
Article 14. Quality assessment of public service basic investigation services
1. The quality of public service basic investigation services is assessed through scoring. The scoring scale is 100 points. Specific scoring scales are determined for each criterion and indicator stipulated in Articles 5, 6, 7, 8, 9, 10, 11, 12, and 13 of this Circular and detailed in the attached Appendix.
2. The quality of public service activities is evaluated at four levels:
a) Excellent when the total score exceeds 80 points, with each criterion's score being more than 70% of its maximum possible score;
b) Good when the total score ranges from 60 to less than 80 points, with each criterion's score being at least 60% of its maximum possible score;
c) Satisfactory when the total score ranges from 50 to less than 60 points, with each criterion's score stipulated in Articles 11 and 12 being at least 50% of its maximum possible score;
d) Unsatisfactory when the total score is less than 50 points or the score of criteria stipulated in Articles 11 and 12 is less than 50% of their maximum possible scores;
e) The quality of public service at points a, b, and c of this clause will be reduced to the next lower level if the total score of any criterion does not meet the required percentage of the maximum score at each level as specified.
Chapter III
IMPLEMENTING PROVISIONS
Article 15. Effective Date
This Circular takes effect from February 8, 2018.
Article 16. Implementation Organization
1. The Science and Technology Department is responsible for organizing guidance, implementation, and monitoring the execution of this Circular.
2. Units under the Ministry and relevant organizations and individuals are responsible for implementing this Circular.
3. During implementation, if difficulties arise, agencies, organizations, and individuals are advised to promptly report them to the Ministry of Natural Resources and Environment for research, consideration, and resolution.
