CIRCULAR
Amending and supplementing some articles of Circular No. 43/2025/TT-MININD July 4, 2025 of the Minister of Industry and Trade on technical safety in mineral exploitation TECHNICAL SAFETY IN MINERAL EXPLOITATION

Pursuant to Decree No. 193/2025/ND-CP dated July 2, 2025 of the Government detailing some provisions and measures for implementing the Law on Geology and Minerals;
Pursuant to Decree No. 40/2025/ND-CP dated February 26, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
At the proposal of the Director of the Department of Technical Safety and Industrial Environment;
The Minister of Industry and Trade issues this Circular amending and supplementing some articles of Circular No. 43/2025/TT-MININD July 4, 2025 of the Minister of Industry and Trade stipulating technical safety in mineral exploitation.
Article 1. Amending and supplementing some articles of Circular No. 43/2025/TT-MININD July 4, 2025 of the Minister of Industry and Trade stipulating technical safety in mineral exploitation.
1. Amending and supplementing Clause 4 and Clause 5 of Article 3 as follows:
“4. The foreman, site commander, or equivalent position hereinafter referred to as the Foreman is the person assigned by the organization or enterprise exploiting minerals to be responsible for managing a subordinate unit or production department directly involved in the mineral exploitation process.
5. The shift leader or equivalent position hereinafter referred to as the Shift Leader is the person assigned by the organization or enterprise exploiting minerals to be responsible for managing a section of a subordinate unit or production department participating in the mineral exploitation process during one shift under the assignment of the Foreman.”
2. Amending and supplementing Article 8
a) Amending and supplementing the title of Article 8 as follows:
“Article 8. System of equipment and means before being put into operation for the first time in underground mines and periodic inspection of equipment and means in mineral exploitation”
b) Supplementing Clause 6 to Article 8 as follows:
“6. Periodic inspection of equipment and means used in mineral exploitation shall be carried out according to technical safety standards in mineral exploitation issued by the Ministry of Industry and Trade.”
Article 2. Implementation clause
This Circular takes effect from December 31, 2025./.
