CIRCULAR
GUIDELINES FOR IMPLEMENTING THE SUBSIDY SYSTEM FOR LEADERSHIP POSITIONS IN OPERA HOUSES AND ART TRoupES Issued by the Ministry of Culture and Information under Decision No. 67/TC-TT dated October 12, 1995
Implementing Decision No. 25/CP dated May 25, 1993 of the Government on the temporary salary system for civil servants, administrative and public service officials, and armed forces personnel.
Following the agreement letters from the Ministry of Finance No. 394/TC-TCNH dated February 23, 1995, the Ministry of Labor, Invalids and Social Affairs No. 3281/LDTBXH-TL dated August 30, 1995, and the Government’s Organizational Cadre Board No. 369/TCCP-BCTL dated September 19, 1995, the Ministry of Culture and Information hereby guides the implementation of the subsidy system for leadership positions in opera houses, art troupes, circus federations, and circus troupes (hereinafter referred to as artistic units) nationwide as follows:
I. PRINCIPLES:
1. Leadership positions in artistic units shall be entitled to position subsidies when such organizations have been established by relevant Ministries, sectors, provincial People's Committees, or municipal People's Committees according to the organizational and operational regulations stipulated by the Ministry of Culture and Information.
2. The person holding a leadership position must have a formal appointment decision from the competent authority; they shall enjoy the subsidy level corresponding to their appointed position. In cases where one individual holds multiple leadership positions, they shall receive the subsidy level corresponding to the highest position held.
3. Where a unit lacks a head, the deputy head or the person delegated with the head's powers shall be entitled to the head's position subsidy. Upon ceasing to hold a leadership position, such individuals shall no longer be eligible for leadership position subsidies. Position subsidies shall be paid concurrently with monthly salaries and shall be included in the calculation of social insurance benefits.
II. APPLICABLE OBJECTS:
Leadership positions in artistic units include:
1. Director, Deputy Director of Opera Houses, Circus Federations, Art Troupes, Head, Deputy Head of Art Troupes.
2. Heads, Deputy Heads of Departments, Heads, Deputy Heads of Performance Units directly subordinate to artistic units and equivalent positions.
III. SUBSIDY LEVELS:
The subsidy levels for leadership positions in artistic units are specified as follows:

1. Under current conditions where it is not possible to establish ranking standards for Opera Houses and Art Troupes, temporarily, Opera Houses (including Circus Federations, Vietnam Symphony Orchestra) managed by the Ministry of Culture and Information, if operating effectively, shall apply the subsidy level for leadership positions at Class I Opera Houses.
2. Opera Houses managed by local authorities and Art Troupes managed by central Ministries and sectors shall apply the subsidy level for leadership positions at Class II Opera Houses.
In exceptional cases, Opera Houses and Art Troupes managed by central Ministries and sectors, and Opera Houses managed by local authorities, if assessed to be functionally, mission-wise, scale-wise, position-wise, and effectiveness-wise equivalent to central Opera Houses managed by the Ministry of Culture and Information, the respective Ministries, sectors, and provincial or municipal People's Committees shall submit proposals to the Ministry of Culture and Information for consideration. After comprehensive review, the Ministry of Culture and Information will propose to the Joint Ministry of Finance, the Government’s Organizational Cadre Board for agreement to apply the subsidy level for leadership positions at Class I Opera Houses.
Art Troupes shall uniformly apply the subsidy level specified in paragraph 2 above, except in exceptional cases recognized as such.
IV. IMPLEMENTATION:
1. Ministries, sectors, provinces, and municipalities shall guide affiliated artistic units to review their organizational structures and appointments to ensure compliance with the officially established artistic performance positions, and implement the subsidy levels prescribed in this Circular.
2. For units applying the subsidy level for leadership positions at Class I Opera Houses, the heads of Ministries, sectors, and provincial or municipal People's Committees shall decide after obtaining agreement from the Ministry of Culture and Information, the Government’s Organizational Cadre Board, and the Ministry of Finance.
3. For units applying the subsidy level for leadership positions at Class II Opera Houses and Art Troupes, the heads of Ministries, sectors, and localities shall decide and send the decisions to the Ministry of Culture and Information for monitoring.
4. The subsidy system for leadership positions in Opera Houses and Art Troupes shall take effect from April 1, 1993.
During implementation, any issues encountered should be reported to the Ministry of Culture and Information for resolution.
