ISSUING REGULATIONS ON CERTIFICATES FOR PARTICIPATION IN PROCUREMENT TRAINING COURSES
THE MINISTER OF PLANNING AND INVESTMENT
WHEREAS Clause 5 of Article 68 of the Government Procurement Law No. 61/2005/QH11 dated November 29, 2005 of the National Assembly;
WHEREAS Decree No. 61/2003/ND-CP dated June 6, 2003 of the Government stipulating the functions, tasks, and powers of the Ministry of Planning and Investment;
WHEREAS Article 5 and Clause 3 of Article 76 of Decree No. 58/2008/ND-CP dated May 5, 2008 of the Government guiding the implementation of the Government Procurement Law and the selection of construction contractors under the Construction Law;
AT THE RECOMMENDATION OF THE DIRECTOR OF THE DEPARTMENT OF PROCUREMENT MANAGEMENT.
DECISION:
Article 1. ATTACHED TO THIS DECISION ARE REGULATIONS ON CERTIFICATES FOR PARTICIPATION IN PROCUREMENT TRAINING COURSES AS PROVIDED FOR IN CLAUSE 3 OF ARTICLE 76 OF DECREE NO. 58/2008/ND-CP DATED MAY 5, 2008 OF THE GOVERNMENT GUIDING THE IMPLEMENTATION OF THE GOVERNMENT PROCUREMENT LAW AND THE SELECTION OF CONSTRUCTION CONTRACTORS UNDER THE CONSTRUCTION LAW.
Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF PUBLICATION IN THE OFFICIAL GAZETTE AND SHALL REPLACE DECREE NO. 1323/2006/QD-BKH ISSUED BY THE MINISTER OF PLANNING AND INVESTMENT ON DECEMBER 12, 2006.
Article 3. MINISTRIES, GOVERNMENT-LEVEL AGENCIES, GOVERNMENT AGENCIES, OTHER CENTRAL LEVEL ORGANIZATIONS, PEOPLE'S COMMITTEES AT ALL LEVELS, ORGANIZATIONS, AND INDIVIDUALS AS PROVIDED FOR IN ARTICLE 5 OF DECREE NO. 58/2008/ND-CP SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION.
