Regarding the establishment of the Labor Relations Committee

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Considering the proposal of the Minister of Labor, War Invalids and Social Affairs.

Pursuant to …;

Article 1. The Labor Relations Committee shall be established.

The Labor Relations Committee shall have the function of advising the Prime Minister on mechanisms, policies, and solutions to build healthy labor relations; establishing coordination mechanisms among relevant agencies and organizations in preventing and resolving labor disputes and strikes.

The Labor Relations Committee shall have its own seal, and its operational budget shall be provided from the State Budget through the Ministry of Labor, War Invalids and Social Affairs.

Article 2. Tasks of the Labor Relations Committee

1. Advising the Prime Minister on directions, mechanisms, and policies related to labor relations; measures for directing and managing the implementation of policies on labor relations; coordinating activities among ministries, sectors, and relevant agencies and organizations in implementing healthy and transparent labor relations and the establishment of inter-sectoral bodies on labor relations at provincial level.

2. Regularly and urgently reporting to the Prime Minister on the implementation of mechanisms and policies on labor relations.

Article 3. Composition of the Labor Relations Committee includes:

1. Chairman of the Committee: The Minister of Labor, War Invalids and Social Affairs.

2. Deputy Chairmen:

- One Vice Minister of Labor, War Invalids and Social Affairs;

- Inviting one leader from the Vietnam General Confederation of Labor and one leader from the Vietnam Chamber of Commerce and Industry.

3. Members of the Committee:

- Representative from the Ministry of Labor, War Invalids and Social Affairs;

- Inviting representatives from the following organizations: Vietnam General Confederation of Labor, Vietnam Chamber of Commerce and Industry, Vietnam Federation of Trade Unions, Vietnam Association of Small and Medium Enterprises.

4. Staff supporting the Committee: The Chairman of the Committee shall utilize the staff of the Ministry of Labor, War Invalids and Social Affairs to support the Labor Relations Committee.

The Chairman of the Labor Relations Committee shall issue the Rules of Operation of the Labor Relations Committee.

Article 4. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

Article 5. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairman of the Labor Relations Committee, and Chairmen of Provincial People's Committees directly under the Central Government are responsible for implementing this Decision./.
