Pursuant to Decree No. 77/2003/ND-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 170/2003/ND-CP dated December 25, 2003 of the Government detailing the implementation of certain provisions of the Price Ordinance;
Pursuant to Decree No. 75/2008/ND-CP dated June 9, 2008 of the Government amending and supplementing some articles of Decree No. 170/2003/ND-CP;
Pursuant to Decree No. 55/2007/ND-CP dated April 6, 2007 of the Government on trading in gasoline and fuel oil;
Considering the current world market prices for gasoline and fuel oil;
Considering Circular No. 811/VPCP-KTTH dated August 13, 2008 of the Government Office regarding the management of gasoline and fuel oil prices for the last five months of 2008.
After reaching consensus with the Ministry of Industry and Trade,
DECISION:
Article 1. Permitting traders engaged in exporting, importing, producing, or processing gasoline and fuel oil (hereinafter referred to as key enterprises) to adjust downward the selling price of gasoline and fuel oil at domestic markets according to the prices registered by key enterprises, specifically: reducing the retail price of gasoline by 1,000 VND per liter and the retail price of fuel oil by 1,000 VND per liter within their own distribution systems. The specific retail prices of gasoline and fuel oil at actual temperatures (including VAT) in areas near fuel oil import ports (Zone 1) are as follows:
- Gasoline RON 92: 18,000 VND per liter,
- Fuel oil: 19,000 VND per liter.
- Prices for other types of gasoline and fuel oil shall be determined by key enterprises based on quality differences and actual market prices for each type of gasoline and fuel oil.
- Retail prices in areas far from fuel oil import ports (Zone 2) shall be implemented in accordance with the current guidance of the Ministry of Industry and Trade (formerly the Ministry of Trade) as set out in Decision No. 0674/2004/QD-BTM dated May 31, 2004.
Article 2. Place of Sale:
- Wholesale: goods are delivered to the central warehouse of the province or city on the buyer's means of transport;
- Retail: goods are sold at gas stations and retail stores in provinces and cities on the buyer's means of transport.
Article 3. Responsibilities of Ministries, Sectors, Localities, and Production and Trading Units:
- Enterprises engaged in production and trading must strictly comply with the directives of the Prime Minister: continue to implement measures to reduce costs, especially fuel costs, to lower product costs. Trading units dealing with gasoline and fuel oil must continue to reduce business management costs.
- Key enterprises must conduct inventory checks in accordance with current regulations before adjusting prices, ensuring smooth business operations and preventing negative impacts.
- Key enterprises must jointly bear legal responsibility for violations related to pricing and fraudulent trade practices in the sale of gasoline and fuel oil within their distribution systems.
- Key enterprises have the responsibility to import gasoline and fuel oil according to schedule and implement circulation reserves as prescribed to ensure sufficient supply of gasoline and fuel oil for domestic market needs under all circumstances.
- Provincial Departments of Finance shall cooperate with Provincial Departments of Industry and Trade and Market Management Agencies to inspect the implementation of gasoline and fuel oil prices in their respective localities, linking price inspections with quality assurance and measurement unit checks corresponding to the prices, promptly identifying and addressing any violations within their authority according to current regulations or reporting to competent authorities for handling in accordance with the law.
Article 4. Technical StandardsThis Decision takes effect from 10:00 AM on August 14, 2008, replacing the gasoline and fuel oil prices in Decision No. 57/2008/QD-BTC dated July 21, 2008 of the Minister of Finance on gasoline and fuel oil prices.
