DECREE

Regulations on registration of nationality and rights for aircrafty

 Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006 and the Law Amending and Supplementing Some Articles of the Civil Aviation Law of Vietnam dated November 21, 2014;

At the proposal of the Minister of Transport,

The Government issues a Decree on the registration of nationality and rights for aircraft.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Decree stipulates the registration of nationality and the registration of rights for aircraft in Vietnam, including: Registration and cancellation of aircraft nationality; registration and cancellation of rights for aircraft; issuance of codes for registering and cancelling international rights for aircraft with Vietnamese nationality; registration and cancellation of documents designating persons entitled to request cancellation of registration or export of aircraft.

2. This Decree does not regulate the registration of nationality and the registration of rights for state service aircraft, including military aircraft, specialized aircraft of customs and police forces, and other aircraft used for state purposes, except when state service aircraft are used for civilian purposes.

3. The registration of mortgage or pledge of aircraft shall be carried out in accordance with the provisions of the law on registration of secured transactions.

Article 2. Applicability

This Decree applies to agencies, organizations, and individuals related to the registration of nationality and the registration of rights for aircraft in Vietnam.

Article 3. Explanation of Terms

1. Aircraft nationality registration includes registration of aircraft with Vietnamese nationality, temporary registration of aircraft with Vietnamese nationality.

2. Rights over aircraft include:

a) Ownership rights to aircraft;

b) Possession rights over aircraft through lease-purchase or lease agreements with terms of six months or more;

c) Mortgage, pledge of aircraft or other secured transactions as provided by civil law;

d) Priority payment rights for salvage costs and aircraft preservation;

đ) Other rights as provided by international treaties to which the Socialist Republic of Vietnam is a party.

3. The Cape Town Convention and Protocol (referred to as the Cape Town Convention) is the Convention on International Interests in Mobile Equipment and the Protocol on Matters Specific to Aircraft Equipment.

4. International interests in aircraft are the rights held by the secured party, lessor, or seller of the aircraft according to the provisions of the Cape Town Convention.

5. Registered international interests in aircraft are international interests in aircraft registered at the International Registry under the provisions of the Cape Town Convention.

6. AEP code (Authority Entry Point Code) is the code issued in accordance with the provisions of the Cape Town Convention for the purpose of registering or cancelling international interests in aircraft.

7. IDERA document (Irrevocable De-registration and Export Request Authorization) is the document issued in accordance with the provisions of the Cape Town Convention, specifying the person entitled to request cancellation of registration or export of aircraft.

8. Priority payment order is the order of debts that are prioritized for payment as provided by law.

Chapter II

REGISTRATION AND CANCELLATION OF AIRCRAFT NATIONALITY; EXPORT OF AIRCRAFT

Section 1

REGISTRATION OF AIRCRAFT NATIONALITY

Article 4. Requirements and conditions for registration of aircraft nationality

1. Requirements for registration of aircraft nationality

a) Aircraft owned by Vietnamese organizations or individuals, aircraft leased-purchased or leased without crew for operation in Vietnam for a term of twenty-four months or more must be registered with Vietnamese nationality in accordance with this Decree.

b) Within six (06) months from the date of importation into Vietnam, aircraft must be registered with Vietnamese nationality.

2. Conditions for aircraft to be registered with Vietnamese nationality

a) Not having nationality of any country or having cancelled foreign nationality registration;

b) Having legal documents proving ownership of the aircraft; possession rights over the aircraft for lease-purchase or lease cases;

c) For used aircraft, it must meet the age requirements of the aircraft as prescribed by law.

d) Meeting the conditions and requirements for national defense and security; aviation safety and security and environmental protection as prescribed by law.

3. Conditions for aircraft to be temporarily registered with Vietnamese nationality

Aircraft may be temporarily registered with Vietnamese nationality if such aircraft are in the manufacturing, assembly, or testing phase in Vietnam and meet the conditions specified in Points a, b, and d Clause 2 of this Article.

4. Persons entitled to propose the registration of aircraft nationality include:

a) Aircraft owner;

b) Leased-purchaser of aircraft, lessee of aircraft (hereinafter collectively referred to as lessee of aircraft).

Article 5. Procedures for registering aircraft with Vietnamese nationality

1. The person requesting to register an aircraft with Vietnamese nationality shall submit the application directly, through postal services, or by other appropriate means to the Civil Aviation Authority of Vietnam and shall be responsible for the accuracy and truthfulness of the information recorded in the application.

2. The application for registering an aircraft with Vietnamese nationality includes:

a) Form No. 01 as prescribed in the Appendix attached to this Decree;

b) A certified copy (or a copy accompanied by the original for verification) of the document proving the legal status of the person requesting registration;

c) A certified copy (or a copy accompanied by the original for verification) of the legal document proving ownership of the aircraft;

d) A certified copy (or a copy accompanied by the original for verification) of the certificate of non-registration issued by the manufacturing country or the certificate of deregistration issued by the country where it was previously registered;

đ) A certified copy (or a copy accompanied by the original for verification) of the documentation on the technical condition of the aircraft, including: Export airworthiness certificate still valid for aircraft produced abroad; confirmation document from the manufacturer regarding compliance with design and manufacturing conditions still valid for newly manufactured aircraft; logbook recording all executed technical instructions or notifications on the aircraft; logbook recording the technical condition of the aircraft, engines, and other equipment;

e) A certified copy (or a copy accompanied by the original for verification) of the aircraft purchase contract, lease contract, or lease-purchase contract.

3. Documents in foreign languages must be legalized according to the provisions of the law on consular certification and legalization.

4. Within five (05) working days from the date of receipt of complete applications as prescribed, the Civil Aviation Authority of Vietnam shall issue the Aircraft Registration Certificate with Vietnamese nationality according to Form No. 04 as prescribed in the Appendix attached to this Decree; if not issued, the Civil Aviation Authority of Vietnam must respond in writing to the applicant and specify the reasons.

In case the application is incomplete, within two (02) working days from the date of receipt of the application, the Civil Aviation Authority of Vietnam shall issue a written guidance to the applicant to complete the application as required.

5. The person requesting to register an aircraft with Vietnamese nationality must pay the fee as prescribed by law.

Article 6. Procedures for temporarily registering aircraft with Vietnamese nationality

1. The person requesting to temporarily register an aircraft with Vietnamese nationality shall submit the application directly, through postal services, or by other appropriate means to the Civil Aviation Authority of Vietnam and shall be responsible for the accuracy and truthfulness of the information recorded in the application.

2. The application for temporarily registering an aircraft with Vietnamese nationality includes:

a) Form No. 01 as prescribed in the Appendix attached to this Decree;

b) A certified copy (or a copy accompanied by the original for verification) of the document proving the legal status of the person requesting registration;

c) A certified copy (or a copy accompanied by the original for verification) of the legal document proving ownership of the aircraft;

d) A certified copy (or a copy accompanied by the original for verification) of the legal document proving that the aircraft is currently in the manufacturing, assembly, or testing phase in Vietnam;

đ) Aircraft design documentation.

3. Documents in foreign languages must be legalized according to the provisions of the law on consular certification and legalization.

4. Within five (05) working days from the date of receipt of complete applications as prescribed, the Civil Aviation Authority of Vietnam shall issue the Temporary Aircraft Registration Certificate with Vietnamese nationality according to Form No. 05 as prescribed in the Appendix attached to this Decree; if not issued, the Civil Aviation Authority of Vietnam must respond in writing to the applicant and specify the reasons.

In case the application is incomplete, within two (02) working days from the date of receipt of the application, the Civil Aviation Authority of Vietnam shall issue a written guidance to the applicant to complete the application as required.

5. The Temporary Aircraft Registration Certificate with Vietnamese nationality is valid for up to thirty-six (36) months from the date of issuance and cannot be extended.

6. The person requesting to temporarily register an aircraft with Vietnamese nationality must pay the fee as prescribed by law.

Article 7. Procedure for Reissuing Aircraft Nationality Registration Certificate

1. In cases where the Aircraft Nationality Registration Certificate of Vietnam or the Temporary Aircraft Nationality Registration Certificate of Vietnam is torn, damaged, or lost, the applicant must notify in writing to the Civil Aviation Authority to obtain a reissued certificate.

2. The applicant for reissuing the Aircraft Nationality Registration Certificate shall submit the application directly, through the postal service system, or by other appropriate means to the Civil Aviation Authority and shall be responsible for the accuracy and truthfulness of the information recorded in the application.

3. The application for reissuing the Aircraft Nationality Registration Certificate includes:

a) Form No. 03 prescribed in the Appendix attached to this Decree;

b) A certified copy (or a copy with the original for comparison) of the documents proving the legal status of the applicant.

4. Within three (03) working days from the date of receipt of the complete application as prescribed, the Civil Aviation Authority shall issue the Aircraft Nationality Registration Certificate of Vietnam or the Temporary Aircraft Nationality Registration Certificate of Vietnam; revoke the Aircraft Nationality Registration Certificate of Vietnam or the Temporary Aircraft Nationality Registration Certificate of Vietnam except in cases of loss; publish the information on the Civil Aviation Authority's electronic website.

In cases where the application is incomplete, within two (02) working days from the date of receipt of the application, the Civil Aviation Authority shall issue a written notice guiding the applicant to complete the application in accordance with the regulations.

5. The applicant for reissuing the Aircraft Nationality Registration Certificate shall pay the fee as prescribed by law.

Section 2

DELETION OF AIRCRAFT NATIONALITY REGISTRATION, EXPORT OF AIRCRAFT

Article 8. Cases of Deletion of Nationality Registration

1. Cases of deletion of nationality registration of aircraft include:

a) Aircraft declared missing under the provisions of the law;

b) Aircraft no longer meeting the conditions stipulated in Article 4 of this Decree;

c) At the request of the owner of the aircraft or the applicant for nationality registration of the aircraft;

d) At the request of the person designated in the IDERA document.

2. Cases of deletion of temporary nationality registration of aircraft include:

a) The validity period of the Temporary Aircraft Nationality Registration Certificate has expired;

b) The aircraft is no longer in the manufacturing, assembly, or testing phase in Vietnam;

c) At the request of the owner of the aircraft or the person designated in the IDERA document.

Article 9. Procedure for Deletion of Nationality Registration of Aircraft

1. For cases of deletion prescribed in Points a and b of Clause 1 and Points a and b of Clause 2 of Article 8 of this Decree, the Civil Aviation Authority shall decide to delete the nationality registration of the aircraft and issue the Aircraft Nationality Registration Deletion Certificate according to Form No. 06 prescribed in the Appendix attached to this Decree; revoke the Aircraft Nationality Registration Certificate of Vietnam or the Temporary Aircraft Nationality Registration Certificate of Vietnam, except in cases of loss or destruction along with the aircraft.

2. For cases of deletion prescribed in Points c and d of Clause 1 and Point c of Clause 2 of Article 8 of this Decree, the applicant for deletion of nationality registration of the aircraft shall submit the application directly, through the postal service system, or by other appropriate means to the Civil Aviation Authority and shall be responsible for the accuracy and truthfulness of the information recorded in the application.

If the IDERA document has been registered in accordance with this Decree, only the person designated in the IDERA document has the right to request deletion of the nationality registration of the aircraft.

3. The application for deletion of nationality registration of the Vietnamese aircraft includes:

a) Form No. 02 prescribed in the Appendix attached to this Decree;

b) A certified copy (or a copy with the original for comparison) of the documents proving the legal status of the applicant for deletion;

b) A certified copy (or a copy with the original for comparison) of the documents proving the legal status of the applicant for deletion;

c) In cases where the applicant for deletion is the person designated in the IDERA document, the application must also include the consent document for deletion and export of the aircraft from those international interests that have been registered with higher priority than the international interest of the applicant for deletion or evidence that the higher-priority international interests have been executed;

d) In cases where the applicant for deletion is the person receiving security by aircraft as designated in the IDERA document, the application must also include evidence that the applicant for deletion has notified in writing to those international interests that have been registered, the owner of the aircraft, and the applicant for nationality registration of the aircraft about the request for deletion of the aircraft at least ten days before submitting the application.

4. Documents in foreign languages must be legalized consularly in accordance with the law on consular certification and legalization.

5. Within five (05) working days from the date of receipt of the complete application as prescribed, the Civil Aviation Authority shall issue the Aircraft Nationality Registration Deletion Certificate of Vietnam according to Form No. 06 prescribed in the Appendix attached to this Decree; revoke the Aircraft Nationality Registration Certificate of Vietnam or the Temporary Aircraft Nationality Registration Certificate of Vietnam, except in cases of loss or destruction along with the aircraft; if not issued, the Civil Aviation Authority must reply in writing to the applicant and specify the reasons.

In cases where the application is incomplete, within two (02) working days from the date of receipt of the application, the Civil Aviation Authority shall issue a written notice guiding the applicant to complete the application in accordance with the regulations.

6. The applicant for deletion of nationality registration of the aircraft shall pay the fee as prescribed by law.

Article 10. Export of Aircraft

1. Conditions for exporting aircraft include:

a) Having a valid Export Airworthiness Certificate issued or recognized by the competent state authority;

b) Meeting requirements for national defense and security; aviation safety, aviation security, and environmental protection as prescribed;

c) Being suitable for the operational or business needs of the organization or individual making the request;

d) The aircraft having been deregistered from its Vietnamese nationality.

2. Persons entitled to request the export of aircraft include:

a) The owner of the aircraft; the lessor of the aircraft;

b) The person designated in the IDERA document.

3. In cases where the owner of the aircraft or the lessor requests the export of the aircraft, they must have the written consent of the person who registered the aircraft.

4. If the IDERA document has been registered according to this Decree, only the person designated in the IDERA document has the right to request the export of the aircraft.

5. The export of aircraft shall be carried out in accordance with this Decree, regulations on granting flight permits, and other relevant legal provisions.

Section 3

NATIONALITY MARKS AND REGISTRATION MARKS

Article 11. Nationality marks and registration marks

1. The nationality mark of Vietnam for aircraft includes the emblem of the Vietnamese National Flag and the registration mark of the aircraft carrying Vietnamese nationality.

2. The registration mark of the aircraft carrying Vietnamese nationality is represented by two (02) consecutive letters "VN" followed by a hyphen "-", one of the following letters, and three (03) Arabic numerals:

a) The letter "A" for jet-powered aircraft (Turbofan/Turbojet);

b) The letter "B" for propeller-driven jet aircraft (Turboprop);

c) The letter "C" for piston-engine aircraft;

d) The letter "D" for other types of aircraft.

Article 12. General requirements for painting and affixing nationality marks and registration marks on aircraft

1. When in operation, aircraft carrying Vietnamese nationality must be painted or affixed with nationality marks and registration marks.

2. Aircraft carrying Vietnamese nationality may not bear marks that contain content or form ensuring similarity or likely to cause confusion with aircraft carrying the nationality of another country.

3. The Civil Aviation Authority of Vietnam is responsible for notifying the International Civil Aviation Organization (ICAO) about the nationality marks and registration marks of aircraft carrying Vietnamese nationality.

Article 13. Position and size of nationality marks and registration marks

1. The nationality marks and registration marks of aircraft carrying Vietnamese nationality displayed on the fuselage and wings of the aircraft must ensure durability, clarity, and easy visibility to the naked eye or by ordinary means of recognition.

2. Requirements for painting or affixing nationality marks and registration marks are as follows:

a) The emblem of the Vietnamese National Flag must be one-third (1/3) the length in width, proportionate and appropriate to each type of aircraft; it must be painted or affixed on both sides of the vertical stabilizer or both sides of the front part of the fuselage of the aircraft.

b) Letters and numbers representing the registration mark must be presented in uppercase letters and numbers; the height of each character (except the hyphen) within the same group of marks must be equal;

c) The width of each character (except the number 1) must be two-thirds (2/3) the height of each character; the width of the number 1 must be one-sixth (1/6) the height of each character. The hyphen must be centered vertically and have a width equal to half the height of each character;

d) Each character's line must be bold, contrasting in color with the background where the mark is painted or affixed. The width of the line equals one-sixth the height of each character. The distance between characters must be at least one-quarter (1/4) the width of each character.

3. The position and height of painting or affixing the registration mark for heavier-than-air aircraft are as follows:

a) On the wing of the aircraft: Underneath the left wing and possibly the entire underside of both wings if extended. The mark must be positioned equidistant from the leading edge and trailing edge of the wing; the top of the mark must point towards the leading edge of the wing. The height of the mark must be at least 50 cm;

b) On the fuselage (or similar structures) and the vertical tail surface: The height of the mark must be at least 30 cm and located on both sides of the fuselage, between the wing and horizontal stabilizer or the upper half of both surfaces for aircraft with a single vertical stabilizer, the upper half of the outer surfaces of multiple vertical stabilizers for aircraft with multiple vertical stabilizers.

4. For painting or affixing marks on other types of aircraft not heavier than air, the registrant of the aircraft decides in accordance with the provisions of Clauses 1 and 2 of this Article.

5. In cases where leased aircraft have their own crew, the aircraft must be painted or affixed with nationality marks and registration marks in accordance with this Decree within six months from the date of importation into Vietnam.

Chapter III

REGISTRATION OF RIGHTS TO AIRCRAFT, DELETION OF OWNERSHIP REGISTRATION FOR AIRCRAFT, RIGHT OF POSSESSION OF AIRCRAFT

Section 1

REGISTRATION OF OWNERSHIP RIGHTS TO AIRCRAFT, RIGHT OF POSSESSION OF AIRCRAFT

1. Large electricity consumers or retail electricity suppliers in authorized zone or cluster models may purchase electricity from the Electricity Corporation to meet their entire demand.

1. Rights to aircraft carrying Vietnamese nationality must be registered in accordance with this Decree.

2. Organizations and individuals of Vietnam holding rights to aircraft carrying the nationality of another country shall carry out registration in accordance with the laws of the country whose aircraft carries such nationality.

3. The time of registration of rights to aircraft as stipulated in Clause 1 of this Article is determined based on the time of receiving valid application files.

Article 15. Procedures for registering ownership rights of aircraft

1. The owner of the aircraft who requests to register the ownership rights of the aircraft shall submit the application directly, through the postal system, or by other means to the Civil Aviation Authority of Vietnam and shall be responsible for the accuracy and truthfulness of the information recorded in the application.

2. The application for registering the ownership rights of Vietnamese aircraft includes:

a) Form No. 01 as prescribed in the Appendix attached to this Decree;

b) A certified copy (or a copy accompanied by the original for verification) of the document proving the legal status of the person requesting registration;

c) A certified copy (or a copy with the original for comparison) of the legal document proving ownership of the aircraft; in cases of transferring ownership of the aircraft, there must also be a document proving the ownership of the previous owner.

3. Documents and applications in foreign languages must be legalized according to the provisions of the law on consular certification and legalization.

4. Within three (03) working days from the date of receipt of all required documents, the Civil Aviation Authority of Vietnam shall issue the Aircraft Ownership Registration Certificate according to Model No. 07 stipulated in the Appendix issued together with this Decree; if not issued, the Civil Aviation Authority of Vietnam must respond in writing to the applicant and specify the reasons.

In case the application is incomplete, within one (01) working day from the date of receipt of the application, the Civil Aviation Authority of Vietnam shall issue a written guidance to the applicant to complete the application in accordance with the regulations.

5. The applicant for registering the ownership rights of the aircraft must pay the prescribed fee according to the law.

Article 16. Procedures for registering possession rights of aircraft

1. The lessee of the aircraft who requests to register the possession rights of the aircraft shall submit the application directly, through the postal system, or by other appropriate means to the Civil Aviation Authority of Vietnam and shall be responsible for the accuracy and truthfulness of the information recorded in the application.

2. The application for registering the possession rights of Vietnamese aircraft includes:

a) Form No. 01 as prescribed in the Appendix attached to this Decree;

b) A certified copy (or a copy accompanied by the original for verification) of the document proving the legal status of the person requesting registration;

c) A certified copy (or a copy with the original for comparison) of the lease agreement or purchase lease agreement for the aircraft, in cases where the lessor in the lease agreement or the purchase lessor in the purchase lease agreement is also the owner of the aircraft;

d) A certified copy (or a copy with the original for comparison) of the lease agreement or purchase lease agreement for the aircraft and a document proving that the lessor or purchase lessor has the right to sublease the aircraft, in cases where the lessor in the lease agreement or the purchase lessor in the purchase lease agreement is not the owner of the aircraft.

3. Documents in foreign languages must be legalized according to the provisions of the law on consular certification and legalization.

4. Within three (03) working days from the date of receipt of all required documents, the Civil Aviation Authority of Vietnam shall issue the Aircraft Possession Registration Certificate according to Model No. 08 stipulated in the Appendix issued together with this Decree; if not issued, the Civil Aviation Authority of Vietnam must respond in writing to the applicant and specify the reasons.

In case the application is incomplete, within one (01) working day from the date of receipt of the application, the Civil Aviation Authority of Vietnam shall issue a written guidance to the applicant to complete the application in accordance with the regulations.

5. The applicant for registering the possession rights of the aircraft must pay the prescribed fee according to the law.

Article 17. Procedures for registering priority payment rights for salvage and preservation services of aircraft

1. Within ninety (90) days from the end of the salvage and preservation work, the applicant for registering priority payment rights for salvage and preservation services of the aircraft shall submit the application directly, through the postal system, or by other appropriate means to the Civil Aviation Authority of Vietnam and shall be responsible for the accuracy and truthfulness of the information recorded in the application.

2. The application for registering priority payment rights for salvage and preservation services of the aircraft includes:

a) Form No. 01 as prescribed in the Appendix attached to this Decree;

b) A certified copy (or a copy with the original for comparison) of the documents proving the legal status of the applicant.

3. Within three (03) working days from the date of receipt of all required documents, the Civil Aviation Authority of Vietnam shall issue the Aircraft Priority Payment Registration Certificate for Salvage and Preservation Services according to Model No. 09 stipulated in the Appendix issued together with this Decree; if not issued, the Civil Aviation Authority of Vietnam must respond in writing to the applicant and specify the reasons.

In case the application is incomplete, within one (01) working day from the date of receipt of the application, the Civil Aviation Authority of Vietnam shall issue a written guidance to the applicant to complete the application in accordance with the regulations.

4. The applicant for registering priority payment rights for salvage and preservation services of the aircraft must pay the prescribed fee according to the law.

Article 18. Registration of Priority Payment Rights for Aircraft Rescue and Preservation Services for Foreign-Owned Aircraft

The registration of priority payment rights for aircraft rescue and preservation services for foreign-owned aircraft shall be carried out in accordance with the laws of the country where the aircraft is registered. The Civil Aviation Authority of Vietnam confirms the rescue and preservation services provided for the aircraft in Vietnam and notifies the country where the aircraft is registered.

Article 19. Procedures for Reissuing Certificates of Registration of Rights for Aircraft

1. If a Certificate of Registration of Rights for Aircraft issued has been torn, damaged, or lost, the applicant must follow the procedures set forth in this Decree to obtain a reissue.

2. The applicant for reissuance of the Certificate of Registration of Rights for Aircraft shall submit the application directly, through the postal system, or by other appropriate means to the Civil Aviation Authority of Vietnam and shall bear responsibility for the accuracy and truthfulness of the information recorded in the application.

3. The application for reissuance of the Certificate of Registration of Rights for Aircraft includes:

a) Form No. 03 prescribed in the Appendix attached to this Decree;

b) A certified copy (or a copy with the original for comparison) of the documents proving the legal status of the applicant.

4. Within three (03) working days from the date of receipt of all required documents, the Civil Aviation Authority of Vietnam shall issue a new Certificate of Ownership Right for Aircraft, Certificate of Possession Right for Aircraft, or Certificate of Registration of Priority Payment Rights for Aircraft Rescue and Preservation Services; revoke the Certificate of Ownership Right for Aircraft, Certificate of Possession Right for Aircraft, or Certificate of Registration of Priority Payment Rights for Aircraft Rescue and Preservation Services in case of loss; publish the information on the Civil Aviation Authority of Vietnam's website; if not issued, the Civil Aviation Authority of Vietnam must respond in writing to the applicant and specify the reasons.

In cases where the application is incomplete, within two (02) working days from the date of receipt of the application, the Civil Aviation Authority of Vietnam shall issue a written notice guiding the applicant to complete the application in accordance with the regulations.

5. The applicant for the Certificate of Registration of Rights for Aircraft shall pay the prescribed fees in accordance with the law.

Section 2

CANCELLATION OF REGISTRATION OF OWNERSHIP RIGHTS AND POSSESSION RIGHTS FOR AIRCRAFT

Article 20. Procedures for Cancellation of Registration of Ownership Rights for Aircraft

1. The owner of the aircraft applying for cancellation of registration of ownership rights shall submit the application directly, through the postal system, or by other appropriate means to the Civil Aviation Authority of Vietnam and shall bear responsibility for the accuracy and truthfulness of the information in the application.

2. The application for cancellation of registration of ownership rights for Vietnamese aircraft includes:

a) Form No. 02 prescribed in the Appendix attached to this Decree;

b) A certified copy (or a copy accompanied by the original for verification) of the document proving the legal status of the applicant for cancellation of registration.

3. Within three (03) working days from the date of receipt of all required documents, the Civil Aviation Authority of Vietnam shall issue a Certificate of Cancellation of Registration of Ownership Rights for Aircraft according to Model No. 10 stipulated in the Appendix attached to this Decree; revoke the previously issued Certificate of Ownership Right for Aircraft; if not issued, the Civil Aviation Authority of Vietnam must respond in writing to the applicant and specify the reasons.

In case the application is incomplete, within one (01) working day from the date of receipt of the application, the Civil Aviation Authority of Vietnam shall issue a written guidance to the applicant to complete the application in accordance with the regulations.

Article 21. Procedure for Removing Registration of Aircraft Possession Rights

1. The lessee of registered aircraft who requests to remove registration of aircraft possession rights shall submit the dossier directly, through the postal system, or by other appropriate means to the Civil Aviation Authority of Vietnam and shall be responsible for the accuracy and truthfulness of the information recorded in the dossier.

2. The dossier for requesting removal of registration of aircraft possession rights includes:

a) Form No. 02 prescribed in the Appendix attached to this Decree;

b) A certified copy (or a copy accompanied by the original for verification) of the document proving the legal status of the applicant for cancellation of registration.

3. Within three (03) working days from the date of receipt of the complete dossier as prescribed, the Civil Aviation Authority of Vietnam shall issue the Certificate of Removal of Registration of Aircraft Possession Rights according to Model No. 10 stipulated in the Appendix issued together with this Decree; recover the previously issued Certificate of Aircraft Possession Rights; in case of non-issuance, the Civil Aviation Authority of Vietnam must respond in writing to the applicant and specify the reasons.

In case the application is incomplete, within one (01) working day from the date of receipt of the application, the Civil Aviation Authority of Vietnam shall issue a written guidance to the applicant to complete the application in accordance with the regulations.

Chapter IV

PROCEDURE FOR ISSUING AEP CODE AND REGISTRATION, REMOVAL OF REGISTRATION OF IDERA DOCUMENTS

Article 22. Procedure for Issuing AEP Code

1. Organizations and individuals having international interests in aircraft bearing Vietnamese nationality who request issuance of AEP code shall submit the dossier directly, through the postal system, or by other appropriate means to the Civil Aviation Authority of Vietnam and shall be responsible for the truthfulness and accuracy of the information recorded in the dossier.

2. The dossier for requesting issuance of AEP code includes:

a) Two (02) application forms for AEP code according to Model No. 11 stipulated in the Appendix issued together with this Decree;

b) Certified copy (or copy accompanied by the original for verification) of documents proving the legal status of the person requesting issuance of AEP code;

c) Certified copy (or copy accompanied by the original for verification) of legal documents proving international interests in aircraft of the person requesting issuance of AEP code.

3. Documents in foreign languages must be legalized according to the provisions of the law on consular certification and legalization.

4. Within three (03) working days from the date of receipt of the complete dossier as prescribed, the Civil Aviation Authority of Vietnam shall issue the AEP code and return one (01) application form to the applicant; in case of non-issuance, the Civil Aviation Authority of Vietnam must respond in writing to the applicant and specify the reasons.

In case the application is incomplete, within one (01) working day from the date of receipt of the application, the Civil Aviation Authority of Vietnam shall issue a written guidance to the applicant to complete the application in accordance with the regulations.

5. The applicant for issuance of AEP code shall pay the fee as prescribed by law.

Article 23. Procedure for Registration of IDERA Document

1. The owner of the aircraft or the person requesting registration of the aircraft who requests registration of the IDERA document shall submit the dossier directly, through the postal system, or by other appropriate means to the Civil Aviation Authority of Vietnam and shall be responsible for the truthfulness and accuracy of the information recorded in the dossier.

2. The dossier for requesting registration of the IDERA document includes:

a) Two (02) application forms for registration of IDERA document according to Model No. 12 stipulated in the Appendix issued together with this Decree;

b) Certified copy (or copy accompanied by the original for verification) of documents proving the legal status of the person requesting registration of the IDERA document;

c) Certified copy (or copy accompanied by the original for verification) of documents proving international interests of the designated person in aircraft bearing Vietnamese nationality.

3. Documents in foreign languages must be legalized according to the provisions of the law on consular certification and legalization.

4. Within five (05) working days from the date of receipt of the complete dossier as prescribed, the Civil Aviation Authority of Vietnam shall confirm the registration in the application form for registration of the IDERA document and return one (01) application form to the applicant; in case of non-issuance, the Civil Aviation Authority of Vietnam must respond in writing to the applicant and specify the reasons.

In case the application is incomplete, within one (01) working day from the date of receipt of the application, the Civil Aviation Authority of Vietnam shall issue a written guidance to the applicant to complete the application in accordance with the regulations.

5. The applicant for registration of the IDERA document shall pay the fee as prescribed by law.

Article 24. Procedure for Removing Registration of IDERA Text

1. The person designated in the IDERA text requesting to remove registration of the IDERA text shall submit the application directly, through the postal system, or by other appropriate means to the Civil Aviation Administration of Vietnam and shall be responsible for the truthfulness and accuracy of the information recorded in the application.

2. The application for removing registration of the IDERA text includes:

a) Two (02) forms for removing registration of the IDERA text according to Form No. 13 prescribed in the Appendix issued together with this Decree;

b) A certified copy (or an un-certified copy accompanied by the original for verification) of the document proving the legal status of the person requesting removal of registration of the IDERA text.

3. Documents in foreign languages must be legalized according to the provisions of the law on consular certification and legalization.

4. Within five (05) working days from the date of receipt of the complete application as prescribed, the Civil Aviation Administration of Vietnam shall issue confirmation of removal of registration on the form for removing registration of the IDERA text and return one (01) form to the applicant; if not issuing, the Civil Aviation Administration of Vietnam must respond in writing to the applicant and specify the reasons.

In case the application is incomplete, within one (01) working day from the date of receipt of the application, the Civil Aviation Authority of Vietnam shall issue a written guidance to the applicant to complete the application in accordance with the regulations.

5. The person requesting removal of registration of the IDERA text must pay the fee as prescribed by law.

Chapter V

REGISTER OF VIETNAMESE AIRCRAFT

Article 25. Register of Vietnamese Aircraft

1. The Register of Vietnamese Aircraft is used to record information related to registration, removal of registration of nationality, and rights over aircraft, the handling of collateral assets secured by aircraft, and other information related to aircraft bearing Vietnamese nationality and temporarily bearing Vietnamese nationality.

The Register of Vietnamese Aircraft is established in the form of a paper Record Book or an electronic Register.

2. The Register of Vietnamese Aircraft includes the following basic contents:

a) Date entered into the Register of Vietnamese Aircraft for each type of registration;

b) Certificate issued for each type of registration: Number, date of issuance;

c) Nationality and registration number;

d) Type of aircraft;

đ) Aircraft manufacturer;

e) Serial number and date of manufacture of the aircraft;

g) Aircraft category;

h) Aircraft type certificate: Number, issuing authority;

i) Export airworthiness certificate: Number, issuing authority, date of issuance;

k) Airworthiness certificate: Number, issuing authority, date of issuance;

l) Owner: Full name, address, nationality;

m) Possessor: Full name, address, nationality;

n) Term of possession for leased aircraft;

o) Operator: Full name, address, nationality;

p) Lessee: Full name, address, nationality;

q) Secured party: Full name, address, nationality;

r) Secured creditor: Full name, address, nationality;

s) Value of the obligation secured by the aircraft;

t) Term of validity of the registration of the security transaction;

u) Person reporting the handling of collateral assets secured by the aircraft: Full name, address, nationality;

v) Full name, address, nationality of the person performing rescue and maintenance of the aircraft;

x) Term of validity for aircraft registered temporarily with nationality;

y) Removal of registration for each type of registration: Date, reason for removal of registration;

z) Other necessary information.

Article 26. Provision of Registration Information in the Register of Vietnamese Aircraft

1. Organizations and individuals related to aircraft operations requesting provision of information already registered in the Register of Vietnamese Aircraft shall submit the application directly, through the postal system, or by other appropriate means to the Civil Aviation Administration of Vietnam.

2. The application for provision of information includes:

a) Form according to Form No. 14 prescribed in the Appendix issued together with this Decree;

b) A certified copy (or an un-certified copy accompanied by the original for verification) of the document proving the legal status of the person requesting provision of information.

3. Within two (02) working days from the date of receipt of the complete application as prescribed, the Civil Aviation Administration of Vietnam shall provide information, issue extracts, and copies from the Register of Vietnamese Aircraft to the applicant; if not providing information, the Civil Aviation Administration of Vietnam must respond in writing to the applicant and specify the reasons.

4. The person requesting provision of information must pay the fee as prescribed by law.

5. Within fifteen (15) working days from the date of issuance of the Certificate of Registration of Nationality of the Aircraft, the Civil Aviation Administration of Vietnam shall provide information about the registration of nationality of the aircraft to the Ministry of Defense for airspace management, flight management, and other purposes as prescribed by law.

Article 27. Handling complaints, suggestions; correcting and supplementing information on aircraft nationality registration and rights registration

1. The Civil Aviation Authority of Vietnam shall be responsible for handling and responding in writing to complaints, suggestions, or requests from organizations and individuals related to aircraft nationality registration or rights registration.

2. A person requesting to correct or supplement information on aircraft nationality registration and rights registration shall submit the application for correction or supplementation directly, through postal service, or other appropriate means to the Civil Aviation Authority of Vietnam.

3. The application for correction or supplementation of information on aircraft nationality registration and civil aircraft rights registration includes:

a) Form No. 03 prescribed in the Appendix attached to this Decree;

b) A certified copy (or a copy accompanied by the original for verification) of documents proving the legal status of the person requesting to correct or supplement information on aircraft nationality registration and civil aircraft rights registration;

c) A certified copy (or a copy accompanied by the original for verification) of documents proving the information to be corrected or supplemented.

4. Documents in foreign languages must be legalized consularly in accordance with the law on consular certification and legalization.

5. Within one (01) working day from the date of receiving complete files as prescribed, the Civil Aviation Authority of Vietnam shall implement the correction or supplementation of information on aircraft nationality registration and civil aircraft rights registration in the Aircraft Register of Vietnam, issue new Certificates, and promulgate relevant documents.

In case of refusal to correct or supplement information on aircraft nationality registration, the Civil Aviation Authority of Vietnam must respond in writing to the applicant and clearly state the reasons.

6. The person requesting to correct or supplement information must pay fees as prescribed by law.

Chapter VI

IMPLEMENTING PROVISIONS

Article 28. Effective Date

1. This Decree takes effect from October 15, 2015.

2. This Decree replaces Decree No. 70/2007/NĐ-CP dated April 20, 2007 on aircraft nationality registration and rights registration for civil aircraft and Decree No. 50/2012/NĐ-CP of the Government dated June 11, 2012 amending and supplementing certain provisions of Decree No. 70/2007/NĐ-CP dated April 20, 2007 on aircraft nationality registration and rights registration for civil aircraft.

Article 29. Transitional Provisions

Certificates related to aircraft registration in Vietnam issued before the effective date of this Decree shall continue to be valid for use according to the validity period stated in such Certificates; in cases where these Certificates expire, new Certificates must be issued in accordance with this Decree.

Article 30. Implementation

1. The Ministry of Transport shall be responsible for organizing the implementation of this Decree.

2. The Ministry of Finance shall stipulate the rates of collection and management and use of various fees and charges related to aircraft nationality registration, rights registration, priority payment right registration for salvage services and aircraft preservation, issuance of registration numbers, cancellation of international rights registration for aircraft bearing Vietnamese nationality, registration and cancellation of designation documents for persons entitled to request cancellation of registration or export of aircraft; provision of information in the Aircraft Register of Vietnam and correction or supplementation of information on aircraft nationality registration and rights registration at the request of the Ministry of Transport.

3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial and centrally-run city People's Committees, and related organizations and individuals shall be responsible for implementing this Decree./.
