OF THE NATIONAL ASSEMBLY ON TRIAL ORGANIZATION OF POSITIONS FOR FULL-TIME MEMBERS OF THE HA NOI CITY PEOPLE'S COUNCIL

||| Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Law on Organization of Local Administration dated June 19, 2015;

Pursuant to the Law Amending and Supplementing Several Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

BASED ON RESOLUTION NO. 97/2019/QH14 OF THE NATIONAL ASSEMBLY ON TRIAL ORGANIZATION OF URBAN ADMINISTRATIVE MODELS IN HA NOI CITY ON NOVEMBER 17, 2019;

BASED ON RESOLUTION NO. 160/2021/QH14 OF THE NATIONAL ASSEMBLY ON TRIAL ORGANIZATION OF POSITIONS FOR FULL-TIME MEMBERS OF THE HA NOI CITY PEOPLE'S COUNCIL ON APRIL 8, 2021;

At the request of the Minister of Home Affairs,

THE GOVERNMENT ISSUES THIS DECREE TO DETAIL AND GUIDE THE IMPLEMENTATION OF RESOLUTION NO. 160/2021/QH14 OF THE NATIONAL ASSEMBLY ON TRIAL ORGANIZATION OF POSITIONS FOR FULL-TIME MEMBERS OF THE HA NOI CITY PEOPLE'S COUNCIL ON APRIL 8, 2021.

ARTICLE 1. The position of full-time member at the Board under the Ha Noi City People's Council as stipulated in Clause 2, Article 1 of Resolution No. 160/2021/QH14 of the National Assembly on trial organization of positions for full-time members of the Ha Noi City People's Council dated April 8, 2021

1. Each Board under the Ha Noi City People's Council shall have one full-time member. The full-time member shall be examined and approved by the Standing Committee of the Ha Noi City People's Council upon the proposal of the Chairman of the Board of the People's Council.

2. The position of full-time member (hereinafter referred to as the full-time member) at each Board under the Ha Noi City People's Council shall be defined as follows:

a) Full-time member of the Legal Affairs Board;

b) Full-time member of the Economy and Budget Board;

c) Full-time member of the Culture and Social Affairs Board;

d) Full-time member of the Urban Affairs Board.

3. Qualifications for the position of full-time member:

a) Being a current member of the Ha Noi City People's Council;

b) Having a bachelor's degree or higher; having expertise and professional qualifications suitable for the position of full-time member at each Board under the Ha Noi City People's Council as stipulated in Clause 2 of this Article; having practical experience and the ability to participate in performing tasks of the Board under the People's Council.

4. Full-time members shall receive salaries according to the current regulations for civil servants and public officials; they shall also receive allowances equivalent to the position of head of department at provincial level and other benefits and policies as prescribed by law.

Article 2. Effective Date

This Decree takes effect from the date of issuance.

Article 3. Responsibility for Implementation

1. The Ministry of Home Affairs shall be responsible for inspecting the implementation of this Decree.

2. The People's Council and People's Committee of Ha Noi City within their respective duties and powers shall be responsible for implementing this Decree.

3. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of the People's Council, Chairmen of the People's Committee of Ha Noi City, and related agencies, organizations, and individuals shall be responsible for enforcing this Decree.
