Based on the supplementary agreement to Article 8 of the Agreement on Transiting Goods signed on April 3, 1994 between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia confirmed by the exchange of letters between the Minister of Trade of the Socialist Republic of Vietnam on October 30, 1995 and the Minister of Commerce of the Kingdom of Cambodia on March 22, 1996;
Based on Clause 3, Article 26, Chapter V, Decree No. 33/CP dated April 19, 1994 of the Government on state management over export and import activities.

Article 1. Supplementing Point 5, Part One of the Regime:
Supplementing the border gate pair
Tinh Bien (An Giang) - Phnom Den (Takeo) for goods of the Kingdom of Cambodia transiting through the territory of Vietnam.
Article 2. Amending Clause 2.1, Point 2, Part One of the Regime as follows:
The Ministry of Trade shall issue a "Transit Goods Permit" according to the request for transit of goods from Cambodian enterprises. The Ministry of Trade of Vietnam authorizes the Regional Export-Import Management Office in Ho Chi Minh City to issue a "Transit Goods Permit" (according to Form No. 07) within four days from the date of receipt of the request for transit of goods from Cambodian enterprises. The name "Transit Goods Permit" replaces the name "Permit for Transporting Transit Goods" in the original regime and Form No. 07.
Article 3. Amending and supplementing Section II, Part Two of the Regime as follows:
Enterprises eligible for consideration to be granted permission to transport transit goods for Cambodian enterprises must meet one of the five conditions below:
1. An enterprise that has been granted a business license for import and export by the Ministry of Trade, which has actually transported transit goods for Cambodian enterprises or exported goods to Cambodia during the years 1990-1995.
2. An enterprise with the function of operating international freight forwarding and/or multimodal transport and combined transport services.
3. An enterprise designated by the People's Committee of a province with a border gate agreed upon by both governments to transport transit goods for Cambodian enterprises.
4. An enterprise that has actually transported transit goods for Cambodian enterprises during the years 1990-1995.
5. An enterprise established with the function of transporting goods for transit to Cambodia.
The above enterprises must submit to the Ministry of Trade an application for transporting transit goods including:
a) Application for transporting transit goods for Cambodian enterprises (according to Form No. 04).
b) Business license for import and export (photocopy certified true copy) for the subject mentioned at point 1/II above.
c) Decision on establishment of the enterprise and registration at the time of establishment (photocopy certified true copy) for the subjects mentioned at points 2/II, 4/II, and 5/II above.
d) Document of the People's Committee of the province or city designating the enterprise in its locality and requesting the Ministry of Trade to approve the enterprise to transport transit goods (for the subject mentioned at point 3/II above).
e) Report on the process of transporting transit goods for Cambodian enterprises and exporting goods to Cambodia (according to Form No. 05 for the subjects mentioned at points 1/II and 4/II above).
Article 4. Amending Point 1, Section I and Point 1, Section II of Part Three as follows:
Photocopy of the Transit Goods Permit (certified true copy).
Article 5. The functional Departments of the Ministry of Trade are responsible for disseminating and guiding enterprises to implement this decision.
Article 6. This Decision takes effect from the date of signature.
