PRIME MINISTER

Based on the Government Organization Law dated September 30, 1992;

On the basis of the Law on Enacting Legal Normative Documents dated November 12, 1996;

Pursuant to the State Budget Law dated March 20, 1996; the Law Amending and Supplementing Certain Provisions of the State Budget Law dated May 20, 1998;

Pursuant to Decree No. 101/CP of the Government dated September 23, 1997 detailing the implementation of certain provisions of the Law on Enactment of Legal Normative Documents;

Considering the proposal of the Minister of Finance,

DECISION:

Article 1. This Decision promulgates the Regulation on Management and Use of Funding to Support the Development of Legal Normative Documents of the National Assembly, the Standing Committee of the National Assembly, the Government, and the Prime Minister.

Article 2. This Decision shall take effect fifteen days from the date of signature.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and municipal People's Committees directly under the central government shall be responsible for implementing this Decision.

REGULATIONS

Management and Use of Funding to Support the Development of Legal Normative Documents

PART I

GENERAL PROVISIONS

Article 1. The state budget supports funding for developing draft laws and draft ordinances according to the National Assembly’s legislative program; draft resolutions with regulatory content of the National Assembly;Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the Standing Committee of the National Assembly; draft resolutions, decrees of the Government according to the Government’s legislative program; draft decisions, directives of the Prime Minister with regulatory content.

Article 2. Funding to support the development of legal normative documents is allocated in the annual budget estimate and balanced into the regular budget plan of the agency assigned to lead the development of legal normative documents, review, examine, organize introduction and publication of legal normative documents.

Article 3.Funding to develop decisions, directives, circulars, joint circulars, and international treaties containing regulatory content not falling within the scope of documents stipulated in Article 1 of this Regulation shall be arranged by the agency leading the development of legal normative documents within the approved annual budget estimate.

Article 4. Other sources of funding such as domestic and foreign organizations and individuals’ aid and sponsorship for the development of legal normative documents are balanced into the budget for developing draft projects and drafts. The use and management of these sources of funding are applied similarly to the use and management of state budget funding for the work of developing legal normative documents.

Chapter II

ESTABLISHING BUDGET ESTIMATES, ISSUANCE, USE AND SETTLEMENT OF FUNDS

Article 5. Annually, based on the legislative program of the National Assembly and the Government and the cost standards for the contents prescribed in Clause 1 of Article 8 of this Regulation, the agency assigned to lead the development of legal normative documents establishes a budget estimate for funding to support the development of legal normative documents and sends it to the Ministry of Finance, the National Assembly Office, the Government Office, and the Ministry of Justice. The deadline for sending the budget estimate coincides with the deadline for submitting the proposed legislative program of the ministry or sector as stipulated in Clause 3 of Article 9 of Decree No. 101/CP dated September 23, 1997.

The Ministry of Finance takes the lead and coordinates with the National Assembly Office, the Government Office, and the Ministry of Justice to determine the level of funding support for each legal normative document to be included in the annual state budget estimate.

Article 6. Based on the approved level of funding support for the development of legal normative documents in the annual budget, the agency assigned to lead the development of legal normative documents establishes a corresponding budget estimate for expenditures in line with the planned progress of the development of legal normative documents and sends it to the Ministry of Finance as the basis for issuing funds.

Article 7. Based on the allocated funding, the approved budget estimate, and the progress of implementing the development of each legal normative document, the Ministry of Finance is responsible for promptly issuing funds to the agency assigned to lead the development of legal normative documents and the agency reviewing, examining, organizing introduction and publication of legal normative documents.

Article 8.

1.Funding to support the development of legal normative documents as stipulated in Article 1 of this Regulation shall be used for the following purposes:

a) Drafting legal normative documents:

Investigation, field survey, inviting experts, collaborators;

Translation, preparation of materials;

Drafting, seminars, preparation of documents;

Printing of materials;

Other expenses (if any).

c) Review and verification work;

d) Work of announcing laws and ordinances.

d) Organizational work for the promulgation of laws and ordinances.

2.The Ministry of Finance shall take the lead and coordinate with the National Assembly Office, the Government Office, and the Ministry of Justice to specify the expenditure levels for each item stipulated in Clause 1 of this Article. Annually, the Ministry of Finance shall be responsible for compiling and settling the budgetary support funds for the development of regulatory legal documents in accordance with current regulations.

Article 9.In cases where a project for developing regulatory legal documents is not included in the annual program for developing regulatory legal documents of the National Assembly, the Government, or where a document is included in the program but is transferred to the following year or temporarily suspended, the drafting agency must promptly notify the Ministry of Finance, the National Assembly Office, the Government Office, and the Ministry of Justice to compile, supplement, and adjust the budget accordingly.

Article 10.Quarterly, the agency assigned the main responsibility for developing regulatory legal documents must report on the use of allocated funds and the progress of developing regulatory legal documents to the Ministry of Finance as a basis for adjusting or providing additional support funds for the development of regulatory legal documents.

Article 11.

1.The management and use of support funds for the development of regulatory legal documents must comply strictly with the provisions of the State Budget Law, Decree No. 87/CP dated December 19, 1996 of the Government detailing the decentralization of budget management, preparation, implementation, and settlement; Decree No. 51/1998/NĐ-CP dated July 18, 1998 of the Government amending and supplementing certain articles of Decree No. 87/CP dated December 19, 1996 mentioned above, and related guiding documents.

2.Agency assigned the main responsibility for developing regulatory legal documents that violate this Regulation and cause wastage of state budget funds shall be subject to legal sanctions in accordance with the law./.
