Pursuant to Decision No. 108/2001/QĐ-TTg dated July 23, 2001 of the Prime Minister establishing the National Steering Committee for Resettlement of the Son La Hydropower Plant Project;

At the proposal of the Chairman of the National Steering Committee for Resettlement of the Son La Hydropower Plant Project.

DECISION:

Article 1. Issued together with this Decision is the Regulation on the Operation of the National Steering Committee for Resettlement of the Son La Hydropower Plant Project.

12/2025/TT-BNNMT dated June 19, 2025 issued by the Minister of Agriculture and EnvironmentThis Decision takes effect fifteen days after the date of signature.

Article 3. The Ministers, Heads of ministerial-level agencies, Heads of government-attached agencies, Chairmen of People's Committees of provinces and centrally governed cities, and members of the National Steering Committee for Resettlement of the Son La Hydropower Plant Project shall be responsible for implementing this Decision.

 REGULATIONS

Operation of the National Steering Committee for Resettlement of the Son La Hydropower Plant Project

(Issued together with Decision No. 69/2002/QĐ-TTg dated June 6, 2002 of the Prime Minister)

Chapter 1:

GENERAL PROVISIONS

Article 1. The National Steering Committee for Resettlement of the Son La Hydropower Plant Project (referred to as the National Steering Committee) established by Decision No. 108/2001/QĐ-TTg dated July 23, 2001 of the Prime Minister has the following tasks:

1. Directing the construction of resettlement models and pilot farms to draw lessons and propose mechanisms and policies for organizing management and implementation of relocation and resettlement suitable for each area.

2. Directing ministries, sectors, local authorities, and coordinating with people's organizations to implement compensation and resettlement for households within the Son La Hydropower Plant Project.

3. Guiding, urging, inspecting ministries, sectors, localities, and proposing policies and solutions to ensure stable production and living conditions for the people in the resettlement process.

4. Regularly reporting to the Prime Minister on the results and progress of relocation and resettlement for the Son La Hydropower Plant Project.

Article 2. The operating funds of the National Steering Committee for Resettlement of the Son La Hydropower Plant Project are provided from the state budget; there is a separate budget prepared and settled annually.

Chapter 2:

OPERATING REGIME

Article 3. The Chairman of the National Steering Committee convenes and chairs regular meetings every six months and extraordinary meetings as required by the situation proposed by members. The Chairman may delegate the Deputy Chairman in charge to chair the meetings. The agenda of the meetings is prepared by the permanent office of the National Steering Committee, and members are responsible for attending fully and according to the composition of the meetings of the National Steering Committee.

Article 4. Regular meetings aim to evaluate the activities of the National Steering Committee, the results of relocation and resettlement, the implementation of policies and systems, the results of resolving difficulties, and requesting the Prime Minister to resolve issues beyond the authority of the National Steering Committee.

Article 5. The National Steering Committee assigns each member to coordinate with ministries and sectors to inspect, build, supplement, and amend policies and systems and solutions for implementing relocation and resettlement for the Son La Hydropower Plant Project; the National Steering Committee is the focal point for coordinating the activities of ministries, sectors, and localities to implement the resettlement project.

Article 6. Information Reporting System

- Periodic reports: Members of the National Steering Committee report monthly and quarterly on the implementation of tasks assigned by the National Steering Committee regarding relocation and resettlement to the permanent office of the National Steering Committee.

- In October each year, members of the National Steering Committee will work directly with ministries and sectors on the implementation of tasks, five-year plans, and annual plans of ministries, sectors, and localities regarding relocation and resettlement for the Son La Hydropower Plant Project.

- Ad hoc reports: Members of the National Steering Committee are responsible for reporting issues related to relocation and resettlement to serve leadership and direction as required by the Chairman of the National Steering Committee.

Article 7. Work Trip System

Based on work requirements, members of the National Steering Committee proactively go to grassroots levels to grasp the situation, solve difficulties and obstacles according to their assigned functions and tasks, and undertake ad hoc trips as required by the Chairman of the National Steering Committee.

Chapter 3:

ASSIGNMENT OF RESPONSIBILITIES OF MEMBERS OF THE NATIONAL STEERING COMMITTEE

Article 8. The Chairman of the National Steering Committee for Resettlement of the Son La Hydropower Plant Project is responsible before the Prime Minister for all activities of the Committee according to the tasks assigned as stipulated in Article 1 of this Regulation; assigning, directing, inspecting, and urging members of the National Steering Committee to fulfill their assigned tasks.

Article 9. Responsibilities of members of the National Steering Committee

1. Comrade representative of the Prime Minister, whose main responsibility is to serve as a direct link between the Prime Minister's directives and the operations of the National Steering Committee; directly assisting the Chairman in inspecting, urging members of the Committee, and directing the implementation of tasks assigned by the Chairman.

2. Deputy Chairman in charge, Vice Minister of Agriculture and Rural Development assists the Chairman in managing and solving the regular work of the National Steering Committee and represents the Chairman in handling specific tasks according to the Chairman's authorization. Directly directs specific tasks:

- Directing the development of planning and resettlement plans.

- Directing the planning and arrangement of agricultural and forestry production linked to processing and consumption of products in the resettlement area.

- Developing mechanisms and policies for developing agricultural and forestry production in the resettlement area.

- Inspecting, urging, and guiding resettlement work.

- Preparing the program and content of National Steering Committee meetings.

- Directing the work of the National Steering Committee Office:

+ Summarizing and reporting on the situation.

+ Ensuring material and financial conditions for the operation of the National Steering Committee as prescribed.

3. Deputy Chairman - Vice Minister of Industry participates in directing the overall activities of the National Steering Committee, directly directing and coordinating:

- Develop planning for industrial and small-scale industrial development linked with agricultural, forestry, and fisheries production in the resettlement areas.

- Direct the construction of the overall progress schedule for population relocation and resettlement, disbursement progress, in accordance with water levels, and consistent with the overall construction progress of the Son La Hydropower Plant.

- Coordinate with the Ministry of Transport, the Ministry of Construction, the General Post Office, and related ministries and sectors in planning and building infrastructure to serve population relocation and resettlement work.

- Direct Vietnam Electricity Corporation to ensure sufficient capital and timely disbursement to effectively implement compensation policies and related policies in the implementation of population relocation and resettlement.

4. The Deputy Minister of Planning and Investment shall have the following responsibilities:

- Chair and coordinate with relevant ministries and sectors to review and approve population relocation and resettlement projects submitted to competent authorities for approval according to current regulations of the Investment Management and Construction Regulation.

- Chair and coordinate with relevant ministries and sectors to develop policies encouraging investment in relocation and resettlement areas, primarily policies for businesses from various economic components investing and developing production in resettlement areas.

- Direct the consolidation and balancing of investment capital plans for population relocation and resettlement according to progress schedules; ensuring adequate budgetary funds according to plans.

5. The Deputy Minister of Finance shall have the following responsibilities:

- Chair and coordinate with relevant ministries and sectors and localities to develop compensation policies and systems for population relocation and resettlement; policies for managing and using state budget funds to implement compensation, relocation, and resettlement work.

- Coordinate with the Ministry of Planning and Investment in balancing, ensuring funding, and guiding the inspection and supervision of funding allocation, expenditure, and settlement of accounts for funds to implement population relocation and resettlement.

6. The Deputy Minister of Science and Technology and Environment shall chair and coordinate with relevant ministries, sectors, and localities to review and address environmental impacts and related issues when implementing population relocation and resettlement. Study contents and models applying science and technology to production, daily life, and infrastructure construction in resettlement areas.

7. The Deputy Minister and Deputy Director of the Committee for Ethnic Minorities and Mountainous Areas shall chair and coordinate with relevant ministries, sectors, and localities to inspect the implementation of ethnic policies, promote and mobilize ethnic groups residing in mountainous areas to implement well the Party and State's policies and guidelines; participate in reviewing resettlement plans and models based on aligning with the Party and State's viewpoints and policies on ethnic affairs (unity, equality, mutual assistance for common development).

8. The Vice Chairman of the National Ethnic Council of the National Assembly shall perform assigned tasks in the State Steering Committee, while chairing and coordinating with National Assembly agencies; provincial People's Councils' delegations, and related agencies to inspect and supervise the implementation of population relocation and resettlement for the Son La Hydropower Plant Project.

9. The Vice Chairman of the Vietnam Farmers' Union shall direct all levels of the Union to participate in implementing population relocation and resettlement; chair and coordinate with agencies to inspect and supervise the implementation of compensation policies and systems, stabilizing and developing agricultural, forestry, and fisheries production; propose and recommend measures to quickly stabilize the lives and develop production for relocated ethnic groups under the Son La Hydropower Plant Project.

10. The Deputy Head of the Central Economic Commission shall chair and coordinate with supervisory agencies to monitor economic policies for population relocation and resettlement under the Son La Hydropower Plant Project; participate in reviewing projects, developing resettlement policies and systems, and inspection work.

11. The Senior Specialist of the Government Office shall have the following responsibilities:

- Serve as the dedicated secretary of the State Steering Committee for population relocation and resettlement of the Son La Hydropower Plant Project.

- Coordinate with the State Steering Committee Office to monitor and consolidate information related to population relocation and resettlement work for the Son La Hydropower Plant Project.

12. The Deputy Chairmen of the People's Committees of Son La and Lai Chau Provinces shall directly implement specific tasks regarding population relocation and resettlement within their respective provinces, including:

- Direct education, propaganda, and persuasion work to ensure that the people comply well with the Party and State's policies and guidelines on population relocation and resettlement.

- Direct the construction and implementation of provincial population relocation and resettlement planning and policies according to the division of labor by the Government; chair the review of population relocation and resettlement projects submitted for approval by competent authorities according to current regulations of the Investment Management and Construction Regulation.

- Develop five-year and annual plans for population relocation and resettlement within each province.

- Organize compensation, relocation of residents, and propose related policies for population relocation and resettlement.

- Organize the stabilization of living conditions and the development of production in resettlement areas.

- Implement regular and ad hoc reporting systems on population relocation and resettlement work.

- Ensure security, political stability, social order, and ethnic unity in resettlement areas.

Chapter 4:

THE SUPPORTING ORGANIZATION OF THE STATE STEERING COMMITTEE

Article 10.

- The State Steering Committee for population relocation and resettlement of the Son La Hydropower Plant Project has a supporting unit which is the Committee Office located at the Ministry of Agriculture and Rural Development (Settlement and New Economic Zone Department).

- The Director of the Settlement and New Economic Zone Department directly serves as the Chief of the Committee Office and is responsible before the State Steering Committee for all activities of the Office. The Deputy Chiefs assisting the Director - Chief of the Office consist of one to two Deputy Chiefs.

- The Committee Office uses the organizational structure, civil servants, and means of the Settlement and New Economic Zone Department to carry out its tasks.

The Committee Office is permitted to use the seal of the Settlement and New Economic Zone Department and open a separate account, receiving operational funds from the state budget allocated by the Ministry of Finance.

Article 11. Duties and powers of the Committee Office:

Duties:

- Coordinate with specialized agencies under the Ministry of Agriculture and Rural Development and those of other ministries and sectors at central and local levels to implement tasks assigned by the National Steering Committee.

- Continuously grasp the situation and advise the National Steering Committee on its work program to effectively carry out the Committee's tasks.

- Prepare reports as required by the National Steering Committee.

- Prepare content and organize meetings and seminars of the National Steering Committee according to the guidance of the Deputy Head of the National Steering Committee.

- Ensure material resources and operating funds for the National Steering Committee within the allocated budget.

- Draft, settle accounts, and finalize financial statements for the operating funds allocated to the National Steering Committee and its Office in accordance with current financial regulations.

Powers:

- Attend meetings of the National Steering Committee.

- Attend meetings of ministries, sectors, and localities related to resettlement for the Son La Hydropower Plant Project.

Chapter 5:

IMPLEMENTING PROVISIONS

Article 12. This regulation applies to the National Steering Committee for resettlement of the Son La Hydropower Plant Project and relevant ministries, sectors, and localities during implementation.

Article 13. Each member of the National Steering Committee shall be personally responsible before the National Steering Committee, the head of the personnel management agency, and the Prime Minister for the tasks assigned by the National Steering Committee; they must use staff, means, and equipment managed by their own unit to perform assigned tasks.

Article 14. In case of difficulties during implementation, the National Steering Committee will compile opinions and propose necessary supplements and amendments to be submitted to the Prime Minister for consideration and decision.
