Detailed regulations on insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates
insurance brokerage, certificate for insurance auxiliary services
Pursuant to the Insurance Business Law dated June 16, 2022;
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Insurance Management and Supervision Department,
The Minister of Finance issues this Circular detailing insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates.
PART I
GENERAL PROVISIONS
This Circular details Clause 6 Article 81, Clause 3 Article 130, Clause 2 Article 138, Clause 2 Article 139, Clause 4 Article 143, and Clause 2 Article 157 of the Insurance Business Law dated June 16, 2022.
The applicable subjects of this Circular include:
1. The Insurance Supervisory and Management Department (Ministry of Finance).
2. Life insurance companies, non-life insurance companies, health insurance companies (hereinafter referred to as insurance companies), branches of foreign non-life insurance companies, organizations providing micro-insurance.
3. Domestic training institutions for insurance as stipulated in Article 7 of this Circular (hereinafter referred to as training institutions).
4. Individuals taking the insurance certificate, insurance agency certificate, insurance brokerage certificate, and insurance auxiliary certificate examinations (hereinafter referred to as candidates).
5. Individuals holding insurance certificates and insurance agency certificates issued before January 1, 2023.
6. Individuals holding insurance certificates, insurance brokerage certificates, and insurance auxiliary certificates issued by foreign insurance training institutions as stipulated in Article 8 of this Circular.
7. Organizations and individuals related to training, organizing examinations, issuing insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates.
1. Procedures for registering for examinations, approving examination results, and reviewing examination papers for insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates; procedures for issuing, revoking, replacing, and converting insurance agency certificates shall be conducted through the Insurance Certificate Examination Management System of the Insurance Supervisory and Management Department (hereinafter referred to as the Examination Management System).
2. Examinations for insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates shall be conducted in either computer-based or paper-based multiple-choice formats. In the case of computer-based examinations, computers must be connected to the Examination Management System.
3. The Insurance Supervisory and Management Department shall develop examination questions and test papers for insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates according to the corresponding training content for each type of certificate as specified in this Circular.
Chapter II
INSURANCE CERTIFICATES, INSURANCE BROKERAGE CERTIFICATES, AND INSURANCE AUXILIARY CERTIFICATES
Section 1
TYPES OF INSURANCE CERTIFICATES, INSURANCE BROKERAGE CERTIFICATES, INSURANCE AUXILIARY CERTIFICATES, TRAINING CONTENT, DOMESTIC AND FOREIGN INSURANCE TRAINING INSTITUTIONS
The insurance certificate prescribed in point b Clause 3, point b Clause 4 Article 81 of the Insurance Business Law dated June 16, 2022 includes the following types:
1. For insurance certificates issued by domestic insurance training institutions:
a) Life insurance certificate;
b) Non-life insurance certificate;
c) Health insurance certificate.
2. For insurance certificates issued by foreign insurance training institutions:
a) Life insurance business certificate;
b) Non-life insurance business certificate;
c) Health insurance business certificate.
3. Insurance certificates issued by domestic or foreign insurance training institutions before January 1, 2023 shall continue to be used as follows:
a) Basic life insurance certificate, life insurance business certificate: equivalent to the insurance certificate prescribed in point a Clause 1 of this Article;
b) Basic non-life insurance certificate, non-life insurance business certificate: equivalent to the insurance certificate prescribed in point b Clause 1 of this Article;
c) Basic health insurance certificate, health insurance business certificate: equivalent to the insurance certificate prescribed in point c Clause 1 of this Article.
Article 5. Insurance Broker Certificate
The insurance broker certificate prescribed in Clause 2, Article 138 of the Insurance Business Law on June 16, 2022 shall be one of the following certificates:
1. Insurance broker certificate issued by domestic training institutions on insurance;
2. Insurance broker certificate issued by foreign training institutions on insurance.
The insurance ancillary services certificate prescribed at point b, Clause 1, and point b, Clause 2, Article 143 of the Insurance Business Law on June 16, 2022 shall be one of the following types of certificates:
1. For advisory certificates issued by domestic training institutions on insurance:
a) Life insurance advisory certificate;
b) Non-life insurance advisory certificate;
c) Health insurance advisory certificate.
2. For risk assessment certificates issued by domestic training institutions on insurance:
a) Life insurance risk assessment certificate;
b) Non-life insurance risk assessment certificate;
c) Health insurance risk assessment certificate.
3. For loss adjustment certificates issued by domestic training institutions on insurance:
a) Marine loss adjustment certificate for ship damage and civil liability of ship owners, cargo transportation insurance by sea and inland waterways (hereinafter referred to as marine loss adjustment certificate);
b) Aviation loss adjustment certificate;
c) Non-life insurance loss adjustment certificate (excluding cargo insurance, aviation insurance).
4. For claims settlement support certificates issued by domestic training institutions on insurance:
a) Life insurance claims settlement support certificate;
b) Non-life insurance claims settlement support certificate;
c) Health insurance claims settlement support certificate.
5. For certificates issued by foreign training institutions on insurance:
a) Insurance certificate prescribed at point a, Clause 2, Article 4 of this Circular has equivalent value to the certificates prescribed at point a, Clause 1, point a, Clause 2, and point a, Clause 4 of this Article;
b) Insurance certificate prescribed at point b, Clause 2, Article 4 of this Circular has equivalent value to the certificates prescribed at point b, Clause 1, point b, Clause 2, Clause 3, and point b, Clause 4 of this Article;
c) Insurance certificate prescribed at point c, Clause 2, Article 4 of this Circular has equivalent value to the certificates prescribed at point c, Clause 1, point c, Clause 2, and point c, Clause 4 of this Article;
d) Non-life insurance loss adjustment certificate issued by foreign training institutions on insurance has equivalent value to the certificates prescribed in Clause 3 of this Article.
Article 7. Domestic Training Institutions on Insurance
Domestic training institutions on insurance are institutions with functions of training on insurance belonging to one of the following cases:
1. Training institutions established by state agencies: Institute, academy, university.
2. Training institutions under or directly under units established by state agencies.
3. Other training institutions with legal personality established and operating legally in Vietnam.
Foreign training institutions on insurance are institutions with functions of training on insurance belonging to one of the following cases:
1. Training institutions under or directly under insurance management and supervision agencies; or training institutions authorized by insurance management and supervision agencies to implement training and issue certificates in the field of insurance.
2. ASEAN Insurance Research and Training Institute (AITRI); International Actuaries Association member organizations.
3. Training organizations from countries that have mutual recognition agreements on insurance certificates with Vietnam.
4. Training institutions from foreign insurance groups, foreign reinsurance groups.
5. Other international training organizations: Australian and New Zealand Institute of Insurance and Finance (ANZIIF), Chartered Insurance Institute (CII), Canadian Institute of Actuaries (CIA), Institute of Risk Management (IRM), Australian Institute of Risk Management (AIRM), Chartered Loss Adjusters Association (CILA), Australian Institute of Chartered Loss Adjusters (AICLA), Lloyd's Maritime Academy, Life Office Management Association (LOMA), Life Insurance Marketing and Research Association (LIMRA).
Article 9. Content of Insurance Certificate Training
Domestic insurance training institutions shall provide insurance certificate training according to the following contents:
1. Content of Life Insurance Certificate Training:
a) General knowledge on insurance and reinsurance;
b) Basic knowledge on life insurance and health insurance business operations;
c) Vietnamese laws on life insurance and health insurance business operations.
2. Content of Non-Life Insurance Certificate Training:
a) General knowledge on insurance and reinsurance;
b) Basic knowledge on non-life insurance and health insurance business operations;
c) Vietnamese laws on non-life insurance and health insurance business operations.
3. Content of Health Insurance Certificate Training:
a) General knowledge on insurance and reinsurance;
b) Basic knowledge on health insurance business operations;
c) Vietnamese laws on health insurance business operations.
Article 10. Content of Insurance Broker Certificate Training
Domestic insurance training institutions shall provide insurance broker certificate training according to the following contents:
1. General Knowledge on Insurance and Insurance Business Operations:
a) Principles of insurance and reinsurance;
b) Basic knowledge on life insurance, non-life insurance, and health insurance business operations.
2. Vietnamese laws on insurance and insurance brokerage business operations.
3. Principles, responsibilities, and ethics of insurance brokerage practice.
4. Skills and practical experience in insurance brokerage practice.
1. Domestic insurance training institutions shall provide ancillary services certificate training according to the following contents:
a) Vietnamese laws on insurance and ancillary services business operations;
b) Basic principles of insurance;
c) Knowledge on insurance business operations;
d) Procedures for implementing ancillary insurance services.
2. The training contents specified in Clause 1 of this Article correspond to the type of insurance and insurance business operations of each ancillary services certificate as stipulated in Article 6 of this Circular.
Section 2
APPLICATIONS, PROCEDURES FOR EXAMINATION, GRADING, ISSUANCE, AND RECALL OF INSURANCE CERTIFICATES, BROKERAGE CERTIFICATES, AND ANCILLARY SERVICES CERTIFICATES BY DOMESTIC INSURANCE TRAINING INSTITUTIONS
The organization of insurance certificate, insurance brokerage certificate, and ancillary services certificate examinations shall be carried out in accordance with the following provisions:
1. The Insurance Supervision and Management Department is the examination organizing unit.
2. Examination sessions shall be held at centralized examination venues announced by the Insurance Supervision and Management Department.
3. Before December 31 of each year, the Insurance Supervision and Management Department shall announce specific examination times and locations for the next year's insurance certificates, insurance brokerage certificates, and ancillary services certificates on the Certificate Examination Management System.
1. Registration for examinations shall be conducted online through the Certificate Examination Management System at least ten days before the examination date. Candidates shall register for the examination through the training institution; the training institution shall register the list of candidates with the required information as stipulated in Clause 2 of this Article on the Certificate Examination Management System and pay the examination fees.
2. Information for registering to take the examination includes:
a) Personal information of the candidate (including: full name, date of birth, Citizen Identity Card number/Identity Card number/Passport number);
b) Name of the examination session for the certificate (detailed for each type of insurance certificate and ancillary services certificate);
c) Type of certificate being registered for the examination (for insurance certificates and ancillary services certificates);
d) Date and location of the examination;
đ) Other relevant information related to the examination session.
3. Three working days before the examination, the Insurance Supervision and Management Department shall announce the list of candidates taking the examination on the Certificate Examination Management System (for cases where all applications and examination fees have been submitted).
1. Each insurance certificate examination and insurance intermediary certificate examination consists of 60 questions with a duration of 90 minutes; each insurance auxiliary certificate examination consists of 80 questions with a duration of 120 minutes.
2. Candidates who answer correctly at least 70% of the total number of questions in the examination will be considered to have passed the respective certificate examination.
The Insurance Management and Supervision Department issues a Decision to approve the examination results for insurance certificates, insurance intermediary certificates, and insurance auxiliary certificates; announces the examination results to the training institutions so that they can inform the candidates (through the Certificate Examination Management System) within five working days from the examination date (for paper-based examinations) or three working days from the examination date (for computer-based examinations).
1. Based on the Decision approving the examination results issued by the Insurance Management and Supervision Department, domestic insurance training institutions shall issue insurance certificates, insurance intermediary certificates, and insurance auxiliary certificates to candidates who have successfully registered for the examination through the training institutions.
2. The issuance of certificates must be completed within ten days from the date of the Decision approving the examination results. Certificates shall be issued according to the models prescribed in the Appendices attached to this Circular: Appendix No. 1 (model of the insurance certificate), Appendix No. 2 (model of the insurance intermediary certificate), and Appendix No. 3 (model of the insurance auxiliary certificate).
3. Within five working days from the date of issuing the insurance certificate, insurance intermediary certificate, or insurance auxiliary certificate, the training institution must update the list of certificates issued by the training institution onto the Certificate Examination Management System according to the model prescribed in Appendix No. 4 attached to this Circular, including the following information:
a) Personal information of the certificate holder (including: full name, date of birth, citizen identification card number/passport number);
b) Name/type of certificate;
c) Date of certificate issuance;
d) Certificate code.
1. Re-examination only applies to paper-based examinations. Candidates submit a re-examination application through the training institution, which forwards it to the Insurance Management and Supervision Department (through the Certificate Examination Management System) within twenty days from the date the Insurance Management and Supervision Department approves the examination results. The re-examination application form is prescribed in Appendix No. 5 attached to this Circular.
2. The Insurance Management and Supervision Department conducts the re-examination and announces the re-examination results on the Certificate Examination Management System within five working days from the date of receiving the candidate's re-examination application.
3. Based on the re-examination results, the Insurance Management and Supervision Department issues a Decision to adjust the examination results (if necessary) and informs the training institution to issue certificates in accordance with Article 16 of this Circular.
Domestic insurance training institutions shall carry out the revocation and replacement of insurance certificates, insurance broker certificates, and insurance ancillary services certificates in accordance with the following provisions:
1. Cases where insurance certificates, insurance broker certificates, and insurance ancillary services certificates are revoked:
a) Individuals who do not participate in the examination or fail to pass the examination for insurance certificates, insurance broker certificates, and insurance ancillary services certificates but still receive certificates from the training institution;
b) Candidates who alter, falsify, or forge personal identification documents (Citizen Identity Card/Identity Card/Passport) during the examination;
c) Individuals who have others take the examination on their behalf;
d) Certificates that are revoked at the request of competent state agencies in accordance with the law.
2. Certificates will be replaced if any of the following personal information of the certificate holder is incorrect or mistaken:
a) Surname/Middle Name/Name;
b) Date of birth;
c) Citizen Identity Card Number/Identity Card Number/Passport Number.
3. Within five working days from the date the training institution has evidence proving that the issued certificate falls under any of the cases stipulated in Clause 1 and Clause 2 of this Article, the training institution shall carry out the revocation and replacement of insurance certificates, insurance broker certificates, and insurance ancillary services certificates that have been issued.
4. Within three working days from the date of revocation or replacement of certificates, the training institution shall notify the Insurance Management and Supervision Department of the list of revoked or replaced insurance certificates, insurance broker certificates, and insurance ancillary services certificates as stipulated in Clause 1 and Clause 2 of this Article; and publish the list of revoked certificates on the training institution's electronic information website. Within three working days from the date of receiving the notification from the training institution, the Insurance Management and Supervision Department shall publicly announce the information about revoked certificates on the Certificate Examination Management System.
5. Individuals whose certificates are revoked in the cases stipulated in Clause 1 of this Article shall not be allowed to participate in insurance certificate examinations for a period of twelve months from the date of certificate revocation.
6. Training institutions violating the regulations on issuing certificates as stipulated in point a, Clause 1 of this Article shall not be permitted to register examination plans and issue insurance certificates, insurance broker certificates, and insurance ancillary services certificates for a period of three years from the date of discovery of the violation (for first-time violations). In case of repeated offenses, the training institution shall not be allowed to continue registering examination plans and issuing insurance certificates, insurance broker certificates, and insurance ancillary services certificates.
Chapter III
INSURANCE AGENCY CERTIFICATES
Section I
CONTENT OF INSURANCE AGENCY CERTIFICATE TRAINING
Article 19. Insurance Agency Certificates
1. Types of insurance agency certificates include:
a) Basic Life Insurance Agency Certificate;
b) Unit-linked Insurance Agency Certificate;
c) Basic Non-life Insurance Agency Certificate;
d) Marine Insurance Agency Certificate;
đ) Aviation Insurance Agency Certificate;
e) Health Insurance Agency Certificate.
a) Basic Life Insurance Agency Certificate issued by life insurance training institutions shall be equivalent to the certificate specified in point a, Clause 1 of this Article;
b) Unit-linked Insurance Agency Certificate issued by life insurance training institutions shall be equivalent to the certificate specified in point b, Clause 1 of this Article;
c) Basic Non-life Insurance Agency Certificate issued by non-life insurance training institutions shall be equivalent to the certificates specified in points c, d, đ, Clause 1 of this Article.
3. The types of insurance agency certificates specified in Clause 1 of this Article shall be used as follows:
a) Basic Life Insurance Agency Certificate: to conduct agency activities for life insurance products (excluding unit-linked insurance products) and health insurance products;
b) Unit-linked Insurance Agency Certificate: to conduct agency activities for unit-linked insurance products;
d) Marine Insurance Agency Certificate: to conduct agency activities for marine insurance products;
đ) Aviation Insurance Agency Certificate: to conduct agency activities for aviation insurance products;
Article 20. Content of insurance agent certificate training
The content of insurance agent certificate training includes:
1. General knowledge about insurance; principles of insurance business operations suitable for each type of insurance agent certificate:
a) For the basic life insurance agent certificate: general knowledge about insurance, principles, and basic knowledge about life insurance business operations (excluding unit-linked insurance), health insurance;
b) For the unit-linked insurance agent certificate: general knowledge about the financial market; basic knowledge about investment; general knowledge about insurance, principles, and basic knowledge about unit-linked insurance business operations;
d) For the marine insurance agent certificate: general knowledge about insurance, principles, and basic knowledge about marine insurance business operations;
e) For the aviation insurance agent certificate: general knowledge about insurance, principles, and basic knowledge about aviation insurance business operations;
f) For the health insurance agent certificate: general knowledge about insurance, principles, and basic knowledge about health insurance business operations;
2. Code of ethics and professional conduct of insurance agents issued by professional organizations;
3. Rights and obligations of insurance companies, branches of foreign non-life insurance companies, micro-insurance mutual organizations, and insurance agents in insurance agency activities;
4. Vietnamese laws on insurance business operations corresponding to the type of insurance and insurance business operations of each type of insurance agent certificate;
5. Skills and practical experience in insurance agency practice;
6. The content of unit-linked insurance agent certificate training, in cases where the basic life insurance agent certificate has already been obtained, includes the contents specified in point b Clause 1 and Clause 4 of this Article;
7. The content of marine insurance agent certificate training, in cases where the basic non-life insurance agent certificate has already been obtained, includes the contents specified in point d Clause 1 and Clause 4 of this Article;
8. The content of aviation insurance agent certificate training, in cases where the basic non-life insurance agent certificate has already been obtained, includes the contents specified in point đ Clause 1 and Clause 4 of this Article;
Section 2
REGISTRATION DOCUMENTS, PROCEDURES, AND REQUIREMENTS FOR EXAMINATION, ISSUANCE, REVOCATION, AND RENEWAL OF INSURANCE AGENT CERTIFICATES
1. Examination Locations:
Insurance agent certificate examinations are organized at the following locations:
a) Concentrated examination venues in provinces and cities announced by the Insurance Supervisory Authority;
b) Examination venues not included in the provinces and cities specified in point a Clause 1 of this Article, registered by insurance companies, branches of foreign non-life insurance companies, and micro-insurance mutual organizations;
c) Examination venues located at the provincial administrative offices of organizations engaged in insurance agency activities that have agreements with insurance companies, branches of foreign non-life insurance companies, and micro-insurance mutual organizations regarding insurance agency activities.
2. In cases where examinations are held at the locations specified in point a Clause 1 of this Article, the Insurance Supervisory Authority organizes the examinations.
3. In cases where examinations are held at the locations specified in point b Clause 1 of this Article, insurance companies, branches of foreign non-life insurance companies, and micro-insurance mutual organizations organize the examinations according to the following regulations:
a) In each province and city, no more than one examination session shall be organized within one month, and each examination session must have a minimum of ten candidates;
b) Ensure material conditions, arrange separate examination rooms to serve the examination process. Each examination room must have a minimum of two technical devices to record all images (with sound) of the examination session, and a stable internet connection to serve remote monitoring through technological applications. For computer-based examinations, ensure that computers function properly and are connected to the Examination Management System, with a minimum number of computers equal to 25% of the number of candidates;
c) Appoint invigilators and graders;
d) Be responsible for the confidentiality of examination questions and answers from the time they receive them until their use is completed for the examination session. Be responsible for compliance with regulations during the organization of the examination;
e) Report examination grading results as stipulated in Clause 1 of Article 24 of this Circular;
f) Retain original paper examination responses and examination session records at insurance companies, branches of foreign non-life insurance companies, and micro-insurance mutual organizations for a minimum of five years, and retain audiovisual recordings of examination sessions for a minimum of three years from the date of the examination session;
g) In cases where the provisions of points b, d, e, or đ of this clause are not followed, insurance companies, branches of foreign non-life insurance companies, and micro-insurance mutual organizations will not be allowed to register plans to organize insurance agent certificate examinations for a period of one month (for first-time violations) or three months (in case of repeated offenses);
4. In cases where examinations are held at the locations specified in point c Clause 1 of this Article, the Insurance Supervisory Authority organizes the examinations according to the following regulations:
a) Examination sessions are organized quarterly; in each province and city, no more than one examination session shall be organized within one quarter, and each examination session must have a minimum of seventy candidates;
b) Insurance companies, branches of foreign non-life insurance companies, and micro-insurance mutual organizations must ensure technical facilities to serve the examination organization process as stipulated in point b Clause 3 of this Article (except for the requirement of technical equipment to serve remote monitoring of examination sessions through technological applications and recording images with sound).
5. Before October 31 each year, the Insurance Management and Supervision Department shall notify the time for organizing examinations at the centralized examination venues as prescribed in Clause 1, Point a of this Article for the following year.
1. Registration of examination plans:
a) For examinations organized at the venues specified in Clause 1, Points a and b of this Circular: before the 25th day of each month, insurance companies, branches of foreign non-life insurance companies, and micro-insurance support organizations shall register with the Insurance Management and Supervision Department through the Insurance Certification Examination Management System for the immediate subsequent month's examination plan.
b) For examinations organized at the venues specified in Clause 1, Point c of this Circular: at least 15 days prior to the end of the quarter, insurance companies, branches of foreign non-life insurance companies, and micro-insurance support organizations shall register the insurance agent certification examination plan for the subsequent quarter.
c) The registration file shall be in accordance with the form prescribed in Appendix No. 6 issued together with this Circular.
2. Notification of examination organization plans:
a) For examinations organized at the venues specified in Clause 1, Points a and b of this Circular: the Insurance Management and Supervision Department shall notify insurance companies, branches of foreign non-life insurance companies, and micro-insurance support organizations of the examination organization plan (including examination format and venue) no later than two working days from the end of the month.
b) For examinations organized at the venues specified in Clause 1, Point c of this Circular: the Insurance Management and Supervision Department shall notify insurance companies, branches of foreign non-life insurance companies, and micro-insurance support organizations of the examination organization plan (including examination format and venue) no later than ten days from the end of the quarter.
3. For examinations organized at the venues specified in Clause 1, Point b of this Circular, if insurance companies, branches of foreign non-life insurance companies, and micro-insurance support organizations intend to change the examination organization plan after being notified by the Insurance Management and Supervision Department (exam venue, exam date, cancellation of the examination), such entities must notify the Insurance Management and Supervision Department (through the Certification Examination Management System) at least one working day before the exam date. In case of failure to comply with this provision, insurance companies, branches of foreign non-life insurance companies, and micro-insurance support organizations will not be allowed to organize examinations at the venues specified in Clause 1, Point b of this Circular for a period of three months (for the first violation) or six months (in case of repeated violations).
4. For examinations organized at the venues specified in Clause 1, Point c of this Circular, if insurance companies, branches of foreign non-life insurance companies, and micro-insurance support organizations intend to change the examination organization plan after being notified by the Insurance Management and Supervision Department (exam venue, exam date, cancellation of the examination), such entities must notify the Insurance Management and Supervision Department (through the Certification Examination Management System) at least five working days before the exam date. In case of failure to comply with this provision, the Insurance Management and Supervision Department will not organize examinations at the venues specified in Clause 1, Point c of this Circular for a period of one quarter (for the first violation) or two quarters (in case of repeated violations).
5. At least one working day before the exam date, insurance companies, branches of foreign non-life insurance companies, and micro-insurance support organizations shall update the list of candidates registered to participate in the insurance agent certification examination for each examination session on the Certification Examination Management System according to the form prescribed in Appendix No. 7 issued together with this Circular.
6. Insurance companies, branches of foreign non-life insurance companies, and micro-insurance support organizations must pay examination fees for candidates according to the list of candidates registered on the Certification Examination Management System as prescribed in Clause 5 of this Article. In case of insufficient payment of examination fees, such entities will not be allowed to register examination plans for the subsequent month (for examinations organized at the venues specified in Clause 1, Points a and b of this Circular) or for the subsequent quarter (for examinations organized at the venues specified in Clause 1, Point c of this Circular).
Article 23. Examination questions, examination time, and passing conditions for the insurance agent certificate examination
1. For the insurance agent certificate examination as prescribed in Clause 1, Article 19 of this Circular: each examination consists of 40 questions, with a duration of 60 minutes.
2. For the insurance agent certificate examination for unit-linked insurance agents who already have a basic life insurance agent certificate; the insurance agent certificate examination for marine insurance and aviation insurance agents who already have a basic non-life insurance agent certificate: each examination consists of 20 questions according to the training content specified in Clause 6, Clause 7, and Clause 8 of Article 20 of this Circular, with a duration of 40 minutes.
3. A candidate who answers correctly at least 75% of the questions in the examination will be considered to have passed the insurance agent certificate examination.
1. Within five working days from the date of the examination, insurance companies, branches of foreign non-life insurance companies, and micro-insurance supply organizations must report the examination scoring results of examinations held in paper format at examination venues specified in Point b, Clause 1, Article 21 of this Circular to the Insurance Management and Supervision Department (through the Certificate Examination Management System) in accordance with the form prescribed in Appendix 8 issued together with this Circular. Insurance companies, branches of foreign non-life insurance companies, and micro-insurance supply organizations shall bear responsibility for the accuracy and honesty of the reported information.
2. The Insurance Management and Supervision Department issues a Decision approving the examination results for the insurance agent certificate and notifies insurance companies, branches of foreign non-life insurance companies, and micro-insurance supply organizations (through the Certificate Examination Management System) within the following deadlines:
a) Within three working days from the examination date for computer-based examinations;
b) Within five working days from the examination date for paper-based examinations organized at examination venues specified in Point a and Point c, Clause 1, Article 21 of this Circular;
c) Within three working days from the date of receiving the examination result report on the Certificate Examination Management System for paper-based examinations organized at examination venues specified in Point b, Clause 1, Article 21 of this Circular.
1. Re-examination only applies to paper-based examinations. Candidates submit a re-examination application through insurance companies, branches of foreign non-life insurance companies, and micro-insurance supply organizations, which then forward the application to the Insurance Management and Supervision Department (through the Certificate Examination Management System) within twenty days from the date the Insurance Management and Supervision Department approves the examination results. The re-examination application form is prescribed in Appendix 5 issued together with this Circular.
2. In cases where a re-examination application is submitted for an examination held at the venue specified in Point b, Clause 1, Article 21 of this Circular, insurance companies, branches of foreign non-life insurance companies, and micro-insurance supply organizations must send the re-examination application along with a copy of the candidate's examination paper to the Insurance Management and Supervision Department (through the Certificate Examination Management System).
3. The Insurance Management and Supervision Department conducts the re-examination and announces the re-examination results on the Certificate Examination Management System within five working days from the date of receiving the candidate's re-examination application; or within five working days from the date of receiving the re-examination application along with a copy of the candidate's examination paper (for examinations held in paper format at the venue specified in Point b, Clause 1, Article 21 of this Circular).
4. Based on the re-examination results, the Insurance Management and Supervision Department issues a Decision to adjust the examination results (if necessary) and issue the insurance agent certificate in accordance with Article 26 of this Circular.
Article 26. Issuance of Insurance Agency Certificates
2. The insurance agency certificate shall be issued in electronic data form through the Certificate Examination Management System. The format of the insurance agency certificate is specified in Appendix 9 attached to this Circular.
3. Insurance companies, branches of foreign non-life insurance companies, and micro-insurance mutual organizations shall receive lists of insurance agency certificates through the Certificate Examination Management System using access accounts provided upon registration for the insurance agency certificate examination plan.
The Insurance Management and Supervision Department shall carry out the revocation and replacement of insurance agency certificates in accordance with the following provisions:
1. Certificates shall be revoked in the following cases:
a) An individual does not participate in the examination or does not pass the insurance agency certificate examination held at the location specified in point b, Clause 1, Article 21 of this Circular but is reported by an insurance company, branch of a foreign non-life insurance company, or micro-insurance mutual organization as having passed the examination;
b) The post-examination review of the candidate's test results does not meet the requirements for passing the insurance agency certificate examination as stipulated in this Circular;
c) A candidate falsifies or forges personal identification documents (Citizen Identification Card/Identity Card/Passport) during the examination;
d) An individual has someone else take the insurance agency certificate examination on their behalf;
đ) An insurance company, branch of a foreign non-life insurance company, micro-insurance mutual organization, and an individual have engaged in fraud in the process of converting insurance agency certificates;
e) The certificate is revoked at the request of a competent state authority in accordance with the law.
2. The certificate shall be replaced in the case prescribed in Clause 2, Article 18 of this Circular.
3. Within three working days from the date the Insurance Management and Supervision Department provides evidence proving that the issued insurance agency certificate falls under one of the circumstances specified in Clause 1 and Clause 2 of this Article, the Insurance Management and Supervision Department shall revoke or replace the issued insurance agency certificate by removing the information from the electronic certificate (in the case of revoking the certificate) or correcting the information on the electronic certificate (in the case of replacing the certificate) on the Certificate Examination Management System.
4. Within three working days from the date of revoking the certificate, the Insurance Management and Supervision Department shall announce the list and information of revoked certificates as specified in Clause 1 of this Article on the Certificate Examination Management System.
5. Individuals whose certificates are revoked in the cases specified in points c, d, đ, and e of Clause 1 of this Article shall not be allowed to sit for the insurance agency certificate examinations for a period of twelve months from the date of revocation of the certificate.
Section 3
REPLACEMENT OF INSURANCE AGENCY CERTIFICATES
Article 28. Principles for Converting Insurance Agency Certificates
The conversion of insurance agency certificates issued before January 1, 2023 to the insurance agency certificates stipulated in this Circular shall be carried out according to the following principles:
5. Converted insurance agency certificates will be stored in electronic form within the Examination Certificate Management System.
1. By June 30, 2025, insurance companies, branches of foreign non-life insurance companies, and micro-insurance mutual organizations shall submit to the Insurance Supervision and Management Department (through the Examination Certificate Management System) applications for converting insurance agency certificates issued before January 1, 2023 to the insurance agency certificates stipulated in this Circular for insurance agents currently working at these entities.
2. Applications for converting insurance agency certificates as stipulated in Clause 1 of this Article shall include:
a) A request letter for certificate conversion (accompanied by a list of insurance agents with certificates to be converted) in the format prescribed in Appendix 10 attached to this Circular;
b) A certified copy of the insurance agency certificate issued before January 1, 2023 for the insurance agent;
c) A certified copy of the citizen identification card/residence book/passport of the insurance agent. In cases where the administrative procedure information system of the Ministry of Finance has completed the connection and sharing of citizen information with the national population database, the Insurance Supervision and Management Department will extract such information from the national population database in accordance with the law.
3. Within fifteen days of receiving the application for certificate conversion, if the application is incomplete or invalid, the Insurance Supervision and Management Department shall issue a notice requesting the insurance company, branch of a foreign non-life insurance company, or micro-insurance mutual organization to supplement and complete the application.
Within sixty days of receiving a complete and valid application, the Insurance Supervision and Management Department shall convert the certificates issued before January 1, 2023 into the certificates stipulated in this Circular. The format of the converted insurance agency certificate shall comply with the provisions set forth in Appendix 9 attached to this Circular.
Chapter IV
RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS IN THE IMPLEMENTATION OF EXAMINATIONS, ISSUANCE, REVOCATION, AND DEMAND FOR INSURANCE CERTIFICATES, INSURANCE AGENCY CERTIFICATES, INSURANCE INTERMEDIARY CERTIFICATES, AND INSURANCE ASSISTANCE CERTIFICATES
1. Issuing the Regulations on the Insurance Certificate Examination, Insurance Agent Certificate Examination, Insurance Broker Certificate Examination, and Insurance Auxiliary Services Certificate Examination.
2. Developing examination question banks for the Insurance Certificate Examination, Insurance Agent Certificate Examination, Insurance Broker Certificate Examination, and Insurance Auxiliary Services Certificate Examination according to the training content specified in this Circular for each type of certificate.
3. Announcing the examination date and location at least thirty-one days before October 31 each year (for Insurance Agent Certificate Examinations held at locations specified in point a, Clause 1, Article 21 of this Circular), or at least thirty-one days before December 31 each year (for Insurance Certificate Examinations, Insurance Broker Certificate Examinations, and Insurance Auxiliary Services Certificate Examinations).
4. Announcing the monthly examination plan for Insurance Agent Certificate Examinations (for examinations held at locations specified in points a and b, Clause 1, Article 21 of this Circular), and quarterly examination plans (for examinations held at locations specified in point c, Clause 1, Article 21 of this Circular) for insurance companies, branches of non-life insurance companies from foreign countries, and micro-insurance mutual organizations.
5. Compiling examination questions, organizing examinations, approving, and announcing the results of the Insurance Certificate Examination, Insurance Agent Certificate Examination, Insurance Broker Certificate Examination, and Insurance Auxiliary Services Certificate Examination.
6. Conducting post-examination reviews for paper-based examinations and monitoring and supervising Insurance Agent Certificate Examinations held at locations specified in point b, Clause 1, Article 21 of this Circular.
7. Organizing re-examinations for the Insurance Certificate Examination, Insurance Agent Certificate Examination, Insurance Broker Certificate Examination, and Insurance Auxiliary Services Certificate Examination for paper-based examinations.
8. Issuing, revoking, and renewing Insurance Agent Certificates; converting Insurance Agent Certificates issued prior to January 1, 2023, to certificates as prescribed in this Circular.
9. Announcing the list of individuals whose certificates have been revoked on the Insurance Certificate Examination Management System.
1. Implementing insurance agent training according to the content stipulated in Article 20 of this Circular.
2. Registering examination plans, updating candidate lists, and submitting examination fees for Insurance Agent Certificate Examinations to the Insurance Management and Supervision Department as prescribed in Clauses 1, 3, 4, 5, and 6, Article 22 of this Circular.
3. Organizing Insurance Agent Certificate Examinations (for examinations held at locations specified in point b, Clause 1, Article 21 of this Circular).
4. Submitting applications for converting Insurance Agent Certificates issued prior to January 1, 2023, to Insurance Agent Certificates as prescribed in this Circular for insurance agents of insurance companies, branches of non-life insurance companies from foreign countries, and micro-insurance mutual organizations as stipulated in Clauses 1 and 2, Article 29 of this Circular to the Insurance Management and Supervision Department.
5. Ensuring the confidentiality of image (with sound) data of examinations held at locations specified in point b, Clause 1, Article 21 of this Circular in accordance with applicable laws.
1. Domestic insurance training institutions shall conduct training for insurance certificates, insurance brokerage certificates, and insurance auxiliary certificates in accordance with the contents prescribed in Articles 9, 10, and 11 of this Circular.
2. Register the list of candidates participating in the examination with the Insurance Management and Supervision Department and submit examination fees for candidates who have registered through the training institution.
3. Issue, renew, and revoke insurance certificates, insurance brokerage certificates, and insurance auxiliary certificates.
4. Announce the list of individuals holding insurance certificates, insurance brokerage certificates, and insurance auxiliary certificates issued, renewed, or revoked by the training institution to the Insurance Management and Supervision Department; announce the list of individuals whose certificates have been revoked on the training institution's website.
5. Retain records regarding the issuance, revocation, and renewal of insurance certificates, insurance brokerage certificates, and insurance auxiliary certificates within the scope of responsibilities of the training institution in accordance with the laws on record keeping.
1. Responsibilities of candidates participating in examinations:
a) Bear responsibility for the completeness, truthfulness, and accuracy of information submitted for registration.
b) Adhere to the Regulations on Insurance Certificate Examinations, Insurance Agency Certificate Examinations, Insurance Brokerage Certificate Examinations, and Insurance Auxiliary Certificate Examinations.
2. Responsibilities of examination supervisors and graders:
Conduct examinations and grading in accordance with the Regulations on Insurance Certificate Examinations, Insurance Agency Certificate Examinations, Insurance Brokerage Certificate Examinations, and Insurance Auxiliary Certificate Examinations.
Chapter V
IMPLEMENTING PROVISIONS
Article 34. Effectiveness of the Circular
1. This Circular takes effect from January 1, 2023.
2. This Circular replaces Circular No. 125/2018/TT-BTC dated December 24, 2018, of the Ministry of Finance on the issuance of insurance agency certificates and Circular No. 65/2019/TT-BTC dated September 16, 2019, of the Ministry of Finance on the content of training, examination, issuance, and recognition of insurance auxiliary certificates.
3. During implementation, if there are difficulties or obstacles, please promptly report to the Ministry of Finance for consideration and resolution.
