ATTACHED TO THIS DECISION ARE PROVISIONAL REGULATIONS ON THE USE OF ADDITIONAL OPERATING FUNDS FOR THE STATE CAPITALIZATION GUIDANCE BOARDS AT THE CENTRAL AND LOCAL LEVELS TO IMPLEMENT DECREE NO. 28/CP OF MAY 7, 1996 OF THE GOVERNMENT.

THIS DECISION SHALL TAKE EFFECT FROM THE DATE OF SIGNATURE. THE STATE CAPITALIZATION GUIDANCE BOARDS AT THE CENTRAL AND LOCAL LEVELS AND RELATED AUTHORITIES SHALL BE RESPONSIBLE FOR ITS IMPLEMENTATION.

Article 1.- ON THE USE OF OPERATING FUNDS OF THE STATE CAPITALIZATION GUIDANCE BOARDS AT THE CENTRAL AND LOCAL LEVELS

Article 2.- (ISSUED ALONG WITH DECISION NO. 697 TC/QD/TCDN OF OCTOBER 1, 1997

TEMPORARY PROVISIONS

BASED ON ARTICLE 2 POINT 3 AND ARTICLE 3 POINT 1 OF DECISION NO. 548/TTg OF AUGUST 13, 1996 OF THE PRIME MINISTER ON THE ESTABLISHMENT OF STATE CAPITALIZATION GUIDANCE BOARDS AT THE CENTRAL AND LOCAL LEVELS, THE REGULAR OPERATING FUNDS OF THE STATE CAPITALIZATION GUIDANCE BOARDS AT THE CENTRAL AND LOCAL LEVELS SHALL BE INCLUDED IN THE ANNUAL NATIONAL BUDGET PLAN FOR CAPITALIZATION IMPLEMENTATION AT EACH BUDGET LEVEL (AT THE CENTRAL LEVEL, IT IS INCLUDED IN THE CENTRAL BUDGET EXPENSES BUDGET, AT THE LOCAL LEVEL, IT IS INCLUDED IN THE LOCAL BUDGET EXPENSES BUDGET). THE MINISTER OF FINANCE ISSUES PROVISIONAL REGULATIONS ON THE USE OF OPERATING FUNDS OF THE STATE CAPITALIZATION GUIDANCE BOARDS AT THE CENTRAL AND LOCAL LEVELS AS FOLLOWS:
1. STAFF WHO ARE SECONDED OR DETACHED TO WORK ON CAPITALIZATION STILL ENJOY BENEFITS PROVIDED BY THE AGENCY OR UNIT THAT DETACHES THE STAFF IN ACCORDANCE WITH CURRENT STATE POLICIES AND REGULATIONS.

2. REGULAR FUNDS PROVIDED TO THE STATE CAPITALIZATION GUIDANCE BOARDS ARE INCLUDED IN THE ANNUAL EXPENSE BUDGET OF THE PERMANENT DEPARTMENT OF THE STATE CAPITALIZATION GUIDANCE BOARD AT EACH LEVEL, INCLUDING AMOUNTS UNDER CURRENT REGULATIONS AND ADDITIONAL AMOUNTS RELATED TO CAPITALIZATION WORK. THE BUDGET FOR THE CENTRAL STATE CAPITALIZATION GUIDANCE BOARD IS INCLUDED IN THE ANNUAL BUDGET OF THE PERMANENT DEPARTMENT OF THE CENTRAL STATE CAPITALIZATION GUIDANCE BOARD UNDER THE STATE CAPITAL AND ASSET MANAGEMENT GENERAL DEPARTMENT AT ENTERPRISES - MINISTRY OF FINANCE. THE STATE CAPITALIZATION GUIDANCE BOARDS OF MINISTRIES AND LOCALITIES ARE INCLUDED IN THE ANNUAL BUDGET OF THE MINISTRIES AND LOCALITIES FOR THE PERMANENT DEPARTMENT OF THE STATE CAPITALIZATION GUIDANCE BOARD OF THE MINISTRIES AND LOCALITIES.

3. THE STATE CAPITALIZATION GUIDANCE BOARDS AT THE CENTRAL AND LOCAL LEVELS ARE RESPONSIBLE FOR USING, MANAGING, AND SETTLING THE ACCOUNTS OF THESE FUNDS IN ACCORDANCE WITH CURRENT STATE FINANCIAL MANAGEMENT REGULATIONS.

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

a. FOR THE CENTRAL STATE CAPITALIZATION GUIDANCE BOARD:

- FOR THE CENTRAL STATE CAPITALIZATION GUIDANCE BOARD: THE PERMANENT DEPARTMENT OF THE CENTRAL STATE CAPITALIZATION GUIDANCE BOARD PREPARES THE BUDGET FOR CAPITALIZATION WORK IN ACCORDANCE WITH CURRENT REGULATIONS AND SUBMISSIONS TO THE BOARD CHAIR FOR APPROVAL AND SUBMISSION TO THE MINISTRY OF FINANCE FOR DISTRIBUTION. THIS EXPENSE IS INCLUDED IN THE ANNUAL BUDGET.

- FOR THE STATE CAPITALIZATION GUIDANCE BOARDS OF MINISTRIES AND CENTRAL SECTORS: THE PERMANENT DEPARTMENT OF THE STATE CAPITALIZATION GUIDANCE BOARDS OF MINISTRIES AND CENTRAL SECTORS PREPARE THE BUDGET FOR CAPITALIZATION WORK AND SUBMIT IT TO THE BOARD CHAIR OF THE MINISTRIES AND SECTORS FOR APPROVAL IN ACCORDANCE WITH CURRENT REGULATIONS AND INCLUDE IT IN THE ANNUAL BUDGET OF THE MINISTRIES AND SECTORS.

II. SPECIFIC PROVISIONS

1. Budget Estimate:

b. FOR THE STATE CAPITALIZATION GUIDANCE BOARDS OF PROVINCES AND CITIES:

- THE PERMANENT DEPARTMENT OF THE STATE CAPITALIZATION GUIDANCE BOARDS OF PROVINCES AND DIRECTLY-GOVERNED CITIES PREPARE THE BUDGET FOR CAPITALIZATION WORK IN ACCORDANCE WITH CURRENT REGULATIONS AND SUBMIT IT TO THE BOARD CHAIR FOR APPROVAL AND INCLUDE IT IN THE ANNUAL BUDGET OF THE PERMANENT DEPARTMENT OF THE PROVINCES AND DIRECTLY-GOVERNED CITIES.

BASED ON THE APPROVED BUDGET, THE DEPARTMENT OF FINANCE PROVIDES FUNDS TO THE PERMANENT DEPARTMENT OF CAPITALIZATION (THROUGH THE STATE CAPITAL AND ASSET MANAGEMENT DEPARTMENT AT ENTERPRISES).

c. FOR THE TOTAL COMPANIES 91, EXPENSES FOR CAPITALIZATION WORK ARE INCLUDED IN THE TOTAL COMPANY'S BUDGET.

2. CONTENT AND PRINCIPLES OF EXPENSES:

2.1. THE REGULAR FUNDS OF THE STATE CAPITALIZATION GUIDANCE BOARDS AT EACH LEVEL ARE USED FOR THE FOLLOWING EXPENSES:

a. EXPENSES FOR CAPITALIZATION PUBLICITY (SUCH AS RADIO, TELEVISION, PRESS, MAGAZINES...).

b. EXPENSES FOR CAPITALIZATION BUSINESS (PRINTING DOCUMENTS, EXPENSES FOR APPRAISAL, APPROVAL OF CAPITALIZATION SCHEMES...).

c. EXPENSES FOR ORGANIZING SEMINARS, TRAINING SESSIONS, MEETINGS, INTERIM AND FINAL SUMMARIES.

d. EXPENSES FOR PURCHASING OFFICE SUPPLIES (STATIONERY, BOOKS, MATERIALS SERVING SPECIALIZED WORK...).

e. EXPENSES FOR PURCHASING EQUIPMENT AND WORKING AIDS FOR CAPITALIZATION WORK.

g. EXPENSES FOR RENTING TRANSPORTATION.

h. EXPENSES FOR OVERTIME SUPPORT DURING LOCAL TRAVEL NOT EXCEEDING 10,000 DONG PER NIGHT/DAY/PERSON.

i. REIMBURSEMENT FOR TRAIN, AIRFARE, AND HOTEL FEES FOR STAFF TRAVELING ON BUSINESS IN ACCORDANCE WITH REGULATIONS AND ACTUAL EXPENSES (IF ANY).

2.2. PRINCIPLES OF EXPENSE MANAGEMENT:

EXPENSES ARE RECORDED IN DETAIL ACCORDING TO THE STATE BUDGET CLASSIFICATION LIST AS PROVIDED IN DECISION NO. 280 TC/QD/NSNN OF APRIL 15, 1997 OF THE MINISTRY OF FINANCE. EXPENSES MUST COMPLY WITH CURRENT STATE POLICIES, REGULATIONS, AND STANDARDS.

THE REGULAR FUNDS OF THE STATE CAPITALIZATION GUIDANCE BOARDS AT EACH LEVEL ARE RECORDED SEPARATELY AND SETTLED WITH THE FUNDS PROVIDER DIRECTLY EVERY QUARTER AND YEAR IN ACCORDANCE WITH CURRENT FINANCIAL REGULATIONS.

1. THIS REGULATION SHALL TAKE EFFECT FROM THE DATE OF SIGNATURE.

2. DURING THE IMPLEMENTATION PROCESS, IF THERE ARE ANY DIFFICULTIES, THEY SHOULD BE REPORTED TO THE MINISTRY OF FINANCE FOR CONSIDERATION AND RESOLUTION.

3. Settlement of Funds:

The regular operating expenses of the Steering Committee for Corporate Shareholding at all levels shall be recorded separately and settled for each item of expenditure directly to the funding authority on a quarterly and annual basis in accordance with the current financial regulations.

III. IMPLEMENTATION:

This provision shall take effect from the date of signature.

In the course of implementation, if there are any difficulties, the Steering Committee for Corporate Shareholding at all levels is requested to report to the Ministry of Finance for consideration and resolution.
