Decree No. 7/SL on the organization of the Office of Ministries and agencies under ministries

DECREE

THE PRESIDENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM

NUMBER 7/SL ON JANUARY 20, 1950

Pursuant to Decree No. 57-SL dated May 3, 1946 on the organization of Offices, Departments, and inspection agencies under Ministries,

Following the resolution of the Council of Ministers;

ISSUES THE DECREE:

Article 1: The Offices of Ministries and subordinate agencies under Ministries, except for the Ministry of National Defense, shall now be reorganized as follows:

I- Office:

Article 2: The Office and Administrative Affairs of Ministries shall now be merged into a single unit called the Ministry Office.

Article 3: At the head of the Office shall be a Director of the Office, who may have one or two Deputy Directors.

The Director and Deputy Directors of the Office shall be appointed by decree upon the proposal of the Minister.

Article 4: The positions of Director of Administrative Affairs, Deputy Director of Administrative Affairs, Chief of Office, Deputy Chief of Office, and Secretary of the Office of Ministries are hereby abolished.

Article 5: Each Ministry's Office shall be divided into several departments.

The first four common departments for all Ministries shall be numbered as follows: Department 1, Department 2, Department 3, and Department 4.

The tasks of these Departments are defined as follows:

Department 1: Incoming and outgoing correspondence; cipher; communication; document storage; management; materials; reception, protocol; conferences; awards, and miscellaneous matters not within the scope of other departments.

Department 2: Personnel; finance, budget, accounting.

Department 3: General matters: planning; propaganda; patriotic competition; reporting; legal affairs; library; press; statistics.

Department 4: Supervision of tasks assigned by the Ministry or subordinate agencies mentioned in Articles 9 and 11; responsible for specialized tasks that are somewhat important but not significant enough to warrant a separate department.

Article 6: In addition to the four main departments mentioned in Article 5, each Ministry may establish additional departments to handle special tasks specific to the Ministry, which are deemed not important enough to form a separate unit outside the Office.

These departments shall be established by a ministerial decree following approval by the Council of Ministers.

Article 7: Each department shall have a Head of Department, and if necessary, a Deputy Head of Department.

The Heads of Department and Deputy Heads of Department shall be appointed by a ministerial decree.

Article 8: Ministers and Deputy Ministers may each have an Assistant Secretary to assist them.

The Assistant Secretaries to Ministers and Deputy Ministers shall be appointed by a ministerial decree.

II- Departments, Bureaus, Divisions, Institutes:

Article 9: A Department is an organization responsible for a sector of work under a Ministry, with a vertical system down to local levels.

A Bureau is an organization specializing in national business operations.

A Division is an organization responsible for a sector of work without a vertical system down to local levels.

An Institute is an organization with a research nature.

All Departments, Bureaus, Divisions, and Institutes shall be established by decree.

Article 10:

At the head of each Department, Bureau, Division, and Institute shall be a Director, and a Deputy Director if needed.

The Directors and Deputy Directors shall be appointed by decree upon the proposal of the Minister.

III- Other Subordinate Agencies:

Article 11: Ministries may have other subordinate units such as Councils, Committees, Teams, and specialized Schools.

Article 12: Councils and specialized Schools, depending on their importance, shall be established by decree or ministerial decree.

Committees and Teams shall be established by ministerial decree.

Article 13: Any provisions contrary to this decree, except for Decree No. 50-SL dated June 18, 1949 organizing the Ministry of National Defense, are hereby repealed.

Article 14: Ministers shall implement this decree accordingly.
