JOINT MINISTRY OF FINANCE - GENERAL POSTAL CORPORATION

JOINT CIRCULAR NO. 7-TT/LB DATED JUNE 20, 1986

GUIDELINES FOR IMPLEMENTING RESOLUTION NO. 112/HĐBT

ON THE ORGANIZATION OF RURAL POST OFFICES

AND DECREE NO. 235-HĐBT ON THE LIVING ALLOWANCE REGIME

FOR HEADS OF RURAL POST OFFICES AND RURAL POST OFFICE STAFF.

Implementing Resolution No. 112-HĐBT dated October 15, 1981 of the Council of Ministers on the organization of rural post offices and Article 10 of Decree No. 235-HĐBT dated September 18, 1985 of the Council of Ministers on the living allowance regime for cadres at communes, wards, and towns; based on Circular No. 74-ĐP/TCCP dated November 26, 1985 and Circular No. 1-ĐP/TCCP dated January 3, 1986 of the Government Organization Department guiding the implementation of Decree No. 235-HĐBT on the regime for rural post office staff, the Joint Ministry of Finance - General Postal Corporation guides the implementation as follows:

I. FUNCTIONS, TASKS, AND LABOR ALLOCATION OF RURAL POST OFFICES.

1. Functions and Duties:

a) According to Resolution No. 112-HĐBT dated October 15, 1981 of the Council of Ministers and Circular No. 1-ĐP/TCCP dated January 3, 1986 of the Government Organization Department, the rural post office is a specialized agency responsible for internal communication work within the commune, under the direct leadership of the Commune People's Committee, while also being subject to professional guidance from the postal service sector.

b) For communes where the postal service sector has not yet taken on the task of delivering mail, newspapers, and telegrams to recipients within the commune, the district post office will enter into a responsibility contract with the rural post office to deliver these items, and the costs will be borne by the postal service sector according to the leasing system stipulated in Section 3 of Circular No. 3-LĐTL dated March 17, 1986 of the General Postal Corporation.

During the implementation of the contract, the rural post office must ensure that all quality standards for the delivery of mail, newspapers, and telegrams set by the postal service sector are met.

2. Labor allocation:

a) To streamline the organizational structure towards efficiency and effectiveness, each rural post office shall have from one to two staff members including the head of the post office and a postman. The determination of the number of staff at the rural post office will be guided by the provincial, municipal, or centrally governed special zone People's Committees based on the provisions of Circular No. 74-ĐP/TCCP dated January 26, 1986 of the Government Organization Department and the specific conditions of the locality, as follows:

- For communes with large areas, high population, and significant internal communication workload, the rural post office shall be allocated one head and one postman.

- For communes with small areas, low population but difficult access roads, the number of staff at the rural post office shall be determined appropriately to ensure internal communication needs without exceeding the limits specified in Circular No. 1-ĐP/TCCP dated January 3, 1986 of the Government Organization Department.

- For communes with minimal internal communication workload, the rural post office shall only require one head who also serves as a postman.

b) Based on the number of staff determined by the district People's Committee for rural post offices in the district, the district post office shall coordinate with the commune People's Committees to reassign the heads and postmen of rural post offices. In cases requiring changes or termination of employment, they shall report to the district People's Committee for resolution according to general regulations.

c) To ensure the quality of service provided by the rural post office, the postal service sector shall provide vocational training for the heads and postmen of rural post offices. The commune People's Committee shall create favorable conditions for the operation of the rural post office and stabilize its staff, avoiding unnecessary changes. From now on, whenever there is a need to change the head of a rural post office, the commune People's Committee and the postal service sector shall provide a one-time allowance for retired rural post office staff due to old age, calculated at one month's living allowance for each year of service, up to a maximum of five months' living allowance (as stipulated in Section 2 of Joint Circular No. 2918-TTLB dated October 4, 1978 of the Ministry of Finance - General Postal Corporation). This one-time allowance does not apply to other retirement cases.

c) To gradually improve the quality of service provided by the rural post office, when necessary, the postal service sector shall organize training sessions for the heads of rural post offices. During the time attending such training sessions organized by the postal service sector, the head of the rural post office shall be provided with expenses for food, study materials, medical care, and travel.

The one-time allowance for retired rural post office staff due to restructuring and the costs for the head of the rural post office attending training sessions organized by the postal service sector shall be borne by the postal service sector and included in the cost of postal business operations.

III. IMPLEMENTATION PROVISIONS

This circular shall be uniformly implemented nationwide from April 1, 1986. Any previous documents (such as Circular No. 19-TTLB dated April 1, 1985 and Section 1 Part II of Circular No. 13-TT/BĐ/TC dated December 10, 1982 of the Joint Ministry of Finance - Postal Service) that conflict with this circular are hereby abolished.

Prior to March 31, 1986, if any place had paid a lower living allowance to the heads and postmen of rural post offices than stipulated in this circular, they shall be entitled to back payment. If a higher amount was paid, no refund is required.

During the implementation process, any issues encountered should be reported to the Joint Ministry for research and resolution.
